<section id="d288868e100" identifier="/us/pl/113/232/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Blackfoot River Land Exchange Act of 2014</shortTitle>”.</content></section>
<section id="d288868e110" identifier="/us/pl/113/232/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>FINDINGS; PURPOSES.</heading><subsection class="firstIndent0 fontsize10" id="yd964d191-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Findings</inline>.—</heading><chapeau>Congress finds that—</chapeau><paragraph class="fontsize10" id="yd964d192-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>the Shoshone-Bannock Tribes, a federally recognized Indian tribe with tribal headquarters at Fort Hall, Idaho—</chapeau><subparagraph class="fontsize10" id="yd964d193-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>adopted a tribal constitution and bylaws on March 31, 1936, that were approved by the Secretary of the Interior on April 30, 1936, pursuant to the Act of June 18, 1934 (<ref href="/us/usc/t25/s461/etseq">25 U.S.C. 461 et seq.</ref>) (commonly known as the “Indian Reorganization Act”);</content></subparagraph>
<subparagraph class="fontsize10" id="yd964f8a4-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>has entered into various treaties with the United States, including the Second Treaty of Fort Bridger, executed on July 3, 1868; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd964f8a5-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>has maintained a continuous government-to-government relationship with the United States since the earliest years of the Union;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd964f8a6-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2)</num><subparagraph class="inline" id="yd964f8a7-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/2/A"><num value="A">(A) </num><content>in 1867, President Andrew Johnson designated by Executive order the Fort Hall Reservation for various bands of Shoshone and Bannock Indians;</content></subparagraph>
<subparagraph class="indentUp0 fontsize10" id="yd964f8a8-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/2/B" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Reservation is located near the cities of Blackfoot and Pocatello in southeastern Idaho; and</content></subparagraph>
<subparagraph class="indentUp0 fontsize10" id="yd964f8a9-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/2/C" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>article 4 of the Second Treaty of Fort Bridger secured the Reservation as a “permanent home” for the Shoshone-Bannock Tribes;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd964f8aa-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3)</num><subparagraph class="inline" id="yd964f8ab-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/3/A"><num value="A">(A) </num><chapeau>according to the Executive order referred to in paragraph (2)(A), the Blackfoot River, as the river existed in its natural state—</chapeau><clause class="fontsize10" id="yd964f8ac-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/3/A/i" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>is the northern boundary of the Reservation; and</content></clause>
<clause class="fontsize10" id="yd964f8ad-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/3/A/ii" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>flows in a westerly direction along that northern boundary; and</content></clause>
</subparagraph>
<subparagraph class="indentUp0 fontsize10" id="yd964f8ae-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/3/B" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>within the Reservation, land use in the River watershed is dominated by—</chapeau><clause class="fontsize10" id="yd964f8af-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/3/B/i" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>rangeland;</content></clause>
<clause class="fontsize10" id="yd964f8b0-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/3/B/ii" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>dry and irrigated farming; and</content></clause>
<clause class="fontsize10" id="yd964f8b1-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/3/B/iii" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>residential development;<page identifier="/us/stat/128/2123">128 STAT. 2123</page></content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd964f8b2-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4)</num><subparagraph class="inline" id="yd964f8b3-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/4/A"><num value="A">(A) </num><chapeau>in 1964, the Corps of Engineers completed a local flood protection project on the River—</chapeau><clause class="fontsize10" id="yd964f8b4-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/4/A/i" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>authorized by section 204 of the Flood Control Act of 1950 (<ref href="/us/stat/64/170">64 Stat. 170</ref>); and</content></clause>
<clause class="fontsize10" id="yd964f8b5-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/4/A/ii" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>sponsored by the Blackfoot River Flood Control District No. 7;</content></clause>
</subparagraph>
<subparagraph class="indentUp0 fontsize10" id="yd964f8b6-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/4/B" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the project consisted of building levees, <amendingAction type="substitute">replacing</amendingAction> irrigation diversion structures, <amendingAction type="substitute">replacing</amendingAction> bridges, and channel realignment; and</content></subparagraph>
