<section id="d85e62" identifier="/us/bill/118/s/546/s1" style="-uslm-lc:I650146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Recruit and Retain Act</shortTitle>”.</content></section>
<section id="d85e72" identifier="/us/bill/118/s/546/s2" style="-uslm-lc:I650141"><num class="fontsize12" value="2">SEC. 2. </num><heading>IMPROVING COPS GRANTS FOR POLICE HIRING PURPOSES.</heading><subsection class="firstIndent0 fontsize10" id="y1da27b68-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s2/a" role="instruction" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10 smallCaps">Grant Use Expansion<inline class="noSmallCaps">.—</inline></heading><chapeau>Section 1701(b) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10381/b">34 U.S.C. 10381(b)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="firstIndent0 fontsize10" id="y1da2a279-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s2/a/1" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (5) through (23) as paragraphs (6) through (24), respectively; and</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y1da2a27a-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s2/a/2" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after paragraph (4) the following:<quotedContent><paragraph class="indentUp0 firstIndent0 fontsize10" id="y1da2c98b-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>to support hiring activities by law enforcement agencies experiencing declines in officer recruitment applications by reducing application-related fees, such as fees for background checks, psychological evaluations, and testing;”</content></paragraph></quotedContent>.</content></paragraph></subsection><subsection class="firstIndent0 fontsize10" id="y1da2c98c-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s2/b" role="instruction" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10 smallCaps">Technical Amendment<inline class="noSmallCaps">.—</inline></heading><content>Section 1701(b)(23) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10381/b/23">34 U.S.C. 10381(b)(23)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>(21)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>(22)</quotedText>”.</content></subsection></section>
<section id="d85e135" identifier="/us/bill/118/s/546/s3" role="instruction" style="-uslm-lc:I650141"><num class="fontsize12" value="3">SEC. 3. </num><heading>ADMINISTRATIVE COSTS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x1da317ad-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650120">  Section 1701 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10381">34 U.S.C. 10381</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="firstIndent0 fontsize10" id="y1da317ae-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s3/1" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsections (i) through (n) as subsections (j) through (o), respectively; and</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y1da317af-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s3/2" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (h) the following:<quotedContent><clause class="indentDown1 firstIndent0 fontsize10" id="y1da33ec0-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10 smallCaps">Administrative Costs<inline class="noSmallCaps">.—</inline></heading><content>Not more than 2 percent of a grant made for the hiring or rehiring of additional career law enforcement officers may be used for costs incurred to administer such grant.”</content></clause></quotedContent>.</content></paragraph></section>
<section id="d85e175" identifier="/us/bill/118/s/546/s4" role="instruction" style="-uslm-lc:I650141"><num class="fontsize12" value="4">SEC. 4. </num><heading>PIPELINE PARTNERSHIP PROGRAM.</heading><content class="firstIndent0 fontsize10" id="x1da3b3f1-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650120">  Section 1701 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10381">34 U.S.C. 10381</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after subsection (o) the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="y1da47742-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="p">“(p) </num><heading class="fontsize10 smallCaps">COPS Pipeline Partnership Program<inline class="noSmallCaps">.—</inline></heading><paragraph class="firstIndent0 fontsize10" id="y1da47743-1325-11ef-b1b5-c54a7bf58f31" role="definitions" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10 smallCaps">Eligible entity defined<inline class="noSmallCaps">.—</inline></heading><chapeau>In this subsection, the term ‘<term>eligible entity</term>’ means a law enforcement agency in partnership with not less than 1 educational institution, which may include 1 or any combination of the following:</chapeau><subparagraph class="firstIndent0 fontsize10" id="y1da47744-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>An elementary school.</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y1da47745-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>A secondary school.</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y1da47746-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>An institution of higher education.</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y1da47747-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>A Hispanic-serving institution.</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y1da47748-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>A historically Black college or university.</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y1da47749-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>A Tribal college.