<chapeau style="-uslm-dtd:text" class="block">This title may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Launch Services Purchase Act of 1990</inline></shortTitle>”.</chapeau><editorialNote style="-uslm-dtd:legis-comment"><b>[</b>Section 202 repealed by section 203(1) of Public Law 105–303.<b>]</b> </editorialNote>

<num style="-uslm-dtd:enum" value="203">SEC. 203. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s2465c">42 U.S.C. 2465c</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
<subsection style="-uslm-dtd:subsection" styleType="OLC" role="undesignated-level"><chapeau style="-uslm-dtd:text">For the purposes of this title—</chapeau>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/101/611/tII/s203/1" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">launch vehicle</term>” means any vehicle constructed for the purpose of operating in, or placing a payload in, outer space; and</content>

<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/101/611/tII/s203/2" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">payload</term>” means an object which a person undertakes to place in outer space by means of a launch vehicle, and includes subcomponents of the launch vehicle specifically designed or adapted for that object.</content>

<num style="-uslm-dtd:enum" value="206">SEC. 206. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s2465f">42 U.S.C. 2465f</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">OTHER ACTIVITIES OF THE NATIONAL AERONAUTICS AND SPACE ADMINISTRATION. </heading>
<subsection style="-uslm-dtd:subsection" styleType="OLC" role="undesignated-level"><chapeau style="-uslm-dtd:text">Commercial payloads may not be accepted for launch as primary payloads on the space shuttle unless the Administrator of the National Aeronautics and Space Administration determines that—</chapeau>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/101/611/tII/s206/1" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the payload requires the unique capabilities of the space shuttle; or</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/101/611/tII/s206/2" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">launching of the payload on the space shuttle is important for either national security or foreign policy purposes.</content>
