<constitutionalAuthorityStatementText>
[Congressional Record Volume 165, Number 1 (Thursday, January 3, 2019)][House]From the Congressional Record Online through the Government Publishing Office [www.gpo.gov]By Mr. KING of Iowa:H.R. 185.Congress has the power to enact this legislation pursuantto the following:Clause 1, Section 8 of Article 1 of the United StatesConstitution, which reads: ``The Congress shall have Power tolay and collected Taxes, Duties, Imposts, and Excises.''Therefore, Congress' taxing power would be the authority torepeal ObamaCare's individual mandate. Clause 3, Section 8 ofArticle 1 of the United States Constitution, which statesCongress' power ``To regulate Commerce . . . among theStates.'' ObamaCare was a clear violation of the CommerceClause, forcing individuals to buy a product, and this billwill ensure that such personal economic decisions arereturned to Americans. In addition, this bill makes specificchanges to existing law in a manner that returns power to theStates and to the People, consistent with Amendment X of theUnited States Constitution.[Page H216]
</constitutionalAuthorityStatementText>
