<section id="d285249e88" identifier="/us/pl/113/273/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x62650281-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t33/s1267">33 USC 1267 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Chesapeake Bay Accountability and Recovery Act of 2014</shortTitle>”.</content></section>
<section id="d285249e103" identifier="/us/pl/113/273/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x6265ece2-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y6265ece3-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Administrator</inline>.—</heading><content>The term “<term>Administrator</term>” means the Administrator of the Environmental Protection Agency.</content></paragraph>
<paragraph class="fontsize10" id="y6265ece4-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Chesapeake bay state</inline>.—</heading><chapeau>The term “<term>Chesapeake Bay State</term>” or “State” means any of—</chapeau><subparagraph class="fontsize10" id="y6265ece5-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the States of Maryland, West Virginia, Delaware, and New York;</content></subparagraph>
<subparagraph class="fontsize10" id="y6265ece6-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Commonwealths of Virginia and Pennsylvania; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6265ece7-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the District of Columbia.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y6265ece8-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Chesapeake bay watershed</inline>.—</heading><content>The term “<term>Chesapeake Bay watershed</term>” means all tributaries, backwaters, and side channels, including watersheds, draining into the Chesapeake Bay.</content></paragraph>
<paragraph class="fontsize10" id="y6265ece9-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Chesapeake executive council</inline>.—</heading><content>The term “<term>Chesapeake Executive Council</term>” has the meaning given the term by section 117(a) of the Federal Water Pollution Control Act (<ref href="/us/usc/t33/s1267/a">33 U.S.C. 1267(a)</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y626613fa-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Chief executive</inline>.—</heading><content>The term “<term>chief executive</term>” means, in the case of a State or Commonwealth, the Governor of the State or Commonwealth and, in the case of the District of Columbia, the Mayor of the District of Columbia.</content></paragraph>
<paragraph class="fontsize10" id="y626613fb-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Director</inline>.—</heading><content>The term “<term>Director</term>” means the Director of the Office of Management and Budget.</content></paragraph>
<paragraph class="fontsize10" id="y626613fc-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">Federal restoration activity</inline>.—</heading><subparagraph class="fontsize10" id="y626613fd-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/7/A" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The term “<term>Federal restoration activity</term>” means a Federal program or project carried out under Federal authority in existence as of the date of enactment of this Act with the express intent to directly protect, conserve, or restore living resources, habitat, water resources, or water quality in the Chesapeake Bay watershed, including programs or projects that provide financial and technical assistance to promote responsible land use, <page identifier="/us/stat/128/2968">128 STAT. 2968</page>
stewardship, and community engagement in the Chesapeake Bay watershed.</content></subparagraph>
<subparagraph class="fontsize10" id="y626613fe-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/7/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Categorization</inline>.—</heading><chapeau>Federal restoration activities may be categorized as follows:</chapeau><clause class="fontsize10" id="y626613ff-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/7/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>Physical restoration.</content></clause>
<clause class="fontsize10" id="y62661400-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/7/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>Planning.</content></clause>
<clause class="fontsize10" id="y62661401-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/7/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>Feasibility studies.</content></clause>
<clause class="fontsize10" id="y62661402-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/7/B/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>Scientific research.</content></clause>
<clause class="fontsize10" id="y62661403-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/7/B/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>Monitoring.</content></clause>
<clause class="fontsize10" id="y62661404-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/7/B/vi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">(vi) </num><content>Education.</content></clause>
<clause class="fontsize10" id="y62661405-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/7/B/vii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">(vii) </num><content>Infrastructure development.</content></clause>

<paragraph class="fontsize10" id="y62661406-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><heading class="fontsize10"><inline class="smallCaps">State restoration activity</inline>.—</heading><subparagraph class="fontsize10" id="y62661407-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/8/A" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The term “<term>State restoration activity</term>” means any State program or project carried out under State authority that directly or indirectly protect, conserve, or restore living resources, habitat, water resources, or water quality in the Chesapeake Bay watershed, including programs or projects that promote responsible land use, stewardship, and community engagement in the Chesapeake Bay watershed.</content></subparagraph>
<subparagraph class="fontsize10" id="y62661408-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/8/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Categorization</inline>.—</heading><chapeau>State restoration activities may be categorized as follows:</chapeau><clause class="fontsize10" id="y62661409-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/8/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>Physical restoration.</content></clause>
