<section id="d660e62" identifier="/us/bill/118/hr/6829/s1" style="-uslm-lc:I650146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Cardiomyopathy Health Education, Awareness, and Research, and AED Training in the Schools Act of 2024</shortTitle>” or the “<shortTitle role="act">HEARTS Act of 2024</shortTitle>”.</content></section>
<section id="d660e75" identifier="/us/bill/118/hr/6829/s2" style="-uslm-lc:I650141"><num class="fontsize12" value="2">SEC. 2. </num><heading>CARDIOMYOPATHY HEALTH EDUCATION, AWARENESS, AND RESEARCH, AND AED TRAINING IN SCHOOLS.</heading><subsection class="firstIndent0 fontsize10" id="y7648b0ac-b8f8-11ef-ab67-8d041baa2714" identifier="/us/bill/118/hr/6829/s2/a" role="instruction" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10 smallCaps">Amendment<inline class="noSmallCaps">.—</inline></heading><content>The Public Health Service Act <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after section 312 (<ref href="/us/usc/t42/s244">42 U.S.C. 244</ref>) the following:<quotedContent><section class="indentUp2 firstIndent-2" id="y764a856d-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650144"><num class="bold" value="312A">“SEC. 312A. </num><heading class="bold">MATERIALS AND RESOURCES TO INCREASE EDUCATION AND AWARENESS OF CARDIOMYOPATHY AMONG SCHOOL ADMINISTRATORS, EDUCATORS, AND FAMILIES.</heading><subsection class="indentDown2 firstIndent0 fontsize10" id="y764a856e-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10 smallCaps">Materials and Resources<inline class="noSmallCaps">.—</inline></heading><chapeau>Not later than 18 months after the date of the enactment of the HEARTS Act of 2024, the Secretary, in consultation with the Director of the Centers for Disease Control and Prevention, shall develop public education materials and resources to be disseminated to school administrators, educators, school health professionals, coaches, families, guardians, caregivers, and other appropriate individuals. The materials and resources shall include—</chapeau><paragraph class="firstIndent0 fontsize10" id="y764a856f-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>information on the signs, symptoms, and risk factors associated with high-risk cardiac conditions and genetic heart rhythm abnormalities that may cause sudden cardiac arrest in children, adolescents, and young adults, including—</chapeau><subparagraph class="firstIndent0 fontsize10" id="y764a8570-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>cardiomyopathy;</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y764a8571-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>long QT syndrome, Brugada syndrome, catecholaminergic polymorphic ventricular tachycardia, short QT syndrome, and Wolff-Parkinson-White syndrome; and</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y764a8572-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>other high-risk cardiac conditions, as determined by the Secretary;</content></subparagraph></paragraph><paragraph class="firstIndent0 fontsize10" id="y764a8573-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>guidelines regarding the placement of automated external defibrillators in schools, early childhood education programs, and child care centers;</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y764a8574-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>training information on automated external defibrillators and cardiopulmonary resuscitation; and</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y764a8575-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>recommendations for how schools, early childhood education programs, and child care centers can develop and implement a cardiac emergency response plan.</content></paragraph></subsection><subsection class="indentDown2 firstIndent0 fontsize10" id="y764a8576-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10 smallCaps">Dissemination of Materials and Resources<inline class="noSmallCaps">.—</inline></heading><chapeau>Not later than 30 months after the date of the enactment of the HEARTS Act of 2024, the Secretary shall disseminate the materials and resources developed under subsection (a) in accordance with the following:</chapeau><paragraph class="firstIndent0 fontsize10" id="y764a8577-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10 smallCaps">Distribution by state educational agencies<inline class="noSmallCaps">.—</inline></heading><chapeau>The Secretary shall make available such materials and resources to State educational agencies to distribute—</chapeau><subparagraph class="firstIndent0 fontsize10" id="y764a8578-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>to school administrators, educators, school health professionals, coaches, families, guardians, caregivers, and other appropriate individuals, the information developed under subsection (a)(1);</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y764a8579-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>to parents, guardians, or other caregivers, the cardiomyopathy risk assessment developed pursuant to section 312B(b)(1); and</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y764a857a-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>to school administrators, educators, school health professionals, and coaches—</chapeau><clause class="firstIndent0 fontsize10" id="y764a857b-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the guidelines described in subsection (a)(2);</content></clause><clause class="firstIndent0 fontsize10" id="y764a857c-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the training information described in subsection (a)(3); and</content></clause><clause class="firstIndent0 fontsize10" id="y764a857d-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>the recommendations described in subsection (a)(4).</content></clause></subparagraph></paragraph><paragraph class="firstIndent0 fontsize10" id="y764a857e-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10 smallCaps">Dissemination to health departments and professionals<inline class="noSmallCaps">.—</inline></heading><content>The Secretary shall make available the materials and resources developed under subsection (a) to State and local health departments, pediatricians, hospitals, and other health professionals, such as nurses and first responders.