Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020, and for other purposes.<?GPOvSpace 08?></officialTitle>

<enactingFormula style="-uslm-lc:I650120">  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</enactingFormula>
<section id="d57673e62" identifier="/us/bill/117/hr/2523/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Training in High-demand Roles to Improve Veteran Employment Act</shortTitle>” or the “<shortTitle role="act">THRIVE Act</shortTitle>”.</content></section>
<section id="d57673e75" identifier="/us/bill/117/hr/2523/s2" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>IMPROVEMENTS TO COVID–19 VETERAN RAPID RETRAINING ASSISTANCE PROGRAM.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d57673e79" identifier="/us/bill/117/hr/2523/s2/a" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 8006 of the American Rescue Plan Act of 2021 (<ref href="/us/pl/117/2">Public Law 117–2</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d57673e94" identifier="/us/bill/117/hr/2523/s2/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> paragraph (3) of subsection (c) and <amendingAction type="insert">inserting</amendingAction> the following new paragraph (3):<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><heading><inline class="smallCaps">Determination of high-demand occupations</inline>.—</heading><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><heading><inline class="smallCaps">Initial implementation</inline>.—</heading><content>In carrying out this section, the Secretary shall use the list of high-demand occupations prepared in conjunction with the Secretary of Labor.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><heading><inline class="smallCaps">Modifications</inline>.—</heading><content>The Secretary of Veterans Affairs may add and remove occupations from the list under subparagraph (A) as the Secretary determines appropriate.”</content></subparagraph></paragraph></quotedContent>;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d57673e130" identifier="/us/bill/117/hr/2523/s2/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in subsection (d)(3)—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d57673e134" identifier="/us/bill/117/hr/2523/s2/a/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>in the matter preceding subparagraph (A), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>(other than such a program pursued solely through distance learning on a half-time basis or less)</quotedText>” after “<quotedText>a covered program of education under the retraining assistance program under this section</quotedText>”; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d57673e142" identifier="/us/bill/117/hr/2523/s2/a/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>in subparagraph (C), by <amendingAction type="delete">striking</amendingAction> “<quotedText>less than a half-time basis</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>a half-time basis or less</quotedText>”;</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d57673e153" identifier="/us/bill/117/hr/2523/s2/a/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsections (f), (g), and (h) as subsections (k), (l), and (m), respectively;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d57673e161" identifier="/us/bill/117/hr/2523/s2/a/4" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (e) the following new subsections:<quotedContent><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="f">“(f) </num><heading><inline class="smallCaps">Employee Assistance</inline>.—</heading><chapeau>The Secretary of Veterans Affairs, in consultation with the Secretary of Labor, shall contact each veteran who pursues a covered program of education under this section—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><content>not later than 30 days after the date on which the veteran begins the program of education to notify the veteran of the availability of employment placement services upon completion of the program; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><content>not later than 14 days after the date on which the veteran completes, or terminates participation in, such program to facilitate the provision of employment placement services to such veteran.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="g">“(g) </num><heading><inline class="smallCaps">Nonprofit Organization</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary of Veterans Affairs shall seek to enter into a memorandum of understanding with one or more qualified nonprofit organizations for the purpose of facilitating the employment of veterans who participate in the retraining assistance program under this section.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><heading><inline class="smallCaps">Qualified nonprofit organization</inline>.—</heading><chapeau>For purposes of this subsection, a qualified nonprofit organization is a nonprofit organization that—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><content>is an association of businesses; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><content>has at least two years of experience providing job placement services for veterans.</content></subparagraph></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="h">“(h) </num><heading><inline class="smallCaps">Follow up Outreach</inline>.—</heading><content>The Secretary of Veterans Affairs, in coordination with the Secretary of Labor, shall contact each veteran who completes a covered program of education under the retraining assistance program under this section 30, 60, 90, and 180 days after the veteran completes such program of education to ask the veteran about the experience of the veteran in the retraining assistance program and the veteran’s employment status.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="i">“(i) </num><heading><inline class="smallCaps">Quarterly Reports</inline>.—</heading><chapeau>Not later than the date that is one year after the date of the enactment of this Act, and quarterly thereafter, the Secretary of Labor shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives a report containing the following information about veterans who participate in the retraining assistance program under this section:</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><content>The percentage of such veterans who found employment before the end of the second calendar quarter after exiting the program.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><content>The percentage of such veterans who found employment before the end of the fourth calendar quarter after exiting the program.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><content>The median earnings of all such veterans for the second quarter after exiting the program.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">“(4) </num><content>The percentage of such veterans who attain a recognized postsecondary credential during the 12-month period after exiting the program.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="j">“(j) </num><heading><inline class="smallCaps">Comptroller General Report</inline>.—</heading><content>Not later than 180 days after the termination of the retraining assistance program under subsection (l), the Comptroller General shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives a report on the outcomes and effectiveness of the program.”