<section id="d285481e192" identifier="/us/pl/113/272/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87c5f244-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s8921">22 USC 8921</ref>.</p></sidenote><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x87c68e85-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y87c68e86-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Account; correspondent account; payable-through account</inline>.—</heading><content>The terms “account”, “correspondent account”, and “payable-through account” have the meanings given those terms in <ref href="/us/usc/t31/s5318A">section 5318A of title 31, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y87c68e87-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate congressional committees</inline>.—</heading><chapeau>The term “<term>appropriate congressional committees</term>” means—</chapeau><subparagraph class="fontsize10" id="y87c68e88-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s2/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Committee on Foreign Relations and the Committee on Banking, Housing, and Urban Affairs of the Senate; and</content></subparagraph>
<subparagraph class="fontsize10" id="y87c68e89-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s2/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Committee on Foreign Affairs and the Committee on Financial Services of the House of Representatives.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y87c68e8a-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Defense article; defense service; training</inline>.—</heading><content>The terms “defense article”, “defense service”, and “training” have the meanings given those terms in section 47 of the Arms Export Control Act (<ref href="/us/usc/t22/s2794">22 U.S.C. 2794</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y87c68e8b-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s2/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Financial institution</inline>.—</heading><content>The term “<term>financial institution</term>” means a financial institution specified in subparagraph (A), (B), (C), (D), (E), (F), (G), (H), (I), (J), (M), or (Y) of <ref href="/us/usc/t31/s5312/a/2">section 5312(a)(2) of title 31, United States Code</ref>.<page identifier="/us/stat/128/2953">128 STAT. 2953</page></content></paragraph>
<paragraph class="fontsize10" id="y87c68e8c-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s2/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Foreign financial institution</inline>.—</heading><content>The term “<term>foreign financial institution</term>” has the meaning given that term in <ref href="/us/cfr/t31/s561.308">section 561.308 of title 31, Code of Federal Regulations</ref> (or any corresponding similar regulation or ruling).</content></paragraph>
<paragraph class="fontsize10" id="y87c68e8d-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s2/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Foreign person</inline>.—</heading><content>The term “<term>foreign person</term>” means any individual or entity that is not a United States citizen, a permanent resident alien, or an entity organized under the laws of the United States or any jurisdiction within the United States.</content></paragraph>
<paragraph class="fontsize10" id="y87c68e8e-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s2/7" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">Knowingly</inline>.—</heading><content>The term “<term>knowingly</term>”, with respect to conduct, a circumstance, or a result, means that a person has actual knowledge, or should have known, of the conduct, the circumstance, or the result.</content></paragraph>
<paragraph class="fontsize10" id="y87c68e8f-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s2/8" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><heading class="fontsize10"><inline class="smallCaps">Russian person</inline>.—</heading><chapeau>The term “<term>Russian person</term>” means—</chapeau><subparagraph class="fontsize10" id="y87c68e90-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s2/8/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>an individual who is a citizen or national of the Russian Federation; or</content></subparagraph>
<subparagraph class="fontsize10" id="y87c68e91-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s2/8/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>an entity organized under the laws of the Russian Federation.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y87c68e92-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s2/9" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><heading class="fontsize10"><inline class="smallCaps">Special russian crude oil project</inline>.—</heading><chapeau>The term “<term>special Russian crude oil project</term>” means a project intended to extract crude oil from—</chapeau><subparagraph class="fontsize10" id="y87c68e93-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s2/9/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the exclusive economic zone of the Russian Federation in waters more than 500 feet deep;</content></subparagraph>
<subparagraph class="fontsize10" id="y87c68e94-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s2/9/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Russian Arctic offshore locations; or</content></subparagraph>
<subparagraph class="fontsize10" id="y87c68e95-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s2/9/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>shale formations located in the Russian Federation.</content></subparagraph>

</section>
<section id="d285481e339" identifier="/us/pl/113/272/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87c6b5a6-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s8922">22 USC 8922</ref>.</p></sidenote><heading>STATEMENT OF POLICY REGARDING UKRAINE.</heading><content style="-uslm-lc:I658120">  It is the policy of the United States to further assist the Government of Ukraine in restoring its sovereignty and territorial integrity to deter the Government of the Russian Federation from further destabilizing and invading Ukraine and other independent countries in Central and Eastern Europe, the Caucasus, and Central Asia. That policy shall be carried into effect, among other things, through a comprehensive effort, in coordination with allies and partners of the United States where appropriate, that includes economic sanctions, diplomacy, assistance for the people of Ukraine, and the provision of military capabilities to the Government of Ukraine that will enhance the ability of that Government to defend itself and to restore its sovereignty and territorial integrity in the face of unlawful actions by the Government of the Russian Federation.</content></section>
<section id="d285481e352" identifier="/us/pl/113/272/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87c6b5a7-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p><p class="leftAlign firstIndent0 fontsize8" id="x87c6b5a8-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s8923">22 USC 8923</ref>.</p></sidenote><heading>SANCTIONS RELATING TO THE DEFENSE AND ENERGY SECTORS OF THE RUSSIAN FEDERATION.</heading><subsection class="firstIndent0 fontsize10" id="y87c974c9-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87c974ca-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Sanctions Relating to the Defense Sector</inline>.—</heading><paragraph class="fontsize10" id="y87c974cb-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Rosoboronexport</inline>.—</heading><content>Except as provided in subsection (d), not later than 30 days after the date of the enactment of this Act, the President shall impose 3 or more of the sanctions described in subsection (c) with respect to Rosoboronexport.</content></paragraph>
