    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">An Act</docTitle><officialTitle style="-uslm-dtd:official-title">to express the intent of the Congress with reference to the regulation of the business of insurance.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
</enactingFormula><section style="-uslm-dtd:section" styleType="OLC" role="undesignated-level" class="inline"><content style="-uslm-dtd:text">That the Congress hereby declares that the continued regulation and taxation by the several States of the business of insurance is in the public interest, and that silence on the part of Congress shall not be construed to impose any barrier to the regulation or taxation of such business by the several States.</content><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t15/s1011">15 U.S.C. 1011</ref><b>]</b> </editorialNote></section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/79/20/s2" styleType="traditional-inline">
            <num style="-uslm-dtd:enum" value="2">Sec. 2. </num><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/79/20/s2/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">The business of insurance, and every person engaged therein, shall be subject to the laws of the several States which relate to the regulation or taxation of such business.</content></subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/79/20/s2/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">No Act of Congress shall be construed to invalidate, impair, or supersede any law enacted by any State for the purpose of regulating the business of insurance, or which imposes a fee or tax upon such business, unless such Act specifically relates to the business of insurance: <i style="-uslm-dtd:italic">Provided,</i> That after June 30, 1948, the Act of July 2, 1890, as amended, known as the Sherman Act, and the Act of October 15, 1914, as amended, known as the Clayton Act, and the Act of September 26, 1914, known as the Federal Trade Commission Act, as amended, shall be applicable to the business of insurance to the extent that such business is not regulated by State law.</content>
            </subsection><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t15/s1012">15 U.S.C. 1012</ref><b>]</b> </editorialNote>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/79/20/s3" styleType="traditional-inline">
            <num style="-uslm-dtd:enum" value="3">Sec. 3. </num><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/79/20/s3/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">Until June 30, 1948, the Act of July 2, 1890, as amended, known as the Sherman Act, and the Act of October 15, 1914, as amended, known as the Clayton Act, and the Act of September 26, 1914, known as the Federal Trade Commission Act, as amended, and the Act of June 19, 1936, known as the Robinson-Patman Antidiscrimination Act, shall not apply to the business of insurance or to acts in the conduct thereof.</content></subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/79/20/s3/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">Nothing contained in this Act shall render the said Sherman Act inapplicable to any agreement to boycott, coerce, or intimidate, or act of boycott, coercion, or intimidation.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/79/20/s3/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c)</num><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/79/20/s3/c/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Nothing contained in this Act shall modify, impair, or supersede the operation of any of the antitrust laws with respect to the business of health insurance (including the business of dental insurance and limited-scope dental benefits).</content></paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/79/20/s3/c/2" styleType="OLC" class="leftIndentDecrease1">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">Paragraph (1) shall not apply with respect to making a contract, or engaging in a combination or conspiracy—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/79/20/s3/c/2/A" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">to collect, compile, or disseminate historical loss data;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/79/20/s3/c/2/B" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">to determine a loss development factor applicable to historical loss data;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/79/20/s3/c/2/C" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">to perform actuarial services if such contract, combination, or conspiracy does not involve a restraint of trade; or</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/79/20/s3/c/2/D" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">to develop or disseminate a standard insurance policy form (including a standard addendum to an insurance policy form and standard terminology in an insurance policy form) if such contract, combination, or conspiracy is not to adhere to such standard form or require adherence to such standard form.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/79/20/s3/c/3" styleType="OLC" class="leftIndentDecrease1">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">For purposes of this subsection—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/79/20/s3/c/3/A" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the term “<quotedText style="-uslm-dtd:quote">antitrust laws</quotedText>” has the meaning given it in subsection (a) of the first section of the Clayton Act (15 U.S.C. 12), except that such term includes section 5 of the Federal Trade Commission Act (15 U.S.C. 45) to the extent that such section 5 applies to unfair methods of competition;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/79/20/s3/c/3/B" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">the term “<quotedText style="-uslm-dtd:quote">business of health insurance (including the business of dental insurance and limited-scope dental benefits)</quotedText>” does not include—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/79/20/s3/c/3/B/i" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the business of life insurance (including annuities); or</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/79/20/s3/c/3/B/ii" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><chapeau style="-uslm-dtd:text">the business of property or casualty insurance, including but not limited to—</chapeau>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/79/20/s3/c/3/B/ii/I" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">any insurance or benefits defined as “<quotedText style="-uslm-dtd:quote">excepted benefits</quotedText>” under paragraph (1), subparagraph (B) or (C) of paragraph (2), or paragraph (3) of section 9832(c) of the Internal Revenue Code of 1986 (26 U.S.C. 9832(c)) whether offered separately or in combination with insurance or benefits described in paragraph (2)(A) of such section; and</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/79/20/s3/c/3/B/ii/II" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">any other line of insurance that is classified as property or casualty insurance under State law;</content>
                            </subclause>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/79/20/s3/c/3/C" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the term “<quotedText style="-uslm-dtd:quote">historical loss data</quotedText>” means information respecting claims paid, or reserves held for claims reported, by any person engaged in the business of insurance; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/79/20/s3/c/3/D" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">the term “<quotedText style="-uslm-dtd:quote">loss development factor</quotedText>” means an adjustment to be made to reserves held for losses incurred for claims reported by any person engaged in the business of insurance, for the purpose of bringing such reserves to an ultimate paid basis.</content>
                    </subparagraph>
                </paragraph>
            </subsection><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t15/s1013">15 U.S.C. 1013</ref><b>]</b> </editorialNote>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/79/20/s4" styleType="traditional-inline">
            <num style="-uslm-dtd:enum" value="4">Sec. 4. </num><content style="-uslm-dtd:text">Nothing contained in this Act shall be construed to affect in any manner the application to the business of insurance of the Act of July 5, 1935, as amended, known as the National Labor Relations Act, or the Act of June 25, 1938, as amended, known as the Fair Labor Standards Act of 1938, or the Act of June 5, 1920, known as the Merchant Marine Act, 1920.</content><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t15/s1014">15 U.S.C. 1014</ref><b>]</b> </editorialNote>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/79/20/s5" styleType="traditional-inline">
            <num style="-uslm-dtd:enum" value="5">Sec. 5. </num><content style="-uslm-dtd:text">As used in this Act, the term “<term style="-uslm-dtd:term">State</term>” includes the several States, Alaska, Hawaii, Puerto Rico, Guam,and the District of Columbia.</content><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t15/s1015">15 U.S.C. 1015</ref><b>]</b> </editorialNote>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/79/20/s6" styleType="traditional-inline">
            <num style="-uslm-dtd:enum" value="6">Sec. 6. </num><content style="-uslm-dtd:text">If any provision of this Act, or the application of such provision to any person or circumstances, shall be held invalid, the remainder of the Act, and the application of such provision to persons or circumstances other than those as to which it is held invalid, shall not be affected.</content><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t15/s1011">15 U.S.C. 1011 note</ref><b>]</b> </editorialNote>
        </section>
