<section id="d377222e88" identifier="/us/pl/113/239/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb9a92c7-e885-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s718o">16 USC 718o note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Permanent Electronic Duck Stamp Act of 2013</shortTitle>”.</content></section>
<section id="d377222e103" identifier="/us/pl/113/239/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb9a92c8-e885-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s718o">16 USC 718o</ref>.</p></sidenote><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xdb9b07f9-e885-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="ydb9b07fa-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Actual stamp</inline>.—</heading><content>The term “<term>actual stamp</term>” means a Federal migratory-bird hunting and conservation stamp required under the Act of March 16, 1934 (<ref href="/us/usc/t16/s718a/etseq">16 U.S.C. 718a et seq.</ref>) (popularly known as the “Duck Stamp Act”), that is printed on paper and sold through the means established by the authority of the Secretary immediately before the date of enactment of this Act.</content></paragraph>
<paragraph class="fontsize10" id="ydb9b07fb-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Automated licensing system</inline>.—</heading><subparagraph class="fontsize10" id="ydb9b07fc-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s2/2/A" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The term “<term>automated licensing system</term>” means an electronic, computerized licensing system used by a State fish and wildlife agency to issue hunting, fishing, and other associated licenses and products.</content></subparagraph>
<subparagraph class="fontsize10" id="ydb9b07fd-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s2/2/B" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Inclusion</inline>.—</heading><content>The term “<term>automated licensing system</term>” includes a point-of-sale, Internet, telephonic system, or other electronic applications used for a purpose described in subparagraph (A).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ydb9b07fe-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Electronic stamp</inline>.—</heading><chapeau>The term “<term>electronic stamp</term>” means an electronic version of an actual stamp that—</chapeau><subparagraph class="fontsize10" id="ydb9b07ff-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s2/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>is a unique identifier for the individual to whom it is issued;</content></subparagraph>
<subparagraph class="fontsize10" id="ydb9b0800-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s2/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>can be printed on paper or produced through an electronic application with the same indicators as the State endorsement provides;</content></subparagraph>
<subparagraph class="fontsize10" id="ydb9b0801-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s2/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>is issued through a State automated licensing system that is authorized, under State law and by the Secretary under this Act, to issue electronic stamps;</content></subparagraph>
<subparagraph class="fontsize10" id="ydb9b0802-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s2/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>is compatible with the hunting licensing system of the State that issues the electronic stamp; and</content></subparagraph>
<subparagraph class="fontsize10" id="ydb9b0803-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s2/3/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>is described in the State application approved by the Secretary under section 4(b).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ydb9b2f14-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s2/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Interior.<page identifier="/us/stat/128/2848">128 STAT. 2848</page></content></paragraph>

<section id="d377222e201" identifier="/us/pl/113/239/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb9b2f15-e885-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s718p">16 USC 718p</ref>.</p></sidenote><heading>AUTHORITY TO ISSUE ELECTRONIC DUCK STAMPS.</heading><subsection class="firstIndent0 fontsize10" id="ydb9b2f16-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Secretary may authorize any State to issue electronic stamps in accordance with this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ydb9b2f17-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Consultation</inline>.—</heading><content>The Secretary shall implement this section in consultation with State management agencies.</content></subsection>
</section>
<section id="d377222e230" identifier="/us/pl/113/239/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb9b2f18-e885-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s718q">16 USC 718q</ref>.</p></sidenote><heading>STATE APPLICATION.</heading><subsection class="firstIndent0 fontsize10" id="ydb9ba449-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Approval of Application Required</inline>.—</heading><content>The Secretary may not authorize a State to issue electronic stamps under this Act unless the Secretary has received and approved an application submitted by the State in accordance with this section. The Secretary may determine the number of new States per year to participate in the electronic stamp program.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ydb9ba44a-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Contents of Application</inline>.—</heading><chapeau>The Secretary may not approve a State application unless the application contains—</chapeau><paragraph class="fontsize10" id="ydb9ba44b-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>a description of the format of the electronic stamp that the State will issue under this Act, including identifying features of the licensee that will be specified on the stamp;</content></paragraph>