</content></subparagraph></paragraph><paragraph class="firstIndent0 fontsize10" id="y1da4774a-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10 smallCaps">Grants<inline class="noSmallCaps">.—</inline></heading><chapeau>The Attorney General shall award competitive grants to eligible entities for recruiting activities that—</chapeau><subparagraph class="firstIndent0 fontsize10" id="y1da4774b-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>support substantial student engagement for the exploration of potential future career opportunities in law enforcement;</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y1da4774c-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>strengthen recruitment by law enforcement agencies experiencing a decline in recruits, or high rates of resignations or retirements;</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y1da4774d-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>enhance community interactions between local youth and law enforcement agencies that are designed to increase recruiting; and</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y1da4774e-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>otherwise improve the outcomes of local law enforcement recruitment through activities such as dedicated programming for students, work-based learning opportunities, project-based learning, mentoring, community liaisons, career or job fairs, work site visits, job shadowing, apprenticeships, or skills-based internships.</content></subparagraph></paragraph><paragraph class="firstIndent0 fontsize10" id="y1da4774f-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10 smallCaps">Funding<inline class="noSmallCaps">.—</inline></heading><content>Of the amounts made available to carry out this part for a fiscal year, the Attorney General may use not more than $3,000,000 to carry out this subsection.”</content></paragraph></subsection></quotedContent>.</content></section>
<section id="d85e265" identifier="/us/bill/118/s/546/s5" role="instruction" style="-uslm-lc:I650141"><num class="fontsize12" value="5">SEC. 5. </num><heading>COPS GRANT GUIDANCE FOR AGENCIES OPERATING BELOW BUDGETED STRENGTH.</heading><content class="firstIndent0 fontsize10" id="x1da5fdf0-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650120">  Section 1704 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10384">34 U.S.C. 10384</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="y1da67321-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10 smallCaps">Guidance for Understaffed Law Enforcement Agencies<inline class="noSmallCaps">.—</inline></heading><paragraph class="firstIndent0 fontsize10" id="y1da67322-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10 smallCaps">Definitions<inline class="noSmallCaps">.—</inline></heading><chapeau>In this subsection:</chapeau><subparagraph class="firstIndent0 fontsize10" id="y1da67323-1325-11ef-b1b5-c54a7bf58f31" role="definitions" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10 smallCaps">Covered applicant<inline class="noSmallCaps">.—</inline></heading><content>The term ‘<term>covered applicant</term>’ means an applicant for a hiring grant under this part seeking funding for a law enforcement agency operating below the budgeted strength of the law enforcement agency.</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y1da67324-1325-11ef-b1b5-c54a7bf58f31" role="definitions" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10 smallCaps">Budgeted strength<inline class="noSmallCaps">.—</inline></heading><content>The term ‘<term>budgeted strength</term>’ means the employment of the maximum number of sworn law enforcement officers the budget of a law enforcement agency allows the agency to employ.</content></subparagraph></paragraph><paragraph class="firstIndent0 fontsize10" id="y1da67325-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10 smallCaps">Procedures<inline class="noSmallCaps">.—</inline></heading><chapeau>Not later than 180 days after the date of enactment of this Act, the Attorney General shall establish consistent procedures for covered applicants, including guidance that—</chapeau><subparagraph class="firstIndent0 fontsize10" id="y1da67326-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>clarifies that covered applicants remain eligible for funding under this part; and</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y1da67327-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>enables covered applicants to attest that the funding from a grant awarded under this part is not being used by the law enforcement agency to supplant State or local funds, as described in subsection (a).</content></subparagraph></paragraph><paragraph class="firstIndent0 fontsize10" id="y1da67328-1325-11ef-b1b5-c54a7bf58f31" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10 smallCaps">Paperwork reduction<inline class="noSmallCaps">.—</inline></heading><content>In developing the procedures and guidance under paragraph (2), the Attorney General shall take measures to reduce paperwork requirements for grants to covered applicants.”</content></paragraph></subsection></quotedContent>.</content></section>