</content></subsection></quotedContent>;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d57673e258" identifier="/us/bill/117/hr/2523/s2/a/5" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="5">(5) </num><content>in subsection (l), as so redesignated, by <amendingAction type="delete">striking</amendingAction> “<quotedText>No retraining assistance may be paid under this section after the date that is 21 months after the date of the enactment of this Act</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>No retraining assistance may be paid under this section for a covered program of education that begins on or after December 11, 2022</quotedText>”;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d57673e269" identifier="/us/bill/117/hr/2523/s2/a/6" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="6">(6) </num><content>in subsection (m), as so redesignated, by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> the following: “<quotedText>, which shall be carried out as if such section were authorized for the payment of readjustment and rehabilitation benefits to or on behalf of veterans under chapters 30, 31, and 41 of <ref href="/us/usc/t38">title 38, United States Code</ref>. Not more than $386,000,000 may be obligated or expended to carry out this section.</quotedText>”; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d57673e283" identifier="/us/bill/117/hr/2523/s2/a/7" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="7">(7) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new subsection:<quotedContent><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="n">“(n) </num><heading><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>The term ‘<term>covered public health emergency</term>’ means the declaration—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><content>of a public health emergency, based on an outbreak of COVID–19 by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<ref href="/us/usc/t42/s247d">42 U.S.C. 247d</ref>); or</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><content>of a domestic emergency, based on an outbreak of COVID–19 by the President, the Secretary of Homeland Security, or State, or local authority.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>The term ‘<term>veteran</term>’ means—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><content>a person who served in the active military, naval, or air service, and who was discharged or released therefrom under conditions other than dishonorable; or</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><content>a member of a reserve component of the Armed Forces who performs active service for a period of 30 days or longer by reason of the covered public health emergency.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><content>The term ‘<term>active service</term>’ has the meaning given such term in <ref href="/us/usc/t10/s101">section 101 of title 10, United States Code</ref>.”</content></paragraph></subsection></quotedContent>.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d57673e337" identifier="/us/bill/117/hr/2523/s2/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Effective Date</inline>.—</heading><content>The amendments made by subsection (a) shall apply as if included in the enactment of the American Rescue Plan Act of 2021 (<ref href="/us/pl/117/2">Public Law 117–2</ref>).</content></subsection></section>
<section id="d57673e350" identifier="/us/bill/117/hr/2523/s3" style="-uslm-lc:I650141"><num value="3">SEC. 3. </num><heading>INFORMATION PROVIDED BY DEPARTMENT OF VETERANS AFFAIRS ABOUT POSTSECONDARY EDUCATIONAL INSTITUTIONS.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d57673e354" identifier="/us/bill/117/hr/2523/s3/a" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Additional Information To Be Provided</inline>.—</heading><chapeau>Subsection (c) of <ref href="/us/usc/t38/s3698">section 3698 of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d57673e369" identifier="/us/bill/117/hr/2523/s3/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in paragraph (1)(C)—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d57673e373" identifier="/us/bill/117/hr/2523/s3/a/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>in clause (xi), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d57673e381" identifier="/us/bill/117/hr/2523/s3/a/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>in clause (xii), by <amendingAction type="delete">striking</amendingAction> the period and <amendingAction type="insert">inserting</amendingAction> a semicolon; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d57673e392" identifier="/us/bill/117/hr/2523/s3/a/1/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new clauses:<quotedContent><clause class="indentUp2 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="xiii">“(xiii) </num><content>whether the institution is listed on the College Navigator website as affiliated with a religion and, if so, which religious denomination;</content></clause><clause class="indentUp2 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="xiv">“(xiv) </num><content>whether the Secretary of Education or other head of a department or agency of the Federal Government has determined that the institution is a minority serving institution and, if so, which one or more types of minority serving institutions; and</content></clause><clause class="indentUp2 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="xv">“(xv) </num><content>whether the institution is gender specific.”</content></clause></quotedContent>; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>not later than such time as the Secretary determines reasonable after the last date on which a student is able to withdraw from the course or program of education without penalty; and</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><content>each individual who is enrolled in a course or program of education and is receiving educational assistance under this chapter to submit to the Secretary verification of such enrollment for each month during which the individual is so enrolled and receiving such educational assistance.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><heading><inline class="smallCaps">Form of verification</inline>.—</heading><content>Verification under this subsection shall be in an electronic form prescribed by the Secretary.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><heading><inline class="smallCaps">Failure to submit verification</inline>.—</heading><content>If an individual fails to submit the verification required under paragraph (1)(B) for two consecutive months, the Secretary may not make a monthly housing stipend payment to the individual under this section until the individual submits such verification.”</content></paragraph></subsection></quotedContent>.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d57673e781" identifier="/us/bill/117/hr/2523/s7/a/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>Section 3673A, as added by section 1013 of such Act, <amendingAction type="amend">is amended</amendingAction>—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d57673e789" identifier="/us/bill/117/hr/2523/s7/a/3/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>in subsection (a), by <amendingAction type="delete">striking</amendingAction> “<quotedText>searchable</quotedText>”; <section id="d57673e919" identifier="/us/bill/117/hr/2523/s8" style="-uslm-lc:I650141"><num value="8">SEC. 8. </num><heading>DETERMINATION OF BUDGETARY EFFECTS.</heading><content style="-uslm-lc:I650120">  The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled “Budgetary Effects of PAYGO Legislation” for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</content></section>
