<section id="d39783e172" identifier="/us/bill/115/hr/3445/tI/s101" style="-uslm-lc:I650143"><num value="101">SEC. 101. </num><heading>STATEMENT OF POLICY.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  It is the policy of the United States to support efforts to—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e178" identifier="/us/bill/115/hr/3445/tI/s101/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>improve the rule of law, promote free and fair elections, strengthen and expand the private sector, and fight corruption in sub-Saharan Africa; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e182" identifier="/us/bill/115/hr/3445/tI/s101/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>promote the role of women in social, political, and economic development in sub-Saharan Africa.</content></paragraph></section>
<section id="d39783e187" identifier="/us/bill/115/hr/3445/tI/s102" style="-uslm-lc:I650143"><num value="102">SEC. 102. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  In this title—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e193" identifier="/us/bill/115/hr/3445/tI/s102/1" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Agoa website</inline>.—</heading><content>The term “<term>AGOA Website</term>” means the website established pursuant to section 103(a).</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e201" identifier="/us/bill/115/hr/3445/tI/s102/2" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Eligible sub-saharan african country</inline>.—</heading><content>The term “<term>eligible sub-Saharan African country</term>” means a country that the President has determined meets the eligibility requirements set forth in section 104 of the African Growth and Opportunity Act (<ref href="/us/usc/t19/s3703">19 U.S.C. 3703</ref>).</content></paragraph></section>
<section id="d39783e214" identifier="/us/bill/115/hr/3445/tI/s103" style="-uslm-lc:I650143"><num value="103">SEC. 103. </num><heading>ACTIVITIES IN SUPPORT OF TRANSPARENCY.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d39783e218" identifier="/us/bill/115/hr/3445/tI/s103/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">AGOA Website</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e225" identifier="/us/bill/115/hr/3445/tI/s103/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>The President shall establish a publicly available website for the collection and dissemination of information regarding the African Growth and Opportunity Act (<ref href="/us/usc/t19/s3701/etseq">19 U.S.C. 3701 et seq.</ref>).</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e237" identifier="/us/bill/115/hr/3445/tI/s103/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Contents</inline>.—</heading><chapeau>The President shall publish on the AGOA Website the information described in paragraph (1), including—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d39783e245" identifier="/us/bill/115/hr/3445/tI/s103/a/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>information and technical assistance provided at United States Agency for International Development regional trade hubs; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d39783e249" identifier="/us/bill/115/hr/3445/tI/s103/a/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>a link to the websites of United States embassies located in eligible sub-Saharan African countries.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e253" identifier="/us/bill/115/hr/3445/tI/s103/a/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><heading><inline class="smallCaps">Actions by united states embassies</inline>.—</heading><chapeau>The Secretary of State should direct United States embassies located in eligible sub-Saharan African countries to—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d39783e261" identifier="/us/bill/115/hr/3445/tI/s103/a/3/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>encourage individuals and businesses in such countries to use the benefits available under the African Growth and Opportunity Act; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d39783e265" identifier="/us/bill/115/hr/3445/tI/s103/a/3/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>include a link to the AGOA Website on the websites of such diplomatic missions.</content></subparagraph></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d39783e269" identifier="/us/bill/115/hr/3445/tI/s103/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">AGOA Forum</inline>.—</heading><chapeau>After each meeting of the United States–Sub-Saharan Africa Trade and Economic Cooperation Forum, the President should publish on the AGOA Website the following:</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e277" identifier="/us/bill/115/hr/3445/tI/s103/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>The outcomes of the meeting of the Forum, including any commitments made by member countries and the private sector.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e281" identifier="/us/bill/115/hr/3445/tI/s103/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>An assessment of progress made with respect to any commitments made by member countries and the private sector from the previous meeting of the Forum.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d39783e285" identifier="/us/bill/115/hr/3445/tI/s103/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Other Information</inline>.—</heading><content>The President should disseminate the information required under this section in a digital format to the public and publish such information on the AGOA Website.</content></subsection></section>
