<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8202b7dd-e896-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Pascua Yaqui Tribe Trust Land Act.</p></sidenote>
<section id="d297801e88" identifier="/us/pl/113/134/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Pascua Yaqui Tribe Trust Land Act</shortTitle>”.</content></section>
<section id="d297801e98" identifier="/us/pl/113/134/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x8202deee-e896-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  For the purposes of this Act, the following definitions apply:</chapeau><paragraph class="fontsize10" id="y8202deef-e896-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/134/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">District</inline>.—</heading><content>The term “<term>District</term>” means the Tucson Unified School District, a school district recognized as such under the laws of the State of Arizona.</content></paragraph>
<paragraph class="fontsize10" id="y8202def0-e896-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/134/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Map</inline>.—</heading><content>The term “<term>map</term>” means the map titled “PYT Land Department” and dated January 15, 2013.</content></paragraph>
<paragraph class="fontsize10" id="y8202def1-e896-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/134/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Interior.</content></paragraph>
<paragraph class="fontsize10" id="y8202def2-e896-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/134/s2/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Tribe</inline>.—</heading><content>The term “<term>Tribe</term>” means the Pascua Yaqui Tribe of Arizona, a federally recognized Indian tribe.</content></paragraph>

<section id="d297801e141" identifier="/us/pl/113/134/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>LANDS TO BE HELD IN TRUST.</heading><subsection class="firstIndent0 fontsize10" id="y82032d13-e896-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/134/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Parcel A</inline>.—</heading><content>Subject to subsection (c) and to valid existing rights, all right, title, and interest of the United States in and to the approximately 10 acres of Federal lands generally depicted on the map as Parcel A are declared to be held in trust by the United States for the benefit of the Tribe.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y82032d14-e896-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/134/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Parcel B</inline>.—</heading><content>Subject to subsection (c) and valid existing rights, all right, title, and interest of the United States in and to the approximately 10 acres of Federal lands generally depicted on the map as Parcel B are declared to be held in trust by the United States for the benefit of the Tribe.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y82032d15-e896-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/134/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><chapeau>Subsections (a) and (b) shall take effect on the day after the date on which—</chapeau><paragraph class="fontsize10" id="y82032d16-e896-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/134/s3/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the District relinquishes all right, title, and interest of the District in and to the land described in subsection (b); and</content></paragraph>
<paragraph class="fontsize10" id="y82032d17-e896-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/134/s3/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the Secretary (or a delegate of the Secretary) approves and records the lease agreement between the Tribe and the District for the construction and operation of a regional transportation facility located on the restricted Indian land of the Tribe in accordance with the requirements of the first section of the Act entitled “An Act to authorize the leasing of restricted Indian lands for public, religious, educational, <page identifier="/us/stat/128/1733">128 STAT. 1733</page>
recreational, residential, business, and other purposes requiring the grant of long-term leases”, approved August 9, 1955 (<ref href="/us/usc/t25/s415">25 U.S.C. 415</ref>), and <ref href="/us/cfr/t25/pt162">part 162 of title 25, Code of Federal Regulations</ref> (including successor regulations).</content></paragraph>
</subsection>
</section>
<section id="d297801e194" identifier="/us/pl/113/134/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>GAMING PROHIBITION.</heading><content style="-uslm-lc:I658120">  The Tribe may not conduct gaming activities on the lands held in trust under this Act, as a matter of claimed inherent authority, or under the authority of any Federal law, including the Indian Gaming Regulatory Act (<ref href="/us/usc/t25/s2701/etseq">25 U.S.C. 2701 et seq.</ref>) or under any regulations thereunder promulgated by the Secretary or the National Indian Gaming Commission.</content></section>
<section id="d297801e204" identifier="/us/pl/113/134/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>WATER RIGHTS.</heading><subsection class="firstIndent0 fontsize10" id="y82035428-e896-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/134/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>There shall not be Federal reserved rights to surface water or groundwater for any land taken into trust by the United States for the benefit of the Tribe under this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y82035429-e896-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/134/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">State Water Rights</inline>.—</heading><content>The Tribe retains any right or claim to water under State law for any land taken into trust by the United States for the benefit of the Tribe under this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y8203542a-e896-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/134/s5/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Forfeiture or Abandonment</inline>.—</heading><content>Any water rights that are appurtenant to land taken into trust by the United States for the benefit of the Tribe under this Act may not be forfeited or abandoned.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y8203542b-e896-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/134/s5/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Administration</inline>.—</heading><content>Nothing in this Act affects or modifies any right of the Tribe or any obligation of the United States under <ref href="/us/pl/95/375">Public Law 95–375</ref> (<ref href="/us/usc/t25/s1300f/etseq">25 U.S.C. 1300f et seq.</ref>).</content></subsection>