</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y764a857f-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10 smallCaps">Posting on website<inline class="noSmallCaps">.—</inline></heading><subparagraph class="firstIndent0 fontsize10" id="y764a8580-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10 smallCaps">CDC<inline class="noSmallCaps">.—</inline></heading><clause class="firstIndent0 fontsize10" id="y764a8581-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10 smallCaps">In general<inline class="noSmallCaps">.—</inline></heading><content>The Secretary, through the Director, shall post the materials and resources developed under subsection (a) on the public Internet website of the Centers for Disease Control and Prevention.</content></clause><clause class="firstIndent0 fontsize10" id="y764a8582-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10 smallCaps">Additional information<inline class="noSmallCaps">.—</inline></heading><content>The Director is encouraged to maintain on such public Internet website such additional information regarding cardiomyopathy as deemed appropriate by the Director.</content></clause></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y764a8583-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10 smallCaps">State educational agencies<inline class="noSmallCaps">.—</inline></heading><content>State educational agencies are encouraged to create public Internet webpages dedicated to cardiomyopathy and post the materials and resources developed under subsection (a) on such webpages.</content></subparagraph></paragraph></subsection><subsection class="indentDown2 firstIndent0 fontsize10" id="y764a8584-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10 smallCaps">Definitions<inline class="noSmallCaps">.—</inline></heading><chapeau>In this section:</chapeau><paragraph class="firstIndent0 fontsize10" id="y764a8585-b8f8-11ef-ab67-8d041baa2714" role="definitions" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>The term ‘<term>cardiomyopathy</term>’ means a heart disease that affects the heart’s muscle (myocardium)—</chapeau><subparagraph class="firstIndent0 fontsize10" id="y764a8586-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>the symptoms of which may vary from case to case, including—</chapeau><clause class="firstIndent0 fontsize10" id="y764a8587-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>cases in which no symptoms are present (asymptomatic); and</content></clause><clause class="firstIndent0 fontsize10" id="y764a8588-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>cases in which there are symptoms of a progressive condition that may result from an impaired ability of the heart to pump blood, such as fatigue, irregular heartbeats (arrhythmia), heart failure, and, potentially, sudden cardiac death; and</content></clause></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y764a8589-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the recognized types of which include dilated, hypertrophic, restrictive, arrhythmogenic right ventricular dysplasia, and left ventricular non-compaction.</content></subparagraph></paragraph><paragraph class="firstIndent0 fontsize10" id="y764a858a-b8f8-11ef-ab67-8d041baa2714" role="definitions" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>The term ‘<term>Director</term>’ means the Director of the Centers for Disease Control and Prevention.</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y764a858b-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>The terms ‘early childhood education program’, ‘elementary school’, and ‘secondary school’ have the meanings given to those terms in section 8101 of the Elementary and Secondary Education Act of 1965.</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y764a858c-b8f8-11ef-ab67-8d041baa2714" role="definitions" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>The term ‘<term>school administrator</term>’ means a principal, director, manager, or other supervisor or leader within an elementary school, secondary school, State-based early childhood education program, or child care center.</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y764a858d-b8f8-11ef-ab67-8d041baa2714" role="definitions" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>The term ‘<term>school health professional</term>’ means a health professional serving at an elementary school, secondary school, State-based early childhood education program, or child care center.</content></paragraph></subsection></section>
<section class="indentUp2 firstIndent-2" id="y764a858e-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650144"><num class="bold" value="312B">“SEC. 312B. </num><heading class="bold">ACTIVITIES RELATING TO CARDIOMYOPATHY.</heading><subsection class="indentDown2 firstIndent0 fontsize10" id="y764a858f-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10 smallCaps">Report on CDC National Cardiomyopathy Activities<inline class="noSmallCaps">.—</inline></heading><paragraph class="firstIndent0 fontsize10" id="y764a8590-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10 smallCaps">In general<inline class="noSmallCaps">.—</inline></heading><chapeau>Not later than 18 months after the date of the enactment of the HEARTS Act of 2024, the Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall submit to Congress a report on findings generated from existing activities conducted by the Centers for Disease Control and Prevention to improve the understanding of the prevalence and epidemiology of cardiomyopathy across the lifespan, from birth to adulthood, with particular interest in the following:</chapeau><subparagraph class="firstIndent0 fontsize10" id="y764a8591-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>The natural history of individuals with cardiomyopathy, in both the pediatric and adult population.</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y764aaba2-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>Estimates of cardiomyopathy-related emergency department visits and hospitalizations, in both the pediatric and adult population.</content></subparagraph></paragraph><paragraph class="firstIndent0 fontsize10" id="y764aaba3-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10 smallCaps">Public access<inline class="noSmallCaps">.—</inline></heading><content>Subject to paragraph (3), the report submitted under this subsection shall be made available to the public.