<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa7220bff-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Hill Creek Cultural Preservation and Energy Development Act.</p></sidenote>
<section id="d391892e88" identifier="/us/pl/113/133/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Hill Creek Cultural Preservation and Energy Development Act</shortTitle>”.</content></section>
<section id="d391892e98" identifier="/us/pl/113/133/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>CLARIFICATION OF AUTHORITY.</heading><content class="firstIndent0 fontsize10" id="xa7225a20-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  The Act entitled “An Act to define the exterior boundary of the Uintah and Ouray Indian Reservation in the State of Utah, and for other purposes”, approved March 11, 1948 (<ref href="/us/stat/62/72">62 Stat. 72</ref>), as amended by the Act entitled “An Act to amend the Act extending the exterior boundary of the Uintah and Ouray Indian Reservation in the State of Utah so as to authorize such State to exchange certain mineral lands for other lands mineral in character” approved August 9, 1955, (<ref href="/us/stat/69/544">69 Stat. 544</ref>), is further amended by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="indentUp0 firstIndent0 fontsize10" id="ya722a841-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“<inline class="smallCaps">Sec. 5. </inline></num><chapeau> In order to further clarify authorizations under this Act, the State of Utah is hereby authorized to relinquish to the United States, for the benefit of the Ute Indian Tribe of the Uintah and Ouray Reservation, State school trust or other State-owned subsurface mineral lands located beneath the surface estate delineated in <ref href="/us/pl/440">Public Law 440</ref> (approved March 11, 1948) and south of the border between Grand County, Utah, and Uintah County, Utah, and select in lieu of such relinquished lands, on an acre-for-acre basis, any subsurface mineral lands of the United States located beneath the surface estate delineated in <ref href="/us/pl/440">Public Law 440</ref> (approved March 11, 1948) and north of the border between Grand County, Utah, and Uintah County, Utah, subject to the following conditions:</chapeau><paragraph class="fontsize10" id="ya722a842-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Reservation by united states</inline>.—</heading><content>The Secretary of the Interior shall reserve an overriding interest in that portion of the mineral estate comprised of minerals subject to leasing under the Mineral Leasing Act (<ref href="/us/usc/t30/s171/etseq">30 U.S.C. 171 et seq.</ref>) in any mineral lands conveyed to the State.</content></paragraph>
<paragraph class="fontsize10" id="ya722a843-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Extent of overriding interest</inline>.—</heading><chapeau>The overriding interest reserved by the United States under paragraph (1) shall consist of—</chapeau><subparagraph class="fontsize10" id="ya722a844-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>50 percent of any bonus bid or other payment received by the State as consideration for securing any lease or authorization to develop such mineral resources;<page identifier="/us/stat/128/1730">128 STAT. 1730</page></content></subparagraph>
<subparagraph class="fontsize10" id="ya722a845-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>50 percent of any rental or other payments received by the State as consideration for the lease or authorization to develop such mineral resources;</content></subparagraph>
<subparagraph class="fontsize10" id="ya722a846-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>a 6.25 percent overriding royalty on the gross proceeds of oil and gas production under any lease or authorization to develop such oil and gas resources; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya722a847-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>an overriding royalty on the gross proceeds of production of such minerals other than oil and gas, equal to 50 percent of the royalty rate established by the Secretary of the Interior by regulation as of October 1, 2011.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya722a848-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Reservation by state of utah</inline>.—</heading><content>The State of Utah shall reserve, for the benefit of its State school trust, an overriding interest in that portion of the mineral estate comprised of minerals subject to leasing under the Mineral Leasing Act (<ref href="/us/usc/t30/s181/etseq">30 U.S.C. 181 et seq.</ref>) in any mineral lands relinquished by the State to the United States.</content></paragraph>
<paragraph class="fontsize10" id="ya722a849-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Extent of overriding interest</inline>.—</heading><chapeau>The overriding interest reserved by the State under paragraph (3) shall consist of—</chapeau><subparagraph class="fontsize10" id="ya722a84a-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>50 percent of any bonus bid or other payment received by the United States as consideration for securing any lease or authorization to develop such mineral resources on the relinquished lands;</content></subparagraph>
<subparagraph class="fontsize10" id="ya722a84b-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>50 percent of any rental or other payments received by the United States as consideration for the lease or authorization to develop such mineral resources;</content></subparagraph>
<subparagraph class="fontsize10" id="ya722a84c-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>a 6.25 percent overriding royalty on the gross proceeds of oil and gas production under any lease or authorization to develop such oil and gas resources; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya722a84d-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>an overriding royalty on the gross proceeds of production of such minerals other than oil and gas, equal to 50 percent of the royalty rate established by the Secretary of the Interior by regulation as of October 1, 2011.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya722a84e-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">No obligation to lease</inline>.—</heading><content>Neither the United States nor the State shall be obligated to lease or otherwise develop oil and gas resources in which the other party retains an overriding interest under this section.</content></paragraph>
<paragraph class="fontsize10" id="ya722a84f-e896-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Cooperative agreements</inline>.—</heading><content>The Secretary of the Interior is authorized to enter into cooperative agreements with the State and the Ute Indian Tribe of the Uintah and Ouray Reservation to facilitate the relinquishment and selection of <page identifier="/us/stat/128/1731">128 STAT. 1731</page>
lands to be conveyed under this section, and the administration of the overriding interests reserved hereunder.”</content></paragraph>
