<section id="d391730e98" identifier="/us/pl/113/135/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Three Kids Mine Remediation and Reclamation Act</shortTitle>”.</content></section>
<section id="d391730e108" identifier="/us/pl/113/135/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x5cb046aa-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y5cb046ab-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Federal land</inline>.—</heading><content>The term “<term>Federal land</term>” means the approximately 948 acres of Bureau of Reclamation and Bureau of Land Management land within the Three Kids Mine Project Site, as depicted on the map.</content></paragraph>
<paragraph class="fontsize10" id="y5cb046ac-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Hazardous substance; pollutant or contaminant; remedy</inline>.—</heading><content>The terms “hazardous substance”, “pollutant or contaminant”, and “remedy” have the meanings given those terms in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<ref href="/us/usc/t42/s9601">42 U.S.C. 9601</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y5cb06dbd-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Henderson redevelopment agency</inline>.—</heading><content>The term “<term>Henderson Redevelopment Agency</term>” means the redevelopment agency of the City of Henderson, Nevada, established and authorized to transact business and exercise the powers of the agency in accordance with the Nevada Community Redevelopment Law (Nev. Rev. Stat. 279.382 to 279.685).</content></paragraph>
<paragraph class="fontsize10" id="y5cb06dbe-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s2/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Map</inline>.—</heading><content>The term “<term>map</term>” means the map entitled “Three Kids Mine Project Area” and dated February 6, 2012.</content></paragraph>
<paragraph class="fontsize10" id="y5cb06dbf-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s2/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Responsible party</inline>.—</heading><content>The term “<term>Responsible Party</term>” means the private sector entity designated by the Henderson Redevelopment Agency, and approved by the State of Nevada, to complete the assessment, remediation, reclamation and redevelopment of the Three Kids Mine Project Site).</content></paragraph>
<paragraph class="fontsize10" id="y5cb06dc0-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s2/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Interior.</content></paragraph>
<paragraph class="fontsize10" id="y5cb06dc1-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s2/7" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">State</inline>.—</heading><content>The term “<term>State</term>” means the State of Nevada.</content></paragraph>
<paragraph class="fontsize10" id="y5cb06dc2-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s2/8" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><heading class="fontsize10"><inline class="smallCaps">Three kids mine project site</inline>.—</heading><chapeau>The term “<term>Three Kids Mine Project Site</term>” means the approximately 1,262 acres of land that is—</chapeau><subparagraph class="fontsize10" id="y5cb06dc3-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s2/8/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>comprised of—</chapeau><clause class="fontsize10" id="y5cb06dc4-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s2/8/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the Federal land; and<page identifier="/us/stat/128/1735">128 STAT. 1735</page></content></clause>
<clause class="fontsize10" id="y5cb06dc5-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s2/8/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the approximately 314 acres of adjacent non-Federal land; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y5cb06dc6-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s2/8/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>depicted as the “Three Kids Mine Project Site” on the map.</content></subparagraph>
</paragraph>
</section>
<section id="d391730e215" identifier="/us/pl/113/135/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5cb06dc7-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p><p class="leftAlign firstIndent0 fontsize8" id="x5cb06dc8-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determinations.</p></sidenote><heading>LAND CONVEYANCE.</heading><subsection class="firstIndent0 fontsize10" id="y5cb17f39-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Notwithstanding sections 202 and 203 of the Federal Land Policy and Management Act of 1976 (<ref href="/us/usc/t43/s1712">43 U.S.C. 1712</ref>, 1713), not later than 90 days after the date on which the Secretary determines that the conditions described in subsection (b) have been met, and subject to valid existing rights and applicable law, the Secretary shall convey to the Henderson Redevelopment Agency all right, title, and interest of the United States in and to the Federal land.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y5cb17f3a-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Conditions</inline>.—</heading><paragraph class="fontsize10" id="y5cb17f3b-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Appraisal; fair market value</inline>.—</heading><subparagraph class="fontsize10" id="y5cb17f3c-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>As consideration for the conveyance under subsection (a), the Henderson Redevelopment Agency shall pay the fair market value of the Federal land, if any, as determined under subparagraph (B) and as adjusted under subparagraph (F).</content></subparagraph>
<subparagraph class="fontsize10" id="y5cb17f3d-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Appraisal</inline>.—</heading><chapeau>The Secretary shall determine the fair market value of the Federal land based on an appraisal—</chapeau><clause class="fontsize10" id="y5cb17f3e-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><chapeau>that is conducted in accordance with nationally recognized appraisal standards, including—</chapeau><subclause class="fontsize10" id="y5cb17f3f-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/B/i/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>the Uniform Appraisal Standards for Federal Land Acquisitions; and</content></subclause>
<subclause class="fontsize10" id="y5cb17f40-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/B/i/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>the Uniform Standards of Professional Appraisal Practice; and</content></subclause>
</clause>
<clause class="fontsize10" id="y5cb17f41-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>that does not take into account any existing contamination associated with historical mining on the Federal land.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y5cb17f42-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Remediation and reclamation costs</inline>.—</heading><clause class="fontsize10" id="y5cb17f43-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5cb17f44-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Cost estimate.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall prepare a reasonable estimate of the costs to assess, remediate, and reclaim the Three Kids Mine Project Site.</content></clause>