<clause class="fontsize10" id="y6266140a-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/8/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>Planning.</content></clause>
<clause class="fontsize10" id="y6266140b-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/8/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>Feasibility studies.</content></clause>
<clause class="fontsize10" id="y6266140c-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/8/B/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>Scientific research.</content></clause>
<clause class="fontsize10" id="y6266140d-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/8/B/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>Monitoring.</content></clause>
<clause class="fontsize10" id="y6266140e-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/8/B/vi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">(vi) </num><content>Education.</content></clause>
<clause class="fontsize10" id="y6266140f-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s2/8/B/vii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">(vii) </num><content>Infrastructure development.</content></clause>
</subparagraph>

</section>
<section id="d285249e312" identifier="/us/pl/113/273/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>CHESAPEAKE BAY CROSSCUT BUDGET.</heading><subsection class="firstIndent0 fontsize10" id="y6266fd70-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6266fd71-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p><p class="leftAlign firstIndent0 fontsize8" id="x62672482-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reports.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>The Director, in consultation with the Chesapeake Executive Council, the chief executive of each Chesapeake Bay State, and the Chesapeake Bay Commission, shall submit to Congress a financial report containing—</chapeau><paragraph class="fontsize10" id="y62672483-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>an interagency crosscut budget that displays, as applicable—</chapeau><subparagraph class="fontsize10" id="y62672484-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the proposed funding for any Federal restoration activity to be carried out in the succeeding fiscal year, including any planned interagency or intra-agency transfer, for each of the Federal agencies that carry out restoration activities;</content></subparagraph>
<subparagraph class="fontsize10" id="y62672485-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>to the extent that information is available, the estimated funding for any State restoration activity to be carried out in the succeeding fiscal year;</content></subparagraph>
<subparagraph class="fontsize10" id="y62672486-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>all expenditures for Federal restoration activities from the preceding 2 fiscal years, the current fiscal year, and the succeeding fiscal year;</content></subparagraph>
<subparagraph class="fontsize10" id="y62672487-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>all expenditures, to the extent that information is available, for State restoration activities during the equivalent time period described in subparagraph (C); and</content></subparagraph>
<subparagraph class="fontsize10" id="y62672488-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/1/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>a section that identifies and evaluates, based on need and appropriateness, specific opportunities to consolidate similar programs and activities within the budget and recommendations to Congress for legislative action to streamline, consolidate, or eliminate similar programs and activities within the budget;<page identifier="/us/stat/128/2969">128 STAT. 2969</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y62672489-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>a detailed accounting of all funds received and obligated by each Federal agency for restoration activities during the current and preceding fiscal years, including the identification of funds that were transferred to a Chesapeake Bay State for restoration activities;</content></paragraph>
<paragraph class="fontsize10" id="y6267248a-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>to the extent that information is available, a detailed accounting from each State of all funds received and obligated from a Federal agency for restoration activities during the current and preceding fiscal years; and</content></paragraph>
<paragraph class="fontsize10" id="y6267248b-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><chapeau>a description of each of the proposed Federal and State restoration activities to be carried out in the succeeding fiscal year (corresponding to those activities listed in subparagraphs (A) and (B) of paragraph (1)), including—</chapeau><subparagraph class="fontsize10" id="y6267248c-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the project description;</content></subparagraph>
<subparagraph class="fontsize10" id="y6267248d-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the current status of the project;</content></subparagraph>
<subparagraph class="fontsize10" id="y6267248e-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/4/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the Federal or State statutory or regulatory authority, program, or responsible agency;</content></subparagraph>
<subparagraph class="fontsize10" id="y6267248f-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/4/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>the authorization level for appropriations;</content></subparagraph>
<subparagraph class="fontsize10" id="y62672490-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/4/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>the project timeline, including benchmarks;</content></subparagraph>
<subparagraph class="fontsize10" id="y62672491-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/4/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>references to project documents;</content></subparagraph>
<subparagraph class="fontsize10" id="y62672492-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/4/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><content>descriptions of risks and uncertainties of project implementation;</content></subparagraph>
