            <num style="-uslm-dtd:enum" value="X">TITLE X—</num><heading style="-uslm-dtd:header">MATTERS RELATING TO DETAINEES<ref style="-uslm-dtd:footnote-ref" idref="ID61E86CA60AC04A9CA03A81C29283D392" class="footnoteRef">1</ref> </heading><footnote id="ID61E86CA60AC04A9CA03A81C29283D392" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">The provisions contained in this title were also enacted by title XIV of the National Defense Authorization Act for Fiscal Year 2006 (Public Law 109–163).                 <num style="-uslm-dtd:enum" value="1001">SEC. 1001. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s2000dd">42 U.S.C. 2000dd note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
                <content style="-uslm-dtd:text" class="block">This title may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Detainee Treatment Act of 2005</inline></shortTitle>”.</content>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/109/148/tX/s1002" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1002">SEC. 1002. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t10/s801">10 U.S.C. 801 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">UNIFORM STANDARDS FOR THE INTERROGATION OF PERSONS UNDER THE DETENTION OF THE DEPARTMENT OF DEFENSE. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1002/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">No person in the custody or under the effective control of the Department of Defense or under detention in a Department of Defense facility shall be subject to any treatment or technique of interrogation not authorized by and listed in the United States Army Field Manual on Intelligence Interrogation.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1002/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Applicability.—</heading><content style="-uslm-dtd:text">Subsection (a) shall not apply with respect to any person in the custody or under the effective control of the Department of Defense pursuant to a criminal law or immigration law of the United States.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1002/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Construction.—</heading><content style="-uslm-dtd:text">Nothing in this section shall be construed to affect the rights under the United States Constitution of any person in the custody or under the physical jurisdiction of the United States.</content>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/109/148/tX/s1003" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1003">SEC. 1003. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s2000dd">42 U.S.C. 2000dd</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PROHIBITION ON CRUEL, INHUMAN, OR DEGRADING TREATMENT OR PUNISHMENT OF PERSONS UNDER CUSTODY OR CONTROL OF THE UNITED STATES GOVERNMENT. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1003/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">No individual in the custody or under the physical control of the United States Government, regardless of nationality or physical location, shall be subject to cruel, inhuman, or degrading treatment or punishment.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1003/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Construction.—</heading><content style="-uslm-dtd:text">Nothing in this section shall be construed to impose any geographical limitation on the applicability of the prohibition against cruel, inhuman, or degrading treatment or punishment under this section.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1003/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Limitation on Supersedure.—</heading><content style="-uslm-dtd:text">The provisions of this section shall not be superseded, except by a provision of law enacted after the date of the enactment of this Act which specifically repeals, modifies, or supersedes the provisions of this section.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1003/d" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Cruel, Inhuman, or Degrading Treatment or Punishment Defined.—</heading><content style="-uslm-dtd:text">In this section, the term “<term style="-uslm-dtd:term">cruel, inhuman, or degrading treatment or punishment</term>” means the cruel, unusual, and inhumane treatment or punishment prohibited by the Fifth, Eighth, and Fourteenth Amendments to the Constitution of the United States, as defined in the United States Reservations, Declarations and Understandings to the United Nations Convention Against Torture and Other Forms of Cruel, Inhuman or Degrading Treatment or Punishment done at New York, December 10, 1984.</content>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/109/148/tX/s1004" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1004">SEC. 1004. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s2000dd–1">42 U.S.C. 2000dd–1</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PROTECTION OF UNITED STATES GOVERNMENT PERSONNEL ENGAGED IN AUTHORIZED INTERROGATIONS.<ref style="-uslm-dtd:footnote-ref" idref="IDEF07A8046EDD48E095AB2F586E1DD88A" class="footnoteRef">1</ref> </heading><footnote id="IDEF07A8046EDD48E095AB2F586E1DD88A" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><content><p style="-uslm-dtd:para; margin-left:1em">Section 8(b) of the Military Commissions Act of 2006 (Public Law 109–366; 42 U.S.C. 2000dd–1 note; 120 Stat. 2636) provides as follows:</p>
                <p style="-uslm-dtd:para; margin-left:1em">(b) <headingText style="-uslm-dtd:header-in-text">Protection of Personnel</headingText>.—Section 1004 of the Detainee Treatment Act of 2005 (42 U.S.C. 2000dd–1) shall apply with respect to any criminal prosecution that—</p>
                <p style="-uslm-dtd:para; margin-left:2em">(1) relates to the detention and interrogation of aliens described in such section;</p>
                <p style="-uslm-dtd:para; margin-left:2em">(2) is grounded in section 2441(c)(3) of title 18, United States Code; and</p>
