    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To amend the DNA Analysis Backlog Elimination Act of 2000 to provide additional resources to State and local prosecutors, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/257/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t34/s10101">34 U.S.C. 10101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading><content style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Justice Served Act of 2018</shortTitle>”.</content>

        <section style="-uslm-dtd:section" identifier="/us/sComp/115/257/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">PROSECUTION OF DNA COLD CASES. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/257/s2/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Debbie Smith DNA Backlog Grant Program.—</heading><chapeau style="-uslm-dtd:text">Section 2 of the DNA Analysis Backlog Elimination Act of 2000 (34 U.S.C. 40701) is amended—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/257/s2/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in subsection (a), by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="9">“(9) </num><content style="-uslm-dtd:text">To increase the capacity of State and local prosecution offices to address the backlog of violent crime cases in which suspects have been identified through DNA evidence.”</content>
                    </paragraph></quotedContent>; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/257/s2/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in subsection (c), by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">“(5) </num><heading style="-uslm-dtd:header">Allocation of grant awards for prosecutors.—</heading><content style="-uslm-dtd:text">For each fiscal year, not less than 5 percent, but not more than 7 percent, of the grant amounts distributed under paragraph (1) shall, if sufficient applications to justify such amounts are received by the Attorney General, be awarded for purposes described in subsection (a)(9), provided that none of the funds required to be distributed under this paragraph shall decrease or otherwise limit the availability of funds required to be awarded to States or units of local government under paragraph (3).”</content>

            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/257/s2/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Prosecution of Cold Cases.—</heading><content style="-uslm-dtd:text">Of the amounts made available to the Attorney General for a DNA Analysis and capacity enhancement program and for other local, State, and Federal forensic activities for the purpose described in section 2 of the DNA Analysis Backlog Elimination Act of 2000 (34 U.S.C. 40701) under the heading “<quotedText style="-uslm-dtd:quote"><headingText style="-uslm-dtd:header-in-text">state and local law enforcement assistance</headingText></quotedText>” under the heading “<quotedText style="-uslm-dtd:quote"><headingText style="-uslm-dtd:header-in-text">Office of Justice Programs</headingText></quotedText>” under the heading <headingText style="-uslm-dtd:header-in-text">“<quotedText style="-uslm-dtd:quote">DEPARTMENT OF JUSTICE</quotedText>”</headingText> in fiscal years 2019, 2020, 2021, and 2022, not less than 5 percent, but not more than 7 percent, of such amounts shall be provided for grants for prosecutors to increase the capacity of State and local prosecution offices  to address cold cases involving violent crime, where suspects have been identified through DNA evidence.</content>
            </subsection>
