    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To amend the Public Health Service Act to increase the preference given, in awarding certain allergies and asthma-related grants, to States that require certain public schools to have allergies and asthma management programs, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/292/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s201">42 U.S.C. 201 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">  This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">School-Based Allergies and Asthma Management Program Act</shortTitle>”. </content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/292/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">ADDITIONAL PREFERENCE TO CERTAIN STATES THAT REQUIRE CERTAIN PUBLIC SCHOOLS TO HAVE ALLERGIES AND ASTHMA MANAGEMENT PROGRAMS. </heading>
            <chapeau style="-uslm-dtd:text" class="block">  Section 399L(d) of the Public Health Service Act (42 U.S.C. 280g(d)) is amended— </chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/292/s2/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">in paragraph (1)(F)— </chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/292/s2/1/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">by redesignating clauses (i), (ii), and (iii) as subclauses (I), (II), and (III), respectively, and moving each of such subclauses (as so redesignated) 2 ems to the right; </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/292/s2/1/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">epinephrine.—In determining</quotedText>” and inserting <quotedContent style="-uslm-dtd:quoted-block"><chapeau style="-uslm-dtd:text">“
<headingText style="-uslm-dtd:header-in-text">epinephrine or school comprehensive allergies and asthma management program.—</headingText>
</chapeau>
                    <clause style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">“(i) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">In determining ”</content>
                    </clause></quotedContent>;</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/292/s2/1/C" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">in the State—</quotedText>” and inserting <quotedContent style="-uslm-dtd:quoted-block" class="inline"><chapeau style="-uslm-dtd:text">“in the State satisfy the criteria described in clause (ii) or clause (iii).</chapeau>
                    <subsection style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">“(ii) </num><heading style="-uslm-dtd:header">Criteria for school personnel administration of epinephrine.—</heading><content style="-uslm-dtd:text">For purposes of clause (i), the criteria described in this clause, with respect to each public elementary school and secondary school in the State, are that each such school— ”</content>
                    </subsection></quotedContent>; and</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/292/s2/1/D" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">by adding at the end the following new clause: <quotedContent style="-uslm-dtd:quoted-block">
                    <clause style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="iii">“(iii) </num><heading style="-uslm-dtd:header">Criteria for school comprehensive allergies and asthma management program.—</heading><chapeau style="-uslm-dtd:text">For purposes of clause (i), the criteria described in this clause, with respect to each public elementary school and secondary school in the State, are that each such school— </chapeau>
                        <subclause style="-uslm-dtd:subclause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="I">“(I) </num><content style="-uslm-dtd:text">has in place a plan for having on the premises of the school during all operating hours of the school a school nurse or one or more other individuals who are designated by the principal (or other appropriate administrative staff) of the school to direct and apply the program described  in subclause (II) on a voluntary basis outside their scope of employment; and </content>
                        </subclause>
                        <subclause style="-uslm-dtd:subclause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="II">“(II) </num><chapeau style="-uslm-dtd:text">has in place, under the direction of a school nurse or other individual designated under subclause (I), a comprehensive school-based allergies and asthma management program that includes— </chapeau>
                            <item style="-uslm-dtd:item" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="aa">“(aa) </num><content style="-uslm-dtd:text">a method to identify all students of such school with a diagnosis of allergies and asthma; </content>
                            </item>
                            <item style="-uslm-dtd:item" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="bb">“(bb) </num><content style="-uslm-dtd:text">an individual student allergies and asthma action plan for each student of such school with a diagnosis of allergies and asthma; </content>
                            </item>
                            <item style="-uslm-dtd:item" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="cc">“(cc) </num><content style="-uslm-dtd:text">allergies and asthma education for school staff who are directly responsible for students who have been identified as having allergies or asthma, such as education regarding basics, management, trigger management, and comprehensive emergency responses with respect to allergies and asthma; </content>
                            </item>
                            <item style="-uslm-dtd:item" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="dd">“(dd) </num><content style="-uslm-dtd:text">efforts to reduce the presence of environmental triggers of allergies and asthma; and </content>
                            </item>
                            <item style="-uslm-dtd:item" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ee">“(ee) </num><content style="-uslm-dtd:text">a system to support students with a diagnosis of allergies or asthma through coordination with family members of such students, primary care providers of such students, primary asthma or allergy care providers of such students, and others as necessary. ”</content>
                            </item>
                        </subclause>
                    </clause></quotedContent>; and</content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/292/s2/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">in paragraph (3)(E)— </chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/292/s2/2/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">in the matter preceding clause (i), by inserting “<quotedText style="-uslm-dtd:quote">, such as the school nurse</quotedText>” after  “<quotedText style="-uslm-dtd:quote">individual</quotedText>”; and </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/292/s2/2/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">in clause (i), by inserting “<quotedText style="-uslm-dtd:quote">school nurse or</quotedText>” before  “<quotedText style="-uslm-dtd:quote">principal</quotedText>”. </content>
                </subparagraph>
            </paragraph>
