<constitutionalAuthorityStatementText>
From the Congressional Record Online through the Government Publishing Office [www.gpo.gov]By Mr. GOSAR:H.R. 5026.Congress has the power to enact this legislation pursuantto the following:This legislation is constitutionally appropriate pursuantto Article I, Section 8, Clause 1 (the Spending Clause). TheSupreme Court, in South Dakota v. Dole (1987), reasoned thatconditions and limitations on funds were constitutional andwithin the power of Congress under the Spending Clause. Thus,conditioning the use of federal funds in order to directappropriate spending goals and purposes are constitutionallypermissible. As the spending is national in scope andpertains to all National Fish Hatcheries, and the conditionsare clear, the legislation is constitutional.[Page H5876]
</constitutionalAuthorityStatementText>
