    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To extend authorization for the September 11th Victim Compensation Fund of 2001 through fiscal year 2092, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/34/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t49/s40101">49 U.S.C. 40101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading><content style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Never Forget the Heroes: James Zadroga, Ray Pfeifer, and Luis Alvarez Permanent Authorization of the September 11th Victim Compensation Fund Act</shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/34/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">SEPTEMBER 11TH VICTIM COMPENSATION FUND OF 2001. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/34/s2/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Authorization and Funding.—</heading><chapeau style="-uslm-dtd:text">Section 410 of the Air Transportation Safety and System Stabilization Act (49 U.S.C. 40101 note) is amended—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/34/s2/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in subsection (c), by striking “<quotedText style="-uslm-dtd:quote">$4,600,000,000</quotedText>” and all that follows through  “<quotedText style="-uslm-dtd:quote">expended</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">such sums as may be necessary for fiscal year 2019 and each fiscal year thereafter through fiscal year 2092, to remain available until expended</quotedText>”; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/34/s2/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in subsection (e), by striking “<quotedText style="-uslm-dtd:quote">Upon completion of all payments under this title</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">On October 1, 2092, or at such time thereafter as all funds are expended</quotedText>”.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/34/s2/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t49/s40101">49 U.S.C. 40101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Extension of Limitation on Claim Filing.—</heading><content style="-uslm-dtd:text">Section 405(a)(3)(B) of the Air Transportation Safety and System Stabilization Act (40 U.S.C. 401010 note) is amended by striking “<quotedText style="-uslm-dtd:quote">the date that is 5 years after the date of enactment of the James Zadroga 9/11 Victim Compensation Fund Reauthorization Act</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">October 1, 2090</quotedText>”.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/34/s2/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Compensation Reduced by Special Master Due to Lack of Funding.—</heading><content style="-uslm-dtd:text">Section 406(d)(2) of the Air Transportation Safety and System Stabilization Act (49 U.S.C. 40101 note) is amended by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="D">“(D) </num><heading style="-uslm-dtd:header">Compensation reduced by special master due to insufficient funding.—</heading>
                    <clause style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">“(i) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">In any claim in Group B as described in section 405(a)(3)(C)(iii) in which, prior to the enactment of the Never Forget the Heroes: James Zadroga, Ray Pfeifer, and Luis Alvarez Permanent Authorization of the September 11th Victim Compensation Fund Act, the Special Master had advised the claimant that the amount of compensation has been reduced on the basis of insufficient funding, the Special Master shall, in the first fiscal year beginning after sufficient funding becomes available under such   Act, pay to the claimant an amount that is, as determined by the Special Master, equal to the difference between—</chapeau>
                        <subclause style="-uslm-dtd:subclause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="I">“(I) </num><content style="-uslm-dtd:text">the amount the claimant would have been paid under this title if sufficient funding was available to the Special Master at the time the Special Master determined the amount due the claimant under this title; and</content>
                        </subclause>
                        <subclause style="-uslm-dtd:subclause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="II">“(II) </num><content style="-uslm-dtd:text">the amount the claimant was paid under this title.</content>
                        </subclause>
                    </clause>
                    <clause style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">“(ii) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">For purposes of this subparagraph:</chapeau>
                        <subclause style="-uslm-dtd:subclause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="I">“(I) </num><heading style="-uslm-dtd:header">Insufficient funding.—</heading><chapeau style="-uslm-dtd:text">The term ‘<quotedText style="-uslm-dtd:quote">insufficient funding</quotedText>’ means funding—</chapeau>
                            <item style="-uslm-dtd:item" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="aa">“(aa) </num><content style="-uslm-dtd:text">that is available to the Special Master under section 410(c) on the day before the date of enactment of the Never Forget the Heroes: James Zadroga, Ray Pfeifer, and Luis Alvarez Permanent Authorization of the September 11th Victim Compensation Fund Act for purposes of compensating claims in Group B as described in section 405(a)(3)(C)(iii); and</content>
                            </item>
                            <item style="-uslm-dtd:item" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="bb">“(bb) </num><content style="-uslm-dtd:text">that the Special Master determines is insufficient for purposes of compensating all such claims and complying with subparagraph (A).</content>
                            </item>
                        </subclause>
