<section id="d261429e90" identifier="/us/pl/113/65/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf8772cc7-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s101">38 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Alicia Dawn Koehl Respect for National Cemeteries Act</shortTitle>”.</content></section>
<section id="d261429e105" identifier="/us/pl/113/65/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>AUTHORITY TO RECONSIDER DECISIONS OF SECRETARY OF VETERANS AFFAIRS OR SECRETARY OF THE ARMY TO INTER THE REMAINS OR HONOR THE MEMORY OF A PERSON IN A NATIONAL CEMETERY.</heading><subsection class="firstIndent0 fontsize10" id="yf877a1f8-e876-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/65/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Authority To Reconsider Prior Decisions</inline>.—</heading><chapeau><ref href="/us/usc/t38/s2411">Section 2411 of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yf877a1f9-e876-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/65/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsection (d) as subsection (f); and</content></paragraph>
<paragraph class="fontsize10" id="yf877a1fa-e876-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/65/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (c) the following new subsections:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="yf8783e3b-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d)</num><paragraph class="inline" id="yf8783e3c-e876-11f0-a1e4-69761a48a15a"><num value="1">(1) </num><chapeau>In a case described in subsection (e), the appropriate Federal official may reconsider a decision to—</chapeau><subparagraph class="fontsize10" id="yf8783e3d-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>inter the remains of a person in a cemetery in the National Cemetery Administration or in Arlington National Cemetery; or</content></subparagraph>
<subparagraph class="fontsize10" id="yf8783e3e-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>honor the memory of a person in a memorial area in a cemetery in the National Cemetery Administration (described in section 2403(a) of this title) or in such an area in Arlington National Cemetery (described in section 2409(a) of this title).</content></subparagraph>
</paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="yf8783e3f-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2)</num><subparagraph class="inline" id="yf8783e40-e876-11f0-a1e4-69761a48a15a"><num value="A">(A)</num><clause class="inline" id="yf8783e41-e876-11f0-a1e4-69761a48a15a"><num value="i">(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf8783e42-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Notices.</p></sidenote><content>In a case described in subsection (e)(1)(A), the appropriate Federal official shall provide notice to the deceased person’s next of kin or other person authorized to arrange burial or memorialization of the deceased person of the decision of the appropriate Federal official to disinter the remains of the deceased person or to remove a memorial headstone or marker memorializing the deceased person.</content></clause>
<clause class="indentUp0 firstIndent0 fontsize10" id="yf8783e43-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>In a case described in subsection (e)(1)(B), if the appropriate Federal official finds, based upon a showing of clear and convincing evidence and after an opportunity for a hearing in a manner prescribed by the appropriate Federal official, that the person had committed a Federal capital crime or a State capital crime but had not been convicted of such crime by reason of such person not being available for trial due to death or flight to avoid prosecution, the appropriate Federal official shall provide notice to the <page identifier="/us/stat/127/670">127 STAT. 670</page>
deceased person’s next of kin or other person authorized to arrange burial or memorialization of the deceased person of the decision of the appropriate Federal official to disinter the remains of the deceased person or to remove a memorial headstone or marker memorializing the deceased person.</content></clause>
</subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="yf8783e44-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>Notice under subparagraph (A) shall be provided by the appropriate Federal official as follows:</chapeau><clause class="fontsize10" id="yf8783e45-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>By the Secretary in accordance with section 5104 of this title.</content></clause>
<clause class="fontsize10" id="yf8783e46-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf8783e47-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Regulations.</p></sidenote><content>By the Secretary of Defense in accordance with such regulations as the Secretary of Defense shall prescribe for purposes of this subsection.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="yf8783e48-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3)</num><subparagraph class="inline" id="yf8783e49-e876-11f0-a1e4-69761a48a15a"><num value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf8783e4a-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="xf8783e4b-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Notice.</p></sidenote><content>Notwithstanding any other provision of law, the next of kin or other person authorized to arrange burial or memorialization of the deceased person shall be allowed a period of 60 days from the date of the notice required by paragraph (2) to file a notice of disagreement with the Federal official that provided the notice.</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="yf8783e4c-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B)</num><clause class="inline" id="yf8783e4d-e876-11f0-a1e4-69761a48a15a"><num value="i">(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf8783e4e-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Review.</p></sidenote><content>A notice of disagreement filed with the Secretary under subparagraph (A) shall be treated as a notice of disagreement filed under section 7105 of this title and shall initiate appellate review in accordance with the provisions of chapter 71 of this title.</content></clause>