<paragraph class="fontsize10" id="y87c974cc-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Russian producers, transferors, or brokers of defense articles</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87c974cd-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote>—</heading><chapeau>Except as provided in subsection (d), on and after the date that is 45 days after the date of the enactment of this Act, the President shall impose 3 or more of the sanctions described in subsection (c) with respect to a foreign person the President determines—</chapeau><subparagraph class="fontsize10" id="y87c974ce-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>is an entity—<page identifier="/us/stat/128/2954">128 STAT. 2954</page></chapeau><clause class="fontsize10" id="y87c974cf-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/a/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>owned or controlled by the Government of the Russian Federation or owned or controlled by nationals of the Russian Federation; and</content></clause>
<clause class="fontsize10" id="y87c974d0-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/a/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><chapeau>that—</chapeau><subclause class="fontsize10" id="y87c974d1-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/a/2/A/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>knowingly manufactures or sells defense articles transferred into Syria or into the territory of a specified country without the consent of the internationally recognized government of that country;</content></subclause>
<subclause class="fontsize10" id="y87c974d2-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/a/2/A/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>transfers defense articles into Syria or into the territory of a specified country without the consent of the internationally recognized government of that country; or</content></subclause>
<subclause class="fontsize10" id="y87c974d3-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/a/2/A/ii/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>brokers or otherwise assists in the transfer of defense articles into Syria or into the territory of a specified country without the consent of the internationally recognized government of that country; or</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="y87c974d4-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>knowingly, on or after the date of the enactment of this Act, assists, sponsors, or provides financial, material, or technological support for, or goods or services to or in support of, an entity described in subparagraph (A) with respect to an activity described in clause (ii) of that subparagraph.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y87c974d5-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Specified country defined</inline>.—</heading><subparagraph class="fontsize10" id="y87c974d6-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/a/3/A" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>In this subsection, the term “<term>specified country</term>” means—</chapeau><clause class="fontsize10" id="y87c974d7-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/a/3/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>Ukraine, Georgia, and Moldova; and</content></clause>
<clause class="fontsize10" id="y87c974d8-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/a/3/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>any other country designated by the President as a country of significant concern for purposes of this subsection, such as Poland, Lithuania, Latvia, Estonia, and the Central Asia republics.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y87c974d9-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87c974da-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Notice to congress</inline>.—</heading><chapeau>The President shall notify the appropriate congressional committees in writing not later than 15 days before—</chapeau><clause class="fontsize10" id="y87c974db-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/a/3/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>designating a country as a country of significant concern under subparagraph (A)(ii); or</content></clause>
<clause class="fontsize10" id="y87c974dc-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/a/3/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>terminating a designation under that subparagraph, including the termination of any such designation pursuant to subsection (h).</content></clause>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y87c974dd-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87c974de-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Sanctions Related to the Energy Sector</inline>.—</heading><paragraph class="fontsize10" id="y87c974df-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Development of special russian crude oil projects</inline>.—</heading><content>Except as provided in subsection (d), on and after the date that is 45 days after the date of the enactment of this Act, the President may impose 3 or more of the sanctions described in subsection (c) with respect to a foreign person if the President determines that the foreign person knowingly makes a significant investment in a special Russian crude oil project.</content></paragraph>
<paragraph class="fontsize10" id="y87c974e0-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Authorization for extension of licensing limitations on certain equipment</inline>.—</heading><content>The President, through the Bureau of Industry and Security of the Department of Commerce or the Office of Foreign Assets Control of the Department of the Treasury, as appropriate, may impose additional licensing requirements for or other restrictions on the export or reexport of items for use in the energy sector of the Russian Federation, including equipment used for tertiary oil recovery.<page identifier="/us/stat/128/2955">128 STAT. 2955</page></content></paragraph>
<paragraph class="fontsize10" id="y87c974e1-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87c974e2-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Contingent sanction relating to gazprom</inline>.—</heading><content>If the President determines that Gazprom is withholding significant natural gas supplies from member countries of the North Atlantic Treaty Organization, or further withholds significant natural gas supplies from countries such as Ukraine, Georgia, or Moldova, the President shall, not later than 45 days after making that determination, impose the sanction described in subsection (c)(7) and at least one additional sanction described in subsection (c) with respect to Gazprom.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y87c974e3-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Sanctions Described</inline>.—</heading><chapeau>The sanctions the President may impose with respect to a foreign person under subsection (a) or (b) are the following:</chapeau><paragraph class="fontsize10" id="y87c974e4-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Export-import bank assistance</inline>.—</heading><content>The President may direct the Export-Import Bank of the United States not to approve the issuance of any guarantee, insurance, extension of credit, or participation in the extension of credit in connection with the export of any goods or services to the foreign person.</content></paragraph>
<paragraph class="fontsize10" id="y87c974e5-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Procurement sanction</inline>.—</heading><content>The President may prohibit the head of any executive agency (as defined in <ref href="/us/usc/t41/s133">section 133 of title 41, United States Code</ref>) from entering into any contract for the procurement of any goods or services from the foreign person.</content></paragraph>