                <p style="-uslm-dtd:para; margin-left:2em">(3) relates to actions occurring between September 11, 2001, and December 30, 2005.</p></content></footnote>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1004/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Protection of United States Government Personnel.—</heading><content style="-uslm-dtd:text">In any civil action or criminal prosecution against an officer, employee, member of the Armed Forces, or other agent of the United States Government who is a United States person, arising out of the officer, employee, member of the Armed Forces, or other agent's engaging in specific operational practices, that involve detention and interrogation of aliens who the President or his designees have determined are believed to be engaged in or associated with international terrorist activity that poses a serious, continuing threat to the United States, its interests, or its allies, and that were officially authorized and determined to be lawful at the time that they were conducted, it shall be a defense that such officer, employee, member of the Armed Forces, or other agent did not know that the practices were unlawful and a person of ordinary sense and understanding would not know the practices were unlawful. Good faith reliance on advice of counsel should be an important factor, among others, to consider in assessing whether a person of ordinary sense and understanding would have known the practices to be unlawful. Nothing in this section shall be construed to limit or extinguish any defense or protection otherwise available to any person or entity from suit, civil or criminal liability, or damages, or to provide immunity from prosecution for any criminal offense by the proper authorities.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1004/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b)<ref style="-uslm-dtd:footnote-ref" idref="ID2A05FA67B64E411ABCBD073B6916F1FF" class="footnoteRef">1</ref> </num><heading style="-uslm-dtd:header">Counsel.—</heading><content style="-uslm-dtd:text">The United States Government shall provide or employ counsel, and pay counsel fees, court costs, bail, and other expenses incident to the representation of an officer, employee, member of the Armed Forces, or other agent described in subsection (a), with respect to any civil action or criminal prosecution or investigation arising out of practices described in that subsection, whether before United States courts or agencies, foreign courts or agencies, or international courts or agencies, under the same conditions, and to the same extent, to which such services and payments are authorized under section 1037 of title 10, United States Code.</content><footnote id="ID2A05FA67B64E411ABCBD073B6916F1FF" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">Section 1004(b) reflects the execution of the amendment made by section 8(a)(3) of Public Law 109–366 including the layered technical amendment by section 1063(d)(1) of P.L. 110–181 which probably should have been made to insert a comma instead of a semicolon. The original amendment was carried out to reflect the probable intent of Congress.</p></footnote>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/109/148/tX/s1005" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1005">SEC. 1005. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t10/s801">10 U.S.C. 801 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PROCEDURES FOR STATUS REVIEW OF DETAINEES OUTSIDE THE UNITED STATES. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1005/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Submittal of Procedures for Status Review of Detainees at Guantanamo Bay, Cuba, and in Afghanistan and Iraq.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/148/tX/s1005/a/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Not later than 180 days after the date of the enactment of this Act, the Secretary of Defense shall submit to the Committee on Armed Services and the Committee on the Judiciary of the Senate and the Committee on Armed Services and the Committee on the Judiciary of the House of Representatives a report setting forth—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/148/tX/s1005/a/1/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the procedures of the Combatant Status Review Tribunals and the Administrative Review Boards established by direction of the Secretary of Defense that are in operation at Guantanamo Bay, Cuba, for determining the status of the detainees held at Guantanamo Bay or to provide an annual review to determine the need to continue to detain an alien who is a detainee; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/148/tX/s1005/a/1/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the procedures in operation in Afghanistan and Iraq for a determination of the status of aliens detained in the custody or under the physical control of the Department of Defense in those countries.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/148/tX/s1005/a/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Designated civilian official.—</heading><content style="-uslm-dtd:text">The procedures submitted to Congress pursuant to paragraph (1)(A) shall ensure that the official of the Department of Defense who is designated by the President or Secretary of Defense to be the final review authority within the Department of Defense with respect to decisions of any such tribunal or board (referred to as the “<quotedText style="-uslm-dtd:quote">Designated Civilian Official</quotedText>”) shall be a civilian officer of the Department of Defense holding an office to which appointments are required by law to be made by the President, by and with the advice and consent of the Senate.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/148/tX/s1005/a/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Consideration of new evidence.—</heading><content style="-uslm-dtd:text">The procedures submitted under paragraph (1)(A) shall provide for periodic review of any new evidence that may become available relating to the enemy combatant status of a detainee.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1005/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Consideration of Statements Derived With Coercion.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/148/tX/s1005/b/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Assessment.