<subparagraph class="indentUp0 fontsize10" id="yd964f8b7-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/4/C" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the channel realignment portion of the project severed various parcels of land located contiguous to the River along the boundary of the Reservation, resulting in Indian land being located north of the Realigned River and non-Indian land being located south of the Realigned River;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd964f8b8-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><chapeau>beginning in 1999, the Cadastral Survey Office of the Bureau of Land Management conducted surveys of—</chapeau><subparagraph class="fontsize10" id="yd964f8b9-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>25 parcels of Indian land; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd964f8ba-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>19 parcels of non-Indian land; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd964f8bb-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><chapeau>the enactment of this Act and separate agreements of the parties would represent a resolution of the disputes described in subsection (b)(1) among—</chapeau><subparagraph class="fontsize10" id="yd964f8bc-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/6/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Tribes;</content></subparagraph>
<subparagraph class="fontsize10" id="yd964f8bd-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/6/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the allottees; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd964f8be-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/a/6/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the non-Indian landowners.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd964f8bf-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Purposes</inline>.—</heading><chapeau>The purposes of this Act are—</chapeau><paragraph class="fontsize10" id="yd964f8c0-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to resolve the land ownership and land use disputes resulting from realignment of the River by the Corps of Engineers during calendar year 1964 pursuant to the project described in subsection (a)(4)(A); and</content></paragraph>
<paragraph class="fontsize10" id="yd964f8c1-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to achieve a final and fair solution to resolve those disputes.</content></paragraph>
</subsection>
</section>
<section id="d288868e304" identifier="/us/pl/113/232/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xd965e322-e886-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="yd965e323-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Allottee</inline>.—</heading><chapeau>The term “<term>allottee</term>” means an heir of an original allottee of the Reservation who owns an interest in a parcel of land that is—</chapeau><subparagraph class="fontsize10" id="yd965e324-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>held in trust by the United States for the benefit of the allottee; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd965e325-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>located north of the Realigned River within the exterior boundaries of the Reservation.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd965e326-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Blackfoot river flood control district no. 7</inline>.—</heading><chapeau>The term “<term>Blackfoot River Flood Control District No. 7</term>” means the governmental subdivision in the State of Idaho, located at 75 East Judicial, Blackfoot, Idaho, that—</chapeau><subparagraph class="fontsize10" id="yd965e327-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>is responsible for maintenance and repair of the Realigned River; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd965e328-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>represents the non-Indian landowners relating to the resolution of the disputes described in section 2(b)(1) in accordance with this Act.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd965e329-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Indian land</inline>.—</heading><chapeau>The term “<term>Indian land</term>” means any parcel of land that is—</chapeau><subparagraph class="fontsize10" id="yd965e32a-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>held in trust by the United States for the benefit of the Tribes or the allottees;</content></subparagraph>
<subparagraph class="fontsize10" id="yd965e32b-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>located north of the Realigned River; and<page identifier="/us/stat/128/2124">128 STAT. 2124</page></content></subparagraph>
<subparagraph class="fontsize10" id="yd965e32c-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><chapeau>identified in exhibit A of the survey of the Bureau of Land Management entitled “Survey of the Blackfoot River of 2002 to 2005”, which is located at—</chapeau><clause class="fontsize10" id="yd965e32d-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/3/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the Fort Hall Indian Agency office of the Bureau of Indian Affairs; and</content></clause>