</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y764aaba4-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10 smallCaps">Privacy protections<inline class="noSmallCaps">.—</inline></heading><content>The Secretary shall ensure that this subsection is carried out in a manner that complies with all applicable privacy laws under Federal and State law.</content></paragraph></subsection><subsection class="indentDown2 firstIndent0 fontsize10" id="y764aaba5-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10 smallCaps">Improving Risk Assessments for Individuals With Cardiomyopathy<inline class="noSmallCaps">.—</inline></heading><paragraph class="firstIndent0 fontsize10" id="y764aaba6-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10 smallCaps">In general<inline class="noSmallCaps">.—</inline></heading><chapeau>The Secretary shall develop and make publicly available a cardiomyopathy risk assessment for health care providers and individuals. Such risk assessment shall, at a minimum, include the following:</chapeau><subparagraph class="firstIndent0 fontsize10" id="y764aaba7-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>Background information on the prevalence, incidence, and health impact of cardiomyopathy, including all forms of cardiomyopathy and their effects on pediatric, adolescent, and adult individuals.</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y764aaba8-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>A worksheet with variables and conditions for an individual or health care provider to use in assessing whether an individual is at risk for cardiomyopathy.</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y764aaba9-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>A worksheet with variables and stages of progression for an individual or health care provider to use in assessing whether and to what extent cardiomyopathy has progressed in an individual.</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y764aabaa-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>Guidelines on cardiomyopathy screenings for individuals who are at risk for, or have a family history of, cardiomyopathy.</content></subparagraph></paragraph><paragraph class="firstIndent0 fontsize10" id="y764aabab-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10 smallCaps">Stakeholder input<inline class="noSmallCaps">.—</inline></heading><chapeau>In carrying out paragraph (1), the Director of the Centers for Disease Control and Prevention shall seek input from external stakeholders including—</chapeau><subparagraph class="firstIndent0 fontsize10" id="y764aabac-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>representatives from national patient advocacy organizations expert in all forms of cardiomyopathy;</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y764aabad-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>representatives from medical professional societies that specialize in the care of adults and pediatrics with cardiomyopathy; and</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y764aabae-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>representatives from other relevant Federal agencies.</content></subparagraph></paragraph></subsection><subsection class="indentDown2 firstIndent0 fontsize10" id="y764aabaf-b8f8-11ef-ab67-8d041baa2714" role="definitions" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10 smallCaps">Definition<inline class="noSmallCaps">.—</inline></heading><content>In this section, the term ‘<term>cardiomyopathy</term>’ has the meaning given to such term in section 312A.</content></subsection></section>
<section class="indentUp2 firstIndent-2" id="y764aabb0-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650144"><num class="bold" value="312C">“SEC. 312C. </num><heading class="bold">CARDIOMYOPATHY RESEARCH.</heading><subsection class="indentDown2 firstIndent0 fontsize10" id="y764aabb1-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10 smallCaps">In General<inline class="noSmallCaps">.—</inline></heading><chapeau>The Secretary, in consultation with the Director of the National Institutes of Health, may expand and coordinate research and related activities of the National Institutes of Health with respect to cardiomyopathy, which may include research with respect to—</chapeau><paragraph class="firstIndent0 fontsize10" id="y764aabb2-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>causation of cardiomyopathy, including genetic causes and molecular biomarkers;</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y764aabb3-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>long-term health outcomes in individuals with cardiomyopathy, including infants, children, teenagers, adults, and elderly individuals; and</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y764aabb4-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>studies using longitudinal data and retrospective analysis to identify effective treatments and outcomes for individuals with cardiomyopathy.</content></paragraph></subsection><subsection class="indentDown2 firstIndent0 fontsize10" id="y764aabb5-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10 smallCaps">Nonduplication<inline class="noSmallCaps">.—</inline></heading><content>The Secretary shall ensure that any research and activities related to cardiomyopathy under this section do not unnecessarily duplicate activities, programs, or efforts of other agencies and offices within the Department of Health and Human Services.</content></subsection><subsection class="indentDown2 firstIndent0 fontsize10" id="y764aabb6-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10 smallCaps">NIH Report<inline class="noSmallCaps">.—</inline></heading><chapeau>Not later than 18 months after the date of the enactment of the HEARTS Act of 2024, the Secretary, in consultation with the Director of the National Institutes of Health, shall submit to Congress a report—</chapeau><paragraph class="firstIndent0 fontsize10" id="y764aabb7-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>outlining the ongoing research efforts of the National Institutes of Health regarding cardiomyopathy; and</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y764aabb8-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>identifying—</chapeau><subparagraph class="firstIndent0 fontsize10" id="y764aabb9-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>a research agenda regarding adult forms of cardiomyopathy;</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y764aabba-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>plans for researching cardiomyopathy affecting the pediatric population; and</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y764aabbb-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>the areas of greatest need for such research.</content></subparagraph></paragraph></subsection><subsection class="indentDown2 firstIndent0 fontsize10" id="y764aabbc-b8f8-11ef-ab67-8d041baa2714" role="definitions" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10 smallCaps">Cardiomyopathy Defined<inline class="noSmallCaps">.—</inline></heading><content>In this section, the term ‘<term>cardiomyopathy</term>’ has the meaning given to such term in section 312A.</content></subsection></section>
