<section id="d295578e102" identifier="/us/pl/113/163/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Victims of Child Abuse Act Reauthorization Act of 2013</shortTitle>”.</content></section>
<section id="d295578e112" identifier="/us/pl/113/163/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>IMPROVING INVESTIGATION AND PROSECUTION OF CHILD ABUSE CASES.</heading><subsection class="firstIndent0 fontsize10" id="ye3e3bc17-e891-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/163/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Reauthorization</inline>.—</heading><chapeau>Section 214B of the Victims of Child Abuse Act of 1990 (<ref href="/us/usc/t42/s13004">42 U.S.C. 13004</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="ye3e3bc18-e891-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/163/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (a), by <amendingAction type="delete">striking</amendingAction> “<quotedText>fiscal years 2004 and 2005</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>fiscal years 2014, 2015, 2016, 2017, and 2018</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="ye3e3bc19-e891-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/163/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in subsection (b), by <amendingAction type="delete">striking</amendingAction> “<quotedText>fiscal years 2004 and 2005</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>fiscal years 2014, 2015, 2016, 2017, and 2018</quotedText>”.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye3e3bc1a-e891-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/163/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Accountability</inline>.—</heading><content>Subtitle A of the Victims of Child Abuse Act of 1990 (<ref href="/us/usc/t42/s13001/etseq">42 U.S.C. 13001 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="indentUp2 firstIndent-2" id="ye3e4314b-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658144"><num class="bold" value="214C">“SEC. 214C. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe3e4314c-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s130005">42 USC 130005</ref>.</p></sidenote><heading class="bold">ACCOUNTABILITY.</heading><chapeau class=" fontsize10" style="-uslm-lc:I658120">  “All grants<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe3e4585d-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Grants.</p></sidenote> awarded by the Administrator under this subtitle shall be subject to the following accountability provisions:</chapeau><paragraph class="indentDown1 fontsize10" id="ye3e4585e-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Audit requirement</inline>.—</heading><subparagraph class="fontsize10" id="ye3e4585f-e891-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><content>In this paragraph, the term ‘<term>unresolved audit finding</term>’ means a finding in the final audit report of the Inspector General of the Department of Justice that the audited grantee has utilized grant funds for an unauthorized expenditure or otherwise unallowable cost that is not closed or resolved within 12 months from the date when the final audit report is issued and any appeal has been completed.</content></subparagraph>
<subparagraph class="fontsize10" id="ye3e45860-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Audit</inline>.—</heading><content>The Inspector General of the Department of Justice shall conduct audits of recipients of grants under this subtitle to prevent waste, fraud, and abuse of funds by grantees.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe3e45861-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote> The Inspector General shall determine the appropriate number of grantees to be audited each year.</content></subparagraph>
<subparagraph class="fontsize10" id="ye3e45862-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe3e45863-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Mandatory exclusion</inline>.—</heading><content>A recipient of grant funds under this subtitle that is found to have an unresolved audit finding shall not be eligible to receive grant funds under this subtitle during the following 2 fiscal years.<page identifier="/us/stat/128/1865">128 STAT. 1865</page></content></subparagraph>
<subparagraph class="fontsize10" id="ye3e45864-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe3e45865-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Priority</inline>.—</heading><content>In awarding grants under this subtitle, the Administrator shall give priority to eligible entities that did not have an unresolved audit finding during the 3 fiscal years prior to submitting an application for a grant under this subtitle.</content></subparagraph>
<subparagraph class="fontsize10" id="ye3e45866-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><heading class="fontsize10"><inline class="smallCaps">Reimbursement</inline>.—</heading><chapeau>If an entity is awarded grant funds under this subtitle during the 2-fiscal-year period in which the entity is barred from receiving grants under paragraph (2), the Administrator shall—</chapeau><clause class="fontsize10" id="ye3e45867-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>deposit an amount equal to the grant funds that were improperly awarded to the grantee into the General Fund of the Treasury; and</content></clause>