<section id="d39783e294" identifier="/us/bill/115/hr/3445/tI/s104" style="-uslm-lc:I650143"><num value="104">SEC. 104. </num><heading>ACTIVITIES IN SUPPORT OF TRADE CAPACITY BUILDING.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  The President should—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e300" identifier="/us/bill/115/hr/3445/tI/s104/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>develop and implement policies that—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d39783e304" identifier="/us/bill/115/hr/3445/tI/s104/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>encourage and facilitate cross-boundary cooperation among eligible sub-Saharan African countries in order to facilitate trade; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d39783e308" identifier="/us/bill/115/hr/3445/tI/s104/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>encourage the provision of technical assistance to eligible sub-Saharan African countries to establish and sustain adequate trade capacity development;</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e312" identifier="/us/bill/115/hr/3445/tI/s104/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>provide specific training for businesses in eligible sub-Saharan African countries and government trade officials of such countries on accessing the benefits under the African Growth and Opportunity Act and other trade preference programs;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e316" identifier="/us/bill/115/hr/3445/tI/s104/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>provide capacity building for African entrepreneurs and trade associations on production strategies, quality standards, formation of cooperatives, market research, and market development;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e320" identifier="/us/bill/115/hr/3445/tI/s104/4" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><content>provide capacity building training to promote diversification of African products and value-added processing; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e324" identifier="/us/bill/115/hr/3445/tI/s104/5" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="5">(5) </num><content>provide capacity building and technical assistance funding for African businesses and institutions to help such businesses and institutions comply with United States counterterrorism initiatives and policies.</content></paragraph></section>

and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e400" identifier="/us/bill/115/hr/3445/tII/s201/a/4" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><content>by <amendingAction type="insert">inserting</amendingAction> after paragraph (2) the following:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><heading><inline class="smallCaps">Fiscal year 2013 and subsequent fiscal years</inline>.—</heading><chapeau>A country shall be a candidate country for purposes of eligibility for assistance for fiscal year 2013 or a subsequent fiscal year if the country—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><content>has a per capita income not greater than the lower middle income country threshold established by the International Bank for Reconstruction and Development for such fiscal year;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><content>is among the 75 countries identified by the International Bank for Reconstruction and Development as having the lowest per capita income; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">“(C) </num><content>meets the requirements under paragraph (1)(B).”</content></subparagraph></paragraph></quotedContent>.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d39783e430" identifier="/us/bill/115/hr/3445/tII/s201/b" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Lower Middle Income Countries</inline>.—</heading><chapeau>Section 606(b) of the Millennium Challenge Act of 2003 (<ref href="/us/usc/t22/s7705/b">22 U.S.C. 7705(b)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e445" identifier="/us/bill/115/hr/3445/tII/s201/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in paragraph (1)—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d39783e449" identifier="/us/bill/115/hr/3445/tII/s201/b/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="amend">amending</amendingAction> the paragraph heading to read as follows: “<quotedText><headingText class="smallCaps">Fiscal years 2006 through 2012</headingText></quotedText>”; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e479" identifier="/us/bill/115/hr/3445/tII/s201/b/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="insert">inserting</amendingAction> after paragraph (1) the following:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><heading><inline class="smallCaps">Fiscal year 2013 and subsequent fiscal years</inline>.—</heading><chapeau>In addition to the countries described in subsection (a), a country shall be a candidate country for purposes of eligibility for assistance for fiscal year 2013 or a subsequent fiscal year if the country—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><content>has a per capita income not greater than the lower middle income country threshold established by the International Bank for Reconstruction and Development for the fiscal year;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><content>is not among the 75 countries identified by the International Bank for Reconstruction and Development as having the lowest per capita income; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">“(C) </num><content>meets the requirements under subsection (a)(1)(B).”</content></subparagraph></paragraph></quotedContent>.