<subparagraph class="fontsize10" id="y62672493-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/4/H" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">(H) </num><content>a list of coordinating entities;</content></subparagraph>
<subparagraph class="fontsize10" id="y62672494-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/4/I" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>a description of the funding history for the project;</content></subparagraph>
<subparagraph class="fontsize10" id="y62672495-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/4/J" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="J">(J) </num><content>cost sharing; and</content></subparagraph>
<subparagraph class="fontsize10" id="y62672496-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/a/4/K" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="K">(K) </num><content>alignment with the existing Chesapeake Bay Agreement, Chesapeake Executive Council goals and priorities, and Annual Action Plan required by section 205 of Executive Order 13508 (<ref href="/us/usc/t33/s1267">33 U.S.C. 1267 note</ref>; relating to Chesapeake Bay protection and restoration).</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y62672497-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Minimum Funding Levels</inline>.—</heading><chapeau>In describing restoration activities in the report required under subsection (a), the Director shall only include—</chapeau><paragraph class="fontsize10" id="y62672498-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>for the first 3 years that the report is required, descriptions of—</chapeau><subparagraph class="fontsize10" id="y62672499-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>Federal restoration activities that have funding amounts greater than or equal to $300,000; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6267249a-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>State restoration activities that have funding amounts greater than or equal to $300,000; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y6267249b-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>for every year thereafter, descriptions of—</chapeau><subparagraph class="fontsize10" id="y6267249c-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>Federal restoration activities that have funding amounts greater than or equal to $100,000; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6267249d-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>State restoration activities that have funding amounts greater than or equal to $100,000.</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y6267249e-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Deadline</inline>.—</heading><content>The Director shall submit to Congress the report required by subsection (a) not later than September 30 of each year.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6267249f-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>Copies of the report required by subsection (a) shall be submitted to the Committees on Appropriations, Natural Resources, Energy and Commerce, and Transportation and Infrastructure of the House of Representatives and the Committees on Appropriations, Environment and Public Works, and Commerce, Science, and Transportation of the Senate.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y626724a0-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s3/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><content>This section shall apply beginning with the first fiscal year after the date of enactment of this Act.<page identifier="/us/stat/128/2970">128 STAT. 2970</page></content></subsection>

<section id="d285249e509" identifier="/us/pl/113/273/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>INDEPENDENT EVALUATOR FOR THE CHESAPEAKE BAY PROGRAM.</heading><subsection class="firstIndent0 fontsize10" id="y626772c1-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x626772c2-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Review.</p><p class="leftAlign firstIndent0 fontsize8" id="x626772c3-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reports.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>There shall be an Independent Evaluator for restoration activities in the Chesapeake Bay watershed, who shall review and report on—</chapeau><paragraph class="fontsize10" id="y626772c4-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>restoration activities; and</content></paragraph>
<paragraph class="fontsize10" id="y626772c5-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>any related topics that are suggested by the Chesapeake Executive Council.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y626772c6-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Appointment</inline>.—</heading><paragraph class="fontsize10" id="y626772c7-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x626772c8-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote>Not later than 30 days after the date of submission of nominees by the Chesapeake Executive Council, the Independent Evaluator shall be appointed by the Administrator from among nominees submitted by the Chesapeake Executive Council with the consultation of the scientific community.</content></paragraph>
<paragraph class="fontsize10" id="y626772c9-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Nominations</inline>.—</heading><content>The Chesapeake Executive Council may nominate for consideration as Independent Evaluator a science-based institution of higher education.</content></paragraph>
<paragraph class="fontsize10" id="y626772ca-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s4/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><content>The Administrator shall only select as Independent Evaluator a nominee that the Administrator determines demonstrates excellence in marine science, policy evaluation, or other studies relating to complex environmental restoration activities.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y626772cb-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/273/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Reports</inline>.—</heading><content>Not later than 180 days after the date of appointment and once every 2 years thereafter, the Independent Evaluator shall submit to Congress a report describing the findings and recommendations of reviews conducted under subsection (a).</content></subsection>
