    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To amend title 5, United States Code, to provide a pathway for temporary seasonal employees in Federal land management agencies to compete for vacant permanent positions under internal merit promotion procedures, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/114/47/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t5/s101">5 U.S.C. 101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Land Management Workforce Flexibility Act</shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/114/47/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">PERSONNEL FLEXIBILITIES RELATING TO LAND MANAGEMENT AGENCIES. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/47/s2/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Subpart I of part III of title 5, United States Code, is amended by inserting after chapter 95 the following:<quotedContent style="-uslm-dtd:quoted-block">
                <chapter style="-uslm-dtd:chapter">
                    <num style="-uslm-dtd:enum" value="96">“CHAPTER 96—</num><heading style="-uslm-dtd:header">PERSONNEL FLEXIBILITIES RELATING TO LAND MANAGEMENT AGENCIES </heading>
                    <toc style="-uslm-dtd:toc">
                        <referenceItem style="-uslm-dtd:toc-entry" role="section"><label>“Sec.</label></referenceItem>
                        <referenceItem style="-uslm-dtd:toc-entry" role="section"><designator>“9601.</designator><label> Definitions.</label></referenceItem>

                    <section style="-uslm-dtd:section" styleType="OLC" role="definitions">
                        <num style="-uslm-dtd:enum" value="9601">“SEC. 9601. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t5/s9601">5 U.S.C. 9601</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Definitions </heading>
                        <chapeau style="-uslm-dtd:text" class="block">“For purposes of this chapter—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">“(1) </num><chapeau style="-uslm-dtd:text">the term ‘<term style="-uslm-dtd:quote">land management agency</term>’ means—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">the Forest Service of the Department of Agriculture;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">the Bureau of Land Management of the Department of the Interior;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">“(C) </num><content style="-uslm-dtd:text">the National Park Service of the Department of the Interior;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="D">“(D) </num><content style="-uslm-dtd:text">the Fish and Wildlife Service of the Department of the Interior;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="E">“(E) </num><content style="-uslm-dtd:text">the Bureau of Indian Affairs of the Department of the Interior; and</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="F">“(F) </num><content style="-uslm-dtd:text">the Bureau of Reclamation of the Department of the Interior; and</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">the term ‘<term style="-uslm-dtd:quote">time-limited appointment</term>’ includes a temporary appointment and a term appointment, as defined by the Office of Personnel Management.</content>
                        </paragraph>
                    </section>
                    <section style="-uslm-dtd:section" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="9602">“SEC. 9602. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t5/s9602">5 U.S.C. 9602</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Competitive service; time-limited appointments </heading>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">“(a) </num><chapeau style="-uslm-dtd:text">Notwithstanding chapter 33 or any other provision of law relating to the examination, certification, and appointment of individuals in the competitive service, an employee of a land  management agency serving under a time-limited appointment in the competitive service is eligible to compete for a permanent appointment in the competitive service at any land management agency or any other agency (as defined in section 101 of title 31) under the internal merit promotion procedures of the applicable agency if—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">the employee was appointed initially under open, competitive examination under subchapter I of chapter 33 to the time-limited appointment;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">the employee has served under 1 or more time-limited appointments by a land management agency for a period or periods totaling more than 24 months without a break of 2 or more years; and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">“(3) </num><content style="-uslm-dtd:text">the employee’s performance has been at an acceptable level of performance throughout the period or periods (as the case may be) referred to in paragraph (2).</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">“(b) </num><content style="-uslm-dtd:text">In determining the eligibility of a time-limited employee under this section to be examined for or appointed in the competitive service, the Office of Personnel Management or other examining agency shall waive requirements as to age, unless the requirement is essential to the performance of the duties of the position.</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="c">“(c) </num><chapeau style="-uslm-dtd:text">An individual appointed under this section—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">becomes a career-conditional employee, unless the employee has otherwise completed the service requirements for career tenure; and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">acquires competitive status upon appointment.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="d">“(d) </num><chapeau style="-uslm-dtd:text">A former employee of a land management agency who served under a time-limited appointment and who otherwise meets the requirements of this section shall be deemed a time-limited employee for purposes of this section if—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">such employee applies for a position covered by this section within the period of 2 years after the most recent date of separation; and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">such employee’s most recent separation was for reasons other than misconduct or performance.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="e">“(e) </num><content style="-uslm-dtd:text">The Office of Personnel Management shall prescribe such regulations as may be necessary to carry out this section.”</content>
                        </subsection>
                    </section>

            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/47/s2/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Clerical Amendment.—</heading><content style="-uslm-dtd:text">The analysis for part III of title 5, United States Code, is amended by inserting after the item for chapter 95 the following:<foreign id="warning-d691797e150" note="processing mode: unknown" role="passthroughContent"><compsdtd:table xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" table-type="subformat" line-rules="no-gen" blank-lines-before="0" blank-lines-after="0"><compsdtd:tgroup cols="2"><compsdtd:tbody><compsdtd:row><compsdtd:entry colname="I60">“<compsdtd:bold>96. </compsdtd:bold>Personnel flexibilities relating to land management agencies</compsdtd:entry><compsdtd:entry colname="I52">
