<enactingFormula style="-uslm-lc:I650120">  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</enactingFormula>
<section id="d7606e62" identifier="/us/bill/117/s/1543/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Suicide Training and Awareness Nationally Delivered for Universal Prevention Act of 2021</shortTitle>” or the “<shortTitle role="act">STANDUP Act of 2021</shortTitle>”.</content></section>
<section id="d7606e75" identifier="/us/bill/117/s/1543/s2" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>STUDENT SUICIDE AWARENESS AND PREVENTION TRAINING.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d7606e79" identifier="/us/bill/117/s/1543/s2/a" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><content>Title V of the Public Health Service Act <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after section 520A of such Act (<ref href="/us/usc/t42/s290bb–32">42 U.S.C. 290bb–32</ref>) the following:<quotedContent><section style="-uslm-lc:I650144"><num class="bold " value="520B">“SEC. 520B. </num><heading class="bold ">STUDENT SUICIDE AWARENESS AND PREVENTION TRAINING.</heading><subsection class="indentDown2 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">“(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><chapeau>In awarding funds under section 520A, the Secretary shall give priority to applications under such section from a State educational agency, local educational agency, or Tribal educational agency, submitted directly or through a State or Indian Tribe, for funding for activities in secondary schools, where such agency has implemented, or includes in such application a plan to implement, a student suicide awareness and prevention training policy, which may include applicable youth suicide early intervention and prevention strategies implemented through section 520E—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><content>establishing and implementing a school-based student suicide awareness and prevention training policy in accordance with subsection (c);</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><content>consulting with stakeholders (including principals, teachers, parents, local Tribal officials, and other relevant experts) and, as appropriate, utilizing information, models, and other resources made available by the Suicide Prevention Technical Assistance Center authorized under section 520C in the development of the policy under paragraph (1); and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><content>collecting and reporting information in accordance with subsection (d).</content></paragraph></subsection><subsection class="indentDown2 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">“(b) </num><heading><inline class="smallCaps">Consideration</inline>.—</heading><content>In giving priority to applicants as described in subsection (a), the Secretary shall, as appropriate, take into consideration the incidence and prevalence of suicide in the applicable jurisdiction and the costs of establishing and implementing, as applicable, a school-based student suicide awareness and prevention training policy.</content></subsection><subsection class="indentDown2 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">“(c) </num><heading><inline class="smallCaps">School-Based Student Suicide Awareness and Prevention Training Policy</inline>.—</heading><chapeau>A school-based student suicide awareness and prevention training policy implemented pursuant to subsection (a)(1) shall—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><content>be evidence-based;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><content>be culturally- and linguistically-appropriate;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><chapeau>provide evidence-based training to students in grades 6 through 12, in coordination with school-based mental health resources, as applicable, regarding—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><content>suicide prevention education and awareness, including associated risk factors;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><content>methods that students can use to seek help; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">“(C) </num><content>student resources for suicide awareness and prevention; and</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">“(4) </num><content>provide for periodic retraining of such students.</content></paragraph></subsection><subsection class="indentDown2 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="d">“(d) </num><heading><inline class="smallCaps">Collection of Information and Reporting</inline>.—</heading><chapeau>Each State educational agency, local educational agency, and Tribal educational agency that receives priority to implement a new training policy pursuant to subsection (a)(1) shall report to the Secretary the following aggregated information, in a manner that protects personal privacy, consistent with applicable Federal and State privacy laws:</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><content>The number of trainings conducted, including the number of student trainings conducted, and the training delivery method used.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><content>The number of students trained, disaggregated by age and grade level.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><content>The number of help-seeking reports made by students after implementation of such policy.</content></paragraph></subsection><subsection class="indentDown2 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="e">“(e) </num><heading><inline class="smallCaps">Evidence-Based Program Availability</inline>.—</heading><chapeau>The Secretary shall coordinate with the Secretary of Education and the Secretary of the Interior to—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><content>make publicly available the policies established by State educational agencies, local educational agencies, and Tribal educational agencies pursuant to this section and the training that is available to students and teams pursuant to such policies, in accordance with section 543A; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><content>provide technical assistance and disseminate best practices on student suicide awareness and prevention training policies, including through the Suicide Prevention Technical Assistance Center authorized under section 520C, as applicable, to State educational agencies, local educational agencies, and Tribal agencies.</content></paragraph></subsection><subsection class="indentDown2 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="f">“(f) </num><heading><inline class="smallCaps">Implementation</inline>.—</heading><content>Not later than September 30, 2024, the Secretary shall report to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives the number of recipients of funds under section 520A who have implemented training policies described in subsection (a)(1) and a summary of the information received under subsection (d).</content></subsection><subsection class="indentDown2 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="g">“(g) </num><heading><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><content>The term ‘<term>evidence-based</term>’ has the meaning given such term in section 8101 of the Elementary and Secondary Education Act of 1965.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><content>The term ‘<term>local educational agency</term>’ has the meaning given to such term in section 8101 of the Elementary and Secondary Education Act of 1965.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><content>The term ‘<term>State educational agency</term>’ has the meaning given to such term in section 8101 of the Elementary and Secondary Education Act of 1965.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">“(4) </num><content>The term ‘<term>Tribal educational agency</term>’ has the meaning given to the term ‘<term>tribal educational agency</term>’ in section 6132 of the Elementary and Secondary Education Act of 1965.”</content></paragraph></subsection></section>

<section id="d7606e238" identifier="/us/bill/117/s/1543/s3" style="-uslm-lc:I650141"><num value="3">SEC. 3. </num><heading>EFFECTIVE DATE.</heading><content style="-uslm-lc:I650120">  The amendment made by this Act shall apply only with respect to applications for assistance under section 520A of the Public Health Service Act (<ref href="/us/usc/t42/s290bb–32">42 U.S.C. 290bb–32</ref>) that are submitted after the date of enactment of this Act.</content></section>