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d39783e509" identifier="/us/bill/115/hr/3445/tII/s201/c" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Reclassification</inline>.—</heading><chapeau>Section 606 of the Millennium Challenge Act of 2003 (<ref href="/us/usc/t22/s7705">22 U.S.C. 7705</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e524" identifier="/us/bill/115/hr/3445/tII/s201/c/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsection (c) as subsection (d); and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e532" identifier="/us/bill/115/hr/3445/tII/s201/c/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (b) the following:<quotedContent><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">“(c) </num><heading><inline class="smallCaps">Treatment of Countries With Per Capita Income Changes</inline>.—</heading><content>A country qualifying for candidate status under this section with a per capita income that changes during the fiscal year such that the country would be reclassified from a low income country to a lower middle income country or from a lower middle income country to a low income country shall retain its candidacy status in its former income classification for such fiscal year and the 2 subsequent fiscal years.”</content></subsection></quotedContent>.</content></paragraph></subsection></section>
<section id="d39783e551" identifier="/us/bill/115/hr/3445/tII/s202" role="instruction" style="-uslm-lc:I650143"><num value="202">SEC. 202. </num><heading>CARRYOVER AUTHORITY FOR PRIVATE-SECTOR MEMBERS OF BOARD OF DIRECTORS.</heading><content class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Section 604(c)(4)(B) of the Millennium Challenge Act of 2003 (<ref href="/us/usc/t22/s7703/c/4/B">22 U.S.C. 7703(c)(4)(B)</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><subparagraph class="indentUp2 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><heading><inline class="smallCaps">Other members</inline>.—</heading><chapeau>Each member of the Board described in paragraph (3)(B)—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>shall be appointed for a term of 3 years;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>may be reappointed for a term of an additional 2 years; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">“(iii) </num><chapeau>may continue to serve in each such appointment until the earlier of—</chapeau><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>the date on which his or her successor is appointed; or</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="II">“(II) </num><content>the date that is 1 year after the expiration of his or her appointment or reappointment, as the case may be.”</content></subclause></clause></subparagraph></quotedContent>.</content></section>
<section id="d39783e595" identifier="/us/bill/115/hr/3445/tII/s203" role="instruction" style="-uslm-lc:I650143"><num value="203">SEC. 203. </num><heading>ADDITIONAL REPORTING TO THE BOARD ON THE TREATMENT OF CIVIL SOCIETY IN AN ELIGIBLE COUNTRY.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Section 607 of the Millennium Challenge Act of 2003 (<ref href="/us/usc/t22/s7706">22 U.S.C. 7706</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e607" identifier="/us/bill/115/hr/3445/tII/s203/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (a), by <amendingAction type="add">adding</amendingAction> at the end the following: “<quotedText>A determination whether a country is eligible for a subsequent, non-concurrent Millennium Challenge Compact shall also be based, to the extent practicable, on significantly improved performance across the criteria in subsection (b) that, at a minimum, are relevant to the preceding Compact, compared to the country’s performance with respect to such criteria when selected for such preceding Compact.</quotedText>”</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e615" identifier="/us/bill/115/hr/3445/tII/s203/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in subsection (b)(1)—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d39783e619" identifier="/us/bill/115/hr/3445/tII/s203/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>in subparagraph (D), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d39783e627" identifier="/us/bill/115/hr/3445/tII/s203/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>in subparagraph (E), by <amendingAction type="add">adding</amendingAction> “<quotedText>and</quotedText>” at the end; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d39783e635" identifier="/us/bill/115/hr/3445/tII/s203/2/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subparagraph class="indentUp2 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="F">“(F) </num><content>the quality of the civil society enabling environment;”</content></subparagraph></quotedContent>;</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e649" identifier="/us/bill/115/hr/3445/tII/s203/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsections (d) and (e) as subsections (e) and (f), respectively; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e657" identifier="/us/bill/115/hr/3445/tII/s203/4" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (c) the following:<quotedContent><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="d">“(d) </num><heading><inline class="smallCaps">Reporting on Treatment of Civil Society</inline>.