    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To authorize the construction maintenance, and operation by the Armory Board of the District of Columbia of a stadium in the District of Columbia, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
</enactingFormula><section class="inline" role="undesignated-level" style="-uslm-dtd:section" styleType="OLC"><content style="-uslm-dtd:text">
This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">District of Columbia Stadium Act of 1957</shortTitle>”.<ref class="footnoteRef" idref="ID4E5E4DB00C864FC38965B2D850E1516B" style="-uslm-dtd:footnote-ref">1</ref></content><footnote id="ID4E5E4DB00C864FC38965B2D850E1516B" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><content><p style="-uslm-dtd:para; margin-left:1em">Section 2(l)(1) of Public Law 118-274 provides “<quotedText style="-uslm-dtd:quote">Effective on the date of the transfer of administrative jurisdiction over the Campus under this section
the District of Columbia Stadium Act of 1957 (sec. 3–321 et seq., D.C. Official Code) is repealed</quotedText>”.  </p>
        <p style="-uslm-dtd:para">  Paragraph (2) of such section 2(l) states “<quotedText style="-uslm-dtd:quote">the lease dated January 14, 1988, between the United States and the District for the use of the Campus, as authorized by section 7(b)(1)(B) of such Act (sec. 3–326(b)(1)(B), D.C. Official Code), is terminated</quotedText>”.</p></content></footnote></section><editorialNote style="-uslm-dtd:legis-comment"><b>[</b>Section 2 repealed<b>]</b> </editorialNote>
        <section identifier="/us/sComp/85/300/s3" style="-uslm-dtd:section" styleType="traditional">
            <num style="-uslm-dtd:enum" value="3">Sec. 3. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b>3–322, D.C. Official Code<b>]</b> </editorialNote><content style="-uslm-dtd:text">The Secretary of the Interior is authorized and directed to acquire by gift, purchase, condemnation, or otherwise, all real property within the boundaries of the East Capitol Street site, as established in the first paragraph under the heading “<quotedText style="-uslm-dtd:quote">(2) East Capitol Street Site</quotedText>” contained in the National Capital Planning Commission report entitled “<quotedText style="-uslm-dtd:quote">Preliminary Report on Sites for National Memorial Stadium</quotedText>” dated November 8, 1956 and thereafter, acting under authority of the Act entitled “<quotedText style="-uslm-dtd:quote">An Act to establish a National Park Service, and for other purposes</quotedText>”, approved August 25, 1916, as amended (16 U. S. C. 1 and the following), the Secretary of the Interior shall enter into a contract with the Board for the construction, maintenance, and operation of the stadium including the operation and maintenance of motor-vehicle parking areas) on such East Capitol Street site, except that such contract may be for a term of not more than thirty years. The Secretary of the Interior is authorized and directed to construct and prepare in areas A, C, D, and E only, on such site, as such areas are indicated on National Capital Parks Map numbered 1.7-146, motor vehicle parking areas, including driveways, walks, lighting, and landscaping, at a total cost not to exceed $2,660,000.</content>
        </section>
        <section identifier="/us/sComp/85/300/s4" style="-uslm-dtd:section" styleType="traditional">
            <num style="-uslm-dtd:enum" value="4">Sec. 4. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b>3–323, D.C. Official Code<b>]</b> </editorialNote><subsection class="inline" identifier="/us/sComp/85/300/s4/a" style="-uslm-dtd:subsection" styleType="OLC"><num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">The Board is hereby authorized to provide for the payment of the cost of preliminary engineering and economic surveys relating to the stadium, and for the payment of the cost of planning, designing and constructing such stadium, and to provide funds for the operation and maintenance of such stadium, and for the payment of interest on the bonds authorized herein during the period of construction and during the 12-month period following completion of construction of the stadium, by an issue or issues of negotiable bonds of the Board, bearing interest, payable annually or semiannually, as the Board shall determine, at a rate not exceeding such rate as shall be approved by the Secretary of the Treasury. All such bonds mag be registered as to principal alone or both principal and interest, shall be payable as to principal within not to exceed thirty years from the date thereof, shall be in such denominations, shall be executed in such manner, and shall be payable in such medium and at such place or places as the Board may determine, and the face amount thereof shall be so calculated as to produce, at the price of their sale, the cost of the stadium constructed pursuant to this Act. The Board may reserve the right to redeem any or all of the bonds before maturity in such manner and at such price or prices not exceeding 105 per centum of the face value and accrued interest as may be fixed by the Board prior to the issuance of the bonds. The Board when it deems advisable may issue refunding bonds to refinance any outstanding bonds, and interest thereon, at maturity or before maturity when called for redemption, except that such refunding bonds shall mature within not to exceed thirty years from the date thereof, or not to exceed fifty years from the date of enactment of this Act, whichever shall first occur.</content></subsection>