<clause class="indentUp0 firstIndent0 fontsize10" id="yf8783e4f-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf8783e50-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Regulations.</p></sidenote><content>A notice of disagreement filed with the Secretary of Defense under subparagraph (A) shall be decided in accordance with such regulations as the Secretary of Defense shall prescribe for purposes of this subsection.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="yf8783e51-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><chapeau>When the decision of the appropriate Federal official to disinter the remains or remove a memorial headstone or marker of the deceased person becomes final either by failure to appeal the decision in accordance with paragraph (3)(A) or by final disposition of the appeal pursuant to paragraph (3)(B), the appropriate Federal official may take any of the following actions:</chapeau><subparagraph class="fontsize10" id="yf8783e52-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>Disinter the remains of the person from the cemetery in the National Cemetery Administration or in Arlington National Cemetery and provide for the reburial or other appropriate disposition of the disinterred remains in a place other than a cemetery in the National Cemetery Administration or in Arlington National Cemetery.</content></subparagraph>
<subparagraph class="fontsize10" id="yf8783e53-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>Remove from a memorial area in a cemetery in the National Cemetery Administration or in Arlington National Cemetery any memorial headstone or marker placed to honor the memory of the person.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yf8783e54-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e)</num><paragraph class="inline" id="yf8783e55-e876-11f0-a1e4-69761a48a15a"><num value="1">(1) </num><chapeau>A case described in this subsection is a case in which the appropriate federal official receives—</chapeau><subparagraph class="fontsize10" id="yf8783e56-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>written notice of a conviction referred to in subsection (b)(1), (b)(2), or (b)(4) of a person described in paragraph (2); or</content></subparagraph>
<subparagraph class="fontsize10" id="yf8783e57-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>information that a person described in paragraph (2) may have committed a Federal capital crime or a State capital crime but was not convicted of such crime by reason of such person not being available for trial due to death or flight to avoid prosecution.</content></subparagraph>
</paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="yf8783e58-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>A person described in this paragraph is a person—</chapeau><subparagraph class="fontsize10" id="yf8783e59-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>whose remains have been interred in a cemetery in the National Cemetery Administration or in Arlington National Cemetery; or<page identifier="/us/stat/127/671">127 STAT. 671</page></content></subparagraph>
<subparagraph class="fontsize10" id="yf8783e5a-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>whose memory has been honored in a memorial area in a cemetery in the National Cemetery Administration or in such an area in Arlington National Cemetery.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="yf8783e5b-e876-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/65/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Modification of Exception To Interment or Memorialization Prohibition</inline>.—</heading><content>Subsection (a)(2) of such section <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>such official approves an application for</quotedText>”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yf8783e5c-e876-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/65/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf8783e5d-e876-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s2411">38 USC 2411 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.—</heading><content>The amendments made by this section shall apply with respect to any interment or memorialization conducted by the Secretary of Veterans Affairs or the Secretary of the Army in a cemetery in the National Cemetery Administration or in Arlington National Cemetery after the date of the enactment of this Act.</content></subsection>

<section id="d261429e323" identifier="/us/pl/113/65/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>DISINTERMENT OF REMAINS OF MICHAEL LASHAWN ANDERSON FROM FORT CUSTER NATIONAL CEMETERY.</heading><subsection class="firstIndent0 fontsize10" id="yf878656e-e876-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/65/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Disinterment of Remains</inline>.—</heading><content>The Secretary of Veterans Affairs shall disinter the remains of Michael LaShawn Anderson from Fort Custer National Cemetery.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yf878656f-e876-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/65/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Notification of Next-of-Kin</inline>.—</heading><chapeau>The Secretary of Veterans Affairs shall—</chapeau><paragraph class="fontsize10" id="yf8786570-e876-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/65/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>notify the next-of-kin of record for Michael LaShawn Anderson of the impending disinterment of his remains; and</content></paragraph>
<paragraph class="fontsize10" id="yf8786571-e876-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/65/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>upon disinterment, relinquish the remains to the next-of-kin of record for Michael LaShawn Anderson or, if the next-of-kin of record for Michael LaShawn Anderson is unavailable, arrange for an appropriate disposition of the remains.</content></paragraph>
