    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To amend title 5, United States Code, to prevent fraud by representative payees.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/126/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t5/s101">5 U.S.C. 101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading><content style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Representative Payee Fraud Prevention Act of 2019</shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/126/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">REPRESENTATIVE PAYEE FRAUD. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/126/s2/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definitions.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/126/s2/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">CSRS.—</heading><chapeau style="-uslm-dtd:text">Section 8331 of title 5, United States Code, is amended—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/126/s2/a/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">in paragraph (31), by striking “<quotedText style="-uslm-dtd:quote">and</quotedText>” at the end;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/126/s2/a/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">in paragraph (32), by striking the period at the end and inserting “<quotedText style="-uslm-dtd:quote">; and</quotedText>”; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/126/s2/a/1/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="33">“(33) </num><content style="-uslm-dtd:text">‘representative payee’ means a person (including an organization) designated under section 8345(e)(1) to receive payments on behalf of a minor or an individual mentally incompetent or under other legal disability.”</content>
                        </paragraph></quotedContent>.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/126/s2/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">FERS.—</heading><chapeau style="-uslm-dtd:text">Section 8401 of title 5, United States Code, is amended—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/126/s2/a/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">in paragraph (37), by striking “<quotedText style="-uslm-dtd:quote">and</quotedText>” at the end;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/126/s2/a/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">in paragraph (38), by striking the period at the end and inserting “<quotedText style="-uslm-dtd:quote">; and</quotedText>”; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/126/s2/a/2/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="39">“(39) </num><content style="-uslm-dtd:text">‘representative payee’ means a person (including an organization) designated under section 8466(c)(1) to receive payments on behalf of a minor or an individual mentally incompetent or under other legal disability.”</content>
                        </paragraph></quotedContent>.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/126/s2/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Embezzlement or Conversion.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/126/s2/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">CSRS.—</heading><content style="-uslm-dtd:text">Subchapter III of chapter 83 of title 5, United States Code, is amended by inserting after section 8345 the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <section style="-uslm-dtd:section" styleType="USC">
                        <num style="-uslm-dtd:enum" value="8345a">“§ 8345a. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t5/s8345a">5 U.S.C. 8345a</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header"> Embezzlement or conversion of payment </heading>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">“(a) </num><heading style="-uslm-dtd:header">Embezzling and Conversion Generally.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">It shall be unlawful for a representative payee to embezzle or in any manner convert all or any part of the amounts received from payments received as a representative payee to a use other than for the use and benefit of the minor or individual on whose behalf such payments were received.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Revocation.—</heading><chapeau style="-uslm-dtd:text">If the Office determines that a representative payee has embezzled or converted payments as described in paragraph (1), the Office shall promptly—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">revoke the certification for payment of benefits to the representative payee; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">“(B) </num><chapeau style="-uslm-dtd:text">certify payment—</chapeau>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">to another representative payee; or</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">if the interest of the individual under this title would be served thereby, to the individual.</content>
                                    </clause>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">“(b) </num><heading style="-uslm-dtd:header">Penalty.—</heading><content style="-uslm-dtd:text">Any person who violates subsection (a)(1) shall be fined under title 18, imprisoned for not more than 5 years, or both.”</content>
                        </subsection>

                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/126/s2/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">FERS.—</heading><content style="-uslm-dtd:text">Subchapter VI of chapter 84 of title 5, United States Code, is amended by inserting after section 8466 the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <section style="-uslm-dtd:section" styleType="USC">
                        <num style="-uslm-dtd:enum" value="8466a">“§ 8466a. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t5/s8466a">5 U.S.C. 8466a</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header"> Embezzlement or conversion of payment </heading>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">“(a) </num><heading style="-uslm-dtd:header">Embezzling and Conversion Generally.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">It shall be unlawful for a representative payee to embezzle or in any manner convert all or any part of the amounts received from payments received as a representative payee to a use other than for the use and benefit of the minor or individual on whose behalf such payments were received.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Revocation.—</heading><chapeau style="-uslm-dtd:text">If the Office determines that a representative payee has embezzled or converted payments as described in paragraph (1), the Office shall promptly—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">revoke the certification for payment of benefits to the representative payee; and</content>

                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">

                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">to another representative payee; or</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">if the interest of the individual under this title would be served thereby, to the individual.</content>
                                    </clause>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">“(b) </num><heading style="-uslm-dtd:header">Penalty.—</heading><content style="-uslm-dtd:text">Any person who violates subsection (a)(1) shall be fined under title 18, imprisoned for not more than 5 years, or both.”</content>
                        </subsection>

