    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To empower the Chief of the United States Capitol Police to unilaterally request the assistance of the DC National Guard or Federal law enforcement agencies in emergencies without prior approval of the Capitol Police Board.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section identifier="/us/sComp/117/77/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t2/s1901">2 U.S.C. 1901 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Capitol Police Emergency Assistance Act of 2021</shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/117/77/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">EMERGENCY ASSISTANCE FOR THE CAPITOL POLICE. </heading>
            <subsection identifier="/us/sComp/117/77/s2/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Assistance by Executive Departments and Agencies.—</heading><chapeau style="-uslm-dtd:text">Section 911(a) of division B of the Department of Defense and Emergency Supplemental Appropriations for Recovery from and Response to Terrorist Attacks on the United States Act, 2002 (2 U.S.C. 1970(a)) is amended—</chapeau>
                <paragraph identifier="/us/sComp/117/77/s2/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in paragraph (1), by inserting “<quotedText style="-uslm-dtd:quote">or in accordance with paragraph (4)</quotedText>” before  “<quotedText style="-uslm-dtd:quote">and on a permanent</quotedText>”;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/117/77/s2/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">in paragraph (4)(B)—</chapeau>
                    <subparagraph identifier="/us/sComp/117/77/s2/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">in the matter preceding clause (i), by striking “<quotedText style="-uslm-dtd:quote">advance</quotedText>”; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/117/77/s2/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">in clause (ii)—</chapeau>
                        <clause identifier="/us/sComp/117/77/s2/a/2/B/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">in subclause (I), by striking “<quotedText style="-uslm-dtd:quote">or</quotedText>” after the semicolon;</content>
                        </clause>
                        <clause identifier="/us/sComp/117/77/s2/a/2/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">in subclause (II), by striking “<quotedText style="-uslm-dtd:quote">and</quotedText>” after the semicolon and inserting “<quotedText style="-uslm-dtd:quote">or</quotedText>”; and</content>
                        </clause>
                        <clause identifier="/us/sComp/117/77/s2/a/2/B/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                            <subclause style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="III">“(III) </num><content style="-uslm-dtd:text">the Chief of the Capitol Police, if the Chief of the Capitol Police has determined that the provision of assistance is necessary to prevent the significant disruption of governmental function and public order within the United States Capitol Buildings and Grounds, as described in section 9 of the Act entitled ‘An Act to define the area of the United States Capitol Grounds, to regulate the use thereof, and for other purposes’, approved July 31, 1946 (2 U.S.C. 1961); and”</content>
                            </subclause></quotedContent>; and</content>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/117/77/s2/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">“(5) </num><heading style="-uslm-dtd:header">Revocation.—</heading><content style="-uslm-dtd:text">The Capitol Police Board may revoke a request for assistance provided under paragraph (4)(B)(ii)(III) upon consultation with appropriate Members of the Senate and House of Representatives in leadership positions.”</content>
                    </paragraph></quotedContent>.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/117/77/s2/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Capitol Police Special Officers.—</heading><chapeau style="-uslm-dtd:text">Section 1017 of division H of the Consolidated Appropriations Resolution, 2003 (2 U.S.C. 1974) is amended—</chapeau>
                <paragraph identifier="/us/sComp/117/77/s2/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">in subsection (a)—</chapeau>
                    <subparagraph identifier="/us/sComp/117/77/s2/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">in the matter preceding paragraph (1), by inserting “<quotedText style="-uslm-dtd:quote">or as determined by the Chief of the Capitol Police in accordance with section 911(a)(4)(B)(ii)(III) of division B of the Department of Defense and Emergency Supplemental Appropriations for Recovery from and Response to Terrorist Attacks on the United States Act, 2002 (2 U.S.C. 1970(a)(4)(B)(ii)(III)),</quotedText>” after  “<quotedText style="-uslm-dtd:quote">Congress,</quotedText>”; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/117/77/s2/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block"><content style="-uslm-dtd:text">“An appointment under this section due to an emergency determined by the Chief of the Capitol Police under paragraph (4)(B)(ii)(III) of section 911(a) of division B of the Department of Defense and Emergency Supplemental Appropriations for Recovery from and Response to Terrorist Attacks on the United States Act, 2002 (2 U.S.C. 1970(a)) shall be in effect for the period of the emergency, unless and until the Capitol Police Board revokes the request for assistance under paragraph (5) of such section.”</content></quotedContent>;</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/117/77/s2/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by striking subsections (c) and (e);</content>
                </paragraph>
                <paragraph identifier="/us/sComp/117/77/s2/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">by redesignating subsections (d), (f), and (g) as subsections (c), (d), and (e), respectively; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/117/77/s2/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">in subsection (d), as redesignated by paragraph (3) of this subsection, by striking “<quotedText style="-uslm-dtd:quote">President pro tempore</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">Majority Leader</quotedText>”.</content>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/117/77/s3" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t2/s1901b">2 U.S.C. 1901b</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">JOINT OVERSIGHT HEARINGS. </heading>
            <subsection identifier="/us/sComp/117/77/s3/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The Committee on Rules and Administration of the Senate and the Committee on House Administration of the House of Representatives (referred to in this section as the “Committees”) are authorized to jointly conduct oversight hearings regarding the Capitol Police Board and may request the attendance of all members of the Capitol Police Board at any such hearing. Members of the Capitol Police Board shall attend a joint hearing under this section, as requested and under such rules or procedures as may be adopted by the Committees.</content>
            </subsection>
            <subsection identifier="/us/sComp/117/77/s3/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Timing.—</heading><content style="-uslm-dtd:text">The Committees may conduct oversight hearings under this section as determined appropriate by the Committees, but shall conduct not less than one oversight hearing under this section during each Congress.</content>
            </subsection>
        </section>
        <section identifier="/us/sComp/117/77/s4" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t2/s1970">2 U.S.C. 1970 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">EFFECTIVE DATE. </heading>
            <content class="block" style="-uslm-dtd:text">The amendments made by this Act shall take effect on October 1, 2021.</content>