<clause class="fontsize10" id="y5cb17f45-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><heading class="fontsize10"><inline class="smallCaps">Considerations</inline>.—</heading><chapeau>The estimate prepared under clause (i) shall be—</chapeau><subclause class="fontsize10" id="y5cb17f46-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/C/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>based on the results of a comprehensive Phase II environmental site assessment of the Three Kids Mine Project Site prepared by the Henderson Redevelopment Agency or a Responsible Party that has been approved by the State; and</content></subclause>
<subclause class="fontsize10" id="y5cb17f47-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/C/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>prepared in accordance with the current version of the ASTM International Standard E–2137–06 (2011) entitled “Standard Guide for Estimating Monetary Costs and Liabilities for Environmental Matters”.</content></subclause>
</clause>
<clause class="fontsize10" id="y5cb17f48-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/C/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><heading class="fontsize10"><inline class="smallCaps">Assessment requirements</inline>.—</heading><chapeau>The Phase II environmental site assessment prepared under clause (ii)(I) shall, without limiting any additional requirements that may be required by the State, be conducted in accordance with the procedures of—</chapeau><subclause class="fontsize10" id="y5cb17f49-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/C/iii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>the most recent version of ASTM International Standard E–1527–05 entitled “Standard Practice for Environmental Site Assessments: <page identifier="/us/stat/128/1736">128 STAT. 1736</page>
Phase I Environmental Site Assessment Process”; and</content></subclause>
<subclause class="fontsize10" id="y5cb17f4a-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/C/iii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>the most recent version of ASTM International Standard E–1903–11 entitled “Standard Guide for Environmental Site Assessments: Phase II Environmental Site Assessment Process”.</content></subclause>
</clause>
<clause class="fontsize10" id="y5cb17f4b-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/C/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><heading class="fontsize10"><inline class="smallCaps">Review of certain information</inline>.—</heading><subclause class="fontsize10" id="y5cb17f4c-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/C/iv/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall review and consider cost information proffered by the Henderson Redevelopment Agency, the Responsible Party, and the State in the preparation of the estimate under this subparagraph.</content></subclause>
<subclause class="fontsize10" id="y5cb17f4d-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/C/iv/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><heading class="fontsize10"><inline class="smallCaps">Final determination</inline>.—</heading><content>If there is a disagreement among the Secretary, Henderson Redevelopment Agency, and the State over the reasonable estimate of costs under this subparagraph, the parties shall jointly select 1 or more experts to assist the Secretary in making the final estimate of the costs.</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="y5cb17f4e-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><heading class="fontsize10"><inline class="smallCaps">Deadline</inline>.—</heading><content>Not later than 30 days after the date of enactment of this Act, the Secretary shall begin the appraisal and cost estimates under subparagraphs (B) and (C), respectively.</content></subparagraph>
<subparagraph class="fontsize10" id="y5cb17f4f-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><heading class="fontsize10"><inline class="smallCaps">Appraisal costs</inline>.—</heading><content>The Henderson Redevelopment Agency or the Responsible Party shall reimburse the Secretary for the costs incurred in performing the appraisal under subparagraph (B).</content></subparagraph>
<subparagraph class="fontsize10" id="y5cb17f50-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/1/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><heading class="fontsize10"><inline class="smallCaps">Adjustment</inline>.—</heading><content>The Secretary shall administratively adjust the fair market value of the Federal land, as determined under subparagraph (B), based on the estimate of remediation, and reclamation costs, as determined under subparagraph (C).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5cb17f51-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Mine remediation and reclamation agreement executed</inline>.—</heading><subparagraph class="fontsize10" id="y5cb17f52-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The conveyance under subsection (a) shall be contingent on—</chapeau><clause class="fontsize10" id="y5cb17f53-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5cb17f54-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Notification.</p></sidenote><content>the Secretary receiving from the State written notification that a mine remediation and reclamation agreement has been executed in accordance with subparagraph (B); and</content></clause>
<clause class="fontsize10" id="y5cb17f55-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the Secretary concurring, not later than 30 days after the date of receipt of the written notification under clause (i), that the requirements under subparagraph (B) have been met.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y5cb17f56-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><chapeau>The mine remediation and reclamation agreement required under subparagraph (A) shall be an enforceable consent order or agreement between the State and the Responsible Party who will be obligated to perform under the consent order or agreement administered by the State that—</chapeau><clause class="fontsize10" id="y5cb17f57-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>obligates the Responsible Party to perform, after the conveyance of the Federal land under this Act, the remediation and reclamation work at the Three Kids Mine Project Site necessary to ensure all remedial actions necessary to protect human health and the environment with respect to any hazardous substances, <page identifier="/us/stat/128/1737">128 STAT. 1737</page>
pollutant, or contaminant will be taken, in accordance with all Federal, State, and local requirements; and</content></clause>