—</heading><chapeau style="-uslm-dtd:text">The procedures submitted to Congress pursuant to subsection (a)(1)(A) shall ensure that a Combatant Status Review Tribunal or Administrative Review Board, or any similar or successor administrative tribunal or board, in making a determination of status or disposition of any detainee under such procedures, shall, to the extent practicable, assess—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/148/tX/s1005/b/1/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">whether any statement derived from or relating to such detainee was obtained as a result of coercion; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/148/tX/s1005/b/1/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the probative value (if any) of any such statement.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/148/tX/s1005/b/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Applicability.—</heading><content style="-uslm-dtd:text">Paragraph (1) applies with respect to any proceeding beginning on or after the date of the enactment of this Act.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1005/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Report on Modification of Procedures.—</heading><content style="-uslm-dtd:text">The Secretary of Defense shall submit to the committees specified in subsection (a)(1) a report on any modification of the procedures submitted under subsection (a). Any such report shall be submitted not later than 60 days before the date on which such modification goes into effect.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1005/d" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Annual Report.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/148/tX/s1005/d/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Report required.—</heading><content style="-uslm-dtd:text">The Secretary of Defense shall submit to Congress an annual report on the annual review process for aliens in the custody of the Department of Defense outside the United States. Each such report shall be submitted in unclassified form, with a classified annex, if necessary. The report shall be submitted not later than December 31 each year.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/148/tX/s1005/d/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Elements of report.—</heading><chapeau style="-uslm-dtd:text">Each such report shall include the following with respect to the year covered by the report:</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/148/tX/s1005/d/2/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">The number of detainees whose status was reviewed.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/148/tX/s1005/d/2/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">The procedures used at each location.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1005/e" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Judicial Review of Detention of Enemy Combatants.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/148/tX/s1005/e/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><editorialNote style="-uslm-dtd:legis-comment"><b>[</b>Omitted-Amendment<b>]</b> </editorialNote>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/148/tX/s1005/e/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Review of decisions of combatant status review tribunals of propriety of detention.—</heading>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/148/tX/s1005/e/2/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Subject to subparagraphs (B), (C), and (D), the United States Court of Appeals for the District of Columbia Circuit shall have exclusive jurisdiction to determine the validity of any final decision of a Combatant Status Review Tribunal that an alien is properly detained as an enemy combatant.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/148/tX/s1005/e/2/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Limitation on claims.—</heading><chapeau style="-uslm-dtd:text">The jurisdiction of the United States Court of Appeals for the District of Columbia Circuit under this paragraph shall be limited to claims brought by or on behalf of an alien—</chapeau>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/109/148/tX/s1005/e/2/B/i" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">who is, at the time a request for review by such court is filed, detained by the United States.</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/109/148/tX/s1005/e/2/B/ii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">for whom a Combatant Status Review Tribunal has been conducted, pursuant to applicable procedures specified by the Secretary of Defense.</content>
                            </clause>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/148/tX/s1005/e/2/C" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Scope of review.—</heading><chapeau style="-uslm-dtd:text">The jurisdiction of the United States Court of Appeals for the District of Columbia Circuit on any claims with respect to an alien under this paragraph shall be limited to the consideration of—</chapeau>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/109/148/tX/s1005/e/2/C/i" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">whether the status determination of the Combatant Status Review Tribunal with regard to such alien was consistent with the standards and procedures specified by the Secretary of Defense for Combatant Status Review Tribunals (including the requirement that the conclusion of the Tribunal be supported by a preponderance of the evidence and allowing a rebuttable presumption in favor of the Government's evidence); and</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/109/148/tX/s1005/e/2/C/ii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">to the extent the Constitution and laws of the United States are applicable, whether the use of such standards and procedures to make the determination is consistent with the Constitution and laws of the United States.</content>
                            </clause>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/148/tX/s1005/e/2/D" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Termination on release from custody.—</heading><content style="-uslm-dtd:text">The jurisdiction of the United States Court of Appeals for the District of Columbia Circuit with respect to the claims of an alien under this paragraph shall cease upon the release of such alien from the custody of the Department of Defense.</content>
