<enactingFormula style="-uslm-lc:I650120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula>
<section id="d90e62" identifier="/us/bill/119/hr/1316/s1" style="-uslm-lc:I650146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Maintaining American Superiority by Improving Export Control Transparency Act</shortTitle>”.</content></section>
<section id="d90e72" identifier="/us/bill/119/hr/1316/s2" role="instruction" style="-uslm-lc:I650141"><num class="fontsize12" value="2">SEC. 2. </num><heading>LICENSING TRANSPARENCY.</heading><content class="firstIndent0 fontsize10" id="x96fdf360-84f3-11f0-b788-db5648f39697" style="-uslm-lc:I650120">  Section 1756 of the Export Control Reform Act of 2018 (<ref href="/us/usc/t50/s4815">50 U.S.C. 4815</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="y96fe6891-84f3-11f0-b788-db5648f39697" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10 smallCaps">Report<inline class="noSmallCaps">.—</inline></heading><paragraph class="firstIndent0 fontsize10" id="y96fe6892-84f3-11f0-b788-db5648f39697" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10 smallCaps">In general<inline class="noSmallCaps">.—</inline></heading><content>Not later than one year after the date of the enactment of this subsection, and not less frequently than annually thereafter, the Secretary, shall, subject to the availability of appropriations, submit to the appropriate congressional committees a report on end-use checks related to, as well as license applications and other requests for authorization for the export, reexport, release, and in-country transfer of items controlled under this part to covered entities.</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y96fe6893-84f3-11f0-b788-db5648f39697" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10 smallCaps">Elements<inline class="noSmallCaps">.—</inline></heading><chapeau>The report required by paragraph (1) shall include, with respect to the preceding one year-period, the following:</chapeau><subparagraph class="firstIndent0 fontsize10" id="y96fe6894-84f3-11f0-b788-db5648f39697" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>For each license application or other request for authorization, the name of the entity submitting the application, a brief description of the item (including the Export Control Classification Number (ECCN) and reason for control, if applicable), the name of the end-user, the end-user’s location, a value estimate, decision with respect to the license application or authorization, and the date of submission.</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y96fe6895-84f3-11f0-b788-db5648f39697" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>The date, location, and result of any end-use checks, to ensure compliance with United States export controls.</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y96fe6896-84f3-11f0-b788-db5648f39697" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>Aggregate statistics on all license applications and other requests for authorization as described in subparagraph (A).</content></subparagraph></paragraph><paragraph class="firstIndent0 fontsize10" id="y96fe6897-84f3-11f0-b788-db5648f39697" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10 smallCaps">Confidentiality of information<inline class="noSmallCaps">.—</inline></heading><content>The information required to be provided in the reports required by this subsection (other than the information required by paragraph (2)(C)) shall be exempt from public disclosure pursuant to section 1761(h)(1).</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y96fe6898-84f3-11f0-b788-db5648f39697" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10 smallCaps">Protecting enforcement information<inline class="noSmallCaps">.—</inline></heading><content>In preparing and submitting a report under subsection (e), the Secretary shall ensure that information that may jeopardize an ongoing investigation shall not be included in the contents of the report.</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y96fe6899-84f3-11f0-b788-db5648f39697" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10 smallCaps">Definitions<inline class="noSmallCaps">.—</inline></heading><chapeau>In this subsection—</chapeau><subparagraph class="firstIndent0 fontsize10" id="y96fe689a-84f3-11f0-b788-db5648f39697" role="definitions" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>the term ‘<term>appropriate congressional committees</term>’ means—</chapeau><clause class="firstIndent0 fontsize10" id="y96fe689b-84f3-11f0-b788-db5648f39697" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the Committee on Foreign Affairs of the House of Representatives; and</content></clause><clause class="firstIndent0 fontsize10" id="y96fe689c-84f3-11f0-b788-db5648f39697" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the Committee on Banking, Housing, and Urban Affairs of the Senate; and</content></clause></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y96fe689d-84f3-11f0-b788-db5648f39697" role="definitions" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>the term ‘<term>covered entity</term>’ means any entity that—</chapeau><clause class="firstIndent0 fontsize10" id="y96fe689e-84f3-11f0-b788-db5648f39697" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>is located in a country listed in Country Group D:5 under Supplement No. 1 to <ref href="/us/cfr/t15/pt740">part 740 of title 15, Code of Federal Regulations</ref>; and</content></clause><clause class="firstIndent0 fontsize10" id="y96fe689f-84f3-11f0-b788-db5648f39697" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>is included on—</chapeau><subclause class="firstIndent0 fontsize10" id="y96fe8fb0-84f3-11f0-b788-db5648f39697" style="-uslm-lc:I650128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>the list maintained and set forth in Supplement No. 4 to part 744 of the Export Administration Regulations; or</content></subclause><subclause class="firstIndent0 fontsize10" id="y96fe8fb1-84f3-11f0-b788-db5648f39697" style="-uslm-lc:I650128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>the list maintained and set forth in Supplement No. 7 to part 744 of the Export Administration Regulations.”</content></subclause></clause></subparagraph></paragraph></subsection></quotedContent>.</content></section>