<paragraph class="fontsize10" id="y87c974e6-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Arms export prohibition</inline>.—</heading><content>The President may prohibit the exportation or provision by sale, lease or loan, grant, or other means, directly or indirectly, of any defense article or defense service to the foreign person and the issuance of any license or other approval to the foreign person under section 38 of the Arms Export Control Act (<ref href="/us/usc/t22/s2778">22 U.S.C. 2778</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y87c974e7-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Dual-use export prohibition</inline>.—</heading><content>The President may prohibit the issuance of any license and suspend any license for the transfer to the foreign person of any item the export of which is controlled under the Export Administration Act of 1979 (<ref href="/us/usc/t50/app2401/etseq">50 U.S.C. App. 2401 et seq.</ref>) (as in effect pursuant to the International Emergency Economic Powers Act (<ref href="/us/usc/t50/s1701/etseq">50 U.S.C. 1701 et seq.</ref>)) or the Export Administration Regulations under subchapter C of chapter VII of <ref href="/us/cfr/t15">title 15, Code of Federal Regulations</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y87c974e8-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/c/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Property transactions</inline>.—</heading><chapeau>The President may, pursuant to such regulations as the President may prescribe, prohibit any person from—</chapeau><subparagraph class="fontsize10" id="y87c974e9-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/c/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>acquiring, holding, withholding, using, transferring, withdrawing, transporting, or exporting any property that is subject to the jurisdiction of the United States and with respect to which the foreign person has any interest;</content></subparagraph>
<subparagraph class="fontsize10" id="y87c974ea-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/c/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>dealing in or exercising any right, power, or privilege with respect to such property; or</content></subparagraph>
<subparagraph class="fontsize10" id="y87c974eb-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/c/5/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>conducting any transaction involving such property.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y87c974ec-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/c/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Banking transactions</inline>.—</heading><content>The President may, pursuant to such regulations as the President may prescribe, prohibit any transfers of credit or payments between financial institutions or by, through, or to any financial institution, to the extent that such transfers or payments are subject to the jurisdiction of the United States and involve any interest of the foreign person.</content></paragraph>
<paragraph class="fontsize10" id="y87c974ed-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/c/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition on investment in equity or debt of sanctioned person</inline>.—</heading><chapeau>The President may, pursuant to such regulations as the President may prescribe, prohibit any United <page identifier="/us/stat/128/2956">128 STAT. 2956</page>
States person from transacting in, providing financing for, or otherwise dealing in—</chapeau><subparagraph class="fontsize10" id="y87c99bfe-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/c/7/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>debt—</chapeau><clause class="fontsize10" id="y87c99bff-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/c/7/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87c99c00-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time periods.</p></sidenote><content>of longer than 30 days’ maturity of a foreign person with respect to which sanctions are imposed under subsection (a) or of longer than 90 days’ maturity of a foreign person with respect to which sanctions are imposed under subsection (b); and</content></clause>
<clause class="fontsize10" id="y87c99c01-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/c/7/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>issued on or after the date on which such sanctions are imposed with respect to the foreign person; or</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y87c99c02-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/c/7/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>equity of the foreign person issued on or after that date.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y87c99c03-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/c/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><heading class="fontsize10"><inline class="smallCaps">Exclusion from the united states and revocation of visa or other documentation</inline>.—</heading><content>In the case of a foreign person who is an individual, the President may direct the Secretary of State to deny a visa to, and the Secretary of Homeland Security to exclude from the United States, the foreign person, subject to regulatory exceptions to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations.</content></paragraph>
<paragraph class="fontsize10" id="y87c99c04-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/c/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><heading class="fontsize10"><inline class="smallCaps">Sanctions on principal executive officers</inline>.—</heading><content>In the case of a foreign person that is an entity, the President may impose on the principal executive officer or officers of the foreign person, or on individuals performing similar functions and with similar authorities as such officer or officers, any of the sanctions described in this subsection applicable to individuals.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y87c99c05-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Exceptions</inline>.—</heading><paragraph class="fontsize10" id="y87c99c06-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Importation of goods</inline>.—</heading><subparagraph class="fontsize10" id="y87c99c07-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The authority to block and prohibit all transactions in all property and interests in property under subsection (c)(5) shall not include the authority to impose sanctions on the importation of goods.</content></subparagraph>
<subparagraph class="fontsize10" id="y87c99c08-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/1/B" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Good defined</inline>.—</heading><content>In this paragraph, the term “<term>good</term>” has the meaning given that term in section 16 of the Export Administration Act of 1979 (<ref href="/us/usc/t50/app2415">50 U.S.C. App. 2415</ref>) (as continued in effect pursuant to the International Emergency Economic Powers Act (<ref href="/us/usc/t50/s1701/etseq">50 U.S.C. 1701 et seq.</ref>)).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y87c99c09-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Additional exceptions</inline>.—</heading><chapeau>The President shall not be required to apply or maintain the sanctions under subsection (a) or (b)—</chapeau><subparagraph class="fontsize10" id="y87c99c0a-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>in the case of procurement of defense articles or defense services under existing contracts, subcontracts, or other business agreements, including ancillary or incidental contracts for goods, or for services or funding (including necessary financial services) associated with such goods, as necessary to give effect to such contracts, subcontracts, or other business agreements, and the exercise of options for production quantities to satisfy requirements essential to the national security of the United States—</chapeau><clause class="fontsize10" id="y87c99c0b-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87c99c0c-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><chapeau>if the President determines in writing that—</chapeau><subclause class="fontsize10" id="y87c99c0d-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/2/A/i/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>the foreign person to which the sanctions would otherwise be applied is a sole source supplier of the defense articles or services;<page identifier="/us/stat/128/2957">128 STAT. 2957</page></content></subclause>
<subclause class="fontsize10" id="y87c99c0e-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/2/A/i/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>the defense articles or services are essential;</content></subclause>
<subclause class="fontsize10" id="y87c99c0f-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/2/A/i/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>alternative sources are not readily or reasonably available; and</content></subclause>
<subclause class="fontsize10" id="y87c99c10-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/2/A/i/IV" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">(IV) </num><content>the national interests of the United States would be adversely affected by the application or maintenance of such sanctions; or</content></subclause>