            <subsection identifier="/us/sComp/85/300/s4/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">The bonds may be sold at not less than par. If the proceeds of the bonds shall exceed the cost, the excess shall be placed in the fund created by section 6 for the payment of the principal and interest of such bonds. Prior to the preparation of definitive bonds the Board may, under like restrictions, issue temporary bonds, or may, under like restrictions, issue temporary bonds or interim certificates without coupons, of any denomination whatsoever, exchangeable for definitive bonds when such bonds that securities have been executed are available for delivery.</content>
            </subsection>
            <subsection identifier="/us/sComp/85/300/s4/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><content style="-uslm-dtd:text">All bonds, or other obligations, issued by the Board under authority of this Act, shall be exempt both as to principal and interest, from all taxation (except estate and inheritance taxes) now or hereafter imposed by the District of Columbia.</content>
            </subsection>
        </section><editorialNote style="-uslm-dtd:legis-comment"><b>[</b>Sections 5 &amp; 6 are repealed<b>]</b> </editorialNote>
        <section identifier="/us/sComp/85/300/s7" style="-uslm-dtd:section" styleType="traditional">
            <num style="-uslm-dtd:enum" value="7">Sec. 7. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b>3–326, D.C. Official Code<b>]</b> </editorialNote><subsection class="inline" identifier="/us/sComp/85/300/s7/a" style="-uslm-dtd:subsection" styleType="OLC"><num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">After payment of the bonds and interest or after a sinking fund sufficient for such purpose shall have been provided and shall be held solely for that purpose, but in any event not later than fifty years from the date of enactment of this Act, all right, title, and interest in and to the stadium constructed under this Act shall vest in the United States.</content></subsection>
            <subsection identifier="/us/sComp/85/300/s7/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b)</num><paragraph class="inline" identifier="/us/sComp/85/300/s7/b/1" style="-uslm-dtd:paragraph" styleType="OLC"><num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">Not later than 180 days after the date of enactment of this subsection, the Secretary of the Interior shall—</chapeau>
                <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/85/300/s7/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">convey without consideration to the government of the District of Columbia all right, title, and interest of the United States in and to the building comprising the stadium constructed under this Act; and</content>
                </subparagraph>
                <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/85/300/s7/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">lease without consideration to the government of the District of Columbia—</chapeau>
                    <clause class="leftIndentDecrease1" identifier="/us/sComp/85/300/s7/b/1/B/i" style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the ground under; and</content>
                    </clause>
                    <clause class="leftIndentDecrease1" identifier="/us/sComp/85/300/s7/b/1/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the parking facilities associated with the stadium constructed under this Act.</content>
                    </clause>
                </subparagraph></paragraph>
                <paragraph class="leftIndentDecrease1" identifier="/us/sComp/85/300/s7/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The lease authorized by paragraph (1)(B) shall be for a period of 50 years.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/85/300/s7/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><chapeau style="-uslm-dtd:text">The conveyance and lease of real property under subsection (b) shall be subject to such terms and conditions (which shall be set forth in the instrument of conveyance) as will ensure that title to the property shall not be transferred by the District to any person or entity other than the United States or any political subdivision or agency of the District of Columbia or the United States and that the property will be used only for—</chapeau>
                <paragraph identifier="/us/sComp/85/300/s7/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">stadium purposes;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/85/300/s7/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">providing recreational facilities, open space, or public outdoor recreation opportunities;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/85/300/s7/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">such other public purposes for which the property was used prior to June 1,1985; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/85/300/s7/c/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">such other public purposes for which the property was approved for use by the Secretary with the concurrence of the National Capital Planning Commission prior to June 1, 1985.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/85/300/s7/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d)</num><paragraph class="inline" identifier="/us/sComp/85/300/s7/d/1" style="-uslm-dtd:paragraph" styleType="OLC"><num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">The instrument of conveyance and the lease referred to in subsection (c) shall provide that all right, title, and interest conveyed to the District of Columbia pursuant to such instrument of conveyance shall revert to the United States and the lease shall terminate if—</chapeau>
                <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/85/300/s7/d/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the terms and conditions referred to in subsection (c) have not been complied with, as determined by the Secretary, and</content>
                </subparagraph>