<clause class="fontsize10" id="yd965e32e-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/3/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the Blackfoot River Flood Control District No. 7.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd965e32f-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Non-indian land</inline>.—</heading><chapeau>The term “<term>non-Indian land</term>” means any parcel of fee land that is—</chapeau><subparagraph class="fontsize10" id="yd965e330-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>located south of the Realigned River; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd965e331-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>identified in exhibit B, which is located at the areas described in clauses (i) and (ii) of paragraph (3)(C).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd965e332-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Non-indian landowner</inline>.—</heading><content>The term “<term>non-Indian landowner</term>” means any individual who holds fee title to non-Indian land and is represented by the Blackfoot River Flood Control District No. 7 for purposes of this Act.</content></paragraph>
<paragraph class="fontsize10" id="yd965e333-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Realigned river</inline>.—</heading><content>The term “<term>Realigned River</term>” means that portion of the River that was realigned by the Corps of Engineers during calendar year 1964 pursuant to the project described in section 2(a)(4)(A).</content></paragraph>
<paragraph class="fontsize10" id="yd965e334-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/7" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">Reservation</inline>.—</heading><content>The term “<term>Reservation</term>” means the Fort Hall Reservation established by Executive order during calendar year 1867 and confirmed by treaty during calendar year 1868.</content></paragraph>
<paragraph class="fontsize10" id="yd965e335-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/8" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><heading class="fontsize10"><inline class="smallCaps">River</inline>.—</heading><content>The term “<term>River</term>” means the Blackfoot River located in the State of Idaho.</content></paragraph>
<paragraph class="fontsize10" id="yd965e336-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/9" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Interior.</content></paragraph>
<paragraph class="fontsize10" id="yd965e337-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s3/10" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><heading class="fontsize10"><inline class="smallCaps">Tribes</inline>.—</heading><content>The term “<term>Tribes</term>” means the Shoshone-Bannock Tribes.</content></paragraph>

<section id="d288868e461" identifier="/us/pl/113/232/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>RELEASE OF CLAIMS TO CERTAIN INDIAN AND NON-INDIAN OWNED LANDS.</heading><subsection class="firstIndent0 fontsize10" id="yd9663158-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd9663159-e886-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Release of Claims</inline>.—</heading><chapeau>Effective on the date of enactment of this Act—</chapeau><paragraph class="fontsize10" id="yd966315a-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>all existing and future claims with respect to the Indian land and the non-Indian land and all right, title, and interest that the Tribes, allottees, non-Indian landowners, and the Blackfoot River Flood Control District No. 7 may have had to that land shall be extinguished;</content></paragraph>
<paragraph class="fontsize10" id="yd966315b-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>any interest of the Tribes, the allottees, or the United States, acting as trustee for the Tribes or allottees, in the Indian land shall be extinguished under section 2116 of the Revised Statutes (commonly known as the “Indian Trade and Intercourse Act”) (<ref href="/us/usc/t25/s177">25 U.S.C. 177</ref>); and</content></paragraph>
<paragraph class="fontsize10" id="yd966315c-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s4/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>to the extent any interest in non-Indian land transferred into trust pursuant to section 5 violates section 2116 of the Revised Statutes (commonly known as the “Indian Trade and Intercourse Act”) (<ref href="/us/usc/t25/s177">25 U.S.C. 177</ref>), that transfer shall be valid, subject to the condition that the transfer is consistent with all other applicable Federal laws (including regulations).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd966315d-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Documentation</inline>.—</heading><content>The Secretary may execute and file any appropriate documents (including a plat or map of the transferred Indian land) that are suitable for filing with the Bingham County clerk or other appropriate county official, as the Secretary determines necessary to carry out this Act.<page identifier="/us/stat/128/2125">128 STAT. 2125</page></content></subsection>
</section>
<section id="d288868e513" identifier="/us/pl/113/232/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>NON-INDIAN LAND TO BE PLACED INTO TRUST FOR TRIBES.</heading><content style="-uslm-lc:I658120">  Effective<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd966315e-e886-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p></sidenote> on the date of enactment of this Act, the non-Indian land shall be considered to be held in trust by the United States for the benefit of the Tribes.</content></section>