</clause>
<clause class="fontsize10" id="y87c99c11-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><chapeau>if the President determines in writing that—</chapeau><subclause class="fontsize10" id="y87c99c12-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/2/A/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>such articles or services are essential to the national security under defense coproduction agreements; and</content></subclause>
<subclause class="fontsize10" id="y87c99c13-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/2/A/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>the national interests of the United States would be adversely affected by the application or maintenance of such sanctions;</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="y87c99c14-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in the case of procurement, to eligible products, as defined in section 308(4) of the Trade Agreements Act of 1979 (<ref href="/us/usc/t19/s2518/4">19 U.S.C. 2518(4)</ref>), of any foreign country or instrumentality designated under section 301(b)(1) of that Act (<ref href="/us/usc/t19/s2511/b/1">19 U.S.C. 2511(b)(1)</ref>);</content></subparagraph>
<subparagraph class="fontsize10" id="y87c99c15-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>to products, technology, or services provided under contracts, subcontracts, or other business agreements (including ancillary or incidental contracts for goods, or for services or funding (including necessary financial services) associated with such goods, as necessary to give effect to such contracts, subcontracts, or other business agreements) entered into before the date on which the President publishes in the Federal Register the name of the foreign person with respect to which the sanctions are to be imposed;</content></subparagraph>
<subparagraph class="fontsize10" id="y87c99c16-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><chapeau>to—</chapeau><clause class="fontsize10" id="y87c99c17-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/2/D/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>spare parts that are essential to United States products or production;</content></clause>
<clause class="fontsize10" id="y87c99c18-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/2/D/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>component parts, but not finished products, essential to United States products or production; or</content></clause>
<clause class="fontsize10" id="y87c99c19-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/2/D/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>routine servicing and maintenance of United States products, to the extent that alternative sources are not readily or reasonably available;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y87c99c1a-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>to information and technology essential to United States products or production; or</content></subparagraph>
<subparagraph class="fontsize10" id="y87c99c1b-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/d/2/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>to food, medicine, medical devices, or agricultural commodities (as those terms are defined in section 101 of the Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010 (<ref href="/us/usc/t22/s8511">22 U.S.C. 8511</ref>)).</content></subparagraph>
</paragraph>
</subsection>

<subsection class="firstIndent0 fontsize10" id="y87c99c2e-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/h" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">(h) </num><heading class="fontsize10"><inline class="smallCaps">Termination</inline>.—</heading><paragraph class="fontsize10" id="y87c99c2f-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/h/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87c99c30-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Certification.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Except as provided in paragraph (2), this section, and sanctions imposed under this section, shall terminate on the date on which the President submits to the appropriate congressional committees a certification that the Government of the Russian Federation has ceased ordering, controlling, or otherwise directing, supporting, or financing, significant acts intended to undermine the peace, security, stability, sovereignty, or territorial integrity of Ukraine, including through an agreement between the appropriate parties.</content></paragraph>
<paragraph class="fontsize10" id="y87c99c31-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s4/h/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Applicability with respect to syria</inline>.—</heading><content>The termination date under paragraph (1) shall not apply with respect to the provisions of subsection (a) relating to the transfer of defense articles into Syria or sanctions imposed pursuant to such provisions.</content></paragraph>

<section id="d285481e986" identifier="/us/pl/113/272/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87c99c32-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p><p class="leftAlign firstIndent0 fontsize8" id="x87c99c33-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s8924">22 USC 8924</ref>.</p></sidenote><heading>SANCTIONS ON RUSSIAN AND OTHER FOREIGN FINANCIAL INSTITUTIONS.</heading><subsection class="firstIndent0 fontsize10" id="y87ca3874-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Facilitation of Certain Defense- and Energy-Related Transactions</inline>.—</heading><content>The President may impose the sanction described in subsection (c) with respect to a foreign financial institution that the President determines knowingly engages, on or after the date of the enactment of this Act, in significant transactions involving activities described in subparagraph (A)(ii) or (B) of section 4(a)(2) or paragraph (1) or (3) of section 4(b) for persons with respect to which sanctions are imposed under section 4.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y87ca3875-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Facilitation of Financial Transactions on Behalf of Specially Designated Nationals</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87ca3876-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="x87ca3877-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote>—</heading><chapeau>The President may impose the sanction described in subsection (c) with respect to a foreign financial institution if the President determines that the foreign financial institution has, on or after the date that is 180 days <page identifier="/us/stat/128/2959">128 STAT. 2959</page>
after the date of the enactment of this Act, knowingly facilitated a significant financial transaction on behalf of any Russian person included on the list of specially designated nationals and blocked persons maintained by the Office of Foreign Assets Control of the Department of the Treasury, pursuant to—</chapeau><paragraph class="fontsize10" id="y87ca3878-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s5/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>this Act;</content></paragraph>
<paragraph class="fontsize10" id="y87ca3879-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s5/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Executive Order No. 13660 (<ref href="/us/fr/79/13">79 Fed. Reg. 13</ref>,493), 13661 (<ref href="/us/fr/79/15">79 Fed. Reg. 15</ref>,535), or 13662 (<ref href="/us/fr/79/16">79 Fed. Reg. 16</ref>,169); or</content></paragraph>