<section class="indentUp2 firstIndent-2" id="y764aabbd-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650144"><num class="bold" value="312D">“SEC. 312D. </num><heading class="bold">PROMOTING STUDENT ACCESS TO AEDS AND CPR.</heading><subsection class="indentDown2 firstIndent0 fontsize10" id="y764aabbe-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10 smallCaps">In General<inline class="noSmallCaps">.—</inline></heading><content>The Secretary may award grants to eligible entities to develop and implement a comprehensive program to promote student access to automated external defibrillators (in this section referred to as ‘AEDs’) and cardiopulmonary resuscitation (in this section referred to as ‘CPR’) in public elementary schools and secondary schools.</content></subsection><subsection class="indentDown2 firstIndent0 fontsize10" id="y764aabbf-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10 smallCaps">Use of Funds<inline class="noSmallCaps">.—</inline></heading><chapeau>An eligible entity receiving a grant under subsection (a) may use funds received through such grant to carry out any of the following activities:</chapeau><paragraph class="firstIndent0 fontsize10" id="y764aabc0-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>Developing and providing comprehensive materials to establish AED and CPR programs in public elementary schools and secondary schools.</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y764aabc1-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>Providing support for CPR and AED training programs in such schools for students, staff, and related sports volunteers.</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y764aabc2-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>Providing support for developing a cardiac emergency response plan within such schools.</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y764aabc3-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>Purchasing AEDs that have been approved under section 515 of the Federal Food, Drug, and Cosmetic Act, cleared under section 510(k) of such Act, or classified under section 513(f)(2) of such Act.</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y764aabc4-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>Purchasing necessary AED batteries and performing necessary AED maintenance (such as by replacing AED pads) in accordance with the labeling of the AED involved.</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y764aabc5-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><content>Replacing old and outdated AED and CPR equipment, machinery, and educational materials.</content></paragraph></subsection><subsection class="indentDown2 firstIndent0 fontsize10" id="y764aabc6-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10 smallCaps">Eligibility; Application<inline class="noSmallCaps">.—</inline></heading><chapeau>To be eligible for a grant under subsection (a), an entity shall—</chapeau><paragraph class="firstIndent0 fontsize10" id="y764aabc7-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>be a local educational agency (including a public charter school operating as a local educational agency under State law), in consultation with a qualified health care entity; and</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y764aabc8-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may reasonably require.</content></paragraph></subsection><subsection class="indentDown2 firstIndent0 fontsize10" id="y764aabc9-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10 smallCaps">Definitions<inline class="noSmallCaps">.—</inline></heading><chapeau>In this section:</chapeau><paragraph class="firstIndent0 fontsize10" id="y764aabca-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10 smallCaps">ESEA terms<inline class="noSmallCaps">.—</inline></heading><content>The terms ‘elementary school’, ‘local educational agency’, and ‘secondary school’ have the meanings given such terms in section 8101 of the Elementary and Secondary Education Act of 1965.</content></paragraph><paragraph class="firstIndent0 fontsize10" id="y764aabcb-b8f8-11ef-ab67-8d041baa2714" role="definitions" style="-uslm-lc:I650122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10 smallCaps">Qualified health care entity<inline class="noSmallCaps">.—</inline></heading><chapeau>The term ‘<term>qualified health care entity</term>’ means a health care entity that—</chapeau><subparagraph class="firstIndent0 fontsize10" id="y764aabcc-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>is—</chapeau><clause class="firstIndent0 fontsize10" id="y764aabcd-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a public entity; or</content></clause><clause class="firstIndent0 fontsize10" id="y764aabce-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>an organization that is described in section 501(c) of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of such Code;</content></clause></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y764aabcf-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>demonstrates an ability to develop, train, and implement a comprehensive program to promote student access to defibrillation in public elementary and secondary schools; and</content></subparagraph><subparagraph class="firstIndent0 fontsize10" id="y764aabd0-b8f8-11ef-ab67-8d041baa2714" style="-uslm-lc:I650124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>is qualified in providing technical assistance in AED and CPR training.”</content></subparagraph></paragraph></subsection></section>