                        </subparagraph>
                    </paragraph><editorialNote style="-uslm-dtd:legis-comment"><b>[</b>Paragraph (3) was repealed by section 1803(b) of division A of Public Law 111–84 (as amended).<b>]</b> </editorialNote>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/148/tX/s1005/e/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Respondent.—</heading><content style="-uslm-dtd:text">The Secretary of Defense shall be the named respondent in any appeal to the United States Court of Appeals for the District of Columbia Circuit under this subsection.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1005/f" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Construction.—</heading><content style="-uslm-dtd:text">Nothing in this section shall be construed to confer any constitutional right on an alien detained as an enemy combatant outside the United States.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1005/g" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">United States Defined.—</heading><content style="-uslm-dtd:text">For purposes of this section, the term “<term style="-uslm-dtd:term">United States</term>”, when used in a geographic sense, is as defined in section 101(a)(38) of the Immigration and Nationality Act and, in particular, does not include the United States Naval Station, Guantanamo Bay, Cuba.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1005/h" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">Effective Date.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/148/tX/s1005/h/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">This section shall take effect on the date of the enactment of this Act.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/148/tX/s1005/h/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Review of combatant status tribunal and military commission decisions.—</heading><content style="-uslm-dtd:text">Paragraphs (2) and (3) of subsection (e) shall apply with respect to any claim whose review is governed by one of such paragraphs and that is pending on or after the date of the enactment of this Act.</content>
                    </paragraph>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/109/148/tX/s1006" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1006">SEC. 1006. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t10/s801">10 U.S.C. 801 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">TRAINING OF IRAQI FORCES REGARDING TREATMENT OF DETAINEES. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1006/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Required Policies.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/148/tX/s1006/a/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Secretary of Defense shall ensure that policies are prescribed regarding procedures for military and civilian personnel of the Department of Defense and contractor personnel of the Department of Defense in Iraq that are intended to ensure that members of the Armed Forces, and all persons acting on behalf of the Armed Forces or within facilities of the Armed Forces, ensure that all personnel of Iraqi military forces who are trained by Department of Defense personnel and contractor personnel of the Department of Defense receive training regarding the international obligations and laws applicable to the humane detention of detainees, including protections afforded under the Geneva Conventions and the Convention Against Torture.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/148/tX/s1006/a/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Acknowledgment of training.—</heading><content style="-uslm-dtd:text">The Secretary shall ensure that, for all personnel of the Iraqi Security Forces who are provided training referred to in paragraph (1), there is documented acknowledgment of such training having been provided.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/148/tX/s1006/a/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Deadline for policies to be prescribed.—</heading><content style="-uslm-dtd:text">The policies required by paragraph (1) shall be prescribed not later than 180 days after the date of the enactment of this Act.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1006/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Army Field Manual.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/148/tX/s1006/b/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Translation.—</heading><content style="-uslm-dtd:text">The Secretary of Defense shall provide for the United States Army Field Manual on Intelligence Interrogation to be translated into arabic and any other language the Secretary determines appropriate for use by members of the Iraqi military forces.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/148/tX/s1006/b/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Distribution.—</heading><content style="-uslm-dtd:text">The Secretary of Defense shall provide for such manual, as translated, to be provided to each unit of the Iraqi military forces trained by Department of Defense personnel or contractor personnel of the Department of Defense.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1006/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Transmittal of Regulations.—</heading><content style="-uslm-dtd:text">Not less than 30 days after the date on which regulations, policies, and orders are first prescribed under subsection (a), the Secretary of Defense shall submit to the Committee on Armed Services of the Senate and the Committee on Armed Services of the House of Representatives copies of such regulations, policies, or orders, together with a report on steps taken to the date of the report to implement this section.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/148/tX/s1006/d" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Annual Report.—</heading><content style="-uslm-dtd:text">Not less than one year after the date of the enactment of this Act, and annually thereafter, the Secretary of Defense shall submit to the Committee on Armed Services of the Senate and the Committee on Armed Services of the House of Representatives a report on the implementation of this section.</content>
                </subsection>
            </section>