<paragraph class="fontsize10" id="y87ca387a-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s5/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>any other Executive order addressing the crisis in Ukraine.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y87ca387b-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s5/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Sanction Described</inline>.—</heading><content>The sanction described in this subsection is, with respect to a foreign financial institution, a prohibition on the opening, and a prohibition or the imposition of strict conditions on the maintaining, in the United States of a correspondent account or a payable-through account by the foreign financial institution.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y87ca387c-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s5/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">National Security Waiver</inline>.—</heading><chapeau>The President may waive the application of sanctions under this section with respect to a foreign financial institution if the President—</chapeau><paragraph class="fontsize10" id="y87ca387d-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s5/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87ca387e-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>determines that the waiver is in the national security interest of the United States; and</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y87ca3883-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s5/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87ca3884-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Certification.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Termination</inline>.—</heading><content>This section, and sanctions imposed under this section, shall terminate on the date on which the President submits to the appropriate congressional committees the certification described in section 4(h).</content></subsection>

<section id="d285481e1129" identifier="/us/pl/113/272/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87ca3885-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s8925">22 USC 8925</ref>.</p></sidenote><heading>INCREASED MILITARY ASSISTANCE FOR THE GOVERNMENT OF UKRAINE.</heading><subsection class="firstIndent0 fontsize10" id="y87caadb6-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s6/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87caadb7-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The President is authorized to provide defense articles, defense services, and training to the Government of Ukraine for the purpose of countering offensive weapons and reestablishing the sovereignty and territorial integrity of Ukraine, including anti-tank and anti-armor weapons, crew weapons and ammunition, counter-artillery radars to identify and target artillery batteries, fire control, range finder, and optical and guidance and control equipment, tactical troop-operated surveillance drones, and secure command and communications equipment, pursuant to the provisions of the Arms Export Control Act (<ref href="/us/usc/t22/s2751/etseq">22 U.S.C. 2751 et seq.</ref>), the Foreign Assistance Act of 1961 (<ref href="/us/usc/t22/s2151/etseq">22 U.S.C. 2151 et seq.</ref>), and other relevant provisions of law.<page identifier="/us/stat/128/2960">128 STAT. 2960</page></content></subsection>
<subsection class="firstIndent0 fontsize10" id="y87caadb8-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s6/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87caadb9-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Report Required</inline>.—</heading><chapeau>Not later than 60 days after the date of the enactment of this Act, the President shall submit a report detailing the anticipated defense articles, defense services, and training to be provided pursuant to this section and a timeline for the provision of such defense articles, defense services, and training, to—</chapeau><paragraph class="fontsize10" id="y87caadba-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s6/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the Committee on Foreign Relations, the Committee on Appropriations, and the Committee on Armed Services of the Senate; and</content></paragraph>
<paragraph class="fontsize10" id="y87caadbb-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s6/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the Committee on Foreign Affairs, the Committee on Appropriations, and the Committee on Armed Services of the House of Representatives.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y87caadbc-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s6/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><paragraph class="fontsize10" id="y87caadbd-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s6/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>There are authorized to be appropriated to the Secretary of State $100,000,000 for fiscal year 2015, $125,000,000 for fiscal year 2016, and $125,000,000 for fiscal year 2017 to carry out activities under this section.</content></paragraph>
<paragraph class="fontsize10" id="y87caadbe-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s6/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Availability of amounts</inline>.—</heading><content>Amounts authorized to be appropriated pursuant to paragraph (1) shall remain available for obligation and expenditure through the end of fiscal year 2018.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y87caadbf-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s6/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Authority for the Use of Funds</inline>.—</heading><content>The funds made available pursuant to subsection (c) for provision of defense articles, defense services, and training may be used to procure such articles, services, and training from the United States Government or other appropriate sources.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y87caadc0-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s6/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Protection of Civilians</inline>.—</heading><content>It is the sense of Congress that the Government of Ukraine should take all appropriate steps to protect civilians.</content></subsection>

<section id="d285481e1227" identifier="/us/pl/113/272/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87caadc1-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s8926">22 USC 8926</ref>.</p></sidenote><heading>EXPANDED NONMILITARY ASSISTANCE FOR UKRAINE.</heading><subsection class="firstIndent0 fontsize10" id="y87ccd0a2-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Assistance to Internally Displaced People in Ukraine</inline>.—</heading><paragraph class="fontsize10" id="y87ccd0a3-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87ccd0a4-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x87ccd0a5-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Plans.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 30 days after the date of the enactment of this Act, the Secretary of State shall submit a plan, including actions by the United States Government, other governments, and international organizations, to meet the need for protection of and assistance for internally displaced persons in Ukraine, to—</chapeau><subparagraph class="fontsize10" id="y87ccd0a6-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Committee on Foreign Relations, the Committee on Appropriations, and the Committee on Energy and Natural Resources of the Senate; and</content></subparagraph>
<subparagraph class="fontsize10" id="y87ccd0a7-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Committee on Foreign Affairs, the Committee on Appropriations, and the Committee on Energy and Commerce of the House of Representatives.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y87ccd0a8-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Elements</inline>.—</heading><chapeau>The plan required by paragraph (1) should include, as appropriate, activities in support of—</chapeau><subparagraph class="fontsize10" id="y87ccd0a9-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>helping to establish a functional and adequately resourced central registration system in Ukraine that can ensure coordination of efforts to provide assistance to internally displaced persons in different regions;</content></subparagraph>
<subparagraph class="fontsize10" id="y87ccd0aa-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>encouraging adoption of legislation in Ukraine that protects internally displaced persons from discrimination based on their status and provides simplified procedures for obtaining the new residency registration or other official documentation that is a prerequisite to receiving appropriate social payments under the laws of Ukraine, such <page identifier="/us/stat/128/2961">128 STAT. 2961</page>
as pensions and disability, child, and unemployment benefits; and</content></subparagraph>
