<section id="d291096e88" identifier="/us/pl/113/197/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x965f2b52-e88c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s609">47 USC 609 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Enhance Labeling, Accessing, and Branding of Electronic Licenses Act of 2014</shortTitle>” or the “<shortTitle role="act">E–LABEL Act</shortTitle>”.</content></section>
<section id="d291096e106" identifier="/us/pl/113/197/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x965f2b53-e88c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s622">47 USC 622 note</ref>.</p></sidenote><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x965f7874-e88c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Congress finds the following:</chapeau><paragraph class="fontsize10" id="y965f7875-e88c-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/197/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The Federal Communications Commission (referred to in this section as the “Commission”) first standardized physical labels for licensed products such as computers, phones, and other electronic devices in 1973, and the Commission has continually refined physical label requirements over time.</content></paragraph>
<paragraph class="fontsize10" id="y965f9f86-e88c-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/197/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>As devices become smaller, compliance with physical label requirements can become more difficult and costly.</content></paragraph>
<paragraph class="fontsize10" id="y965f9f87-e88c-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/197/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Many manufacturers and consumers of licensed devices in the United States would prefer to have the option to provide or receive important Commission labeling information digitally on the screen of the device, at the discretion of the user.</content></paragraph>
<paragraph class="fontsize10" id="y965f9f88-e88c-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/197/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>An electronic labeling option would give flexibility to manufacturers in meeting labeling requirements.</content></paragraph>

<section id="d291096e138" identifier="/us/pl/113/197/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>AUTHORIZATION FOR FEDERAL COMMUNICATIONS COMMISSION TO ALLOW ELECTRONIC LABELING.</heading><content class="firstIndent0 fontsize10" id="x965fc699-e88c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Title VII of the Communications Act of 1934 (<ref href="/us/usc/t47/s601/etseq">47 U.S.C. 601 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="y966014ba-e88c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="720">“SEC. 720. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x966014bb-e88c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s621">47 USC 621</ref>.</p></sidenote><heading class="fontsize12">OPTIONAL ELECTRONIC LABELING OF COMMUNICATIONS EQUIPMENT.</heading><subsection class="firstIndent0 fontsize10" id="y966014bc-e88c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section—</chapeau><paragraph class="fontsize10" id="y966014bd-e88c-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the term ‘<term>electronic labeling</term>’ means displaying required labeling and regulatory information electronically; and</content></paragraph>
<paragraph class="fontsize10" id="y966014be-e88c-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>the term ‘<term>radiofrequency device with display</term>’ means any equipment or device that—</chapeau><subparagraph class="fontsize10" id="y966014bf-e88c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>is required under regulations of the Commission to be authorized by the Commission before the equipment or device may be marketed or sold within the United States; and</content></subparagraph>
<subparagraph class="fontsize10" id="y966014c0-e88c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>has the capability to digitally display required labeling and regulatory information.<page identifier="/us/stat/128/2056">128 STAT. 2056</page></content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y966014c1-e88c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x966014c2-e88c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s622">47 USC 622</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Requirement To Promulgate Regulations for Electronic Labeling</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x966014c3-e88c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote>—</heading><content>Not later than 9 months after the date of enactment of the Enhance Labeling, Accessing, and Branding of Electronic Licenses Act of 2014, the Commission shall promulgate regulations or take other appropriate action, as necessary, to allow manufacturers of radiofrequency devices with display the option to use electronic labeling for the equipment in place of affixing physical labels to the equipment.”</content></subsection>

<section id="d291096e219" identifier="/us/pl/113/197/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x966014c4-e88c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s622">47 USC 622 note</ref>.</p></sidenote><heading>SAVINGS CLAUSE.</heading><content style="-uslm-lc:I658120">  The amendment made by section 3 shall not be construed to affect the authority of the Federal Communications Commission under section 302 of the Communications Act of 1934 (<ref href="/us/usc/t47/s302a">47 U.S.C. 302a</ref>) to provide for electronic labeling of devices.</content></section>