<section id="d85e339" identifier="/us/bill/118/s/546/s6" style="-uslm-lc:I650141"><num class="fontsize12" value="6">SEC. 6. </num><heading>STUDY ON POLICE RECRUITMENT.</heading><subsection class="firstIndent0 fontsize10" id="y1da820d9-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/a" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10 smallCaps">Study<inline class="noSmallCaps">.—</inline></heading><paragraph class="firstIndent0 fontsize10" id="y1da820da-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/a/1" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10 smallCaps">In general<inline class="noSmallCaps">.—</inline></heading><chapeau>The Comptroller General of the United States shall conduct a study to consider the comprehensive effects of recruitment and attrition rates on Federal, State, Tribal, and local law enforcement agencies in the United States, to identify—</chapeau><subparagraph class="firstIndent0 fontsize10" id="y1da820db-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/a/1/A" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>the primary reasons that law enforcement officers—</chapeau><clause class="firstIndent0 fontsize10" id="y1da820dc-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/a/1/A/i" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>join law enforcement agencies; and</content></clause><clause class="firstIndent0 fontsize10" id="y1da820dd-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/a/1/A/ii" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>resign or retire from law enforcement agencies;</content></clause></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y1da820de-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/a/1/B" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>how the reasons described in subparagraph (A) may have changed over time;</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y1da820df-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/a/1/C" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the effects of recruitment and attrition on public safety;</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y1da847f0-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/a/1/D" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>the effects of electronic media on recruitment efforts;</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y1da847f1-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/a/1/E" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>barriers to the recruitment and retention of Federal, State, and local law enforcement officers; and</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y1da847f2-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/a/1/F" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>recommendations for potential ways to address barriers to the recruitment and retention of law enforcement officers, including the barriers identified in subparagraph (E).</content></subparagraph></paragraph><paragraph class="firstIndent0 fontsize10" id="y1da847f3-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/a/2" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10 smallCaps">Representative cross-section<inline class="noSmallCaps">.—</inline></heading><subparagraph class="firstIndent0 fontsize10" id="y1da847f4-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/a/2/A" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10 smallCaps">In general<inline class="noSmallCaps">.—</inline></heading><chapeau>The Comptroller General of the United States shall endeavor to ensure accurate representation of law enforcement agencies in the study conducted pursuant to paragraph (1) by surveying a broad cross-section of law enforcement agencies—</chapeau><clause class="firstIndent0 fontsize10" id="y1da847f5-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/a/2/A/i" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>from various regions of the United States;</content></clause><clause class="firstIndent0 fontsize10" id="y1da847f6-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/a/2/A/ii" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>of different sizes; and</content></clause><clause class="firstIndent0 fontsize10" id="y1da847f7-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/a/2/A/iii" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>from rural, suburban, and urban jurisdictions.</content></clause></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y1da847f8-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/a/2/B" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10 smallCaps">Methods description<inline class="noSmallCaps">.—</inline></heading><content>The study conducted pursuant to paragraph (1) shall include in the report under subsection (b) a description of the methods used to identify a representative sample of law enforcement agencies.</content></subparagraph></paragraph></subsection><subsection class="firstIndent0 fontsize10" id="y1da847f9-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/b" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10 smallCaps">Report<inline class="noSmallCaps">.—</inline></heading><chapeau>Not later than 540 days after the date of enactment of this Act, the Comptroller General of the United States shall—</chapeau><paragraph class="firstIndent0 fontsize10" id="y1da847fa-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/b/1" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a report containing the study conducted under subsection (a); and</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y1da847fb-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/b/2" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>make the report submitted under paragraph (1) publicly available online.</content></paragraph></subsection><subsection class="firstIndent0 fontsize10" id="y1da847fc-1325-11ef-b1b5-c54a7bf58f31" identifier="/us/bill/118/s/546/s6/c" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10 smallCaps">Confidentiality<inline class="noSmallCaps">.—</inline></heading><content>The Comptroller General of the United States shall ensure that the study conducted under subsection (a) protects the privacy of participating law enforcement agencies.</content></subsection></section>
