<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa968e732-e874-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">District of Columbia Chief Financial Officer Vacancy Act.</p></sidenote>
<section id="d357152e88" identifier="/us/pl/113/8/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">District of Columbia Chief Financial Officer Vacancy Act</shortTitle>”.</content></section>
<section id="d357152e98" identifier="/us/pl/113/8/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>AUTHORIZING DISTRICT OF COLUMBIA TREASURER OR DEPUTY CHIEF FINANCIAL OFFICER OF OFFICE OF CHIEF FINANCIAL OFFICER OF THE DISTRICT OF COLUMBIA TO SERVE AS ACTING CHIEF FINANCIAL OFFICER IN EVENT OF VACANCY IN OFFICE.</heading><subsection class="firstIndent0 fontsize10" id="ya9693553-e874-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/8/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Authorizing Service in Acting Capacity in Event of Vacancy in Office</inline>.—</heading><content>Section 424(b) of the District of Columbia Home Rule Act (sec. 1–204.24(b), D.C. Official Code) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new paragraph:<quotedContent><paragraph class="fontsize10" id="ya9695c64-e874-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Authorizing treasurer or deputy cfo to perform duties in acting capacity in event of vacancy in office</inline>.—</heading><subparagraph class="fontsize10" id="ya9695c65-e874-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Service as cfo</inline>.—</heading><clause class="fontsize10" id="ya9695c66-e874-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Except as provided in clause (ii), if there is a vacancy in the Office of Chief Financial Officer because the Chief Financial Officer has died, resigned, or is otherwise unable to perform the functions and duties of the Office—</chapeau><subclause class="fontsize10" id="ya9695c67-e874-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>the District of Columbia Treasurer shall serve as the Chief Financial Officer in an acting capacity, subject to the time limitation of subparagraph (B); or</content></subclause>
<subclause class="fontsize10" id="ya9695c68-e874-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>the Mayor may direct one of the Deputy Chief Financial Officers of the Office referred to in subparagraphs (A) through (D) of subsection (a)(3) to serve as the Chief Financial Officer in an acting capacity, subject to the time limitation of subparagraph (B).</content></subclause>

<clause class="fontsize10" id="ya9695c69-e874-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Exclusion of certain individuals</inline>.—</heading><content>Notwithstanding clause (i), an individual may not serve as the Chief Financial Officer under such clause if the individual did not serve as the District of Columbia Treasurer or as one of such Deputy Chief Financial <page identifier="/us/stat/127/442">127 STAT. 442</page>
Officers of the Office of the Chief Financial Officer (as the case may be) for at least 90 days during the 1-year period which ends on the date the vacancy occurs.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ya9695c6a-e874-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Time limitation</inline>.—</heading><content>A vacancy in the Office of the Chief Financial Officer may not be filled by the service of any individual in an acting capacity under subparagraph (A) after the expiration of the 210-day period which begins on the date the vacancy occurs.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="ya9695c6b-e874-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/8/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Conforming Amendment</inline>.—</heading><content>Section 424(b)(2)(D) of such Act (sec. 1–204.24(b)(2)(D), D.C. Official Code) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>Any vacancy</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>Subject to paragraph (3), any vacancy</quotedText>”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya9695c6c-e874-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/8/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><content>The amendments made by this Act shall apply with respect to vacancies occurring on or after the date of the enactment of this Act.</content></subsection>