<subparagraph class="fontsize10" id="y87ccd0ab-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><chapeau>helping to ensure that information is available to internally displaced persons about—</chapeau><clause class="fontsize10" id="y87ccd0ac-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/a/2/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>government agencies and independent groups that can provide assistance to such persons in various regions; and</content></clause>
<clause class="fontsize10" id="y87ccd0ad-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/a/2/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>evacuation assistance available to persons seeking to flee armed conflict areas.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y87ccd0ae-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87ccd0af-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Assistance through international organizations</inline>.—</heading><content>The President shall instruct the United States permanent representative or executive director, as the case may be, to the relevant United Nations voluntary agencies, including the United Nations High Commissioner for Refugees and the United Nations Office for the Coordination of Humanitarian Affairs, and other appropriate international organizations, to use the voice and vote of the United States to support appropriate assistance for internally displaced persons in Ukraine.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y87ccd0b0-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Assistance to the Defense Sector of Ukraine</inline>.—</heading><content>The Secretary of State and the Secretary of Defense should assist entities in the defense sector of Ukraine to reorient exports away from customers in the Russian Federation and to find appropriate alternative markets for those entities in the defense sector of Ukraine that have already significantly reduced exports to and cooperation with entities in the defense sector of the Russian Federation.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y87ccd0b1-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Assistance To Address the Energy Crisis in Ukraine</inline>.—</heading><paragraph class="fontsize10" id="y87ccd0b2-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Emergency energy assistance</inline>.—</heading><subparagraph class="fontsize10" id="y87ccd0b3-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Plan required</inline>.—</heading><content>The Secretary of State and the Secretary of Energy, in collaboration with the Administrator of the United States Agency for International Development and the Administrator of the Federal Emergency Management Agency, shall work with officials of the Government of Ukraine to develop a short-term emergency energy assistance plan designed to help Ukraine address the potentially severe short-term heating fuel and electricity shortages facing Ukraine in 2014 and 2015.</content></subparagraph>
<subparagraph class="fontsize10" id="y87ccd0b4-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Elements</inline>.—</heading><chapeau>The plan required by subparagraph (A) should include strategies to address heating fuel and electricity shortages in Ukraine, including, as appropriate—</chapeau><clause class="fontsize10" id="y87ccd0b5-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the acquisition of short-term, emergency fuel supplies;</content></clause>
<clause class="fontsize10" id="y87ccd0b6-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the repair or replacement of infrastructure that could impede the transmission of electricity or transportation of fuel;</content></clause>
<clause class="fontsize10" id="y87ccd0b7-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/1/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>the prioritization of the transportation of fuel supplies to the areas where such supplies are needed most;</content></clause>
<clause class="fontsize10" id="y87ccd0b8-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/1/B/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>streamlining emergency communications throughout national, regional, and local governments to manage the potential energy crisis resulting from heating fuel and electricity shortages;</content></clause>
<clause class="fontsize10" id="y87ccd0b9-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/1/B/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>forming a crisis management team within the Government of Ukraine to specifically address the potential crisis, including ensuring coordination of the team’s efforts with the efforts of outside governmental <page identifier="/us/stat/128/2962">128 STAT. 2962</page>
and nongovernmental entities providing assistance to address the potential crisis; and</content></clause>
<clause class="fontsize10" id="y87ccd0ba-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/1/B/vi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">(vi) </num><content>developing a public outreach strategy to facilitate preparation by the population and communication with the population in the event of a crisis.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y87ccd0bb-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Assistance</inline>.—</heading><chapeau>The Secretary of State, the Secretary of Energy, and the Administrator of the United States Agency for International Development are authorized to provide assistance in support of, and to invest in short-term solutions for, enabling Ukraine to secure the energy safety of the people of Ukraine during 2014 and 2015, including through—</chapeau><clause class="fontsize10" id="y87ccd0bc-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/1/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>procurement and transport of emergency fuel supplies, including reverse pipeline flows from Europe;</content></clause>
<clause class="fontsize10" id="y87ccd0bd-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/1/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>provision of technical assistance for crisis planning, crisis response, and public outreach;</content></clause>
<clause class="fontsize10" id="y87ccd0be-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/1/C/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>repair of infrastructure to enable the transport of fuel supplies;</content></clause>
<clause class="fontsize10" id="y87ccd0bf-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/1/C/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>repair of power generating or power transmission equipment or facilities;</content></clause>
<clause class="fontsize10" id="y87ccd0c0-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/1/C/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>procurement and installation of compressors or other appropriate equipment to enhance short-term natural gas production;</content></clause>
<clause class="fontsize10" id="y87ccd0c1-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/1/C/vi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">(vi) </num><content>procurement of mobile electricity generation units;</content></clause>
<clause class="fontsize10" id="y87ccd0c2-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/1/C/vii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">(vii) </num><content>conversion of natural gas heating facilities to run on other fuels, including alternative energy sources; and</content></clause>
<clause class="fontsize10" id="y87ccd0c3-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/1/C/viii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="viii">(viii) </num><content>provision of emergency weatherization and winterization materials and supplies.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y87ccd0c4-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Reduction of ukraine’s reliance on energy imports</inline>.—</heading><subparagraph class="fontsize10" id="y87ccd0c5-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Plans required</inline>.—</heading><content>The Secretary of State, in collaboration with the Secretary of Energy and the Administrator of the United States Agency for International Development, shall work with officials of the Government of Ukraine to develop medium- and long-term plans to increase energy production and efficiency to increase energy security by helping Ukraine reduce its dependence on natural gas imported from the Russian Federation.</content></subparagraph>
