Clay Shaw, Jr. Missing Children’s Assistance Reauthorization Act of 2013</shortTitle>”.</content></section>
<section id="d373402e102" identifier="/us/pl/113/38/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>AMENDMENTS.</heading><subsection class="firstIndent0 fontsize10" id="y56aff9d7-e87b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/38/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Findings</inline>.—</heading><chapeau>Section 402 of the Missing Children’s Assistance Act (<ref href="/us/usc/t42/s5771">42 U.S.C. 5771</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y56aff9d8-e87b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/38/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (3) through (9) as paragraphs (4) through (10), respectively, and</content></paragraph>

<quotedContent><subparagraph class="indentDown1 fontsize10" id="y56b020fb-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="T">“(T) </num><content>provide technical assistance and training to State and local law enforcement agencies and statewide clearinghouses to coordinate with State and local educational agencies in identifying and recovering missing children;</content></subparagraph>
<subparagraph class="indentDown1 fontsize10" id="y56b020fc-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="U">“(U) </num><content>assist the efforts of law enforcement agencies in coordinating with child welfare agencies to respond to foster children missing from the State welfare system; and</content></subparagraph>
<subparagraph class="indentDown1 fontsize10" id="y56b020fd-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">“(V) </num><content>provide technical assistance to law enforcement agencies and first responders in identifying, locating, and recovering victims of, and children at risk for, child sex trafficking.”</content></subparagraph>

<subparagraph class="fontsize10" id="y56b020fe-e87b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/38/s2/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="amend">amending</amendingAction> paragraph (2) to read as follows:<quotedContent><paragraph class="indentDown1 fontsize10" id="y56b0480f-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Limitation</inline>.—</heading><subparagraph class="fontsize10" id="y56b04810-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Notwithstanding any other provision of law, no Federal funds may be used to pay the compensation of an individual employed by the Center if such compensation, as determined at the beginning of each grant year, exceeds 110 percent of the maximum annual salary payable to a member of the Federal Government’s Senior Executive Service (SES) for that year. The Center may compensate an employee at a higher rate provided the amount in excess of this limitation is paid with non-Federal funds.</content></subparagraph>
<subparagraph class="fontsize10" id="y56b04811-e87b-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Definition of compensation</inline>.—</heading><chapeau>For the purpose of this paragraph, the term ‘<term>compensation</term>’—</chapeau><clause class="fontsize10" id="y56b04812-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>includes salary, bonuses, periodic payments, severance pay, the value of a compensatory or paid leave benefit not excluded by clause (ii), and the fair market value of any employee perquisite or benefit not excluded by clause (ii); and</content></clause>
<clause class="fontsize10" id="y56b04813-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>excludes any Center expenditure for health, medical, or life insurance, or disability or retirement pay, including pensions benefits.”</content></clause>

<subparagraph class="fontsize10" id="y56b04816-e87b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/38/s2/b/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>kidnapings</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>kidnappings</quotedText>”, and</content></subparagraph>

<section id="d373402e425" identifier="/us/pl/113/38/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>AUTHORIZATION OF APPROPRIATIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x56b0481b-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 407 of the Missing Children’s Assistance Act (<ref href="/us/usc/t42/s5777">42 U.S.C. 5777</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y56b0481c-e87b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/38/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (a) by <amendingAction type="delete">striking</amendingAction> “<quotedText>such</quotedText>” and all that follows through the period at the end, and <amendingAction type="insert">inserting</amendingAction> “<quotedText>$40,000,000 for each of the fiscal years 2014 through 2018, up to $32,200,000 of which shall be used to carry out section 404(b) for each such fiscal year.</quotedText>”, and<page identifier="/us/stat/127/529">127 STAT. 529</page></content></paragraph>