—</heading><chapeau>For the 7-year period beginning on the date of the enactment of this subsection, before the Board selects an eligible country for a Compact under subsection (c), the Corporation shall provide information to the Board regarding the country’s treatment of civil society, including classified information, as appropriate. The information shall include an assessment and analysis of factors including—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><content>any relevant laws governing the formation or establishment of a civil society organization, particularly laws intended to curb the activities of foreign civil society organizations;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><content>any relevant laws governing the operations of a civil society organization, particularly those laws seeking to define or otherwise regulate the actions of foreign civil society organizations;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><content>laws relating to the legal status of civil society organizations, including laws which effectively discriminate against foreign civil society organizations as compared to similarly situated domestic organizations;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">“(4) </num><content>laws regulating the freedom of expression and peaceful assembly; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="5">“(5) </num><content>laws regulating the usage of the Internet, particularly by foreign civil society organizations.”</content></paragraph></subsection></quotedContent>.</content></paragraph></section>
<section id="d39783e696" identifier="/us/bill/115/hr/3445/tII/s204" style="-uslm-lc:I650143"><num value="204">SEC. 204. </num><heading>CONCURRENT COMPACTS UNDER THE MILLENNIUM CHALLENGE ACT OF 2003.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d39783e700" identifier="/us/bill/115/hr/3445/tII/s204/a" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 609 of the Millennium Challenge Act of 2003 (<ref href="/us/usc/t22/s7708">22 U.S.C. 7708</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e715" identifier="/us/bill/115/hr/3445/tII/s204/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> the first sentence of subsection (k);</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e723" identifier="/us/bill/115/hr/3445/tII/s204/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsection (k) (as so amended) as subsection (l); and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e731" identifier="/us/bill/115/hr/3445/tII/s204/a/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (j) the following:<quotedContent><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="k">“(k) </num><heading><inline class="smallCaps">Concurrent Compacts</inline>.—</heading><chapeau>An eligible country that has entered into and has in effect a Compact under this section may enter into and have in effect at the same time not more than one additional Compact in accordance with the requirements of this title if—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><content>one or both of the Compacts are or will be for purposes of regional economic integration, increased regional trade, or cross-border collaborations; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><content>the Board determines that the country is making considerable and demonstrable progress in implementing the terms of the existing Compact and supplementary agreements thereto.”</content></paragraph></subsection></quotedContent>.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d39783e757" identifier="/us/bill/115/hr/3445/tII/s204/b" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Conforming Amendment</inline>.—</heading><content>Section 613(b)(2)(A) of such Act (<ref href="/us/usc/t22/s7712/b/2/A">22 U.S.C. 7712(b)(2)(A)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>the</quotedText>” before “<quotedText>Compact</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>any</quotedText>”.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d39783e778" identifier="/us/bill/115/hr/3445/tII/s204/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Applicability</inline>.—</heading><content>The amendments made by this section apply with respect to Compacts entered into between the United States and an eligible country under the Millennium Challenge Act of 2003 before, on, or after the date of the enactment of this Act.</content></subsection></section>
<section id="d39783e788" identifier="/us/bill/115/hr/3445/tII/s205" role="instruction" style="-uslm-lc:I650143"><num value="205">SEC. 205. </num><heading>PUBLIC NOTIFICATION OF ENTERING INTO A COMPACT.</heading><content class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Section 610 of the Millennium Challenge Act of 2003 (<ref href="/us/usc/t22/s7709">22 U.S.C. 7709</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><section style="-uslm-lc:I650143"><num value="610">“SEC. 610. </num><heading>CONGRESSIONAL AND PUBLIC NOTIFICATION.</heading><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">“(a) </num><heading><inline class="smallCaps">Congressional Consultations and Notifications</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>The Board, acting through the Chief Executive Officer, shall consult with and notify the appropriate congressional committees not later than 15 days before taking any of the actions described in paragraph (2).</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><heading><inline class="smallCaps">Actions described</inline>.—</heading><chapeau>The actions described in this paragraph are—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><content>providing assistance for an eligible country under section 609(g);</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>commencing negotiations with an eligible country to provide assistance for—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>a Compact under section 605; or</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>an agreement under section 616;</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">“(C) </num><content>signing such a Compact or agreement; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="D">“(D) </num><content>terminating assistance under such a Compact or agreement.