<subparagraph class="fontsize10" id="y87ccd0c6-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Elements</inline>.—</heading><chapeau>The medium- and long-term plans required by subparagraph (A) should include strategies, as appropriate, to—</chapeau><clause class="fontsize10" id="y87ccd0c7-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>improve corporate governance and unbundling of state-owned oil and gas sector firms;</content></clause>
<clause class="fontsize10" id="y87ccd0c8-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>increase production from natural gas fields and from other sources, including renewable energy;</content></clause>
<clause class="fontsize10" id="y87ccd0c9-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/2/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>license new oil and gas blocks transparently and competitively;</content></clause>
<clause class="fontsize10" id="y87ccd0ca-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/2/B/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>modernize oil and gas upstream infrastructure; and</content></clause>
<clause class="fontsize10" id="y87ccd0cb-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/2/B/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>improve energy efficiency.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y87ccd0cc-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Prioritization</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87ccd0cd-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote>—</heading><content>The Secretary of State, the Administrator of the United States Agency for International Development, and the Secretary of Energy should, during fiscal years 2015 through 2018, work with other <page identifier="/us/stat/128/2963">128 STAT. 2963</page>
donors, including multilateral agencies and nongovernmental organizations, to prioritize, to the extent practicable and as appropriate, the provision of assistance from such donors to help Ukraine to improve energy efficiency, increase energy supplies produced in Ukraine, and reduce reliance on energy imports from the Russian Federation, including natural gas.</content></subparagraph>
<subparagraph class="fontsize10" id="y87ccd0ce-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of appropriations</inline>.—</heading><content>There are authorized to be appropriated $50,000,000 in the aggregate for fiscal years 2016 through 2018 to carry out activities under this paragraph.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y87ccd0cf-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Support from the overseas private investment corporation</inline>.—</heading><chapeau>The Overseas Private Investment Corporation shall—</chapeau><subparagraph class="fontsize10" id="y87ccd0d0-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>prioritize, to the extent practicable, support for investments to help increase energy efficiency, develop domestic oil and natural gas reserves, improve and repair electricity infrastructure, and develop renewable and other sources of energy in Ukraine; and</content></subparagraph>
<subparagraph class="fontsize10" id="y87ccd0d1-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87ccd0d2-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Procedures.</p></sidenote><content>implement procedures for expedited review and, as appropriate, approval, of applications by eligible investors (as defined in section 238 of the Foreign Assistance Act of 1961 (<ref href="/us/usc/t22/s2198">22 U.S.C. 2198</ref>)) for loans, loan guarantees, and insurance for such investments.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y87ccd0d3-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Support by the world bank group and the european bank for reconstruction and development</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87ccd0d4-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p></sidenote>—</heading><chapeau>The President shall, to the extent practicable and as appropriate, direct the United States Executive Directors of the World Bank Group and the European Bank for Reconstruction and Development to use the voice, vote, and influence of the United States to encourage the World Bank Group and the European Bank for Reconstruction and Development and other international financial institutions—</chapeau><subparagraph class="fontsize10" id="y87ccd0d5-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>to invest in, and increase their efforts to promote investment in, projects to improve energy efficiency, improve and repair electricity infrastructure, develop domestic oil and natural gas reserves, and develop renewable and other sources of energy in Ukraine; and</content></subparagraph>
<subparagraph class="fontsize10" id="y87ccd0d6-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/c/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>to stimulate private investment in such projects.</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y87ccd0d7-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Assistance to Civil Society in Ukraine</inline>.—</heading><paragraph class="fontsize10" id="y87ccd0d8-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Secretary of State and the Administrator of the United States Agency for International Development shall, directly or through nongovernmental or international organizations, such as the Organization for Security and Co-operation in Europe, the National Endowment for Democracy, and related organizations—</chapeau><subparagraph class="fontsize10" id="y87ccd0d9-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/d/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>strengthen the organizational and operational capacity of democratic civil society in Ukraine;</content></subparagraph>
<subparagraph class="fontsize10" id="y87ccd0da-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/d/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>support the efforts of independent media outlets to broadcast, distribute, and share information in all regions of Ukraine;</content></subparagraph>
<subparagraph class="fontsize10" id="y87ccd0db-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/d/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>counter corruption and improve transparency and accountability of institutions that are part of the Government of Ukraine; and</content></subparagraph>
<subparagraph class="fontsize10" id="y87ccd0dc-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s7/d/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>provide support for democratic organizing and election monitoring in Ukraine.<page identifier="/us/stat/128/2964">128 STAT. 2964</page></content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y87cd451c-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s8/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Prioritization of Broadcasting Into Ukraine, Georgia, and Moldova</inline>.—</heading><content>The plan required by subsection (a) shall prioritize broadcasting into Ukraine, Georgia, and Moldova by the Voice of America and Radio Free Europe/Radio Liberty.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y87cd451d-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s8/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Additional Priorities</inline>.—</heading><chapeau>In developing the plan required by subsection (a), the Chairman shall consider—</chapeau><paragraph class="fontsize10" id="y87cd451e-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s8/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>near-term increases in Russian-language broadcasting for countries of the former Soviet Union (other than the countries specified in subsection (b)), including Latvia, Lithuania, and Estonia; and</content></paragraph>