<paragraph class="fontsize10" id="ydb9ba44c-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>a description of any fee the State will charge for issuance of an electronic stamp;</content></paragraph>
<paragraph class="fontsize10" id="ydb9ba44d-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s4/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>a description of the process the State will use to account for and transfer to the Secretary the amounts collected by the State that are required to be transferred to the Secretary under the program;</content></paragraph>
<paragraph class="fontsize10" id="ydb9ba44e-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s4/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the manner by which the State will transmit electronic stamp customer data to the Secretary;</content></paragraph>
<paragraph class="fontsize10" id="ydb9ba44f-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s4/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>the manner by which actual stamps will be delivered;</content></paragraph>
<paragraph class="fontsize10" id="ydb9ba450-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s4/b/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>the policies and procedures under which the State will issue duplicate electronic stamps; and</content></paragraph>
<paragraph class="fontsize10" id="ydb9ba451-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s4/b/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>such other policies, procedures, and information as may be reasonably required by the Secretary.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ydb9ba452-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Publication of Deadlines, Eligibility Requirements, and Selection Criteria</inline>.—</heading><chapeau>Not later than 30 days before the date on which the Secretary begins accepting applications under this section, the Secretary shall publish—</chapeau><paragraph class="fontsize10" id="ydb9ba453-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s4/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>deadlines for submission of applications;</content></paragraph>
<paragraph class="fontsize10" id="ydb9ba454-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s4/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>eligibility requirements for submitting applications; and</content></paragraph>
<paragraph class="fontsize10" id="ydb9ba455-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s4/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>criteria for approving applications.</content></paragraph>
</subsection>
</section>
<section id="d377222e318" identifier="/us/pl/113/239/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb9ba456-e885-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s718r">16 USC 718r</ref>.</p></sidenote><heading>STATE OBLIGATIONS AND AUTHORITIES.</heading><subsection class="firstIndent0 fontsize10" id="ydb9c1987-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Delivery of Actual Stamp</inline>.—</heading><chapeau>The Secretary shall require that each individual to whom a State sells an electronic stamp under this Act shall receive an actual stamp—</chapeau><paragraph class="fontsize10" id="ydb9c1988-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s5/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb9c1989-e885-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote>by not later than the date on which the electronic stamp expires under section 6(c); and</content></paragraph>
<paragraph class="fontsize10" id="ydb9c198a-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s5/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in a manner agreed upon by the State and Secretary.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ydb9c198b-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Collection and Transfer of Electronic Stamp Revenue and Customer Information</inline>.—</heading><paragraph class="fontsize10" id="ydb9c198c-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s5/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Requirement to transmit</inline>.—</heading><chapeau>The Secretary shall require each State authorized to issue electronic stamps to collect and submit to the Secretary in accordance with this section—</chapeau><subparagraph class="fontsize10" id="ydb9c198d-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s5/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the first name, last name, and complete mailing address of each individual that purchases an electronic stamp from the State;</content></subparagraph>
<subparagraph class="fontsize10" id="ydb9c198e-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s5/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the face value amount of each electronic stamp sold by the State; and<page identifier="/us/stat/128/2849">128 STAT. 2849</page></content></subparagraph>
<subparagraph class="fontsize10" id="ydb9c198f-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s5/b/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the amount of the Federal portion of any fee required by the agreement for each stamp sold.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ydb9c1990-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s5/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Time of transmittal</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb9c1991-e885-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Contracts.</p></sidenote>—</heading><content>The Secretary shall require the submission under paragraph (1) to be made with respect to sales of electronic stamps by a State according to the written agreement between the Secretary and the State agency.</content></paragraph>