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><heading><inline class="smallCaps">Economic justification</inline>.—</heading><chapeau>Any notification relating to the intent to negotiate or sign a Compact shall include a report describing the projected economic justification for the Compact, including, as applicable—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><content>the expected economic rate of return of the Compact;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><content>a cost-benefit analysis of the Compact;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">“(C) </num><content>a description of the impact on beneficiary populations;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="D">“(D) </num><content>the likelihood that the investment will catalyze private sector investments; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="E">“(E) </num><content>any other applicable economic factors that justify each project to be funded under such a Compact to the extent practicable and appropriate.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">“(4) </num><heading><inline class="smallCaps">Risk management plan</inline>.—</heading><chapeau>Not later than 60 days before signing each concurrent Compact, as authorized under section 609, the Board, acting through the Chief Executive Officer, shall consult with and provide to the appropriate congressional committees—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>an assessment and, as appropriate, the identification of potential measures to mitigate risks, of—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>the countries’ commitment to regional integration and cross-border cooperation and capacity to carry out commitments;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>political and policy risks, including risks that could affect country eligibility;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>risks associated with realizing economic returns;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>time and completion risks; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="v">“(v) </num><content>cost and financial risks; and</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>an assessment of measures to be taken to mitigate any identified risks, including—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>securing other potential donors to finance projects or parts of projects as needed; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>partnering with regional organizations to support and oversee effective cross-border cooperation.</content></clause></subparagraph></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">“(b) </num><heading><inline class="smallCaps">Congressional and Public Notification After Entering Into a Compact</inline>.—</heading><chapeau>Not later than 10 days after entering into a Compact with an eligible country, the Board, acting through the Chief Executive Officer, shall—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><content>publish the text of the Compact on the website of the Corporation;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><content>provide the appropriate congressional committees with a detailed summary of the Compact and, upon request, the text of the Compact; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><content>publish in the Federal Register a detailed summary of the Compact and a notice of availability of the text of the Compact on the website of the Corporation.”</content></paragraph></subsection></section>

<section id="d39783e948" identifier="/us/bill/115/hr/3445/tII/s206" style="-uslm-lc:I650143"><num value="206">SEC. 206. </num><heading>DISCLOSURE.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d39783e952" identifier="/us/bill/115/hr/3445/tII/s206/a" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Requirement for Timely Disclosure</inline>.—</heading><chapeau>Section 612(a) of the Millennium Challenge Act of 2003 (<ref href="/us/usc/t22/s7711/a">22 U.S.C. 7711(a)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e967" identifier="/us/bill/115/hr/3445/tII/s206/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>in the subsection heading, by <amendingAction type="insert">inserting</amendingAction> “<quotedText><headingText class="smallCaps">Timely</headingText></quotedText>” before “<quotedText><headingText class="smallCaps">Disclosure</headingText></quotedText>”; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e981" identifier="/us/bill/115/hr/3445/tII/s206/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in the matter preceding paragraph (1)—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d39783e985" identifier="/us/bill/115/hr/3445/tII/s206/a/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>The Corporation</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>Not later than 90 days after the last day of each fiscal quarter, the Corporation</quotedText>”; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d39783e996" identifier="/us/bill/115/hr/3445/tII/s206/a/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>on at least a quarterly basis,</quotedText>”.</content></subparagraph></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d39783e1004" identifier="/us/bill/115/hr/3445/tII/s206/b" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Dissemination</inline>.—</heading><content>Section 612(b) of the Millennium Challenge Act of 2003 (<ref href="/us/usc/t22/s7711/b">22 U.S.C. 7711(b)</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">“(b) </num><heading><inline class="smallCaps">Dissemination</inline>.—</heading><chapeau>The Board, acting through the Chief Executive Officer, shall make the information required to be disclosed under subsection (a) available to the public—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><content>by publishing it on the website of the Corporation;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><content>by providing notice of the availability of such information in the Federal Register; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><content>by any other methods that the Board determines to be appropriate.”</content></paragraph></subsection></quotedContent>.</content></subsection></section>
