<section id="d376830e104" identifier="/us/pl/113/242/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Death in Custody Reporting Act of 2013</shortTitle>”.</content></section>
<section id="d376830e114" identifier="/us/pl/113/242/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x46743290-e885-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s13727">42 USC 13727</ref>.</p></sidenote><heading>STATE INFORMATION REGARDING INDIVIDUALS WHO DIE IN THE CUSTODY OF LAW ENFORCEMENT.</heading><subsection class="firstIndent0 fontsize10" id="y4674ced1-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>For each fiscal year after the expiration of the period specified in subsection (c)(1) in which a State receives funds for a program referred to in subsection (c)(2), the State shall report to the Attorney General, on a quarterly basis and pursuant to guidelines established by the Attorney General, information regarding the death of any person who is detained, under arrest, or is in the process of being arrested, is en route to be incarcerated, or is incarcerated at a municipal or county jail, State prison, State-run boot camp prison, boot camp prison that is contracted out by the State, any State or local contract facility, or other local or State correctional facility (including any juvenile facility).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y4674ced2-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Information Required</inline>.—</heading><chapeau>The report required by this section shall contain information that, at a minimum, includes—</chapeau><paragraph class="fontsize10" id="y4674ced3-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the name, gender, race, ethnicity, and age of the deceased;</content></paragraph>
<paragraph class="fontsize10" id="y4674ced4-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the date, time, and location of death;</content></paragraph>
<paragraph class="fontsize10" id="y4674ced5-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s2/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the law enforcement agency that detained, arrested, or was in the process of arresting the deceased; and</content></paragraph>
<paragraph class="fontsize10" id="y4674ced6-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s2/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>a brief description of the circumstances surrounding the death.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y4674ced7-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Compliance and Ineligibility</inline>.—</heading><paragraph class="fontsize10" id="y4674ced8-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Compliance date</inline>.—</heading><chapeau>Each State shall have not more than 120 days from the date of enactment of this Act to comply with subsection (a), except that—</chapeau><subparagraph class="fontsize10" id="y4674ced9-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s2/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Attorney General may grant an additional 120 days to a State that is making good faith efforts to comply with such subsection; and</content></subparagraph>
<subparagraph class="fontsize10" id="y4674ceda-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s2/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4674cedb-e885-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Waiver authority.</p></sidenote><content>the Attorney General shall waive the requirements of subsection (a) if compliance with such subsection by a State would be unconstitutional under the constitution of such State.<page identifier="/us/stat/128/2861">128 STAT. 2861</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y4674cedc-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Ineligibility for funds</inline>.—</heading><content>For any fiscal year after the expiration of the period specified in paragraph (1), a State that fails to comply with subsection (a), shall, at the discretion of the Attorney General, be subject to not more than a 10-percent reduction of the funds that would otherwise be allocated for that fiscal year to the State under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t42/s3750/etseq">42 U.S.C. 3750 et seq.</ref>), whether characterized as the Edward Byrne Memorial State and Local Law Enforcement Assistance Programs, the Local Government Law Enforcement Block Grants Program, the Edward Byrne Memorial Justice Assistance Grant Program, or otherwise.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y4674cedd-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Reallocation</inline>.—</heading><content>Amounts not allocated under a program referred to in subsection (c)(2) to a State for failure to fully comply with subsection (a) shall be reallocated under that program to States that have not failed to comply with such subsection.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y4674cede-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><content>In this section the terms “boot camp prison” and “State” have the meaning given those terms, respectively, in section 901(a) of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t42/s3791/a">42 U.S.C. 3791(a)</ref>).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y4674cedf-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s2/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Study and Report of Information Relating to Deaths in Custody</inline>.—</heading><paragraph class="fontsize10" id="y4674cee0-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s2/f/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Study required</inline>.—</heading><chapeau>The Attorney General shall carry out a study of the information reported under subsection (b) and section 3(a) to—</chapeau><subparagraph class="fontsize10" id="y4674cee1-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s2/f/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>determine means by which such information can be used to reduce the number of such deaths; and</content></subparagraph>
<subparagraph class="fontsize10" id="y4674cee2-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s2/f/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>examine the relationship, if any, between the number of such deaths and the actions of management of such jails, prisons, and other specified facilities relating to such deaths.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y4674cee3-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s2/f/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>Not later than 2 years after the date of the enactment of this Act, the Attorney General shall prepare and submit to Congress a report that contains the findings of the study required by paragraph (1).</content></paragraph>

<section id="d376830e267" identifier="/us/pl/113/242/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4674cee4-e885-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s13727a">42 USC 13727a</ref>.</p></sidenote><heading>FEDERAL LAW ENFORCEMENT DEATH IN CUSTODY REPORTING REQUIREMENT.</heading><subsection class="firstIndent0 fontsize10" id="y46751d05-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x46751d06-e885-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Effective date.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>For each fiscal year (beginning after the date that is 120 days after the date of the enactment of this Act), the head of each Federal law enforcement agency shall submit to the Attorney General a report (in such form and manner specified by the Attorney General) that contains information regarding the death of any person who is—</chapeau><paragraph class="fontsize10" id="y46751d07-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>detained, under arrest, or is in the process of being arrested by any officer of such Federal law enforcement agency (or by any State or local law enforcement officer while participating in and for purposes of a Federal law enforcement operation, task force, or any other Federal law enforcement capacity carried out by such Federal law enforcement agency); or</content></paragraph>
<paragraph class="fontsize10" id="y46751d08-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>en route to be incarcerated or detained, or is incarcerated or detained at—</chapeau><subparagraph class="fontsize10" id="y46754419-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s3/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>any facility (including any immigration or juvenile facility) pursuant to a contract with such Federal law enforcement agency;</content></subparagraph>
<subparagraph class="fontsize10" id="y4675441a-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s3/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>any State or local government facility used by such Federal law enforcement agency; or<page identifier="/us/stat/128/2862">128 STAT. 2862</page></content></subparagraph>
<subparagraph class="fontsize10" id="y4675441b-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s3/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>any Federal correctional facility or Federal pre-trial detention facility located within the United States.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y4675441c-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Information Required</inline>.—</heading><content>Each report required by this section shall include, at a minimum, the information required by section 2(b).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y4675441d-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/242/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Study and Report</inline>.—</heading><content>Information reported under subsection (a) shall be analyzed and included in the study and report required by section 2(f).</content></subsection>