<clause class="fontsize10" id="y5cb17f58-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>contains provisions determined to be necessary by the State and the Henderson Redevelopment Agency, including financial assurance provisions to ensure the completion of the remedy.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5cb17f59-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s3/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Notification from agency</inline>.—</heading><content>As a condition of the conveyance under subsection (a), not later than 90 days after the date of execution of the mine remediation and reclamation agreement required under paragraph (2), the Secretary shall accept written notification from the Henderson Redevelopment Agency that the Henderson Redevelopment Agency is prepared to accept conveyance of the Federal land under subsection (a).</content></paragraph>
</subsection>
</section>
<section id="d391730e471" identifier="/us/pl/113/135/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>WITHDRAWAL.</heading><subsection class="firstIndent0 fontsize10" id="y5cb1cd7a-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5cb1cd7b-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Effective date.</p><p class="leftAlign firstIndent0 fontsize8" id="x5cb1cd7c-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote>Subject to valid existing rights, for the 10-year period beginning on the earlier of the date of enactment of this Act or the date of the conveyance required by this Act, the Federal land is withdrawn from all forms of—</chapeau><paragraph class="fontsize10" id="y5cb1cd7d-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>entry, appropriation, operation, or disposal under the public land laws;</content></paragraph>
<paragraph class="fontsize10" id="y5cb1cd7e-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>location, entry, and patent under the mining laws; and</content></paragraph>
<paragraph class="fontsize10" id="y5cb1cd7f-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s4/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>disposition under the mineral leasing, mineral materials, and the geothermal leasing laws.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y5cb1cd80-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Existing Reclamation Withdrawals</inline>.—</heading><chapeau>Subject to valid existing rights, any withdrawal under the public land laws that includes all or any portion of the Federal land for which the Bureau of Reclamation has determined that the Bureau of Reclamation has no further need under applicable law is relinquished and revoked solely to the extent necessary—</chapeau><paragraph class="fontsize10" id="y5cb1cd81-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to exclude from the withdrawal the property that is no longer needed; and</content></paragraph>
<paragraph class="fontsize10" id="y5cb1cd82-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to allow for the immediate conveyance of the Federal land as required under this Act.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y5cb1cd83-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Existing Reclamation Project and Permitted Facilities</inline>.—</heading><content>Except as provided in subsection (a), nothing in this Act diminishes, hinders, or interferes with the exclusive and perpetual use by the existing rights holders for the operation, maintenance, and improvement of water conveyance infrastructure and facilities, including all necessary ingress and egress, situated on the Federal land that were constructed or permitted by the Bureau of Reclamation before the effective date of this Act.</content></subsection>
</section>
<section id="d391730e534" identifier="/us/pl/113/135/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>ACEC BOUNDARY ADJUSTMENT.</heading><content style="-uslm-lc:I658120">  Notwithstanding section 203 of the Federal Land Policy and Management Act of 1976 (<ref href="/us/usc/t43/s1713">43 U.S.C. 1713</ref>), the boundary of the River Mountains Area of Critical Environmental Concern (NVN 76884) is adjusted to exclude any portion of the Three Kids Mine Project Site consistent with the map.</content></section>
<section id="d391730e544" identifier="/us/pl/113/135/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>RESPONSIBILITIES OF THE PARTIES.</heading><subsection class="firstIndent0 fontsize10" id="y5cb21ba4-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s6/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Responsibility of Parties to Mine Remediation and Reclamation Agreement</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5cb21ba5-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p></sidenote>—</heading><content>On completion of the conveyance under section 3, the responsibility for complying with the mine remediation and reclamation agreement executed under section 3(b)(2) shall apply to the Responsible Party and the State of Nevada.<page identifier="/us/stat/128/1738">128 STAT. 1738</page></content></subsection>
<subsection class="firstIndent0 fontsize10" id="y5cb21ba6-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s6/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Savings Provision</inline>.—</heading><chapeau>If the conveyance under this Act has occurred, but the terms of the agreement executed under section 3(b)(2) have not been met, nothing in this Act—</chapeau><paragraph class="fontsize10" id="y5cb21ba7-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s6/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>affects the responsibility of the Secretary to take any additional response action necessary to protect public health and the environment from a release or the threat of a release of a hazardous substance, pollutant, or contaminant; or</content></paragraph>
<paragraph class="fontsize10" id="y5cb21ba8-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s6/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>unless otherwise expressly provided, modifies, limits, or otherwise affects—</chapeau><subparagraph class="fontsize10" id="y5cb21ba9-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s6/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the application of, or obligation to comply with, any law, including any environmental or public health law; or</content></subparagraph>
<subparagraph class="fontsize10" id="y5cb21baa-e896-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/135/s6/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the authority of the United States to enforce compliance with the requirements of any law or the agreement executed under section 3(b)(2).</content></subparagraph>

<section id="d391730e594" identifier="/us/pl/113/135/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><heading>SOUTHERN NEVADA PUBLIC LANDS MANAGEMENT ACT.</heading><content style="-uslm-lc:I658120">  Southern Nevada Public Land Management Act of 1998 (<ref href="/us/usc/t31/s6901">31 U.S.C. 6901 note</ref>; <ref href="/us/pl/105/263">Public Law 105–263</ref>) shall not apply to land conveyed under this Act.</content></section>
