The nature of thetissue harvesting and transplant business is typicallynational in scope as donors and donees are matched throughnational databases and then the tissue and parts are shippedamong the states. The power to regulate inter-state commerce is set forthArticle I, Section 8 power to ``regulate commerce among theseveral states.'' If the matter in question is not a purelylocal matter (intra-state) or if it has an impact on inter-state commerce, it falls within the Congressional power toregulate interstate commerce.