<section id="d39783e1042" identifier="/us/bill/115/hr/3445/tII/s207" role="instruction" style="-uslm-lc:I650143"><num value="207">SEC. 207. </num><heading>RESTRICTION ON THE USE OF ASSISTANCE UNDER SECTION 616.</heading><content class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Section 616(d) of the Millennium Challenge Act of 2003 (<ref href="/us/usc/t22/s7715/d">22 U.S.C. 7715(d)</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="d">“(d) </num><heading><inline class="smallCaps">Funding</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><heading><inline class="smallCaps">Limitation</inline>.—</heading><content>Not more than 10 percent of the amounts made available to carry out this Act for a fiscal year may be made available to carry out this section.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><heading><inline class="smallCaps">Restriction relating to assistance</inline>.—</heading><content>None of the funds authorized to carry out the purposes of this Act shall be available for assistance under this section to a country that does not qualify as a candidate country under section 606 for the fiscal year during which such assistance is provided.”</content></paragraph></subsection></quotedContent>.</content></section>
<section id="d39783e1081" identifier="/us/bill/115/hr/3445/tII/s208" style="-uslm-lc:I650143"><num value="208">SEC. 208. </num><heading>STUDY ON SUBNATIONAL COMPACTS.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d39783e1085" identifier="/us/bill/115/hr/3445/tII/s208/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><content>Not later than 180 days after the date of the enactment of this Act, the Board of the Millennium Challenge Corporation, acting through the Chief Executive Officer, shall submit a study to the appropriate congressional committees that assesses the feasibility and desirability of developing partnerships at the subnational level within candidate countries that would be complementary to, and, as applicable, concurrent with, any Millennium Challenge Corporation national-level or regional investments.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d39783e1093" identifier="/us/bill/115/hr/3445/tII/s208/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Content</inline>.—</heading><chapeau>The study required under subsection (a) shall examine—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e1101" identifier="/us/bill/115/hr/3445/tII/s208/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>the extent to which targeting investments at the subnational level might provide new opportunities for reducing poverty through economic growth;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e1105" identifier="/us/bill/115/hr/3445/tII/s208/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>the extent to which traditional approaches to defining poverty may not adequately capture the nature of poverty within a country;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e1109" identifier="/us/bill/115/hr/3445/tII/s208/b/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>the types of subnational entities that might be appropriate partners for subnational Millennium Challenge Corporation compacts;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e1113" identifier="/us/bill/115/hr/3445/tII/s208/b/4" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><content>how candidates for subnational partners might best be identified; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e1117" identifier="/us/bill/115/hr/3445/tII/s208/b/5" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="5">(5) </num><content>what role each national government should play in creating or implementing a subnational partnership.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d39783e1121" identifier="/us/bill/115/hr/3445/tII/s208/c" role="definitions" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Appropriate Congressional Committees</inline>.—</heading><chapeau>In this subsection, the term “<term>appropriate congressional committees</term>” means—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e1129" identifier="/us/bill/115/hr/3445/tII/s208/c/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>the Committee on Foreign Relations of the Senate;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e1133" identifier="/us/bill/115/hr/3445/tII/s208/c/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>the Committee on Appropriations of the Senate;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e1137" identifier="/us/bill/115/hr/3445/tII/s208/c/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>the Committee on Foreign Affairs of the House of Representatives; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d39783e1141" identifier="/us/bill/115/hr/3445/tII/s208/c/4" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><content>the Committee on Appropriations of the House of Representatives.</content></paragraph></subsection></section>