<paragraph class="fontsize10" id="ydb9c1992-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s5/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Additional fees not affected</inline>.—</heading><content>This section shall not apply to the State portion of any fee collected by a State under subsection (c).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ydb9c1993-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s5/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Electronic Stamp Issuance Fee</inline>.—</heading><content>A State authorized to issue electronic stamps may charge a reasonable fee to cover costs incurred by the State and the Department of the Interior in issuing electronic stamps under this Act, including costs of delivery of actual stamps.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ydb9c1994-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s5/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Duplicate Electronic Stamps</inline>.—</heading><content>A State authorized to issue electronic stamps may issue a duplicate electronic stamp to replace an electronic stamp issued by the State that is lost or damaged.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ydb9c1995-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s5/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Limitation on Authority To Require Purchase of State License</inline>.—</heading><content>A State may not require that an individual purchase a State hunting license as a condition of issuing an electronic stamp under this Act.</content></subsection>

<section id="d377222e436" identifier="/us/pl/113/239/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb9c1996-e885-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s718s">16 USC 718s</ref>.</p></sidenote><heading>ELECTRONIC STAMP REQUIREMENTS; RECOGNITION OF ELECTRONIC STAMP.</heading><subsection class="firstIndent0 fontsize10" id="ydb9c67b7-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s6/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Stamp Requirements</inline>.—</heading><chapeau>The Secretary shall require an electronic stamp issued by a State under this Act—</chapeau><paragraph class="fontsize10" id="ydb9c67b8-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s6/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to have the same format as any other license, validation, or privilege the State issues under the automated licensing system of the State; and</content></paragraph>
<paragraph class="fontsize10" id="ydb9c67b9-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s6/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to specify identifying features of the licensee that are adequate to enable Federal, State, and other law enforcement officers to identify the holder.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ydb9c67ba-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s6/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Recognition of Electronic Stamp</inline>.—</heading><chapeau>Any electronic stamp issued by a State under this Act shall, during the effective period of the electronic stamp—</chapeau><paragraph class="fontsize10" id="ydb9c67bb-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s6/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>bestow upon the licensee the same privileges as are bestowed by an actual stamp;</content></paragraph>
<paragraph class="fontsize10" id="ydb9c67bc-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s6/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>be recognized nationally as a valid Federal migratory bird hunting and conservation stamp; and</content></paragraph>
<paragraph class="fontsize10" id="ydb9c67bd-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s6/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>authorize the licensee to hunt migratory waterfowl in any other State, in accordance with the laws of the other State governing that hunting.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ydb9c67be-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s6/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Duration</inline>.—</heading><content>An electronic stamp issued by a State shall be valid for a period agreed to by the State and the Secretary, which shall not exceed 45 days.</content></subsection>

<section id="d377222e498" identifier="/us/pl/113/239/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb9c67bf-e885-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s718t">16 USC 718t</ref>.</p></sidenote><heading>TERMINATION OF STATE PARTICIPATION.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xdb9c8dd0-e885-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  The <sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb9c8dd1-e885-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Notification.</p><p class="leftAlign firstIndent0 fontsize8" id="xdb9c8dd2-e885-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p></sidenote>authority of a State to issue electronic stamps under this Act may be terminated—</chapeau><paragraph class="fontsize10" id="ydb9c8dd3-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s7/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>by the Secretary, if the Secretary—</chapeau><subparagraph class="fontsize10" id="ydb9c8dd4-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s7/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>finds that the State has violated any of the terms of the application of the State approved by the Secretary under section 4; and</content></subparagraph>
<subparagraph class="fontsize10" id="ydb9c8dd5-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s7/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>provides to the State written notice of the termination by not later than the date that is 30 days before the date of termination; or<page identifier="/us/stat/128/2850">128 STAT. 2850</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ydb9c8dd6-e885-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/239/s7/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by the State, by providing written notice to the Secretary by not later than the date that is 30 days before the termination date.</content></paragraph>