<section id="d288868e524" identifier="/us/pl/113/232/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>TRUST LAND TO BE CONVERTED TO FEE LAND.</heading><subsection class="firstIndent0 fontsize10" id="yd966586f-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s6/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>As soon as practicable after the date of enactment of this Act, the Secretary shall transfer the Indian land to the Blackfoot River Flood Control District No. 7 for use or sale in accordance with subsection (b).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd9665870-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s6/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Use of Land</inline>.—</heading><paragraph class="fontsize10" id="yd9665871-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s6/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Blackfoot River Flood Control District No. 7 shall use any proceeds from the sale of land described in subsection (a) according to the following priorities:</chapeau><subparagraph class="fontsize10" id="yd9665872-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s6/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>To compensate, at fair market value, each non-Indian landowner for the net loss of land to that non-Indian landowner resulting from the implementation of this Act.</content></subparagraph>
<subparagraph class="fontsize10" id="yd9665873-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s6/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>To compensate the Blackfoot River Flood Control District No. 7 for any administrative or other expenses relating to carrying out this Act.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd9665874-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s6/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Remaining land</inline>.—</heading><content>If any land remains to be conveyed or proceeds remain after the sale of the land, the Blackfoot River Flood Control District No. 7 may dispose of that remaining land or proceeds as the Blackfoot River Flood Control District No. 7 determines to be appropriate.</content></paragraph>
</subsection>
</section>
<section id="d288868e574" identifier="/us/pl/113/232/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><heading>EFFECT ON ORIGINAL RESERVATION BOUNDARY.</heading><content style="-uslm-lc:I658120">  Nothing in this Act affects the original boundary of the Reservation, as established by Executive order during calendar year 1867 and confirmed by treaty during calendar year 1868.</content></section>
<section id="d288868e581" identifier="/us/pl/113/232/s8" style="-uslm-lc:I658141"><num class="fontsize12" value="8">SEC. 8. </num><heading>EFFECT ON TRIBAL WATER RIGHTS.</heading><content style="-uslm-lc:I658120">  Nothing in this Act extinguishes or conveys any water right of the Tribes, as established in the agreement entitled “1990 Fort Hall Indian Water Rights Agreement” and ratified by section 4 of the Fort Hall Indian Water Rights Act of 1990 (<ref href="/us/pl/101/602">Public Law 101–602</ref>; <ref href="/us/stat/104/3060">104 Stat. 3060</ref>).</content></section>
<section id="d288868e594" identifier="/us/pl/113/232/s9" style="-uslm-lc:I658141"><num class="fontsize12" value="9">SEC. 9. </num><heading>EFFECT ON CERTAIN OBLIGATIONS.</heading><subsection class="firstIndent0 fontsize10" id="yd966a595-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s9/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Except as provided in subsection (b), nothing in this Act affects the obligation of Blackfoot River Flood Control District No. 7 to maintain adequate rights-of-way for the operation and maintenance of the local flood protection projects described in section 2(a)(4) pursuant to agreements between the Blackfoot River Flood Control District No. 7 and the Corps of Engineers.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd966a596-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s9/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Restriction on Fees</inline>.—</heading><content>Any land conveyed to the Tribes pursuant to this Act shall not be subject to fees assessed by Blackfoot River Flood Control District No. 7.</content></subsection>

<section id="d288868e618" identifier="/us/pl/113/232/s10" style="-uslm-lc:I658142"><num class="fontsize12" value="10">SEC. 10. </num><heading>DISCLAIMERS REGARDING CLAIMS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xd966cca7-e886-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Nothing in this Act—</chapeau><paragraph class="fontsize10" id="yd966cca8-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s10/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>affects in any manner the sovereign claim of the State of Idaho to title in and to the beds and banks of the River under the equal footing doctrine of the Constitution of the United States;</content></paragraph>
<paragraph class="fontsize10" id="yd966cca9-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s10/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>affects any action by the State of Idaho to establish the title described in paragraph (1) under section 2409a of <page identifier="/us/stat/128/2126">128 STAT. 2126</page>
<ref href="/us/usc/t28">title 28, United States Code</ref> (commonly known as the “Quiet Title Act”);</content></paragraph>
<paragraph class="fontsize10" id="yd966ccaa-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s10/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>affects the ability of the Tribes or the United States to claim ownership of the beds and banks of the River; or</content></paragraph>
<paragraph class="fontsize10" id="yd966ccab-e886-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/232/s10/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>extinguishes or conveys any water rights of non-Indian landowners or the claims of those landowners to water rights in the Snake River Basin Adjudication.</content></paragraph>