                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/126/s2/b/3/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t5/s8301">5 U.S.C. 8301</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">The table of sections for chapter 83 of title 5, United States Code,is amended by inserting after the item relating to section 8345 the following:<quotedContent style="-uslm-dtd:quoted-block">
                        <toc style="-uslm-dtd:toc">

            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/126/s2/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Deferral of Payment Pending Appointment of Representative Payee.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/126/s2/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">CSRS.—</heading><chapeau style="-uslm-dtd:text">Section 8345(e) of title 5, United States Code, is amended—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/126/s2/c/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">by inserting “<quotedText style="-uslm-dtd:quote">(1)</quotedText>” after  “<quotedText style="-uslm-dtd:quote">(e)</quotedText>”;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/126/s2/c/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">in the first sentence, by inserting “<quotedText style="-uslm-dtd:quote">(including an organization)</quotedText>” after  “<quotedText style="-uslm-dtd:quote">person</quotedText>”;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/126/s2/c/1/C" styleType="OLC">

                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/126/s2/c/1/D" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">If the Office determines that direct payment of a benefit to an individual mentally incompetent or under other legal disability would cause substantial harm to the individual, the Office may defer or suspend direct payment of the benefit until such time as the appointment of a representative payee is made. The Office shall resume payment as soon as practicable, including all amounts due.”</content>
                        </paragraph></quotedContent>.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/126/s2/c/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">FERS.—</heading><chapeau style="-uslm-dtd:text">Section 8466(c) of title 5, United States Code, is amended—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/126/s2/c/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">by inserting “<quotedText style="-uslm-dtd:quote">(1)</quotedText>” after  “<quotedText style="-uslm-dtd:quote">(c)</quotedText>”;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/126/s2/c/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">in the first sentence, by inserting “<quotedText style="-uslm-dtd:quote">(including an organization)</quotedText>” after  “<quotedText style="-uslm-dtd:quote">person</quotedText>”;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/126/s2/c/2/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><chapeau style="-uslm-dtd:text">in the second sentence—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/116/126/s2/c/2/C/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">by inserting “<quotedText style="-uslm-dtd:quote">(including an organization)</quotedText>” after  “<quotedText style="-uslm-dtd:quote">any person</quotedText>”; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/116/126/s2/c/2/C/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">by inserting “<quotedText style="-uslm-dtd:quote">and may appropriately receive such payments on behalf of the claimant</quotedText>” after  “<quotedText style="-uslm-dtd:quote">claimant</quotedText>” the second place it appears; and</content>

                    </subparagraph>

                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC" class="leftIndentDecrease1">

                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Limitations on Appointments of Representative Payees.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/126/s2/d/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">CSRS.—</heading><content style="-uslm-dtd:text">Section 8345 of title 5, United States Code, is amended by inserting after subsection (e) the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <subsection style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="f">“(f) </num><chapeau style="-uslm-dtd:text">The Office may not authorize a person to receive payments on behalf of a minor or individual of legal disability under subsection (e) if that person has been convicted of a violation of—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">section 8345a or 8466a;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">section 208 or 1632 of the Social Security Act (42 U.S.C. 408, 1383a); or</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">“(3) </num><content style="-uslm-dtd:text">section 6101 of title 38.”</content>
                        </paragraph>
                    </subsection></quotedContent>.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/126/s2/d/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">FERS.—</heading><content style="-uslm-dtd:text">Section 8466 of title 5, United States Code, is amended by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <subsection style="-uslm-dtd:subsection" styleType="OLC">

            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/126/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">IMPLEMENTATION. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/126/s3/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Authorization of Payments.—</heading><content style="-uslm-dtd:text">Section 8348(a)(1)(B) of title 5, United States Code, is amended by inserting “<quotedText style="-uslm-dtd:quote">in administering fraud prevention under sections 8345, 8345a, 8466, and 8466a of this title,</quotedText>” after  “<quotedText style="-uslm-dtd:quote">8465(b) of this title,</quotedText>”.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/126/s3/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t5/s8331">5 U.S.C. 8331 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Regulations.—</heading><chapeau style="-uslm-dtd:text">Not later than 1 year after the date of enactment of this Act, the Office of Personnel Management—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/126/s3/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">shall promulgate regulations to carry out the amendments made by section 2; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/126/s3/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">may promulgate additional regulations relating to the administration of the representative payee program.</content>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/126/s4" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t5/s8331">5 U.S.C. 8331 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">EFFECTIVE DATE. </heading><chapeau style="-uslm-dtd:text">The amendments made by section 2—</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/126/s4/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">shall take effect on the date of the enactment of this Act; and</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/126/s4/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">apply on and after the effective date of the regulations promulgated under section 3(b)(1).</content>
            </paragraph>