<paragraph class="fontsize10" id="y87cd451f-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s8/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>increases in broadcasting in other critical languages, including Ukrainian and Romanian languages.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y87cd4520-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s8/d" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Broadcasting Defined</inline>.—</heading><content>In this section, the term “<term>broadcasting</term>” means the distribution of media content via radio broadcasting, television broadcasting, and Internet-based platforms, among other platforms.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y87cd4521-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s8/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><paragraph class="fontsize10" id="y87cd4522-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s8/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>There are authorized to be appropriated to the Broadcasting Board of Governors $10,000,000 for each of fiscal years 2016 through 2018 to carry out activities under this section.</content></paragraph>
<paragraph class="fontsize10" id="y87cd4523-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s8/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Supplement not supplant</inline>.—</heading><content>Amounts authorized to be appropriated pursuant to paragraph (1) shall supplement and not supplant other amounts made available for activities described in this section.</content></paragraph>

the Organization for Security and Co-operation in Europe, the National Endowment for Democracy, and related organizations—</chapeau><paragraph class="fontsize10" id="y87cdba56-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s9/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>improve democratic governance, transparency, accountability, rule of law, and anti-corruption efforts in the Russian Federation;</content></paragraph>
<paragraph class="fontsize10" id="y87cdba57-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s9/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>strengthen democratic institutions and political and civil society organizations in the Russian Federation;</content></paragraph>
<paragraph class="fontsize10" id="y87cdba58-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s9/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>expand uncensored Internet access in the Russian Federation; and</content></paragraph>
<paragraph class="fontsize10" id="y87cdba59-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s9/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>expand free and unfettered access to independent media of all kinds in the Russian Federation, including through increasing United States Government-supported broadcasting activities, and assist with the protection of journalists and civil society activists who have been targeted for free speech activities.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y87cdba5a-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s9/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><content>There are authorized to be appropriated to the Secretary of State $20,000,000 for each of fiscal years 2016 through 2018 to carry out the activities set forth in subsection (a).</content></subsection>

<section id="d285481e1848" identifier="/us/pl/113/272/s10" style="-uslm-lc:I658142"><num class="fontsize12" value="10">SEC. 10. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87cdba63-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s8929">22 USC 8929</ref>.</p></sidenote><heading>REPORT ON NON-COMPLIANCE BY THE RUSSIAN FEDERATION OF ITS OBLIGATIONS UNDER THE INF TREATY.</heading><subsection class="firstIndent0 fontsize10" id="y87ce7db4-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s10/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Findings</inline>.—</heading><chapeau>Congress makes the following findings:</chapeau><paragraph class="fontsize10" id="y87ce7db5-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s10/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The Russian Federation is in violation of its obligations under the Treaty between the United States of America and the Union of Soviet Socialist Republics on the Elimination of Their Intermediate-Range and Shorter-Range Missiles, signed at Washington December 8, 1987, and entered into force June 1, 1988 (commonly referred to as the “Intermediate-Range Nuclear Forces Treaty” or “INF Treaty”).</content></paragraph>
<paragraph class="fontsize10" id="y87ce7db6-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s10/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>This behavior poses a threat to the United States, its deployed forces, and its allies.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y87ce7db7-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s10/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Sense of Congress</inline>.—</heading><chapeau>It is the sense of Congress that—</chapeau><paragraph class="fontsize10" id="y87ce7db8-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s10/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the President should hold the Russian Federation accountable for being in violation of its obligations under the INF Treaty; and</content></paragraph>
<paragraph class="fontsize10" id="y87ce7db9-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s10/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the President should demand the Russian Federation completely and verifiably eliminate the military systems that constitute the violation of its obligations under the INF Treaty.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y87ce7dba-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s10/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><paragraph class="fontsize10" id="y87ce7dbb-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s10/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87ce7dbc-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 90 days after the date of the enactment of this Act, and every 90 days thereafter, the President shall submit to the committees specified in subsection (d) a report that includes the following elements:</chapeau><page identifier="/us/stat/128/2966">128 STAT. 2966</page>
<subparagraph class="fontsize10" id="y87ce7dbd-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s10/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>A description of the status of the President’s efforts, in cooperation with United States allies, to hold the Russian Federation accountable for being in violation of its obligations under the INF Treaty and obtain the complete and verifiable elimination of its military systems that constitute the violation of its obligations under the INF Treaty.</content></subparagraph>
<subparagraph class="fontsize10" id="y87ce7dbe-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s10/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87ce7dbf-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>The President’s assessment as to whether it remains in the national security interests of the United States to remain a party to the INF Treaty, and other related treaties and agreements, while the Russian Federation is in violation of its obligations under the INF Treaty.</content></subparagraph>
<subparagraph class="fontsize10" id="y87ce7dc0-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s10/c/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>Notification of any deployment by the Russian Federation of a ground launched ballistic or cruise missile system with a range of between 500 and 5,500 kilometers.</content></subparagraph>
<subparagraph class="fontsize10" id="y87ce7dc1-e880-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/272/s10/c/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87ce7dc2-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Plans.</p><p class="leftAlign firstIndent0 fontsize8" id="x87ce7dc3-e880-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><content>A plan developed by the Secretary of State, in consultation with the Director of National Intelligence and the Defense Threat Reduction Agency (DTRA), to verify that the Russian Federation has fully and completely dismantled any ground launched cruise missiles or ballistic missiles with a range of between 500 and 5,500 kilometers, including details on facilities that inspectors need access to, people inspectors need to talk with, how often inspectors need the accesses for, and how much the verification regime would cost.</content></subparagraph>
