<constitutionalAuthorityStatementText>
From the Congressional Record Online through the Government Publishing Office [www.gpo.gov]By Mr. THORNBERRY:H.R. 3840.Congress has the power to enact this legislation pursuantto the following:Article I, Section 8 of the Constitution, ``The Congressshall have Power . . . To declare War . . .'' and ``To makeRules for the Government and Regulation of the land and navalForces.''This bill would establish an independent organizationwithin the Department of Defense to develop and coordinatenet assessments of the military capabilities of the UnitedStates compared to potential adversaries in order to identifyemerging threats or opportunities. Congressional authority toestablish such an office falls within two clauses of ArticleI, Section 8 of the Constitution, which give Congress thespecific power ``To make Rules for the Government andRegulation of the land and naval Forces,'' and, moregenerally, ``To declare War.'' The organization that would beestablished by this bill is a function of the ``Governmentand Regulation of the land and naval Forces'' andCongressional power to declare war.[Page H135]
</constitutionalAuthorityStatementText>