                <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/85/300/s7/d/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">such noncompliance has not been corrected within ninety days after written notice of such noncompliance has been received by the Mayor of the District of Columbia. Such noncompliance shall be treated as corrected if the District of Columbia and the Secretary enter into an agreement, with the concurrence of the National Capital Planning Commission, which the Secretary considers adequate to ensure that the property will be used in a manner consistent with the purposes referred to in subsection (c).</content>
                </subparagraph></paragraph>
                <paragraph class="leftIndentDecrease1" identifier="/us/sComp/85/300/s7/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">No person may bring an action respecting a violation of any term or condition referred to in subsection (c) before the expiration of ninety days after the date on which such person has notified the Mayor of the District of Columbia of the alleged violation. The notice shall include notice of such person’s intention to bring an action to declare a reversion and termination of the lease under paragraph (1) of this subsection.</content>
                </paragraph>
                <paragraph class="leftIndentDecrease1" identifier="/us/sComp/85/300/s7/d/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The conveyance of real property under subsection (b) shall be made subject to the condition that the District of Columbia shall bear the cost of removing structures or rehabilitating the land or stadium should the stadium revert to the United States pursuant to this subsection.</content>
                </paragraph>
                <paragraph class="leftIndentDecrease1" identifier="/us/sComp/85/300/s7/d/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">Any property which reverts to the Secretary under this subsection shall be administered by the Secretary as part of the Park System of the Nation’s Capital in accordance with the provisions of the Act of August 25, 1916 (16 U.S.C. 1, 2-4), and other provisions of the law generally applicable to units of the national park system.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/85/300/s7/e" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e)</num><paragraph class="inline" identifier="/us/sComp/85/300/s7/e/1" style="-uslm-dtd:paragraph" styleType="OLC"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Upon receipt of a written description from the District of Columbia of not more than 15 contiguous acres (hereinafter referred to as “<quotedText style="-uslm-dtd:quote">the 15 acres</quotedText>”), within the area designated “<quotedText style="-uslm-dtd:quote">D</quotedText>” on the revised map entitled “<quotedText style="-uslm-dtd:quote">Map to Designate Transfer of Stadium and Lease of Parking Lots to the District</quotedText>” and bound by 21st Street, NE, Oklahoma Avenue, NE, Benning Road, NE, the Metro line, and C Street, NE, and execution of a long-term lease by the Mayor of the District of Columbia that is contingent upon the Secretary’s conveyance of the 15 acres and for the purpose consistent with this paragraph, the Secretary shall convey the 15 acres described land to the District of Columbia for the purpose of siting, developing, and operating an educational institution for the public welfare, with first preference given to a pre-collegiate public boarding school.</content></paragraph>
                <paragraph class="leftIndentDecrease1" identifier="/us/sComp/85/300/s7/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Upon conveyance, the portion of the stadium lease that affects the 15 acres on the property and all the conditions associated therewith shall terminate, and the 15 acres property shall be removed from the “<quotedText style="-uslm-dtd:quote">Map to Designate Transfer of Stadium and Lease of Parking Lots to the District</quotedText>”, and the long-term lease described in paragraph (1) of this subsection shall take effect immediately. The Mayor of the District of Columbia shall execute and deliver a quitclaim deed to effectuate the District’s responsibilities under this section.</content>
                </paragraph>
            </subsection>
        </section><editorialNote style="-uslm-dtd:legis-comment"><b>[</b>Sections 8 through 10 are repealed<b>]</b> </editorialNote>
        <section identifier="/us/sComp/85/300/s11" style="-uslm-dtd:section" styleType="traditional">
            <num style="-uslm-dtd:enum" value="11">Sec. 11. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b>3–330, D.C. Official Code<b>]</b> </editorialNote><chapeau style="-uslm-dtd:text">As used in this Act the term—</chapeau>
            <paragraph identifier="/us/sComp/85/300/s11/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1)<ref class="footnoteRef" idref="IDD22498B33A6347F0948068FA7C03429D" style="-uslm-dtd:footnote-ref">2</ref> </num><content style="-uslm-dtd:text">
“<quotedText style="-uslm-dtd:quote">stadium</quotedText>” includes all equipment, appliances, facilities, and property of any kind (including any area designated A, B, C, D, or E on the revised map entitled “<quotedText style="-uslm-dtd:quote">Map to Designate Transfer of Stadium and Lease of Parking Lots to the District</quotedText>”, prepared jointly by the National Park Service (National Capital Region) and the District of Columbia Department of Public Works for site development and dated October 1986 (NPS drawing number 831/87284-A)), necessary to carry out the purposes of this Act.</content><footnote id="IDD22498B33A6347F0948068FA7C03429D" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">2</sup><p style="-uslm-dtd:para; margin-left:1em">So in law. There are no subsequent paragraphs in section 11.</p></footnote>
            </paragraph>