                        <subclause style="-uslm-dtd:subclause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="II">“(II) </num><heading style="-uslm-dtd:header">Sufficient funding.—</heading><chapeau style="-uslm-dtd:text">The term ‘<quotedText style="-uslm-dtd:quote">sufficient funding</quotedText>’ means funding—</chapeau>
                            <item style="-uslm-dtd:item" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="aa">“(aa) </num><content style="-uslm-dtd:text">made available to the Special Master for purposes of compensating claims in Group B as described in section 405(a)(3)(C)(iii) through an Act of Congress that is enacted after the date on which the amount of the claim described in clause (i) has been reduced; and</content>
                            </item>
                            <item style="-uslm-dtd:item" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="bb">“(bb) </num><content style="-uslm-dtd:text">that the Special Master determines is sufficient for purposes of compensating all claims in such Group B.”</content>
                            </item>
                        </subclause>
                    </clause>
                </subparagraph></quotedContent>.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/34/s2/d" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Limitations on Noneconomic Loss.—</heading><chapeau style="-uslm-dtd:text">Section 405(b)(7)(A) of the of the Air Transportation Safety and System Stabilization Act (49 U.S.C. 40101 note) is amended—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/34/s2/d/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">by redesignating clauses (i) and (ii) as subclauses (I) and (II) respectively, and adjusting the margins accordingly;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/34/s2/d/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">With respect to</quotedText>” and inserting the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <clause style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">“(i) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Except as provided in clause (ii), with respect to”</content>
                    </clause></quotedContent>; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/34/s2/d/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <subsection style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">“(ii) </num><heading style="-uslm-dtd:header">Exception.—</heading><content style="-uslm-dtd:text">The Special Master may exceed the applicable limitation in clause (i) for a claim in Group B as described in subsection (a)(3)(C)(iii) if the Special Master determines that the claim presents special circumstances.”</content>
                    </subsection></quotedContent>.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/34/s2/e" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t49/s40101">49 U.S.C. 40101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Adjustment of Annual Gross Income Limitation.—</heading><content style="-uslm-dtd:text">Section 405(b)(7)(B)(ii) of the Air Transportation Safety and System Stabilization Act (40 U.S.C. 40101 note) is amended by striking “<quotedText style="-uslm-dtd:quote">$200,000.</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">the annual gross income limitation. The 133 STAT. 1042 annual gross income limitation in effect on the date of enactment of the Never Forget the Heroes: James Zadroga, Ray Pfeifer, and Luis Alvarez Permanent Authorization of the September 11th Victim Compensation Fund Act is $200,000. The Special Master shall periodically adjust that annual gross income limitation to account for inflation.</quotedText>”.</content>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/34/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">APPOINTMENT OF SPECIAL MASTER AND DEPUTY SPECIAL MASTERS. </heading><chapeau style="-uslm-dtd:text">Section 404 of the Air Transportation Safety and System Stabilization Act (49 U.S.C. 40101 note) is amended—</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/34/s3/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">by redesignating subsection (b) as subsection (c); and</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/34/s3/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by inserting after subsection (a) the following:<quotedContent style="-uslm-dtd:quoted-block">
                <subsection style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">“(b) </num><heading style="-uslm-dtd:header">Appointment of Special Master and Deputy Special Masters.—</heading><content style="-uslm-dtd:text">The Attorney General may appoint a Special Master and no more than two Deputy Special Masters without regard to the provisions of title 5, United States Code, governing appointments in the competitive service. Any such employee shall serve at the pleasure of the Attorney General. The Attorney General shall fix the annual salary of the Special Master and the Deputy Special Masters.”</content>
                </subsection></quotedContent>.</content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/34/s4" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><heading style="-uslm-dtd:header">BUDGETARY EFFECTS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/34/s4/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Statutory PAYGO Scorecards.—</heading><content style="-uslm-dtd:text">The budgetary effects of this Act shall not be entered on either PAYGO scorecard maintained pursuant to section 4(d) of the Statutory Pay-As-You-Go Act of 2010.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/34/s4/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Senate PAYGO Scorecards.—</heading><content style="-uslm-dtd:text">The budgetary effects of this Act shall not be entered on any PAYGO scorecard maintained for purposes of section 4106 of House Concurrent Resolution 71 (115th Congress).</content>
            </subsection>
