<constitutionalAuthorityStatementText>
[Congressional Record Volume 163, Number 107 (Thursday, June 22, 2017)]From the Congressional Record Online through the Government Publishing Office [www.gpo.gov]By Mr. GOSAR:H.R. 3005.Congress has the power to enact this legislation pursuantto the following:Article IV, Section 3, Clause 2 (The Property Clause). TheProperty Clause states that Congress has the power to makeall needful rules and regulations respecting the territory orother property belonging to the United States. The SupremeCourt in Fort Leavenworth Railroad v. Lowe (1885), reasonedthat the authority of the federal government over federallands is ``necessarily paramount.'' The Court opinion went onto further reason that state governments also have rightsthough with regards to certain activities that take place onfederal lands within state borders. The Act providesguidelines for controlling populations of bison in GrandCanyon National Park and requires the Secretary to coordinatewith the appropriate State Wildlife Management Agency, thusmaking it constitutionally permissible.[Page H5110]
</constitutionalAuthorityStatementText>
