    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To provide for research into problems of flight within and outside the earth's atmosphere, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

        <title style="-uslm-dtd:title; -uslm-dtd-nonstandard:all-cap 10 no-bold" identifier="/us/sComp/85/568/tI" styleType="nonstandard">
            <num style="-uslm-dtd:enum" value="I">TITLE I—</num><heading style="-uslm-dtd:header">SHORT TITLE, DECLARATION OF POLICY, AND DEFINITIONS<ref style="-uslm-dtd:footnote-ref" idref="ID5F327AF9103947AD94D50CCBA66C54E0" class="footnoteRef">1</ref> </heading><footnote id="ID5F327AF9103947AD94D50CCBA66C54E0" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">Generally, section 6 of Public Law 111–314 (enacted December 18, 2010) provides for a repeal of a majority of sections in the National Aeronautics and Space Act of 1958. Section 3 of such Public Law provides for the enactment into law a new title 51, United States Code. Many of the provisions repealed have been codified to title 51, USC. See bracketed notes throughout this Act which include details related to a repeal. Also, see Law Revision Counsel's disposition tables set out in the committee report for H.R. 3237 found in a pdf file located in /comp/science to see where the prior provisions have been restated in the new title 51, United States Code.</p></footnote>

                <num style="-uslm-dtd:enum" value="101">Sec. 101. </num><content style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">National Aeronautics and Space Act of 1958</inline></shortTitle>”.</content><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s2451">42 U.S.C. 2451 Note</ref><b>]</b> </editorialNote>

            <num style="-uslm-dtd:enum" value="III">TITLE III—</num><heading style="-uslm-dtd:header">MISCELLANEOUS </heading>
            <section style="-uslm-dtd:section" identifier="/us/sComp/85/568/tIII/s301" styleType="traditional">
                <heading style="-uslm-dtd:header">national advisory committee for aeronautics </heading>
                <num style="-uslm-dtd:enum" value="301">Sec. 301. </num><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/85/568/tIII/s301/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">The National Advisory Committee for Aeronautics, on the effective date of this section, shall cease to exist. On such date all functions, powers, duties, and obligations, and all real and personal property, personnel (other than members of the Committee), funds, and records of that organization, shall be transferred to the Administration.</content><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s2472">42 U.S.C. 2472</ref> nt<b>]</b> </editorialNote></subsection><editorialNote style="-uslm-dtd:legis-comment"><b>[</b>Sections 302 and 303 were repealed by section 6 of Public Law 111–314.                 <heading style="-uslm-dtd:header">security </heading>
                <num style="-uslm-dtd:enum" value="304">Sec. 304. </num><editorialNote style="-uslm-dtd:legis-comment"><b>[</b>Section 304(a) was repealed by section 6 of Public Law 111–314. See Law Revision Counsel's disposition tables for those provisions that were included in title 51, USC as enacted into law by section 3 of such Public Law.<b>]</b> </editorialNote>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/85/568/tIII/s304/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">The Atomic Energy Commission may authorize any of its employees, or employees of any contractor, prospective contractor, licensee, or prospective licensee of the Atomic Energy Commission or any other person authorized to have access to Restricted Data by the Atomic Energy Commission under subsection 145 b. of the Atomic Energy Act of 1954 (42 U.S.C. 2165(b)), to permit any member, officer, or employee of the Council, or the Administrator, or any officer, employee, member of an advisory committee, contractor, subcontractor, or officer or employee of a contractor or subcontractor of the Administration, to have access to Restricted Data relating to aeronautical and space activities which is required in the performance of his duties and so certified by the Council or the Administrator, as the case may be, but only if (1) the Council or Administrator or designee thereof has determined, in accordance with the established personnel security procedures and standards of the Council or Administration, that permitting such individual to have access to such Restricted Data will not endanger the common defense and security, and (2) the Council or Administrator or designee thereof finds that the established personnel and other security procedures and standards of the Council or Administration are adequate and in reasonable conformity to the standards established by the Atomic Energy Commission under section 145 of the Atomic Energy Act of 1954 (42 U.S.C. 2165). Any individual granted access to such Restricted Data pursuant to this subsection may exchange such Data with any individual who (A) is an officer or employee of the Department of Defense, or any department or agency thereof, or a member of the armed forces, or a contractor or subcontractor of any such department, agency, or armed force, or an officer or employee of any such contractor or subcontractor, and (B) has been authorized to have access to Restricted Data under the provisions of section 143 of the Atomic Energy Act of 1954 (42 U.S.C. 2163).</content><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s2455">42 U.S.C. 2455</ref><b>]</b> </editorialNote>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/85/568/tIII/s304/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><chapeau style="-uslm-dtd:text">Chapter 37 of title 18 of the United States Code (entitled Espionage and Censorship) is amended by—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/85/568/tIII/s304/c/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">adding at the end thereof the following new section:<quotedContent style="-uslm-dtd:quoted-block">
                        <section style="-uslm-dtd:section" styleType="USC">
                            <num style="-uslm-dtd:enum" value="799">“§ 799. </num><heading style="-uslm-dtd:header">Violation of regulations of National Aeronautics and Space Administration </heading>
                            <content style="-uslm-dtd:text" class="block">“Whoever willfully shall violate, attempt to violate, or conspire to violate any regulation or order promulgated by the Administrator of the National Aeronautics and Space Administration for the protection or security of any laboratory, station, base or other facility, or part thereof, or any aircraft, missile, spacecraft, or similar vehicle, or part thereof, or other property or equipment in the custody of the Administration, or any real or personal property or equipment in the custody of any contractor under any contract with the Administration or any subcontractor of any such contractor, shall be fined not more than $5,000, or imprisoned not more than one year, or both.”</content>

                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/85/568/tIII/s304/d" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><content style="-uslm-dtd:text">Section 1114 of title 18 of the United States Code is amended by inserting immediately before “<quotedText style="-uslm-dtd:quote">while engaged in the performance of his official duties</quotedText>” the following: “<quotedText style="-uslm-dtd:quote">or any officer or employee of the National Aeronautics and Space Administration directed to guard and protect property of the United States under the administration and control of the National Aeronautics and Space Administration,</quotedText>”.</content><editorialNote style="-uslm-dtd:legis-comment"><b>[</b>Section 304(e) and (f) were repealed by section 6 of Public Law 111–314.