<clause class="fontsize10" id="ye3e45868-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>seek to recoup the costs of the repayment to the fund from the grant recipient that was erroneously awarded grant funds.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="indentDown1 fontsize10" id="ye3e45869-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Nonprofit organization requirements</inline>.—</heading><subparagraph class="fontsize10" id="ye3e4586a-e891-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><content>For purposes of this paragraph, the term ‘<term>nonprofit organization</term>’ means an organization that is described in section 501(c)(3) of the Internal Revenue Code of 1986 and is exempt from taxation under section 501(a) of such Code.</content></subparagraph>
<subparagraph class="fontsize10" id="ye3e4586b-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition</inline>.—</heading><content>The Administrator may not award a grant under any grant program described in this subtitle to a nonprofit organization that holds money in offshore accounts for the purpose of avoiding paying the tax described in section 511(a) of the Internal Revenue Code of 1986.</content></subparagraph>
<subparagraph class="fontsize10" id="ye3e4586c-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Disclosure</inline>.—</heading><content>Each nonprofit organization that is awarded a grant under this subtitle and uses the procedures prescribed in regulations to create a rebuttable presumption of reasonableness for the compensation of its officers, directors, trustees and key employees, shall disclose to the Administrator, in the application for the grant, the process for determining such compensation, including the independent persons involved in reviewing and approving such compensation, the comparability data used, and contemporaneous substantiation of the deliberation and decision.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe3e4586d-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p></sidenote> Upon request, the Administrator shall make the information disclosed under this subparagraph available for public inspection.</content></subparagraph>
</paragraph>
<paragraph class="indentDown1 fontsize10" id="ye3e4586e-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Conference expenditures</inline>.—</heading><subparagraph class="fontsize10" id="ye3e4586f-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Limitation</inline>.—</heading><content>No amounts authorized to be appropriated to the Department of Justice under this subtitle may be used by the Administrator, or by any individual or organization awarded discretionary funds through a cooperative agreement under this Act, to host or support any expenditure for conferences that uses more than $20,000 in Department funds, unless the Deputy Attorney General or such Assistant Attorney Generals, Directors, or principal deputies as the Deputy Attorney General may designate, including the Administrator, provides prior written authorization through an award process or subsequent application that the funds may be expended to host a conference.</content></subparagraph>
<subparagraph class="fontsize10" id="ye3e47f80-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe3e47f81-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Cost estimate.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Written approval</inline>.—</heading><content>Written approval under subparagraph (A) shall include a written estimate of all costs associated with the conference, including the cost <page identifier="/us/stat/128/1866">128 STAT. 1866</page>
of all food and beverages, audiovisual equipment, honoraria for speakers, and any entertainment.</content></subparagraph>
<subparagraph class="fontsize10" id="ye3e47f82-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>The Deputy Attorney General shall submit an annual report to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives on all approved conference expenditures referenced in this paragraph.”</content></subparagraph>

<section id="d295578e354" identifier="/us/pl/113/163/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>CRIME VICTIMS FUND.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xe3e47f83-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 1402(d)(3) of the Victims of Crime Act of 1984 (<ref href="/us/usc/t42/s10601/d/3">42 U.S.C. 10601(d)(3)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="ye3e47f84-e891-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/163/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>(A)</quotedText>” before “<quotedText>Of the sums</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="ye3e4a695-e891-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/163/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>available for the United States Attorneys Offices</quotedText>” and all that follows and <amendingAction type="insert">inserting</amendingAction> the following: <quotedContent>“available only for—<clause class="indentUp2 fontsize10" id="ye3e4a696-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the United States Attorneys Offices and the Federal Bureau of Investigation to provide and improve services for the benefit of crime victims in the Federal criminal justice system (as described in 3771 of <ref href="/us/usc/t18">title 18, United States Code</ref>, and section 503 of the Victims’ Rights and Restitution Act of 1990 (<ref href="/us/usc/t42/s10607">42 U.S.C. 10607</ref>)) through victim coordinators, victims’ specialists, and advocates, including for the administrative support of victim coordinators and advocates providing such services; and</content></clause>
<clause class="indentUp2 fontsize10" id="ye3e4a697-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>a Victim Notification System.</chapeau><subparagraph class="indentDown1 fontsize10" id="ye3e4a698-e891-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>Amounts made available under subparagraph (A) may not be used for any purpose that is not specified in clause (i) or (ii) of subparagraph (A).”</content></subparagraph>
