<section id="d266359e85" identifier="/us/pl/113/45/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2af74ef4-e87a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t49/s31305">49 USC 31305 note</ref>.</p></sidenote><heading>COMMERCIAL MOTOR VEHICLE OPERATOR REQUIREMENTS RELATING TO SLEEP DISORDERS.</heading><subsection class="firstIndent0 fontsize10" id="y2af77605-e87a-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/45/s1/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Secretary of Transportation may implement or enforce a requirement providing for the screening, testing, or treatment (including consideration of all possible treatment alternatives) of individuals operating commercial motor vehicles for sleep disorders only if the requirement is adopted pursuant to a rulemaking proceeding.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y2af77606-e87a-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/45/s1/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.—</heading><content>Subsection (a) shall not apply to a requirement that was in force before September 1, 2013.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y2af77607-e87a-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/45/s1/c" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Sleep Disorders Defined</inline>.—</heading><content>In this section, the term “<term>sleep disorders</term>” includes obstructive sleep apnea.</content></subsection>