<section id="d373402e465" identifier="/us/pl/113/38/s4" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>OVERSIGHT AND ACCOUNTABILITY.</heading><content class="firstIndent0 fontsize10" id="x56b0963e-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  The Missing Children’s Assistance Act (<ref href="/us/usc/t42/s5771/etseq">42 U.S.C. 5771 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after section 406 the following:<quotedContent><section class="centered fontsize12" id="y56b1327f-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658143"><num class="fontsize12" value="407">“SEC. 407. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56b13280-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s5776a">42 USC 5776a</ref>.</p></sidenote><heading class="fontsize12">OVERSIGHT AND ACCOUNTABILITY.</heading><chapeau class=" fontsize10" style="-uslm-lc:I658120">  “All grants<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56b13281-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Grants.</p></sidenote> awarded by the Department of Justice that are authorized under this title shall be subject to the following:</chapeau><paragraph class="fontsize10" id="y56b13282-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56b13283-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Audit requirement</inline>.—</heading><content>For 2 of the fiscal years in the period of fiscal years 2014 through 2018, the Inspector General of the Department of Justice shall conduct audits of the recipient of grants under this title to prevent waste, fraud, and abuse by the grantee.</content></paragraph>
<paragraph class="fontsize10" id="y56b13284-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Mandatory exclusion</inline>.—</heading><content>If the recipient of grant funds under this title is found to have an unresolved audit finding, then that entity shall not be eligible to receive grant funds under this title during the 2 fiscal years beginning after the 12-month period described in paragraph (4).</content></paragraph>
<paragraph class="fontsize10" id="y56b13285-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Repayment of grant funds</inline>.—</heading><chapeau>If an entity is awarded grant funds under this title during the 2-fiscal-year period in which the entity is barred from receiving grants under paragraph (2), the Attorney General shall—</chapeau><subparagraph class="fontsize10" id="y56b13286-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>deposit an amount equal to the grant funds that were improperly awarded to the grantee into the General Fund of the Treasury; and</content></subparagraph>
<subparagraph class="fontsize10" id="y56b13287-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>seek to recoup the costs of the repayment to the fund from the grant recipient that was erroneously awarded grant funds.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y56b13288-e87b-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56b13289-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Defined term</inline>.—</heading><content>In this section, the term ‘<term>unresolved audit finding</term>’ means an audit report finding in the final report of the Inspector General of the Department of Justice that the grantee has utilized grant funds for an unauthorized expenditure or otherwise unallowable cost that is not closed or resolved within a 12-month period beginning on the date when the final audit report is issued.</content></paragraph>
<paragraph class="fontsize10" id="y56b1328a-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Nonprofit organization requirements</inline>.—</heading><subparagraph class="fontsize10" id="y56b1328b-e87b-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><content>For purposes of this section and the grant programs described in this title, the term ‘<term>nonprofit</term>’, relating to an entity, means the entity is described in section 501(c)(3) of the Internal Revenue Code of 1986 and is exempt from taxation under section 501(a) of such Code.</content></subparagraph>
<subparagraph class="fontsize10" id="y56b1328c-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition</inline>.—</heading><content>The Attorney General shall not award a grant under any grant program described in this title to a nonprofit organization that holds money in off-shore accounts for the purpose of avoiding paying the tax described in section 511(a) of the Internal Revenue Code of 1986.</content></subparagraph>
<subparagraph class="fontsize10" id="y56b1328d-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Disclosure</inline>.—</heading><content>Each nonprofit organization that is awarded a grant under this title and uses the procedures prescribed in regulations under section 53.4958–6 of <ref href="/us/cfr/t26">title 26 of the Code of Federal Regulations</ref> to create a rebuttable presumption of reasonableness of the compensation for its officers, directors, trustees and key employees, shall disclose to the Attorney General the process for determining such compensation, including the independent persons involved in reviewing and approving such compensation, <page identifier="/us/stat/127/530">127 STAT. 530</page>
the comparability data used, and contemporaneous substantiation of the deliberation and decision. Upon request, the Attorney General shall make the information available for public inspection.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y56b1328e-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Conference expenditures</inline>.—</heading><subparagraph class="fontsize10" id="y56b1328f-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Limitation</inline>.—</heading><content>No amounts authorized to be appropriated under this title may be used to host or support any expenditure for conferences that uses more than $20,000 unless the Deputy Attorney General or the appropriate Assistant Attorney General, Director, or principal deputy director as the Deputy Attorney General may designate, provides prior written authorization that the funds may be expended to host a conference.</content></subparagraph>
<subparagraph class="fontsize10" id="y56b13290-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56b13291-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Estimate.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Written approval</inline>.—</heading><content>Written approval under subparagraph (A) shall include a written estimate of all costs associated with the conference, including the cost of all food and beverages, audio/visual equipment, honoraria for speakers, and any entertainment.</content></subparagraph>
<subparagraph class="fontsize10" id="y56b13292-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>The Deputy Attorney General shall submit an annual report to the Committee on the Judiciary of the Senate, the Committee on the Judiciary of the House of Representatives, and the Committee on Education and the Workforce of the House of Representatives on all conference expenditures approved by operation of this paragraph.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y56b13293-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition on lobbying activity</inline>.—</heading><subparagraph class="fontsize10" id="y56b13294-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Amounts authorized to be appropriated under this title may not be utilized by any grant recipient to—</chapeau><clause class="fontsize10" id="y56b13295-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>lobby any representative of the Department of Justice regarding the award of any grant funding; or</content></clause>
<clause class="fontsize10" id="y56b13296-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>lobby any representative of a Federal, State, local, or tribal government regarding the award of grant funding.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y56b13297-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Penalty</inline>.—</heading><chapeau>If the Attorney General determines that any recipient of a grant under this title has violated subparagraph (A), the Attorney General shall—</chapeau><clause class="fontsize10" id="y56b13298-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>require the grant recipient to repay the grant in full; and</content></clause>
<clause class="fontsize10" id="y56b13299-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>prohibit the grant recipient from receiving another grant under this title for not less than 5 years.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y56b1329a-e87b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Clarification</inline>.—</heading><content>For purposes of this paragraph, submitting an application for a grant under this title shall <page identifier="/us/stat/127/531">127 STAT. 531</page>
not be considered lobbying activity in violation of subparagraph (A).”</content></subparagraph>
