<section id="d55366e62" identifier="/us/bill/114/s/1550/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Program Management Improvement Accountability Act</shortTitle>”.</content></section>
<section id="d55366e72" identifier="/us/bill/114/s/1550/s2" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>PROJECT MANAGEMENT.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d55366e76" identifier="/us/bill/114/s/1550/s2/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Deputy Director for Management</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d55366e83" identifier="/us/bill/114/s/1550/s2/a/1" role="instruction" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Additional functions</inline>.—</heading><content><ref href="/us/usc/t31/s503">Section 503 of title 31, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">“(c) </num><heading><inline class="smallCaps">Program and Project Management</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><heading><inline class="smallCaps">Requirement</inline>.—</heading><chapeau>Subject to the direction and approval of the Director, the Deputy Director for Management or a designee shall—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><content>adopt governmentwide standards, policies, and guidelines for program and project management for executive agencies;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><content>oversee implementation of program and project management for the standards, policies, and guidelines established under subparagraph (A);</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">“(C) </num><content>chair the Program Management Policy Council established under section 1126(b);</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="D">“(D) </num><content>establish standards and policies for executive agencies, consistent with widely accepted standards for program and project management planning and delivery;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="E">“(E) </num><content>engage with the private sector to identify best practices in program and project management that would improve Federal program and project management;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="F">“(F) </num><content>conduct portfolio reviews to address programs identified as high risk by the Government Accountability Office;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="G">“(G) </num><content>not less than annually, conduct portfolio reviews of agency programs in coordination with Project Management Improvement Officers designated under section 1126(a)(1) to assess the quality and effectiveness of program management; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="H">“(H) </num><content>establish a 5-year strategic plan for program and project management.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><heading><inline class="smallCaps">Application to department of defense</inline>.—</heading><chapeau>Paragraph (1) shall not apply to the Department of Defense to the extent that the provisions of that paragraph are substantially similar to or duplicative of—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><content>the provisions of chapter 87 of title 10; or</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><content>policy, guidance, or instruction of the Department related to program management.”</content></subparagraph></paragraph></subsection></quotedContent>.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d55366e165" identifier="/us/bill/114/s/1550/s2/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Deadline for standards, policies, and guidelines</inline>.—</heading><content>Not later than 1 year after the date of enactment of this Act, the Deputy Director for Management of the Office of Management and Budget shall issue the standards, policies, and guidelines required under <ref href="/us/usc/t31/s503/c">section 503(c) of title 31, United States Code</ref>, as added by paragraph (1).</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d55366e177" identifier="/us/bill/114/s/1550/s2/a/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><heading><inline class="smallCaps">Regulations</inline>.—</heading><content>Not later than 90 days after the date on which the standards, policies, and guidelines are issued under paragraph (2), the Deputy Director for Management of the Office of Management and Budget, in consultation with the Program Management Policy Council established under <ref href="/us/usc/t31/s1126/b">section 1126(b) of title 31, United States Code</ref>, as added by subsection (b)(1), and the Director of the Office of Management and Budget, shall issue any regulations as are necessary to implement the requirements of <ref href="/us/usc/t31/s503/c">section 503(c) of title 31, United States Code</ref>, as added by paragraph (1).</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d55366e192" identifier="/us/bill/114/s/1550/s2/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Program Management Improvement Officers and Program Management Policy Council</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d55366e199" identifier="/us/bill/114/s/1550/s2/b/1" role="instruction" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Amendment</inline>.—</heading><content><ref href="/us/usc/t31/ch11">Chapter 11 of title 31, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section style="-uslm-lc:I650164"><num value="1126">“§ 1126.</num><heading> Program management improvement officers and program management policy council</heading><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">“(a) </num><heading><inline class="smallCaps">Program Management Improvement Officers</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><heading><inline class="smallCaps">Designation</inline>.—</heading><content>The head of each agency described in section 901(b) shall designate a senior executive of the agency as the Program Management Improvement Officer of the agency.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><heading><inline class="smallCaps">Functions</inline>.—</heading><chapeau>The Program Management Improvement Officer of an agency designated under paragraph (1) shall—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><content>implement program management policies established by the agency under section 503(c); and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>develop a strategy for enhancing the role of program managers within the agency that includes the following:</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>Enhanced training and educational opportunities for program managers that shall include—</chapeau><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>training in the relevant competencies encompassed with program and project manager within the private sector for program managers; and</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="II">“(II) </num><content>training that emphasizes cost containment for large projects and programs.</content></subclause></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>Mentoring of current and future program managers by experienced senior executives and program managers within the agency.</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>Improved career paths and career opportunities for program managers.</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>A plan to encourage the recruitment and retention of highly qualified individuals to serve as program managers.</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="v">“(v) </num><content>Improved means of collecting and disseminating best practices and lessons learned to enhance program management across the agency.</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="vi">“(vi) </num><content>Common templates and tools to support improved data gathering and analysis for program management and oversight purposes.</content></clause></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><heading><inline class="smallCaps">Application to department of defense</inline>.—</heading><content>This subsection shall not apply to the Department of Defense to the extent that the provisions of this subsection are substantially similar to or duplicative of the provisions of chapter 87 of title 10. For purposes of paragraph (1), the Under Secretary of Defense for Acquisition, Technology, and Logistics (or a designee of the Under Secretary) shall be considered the Program Management Improvement Officer.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">“(b) </num><heading><inline class="smallCaps">Program Management Policy Council</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><heading><inline class="smallCaps">Establishment</inline>.—</heading><content>There is established in the Office of Management and Budget a council to be known as the ‘Program Management Policy Council’ (in this subsection referred to as the ‘Council’).</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><heading><inline class="smallCaps">Purpose and functions</inline>.—</heading><chapeau>The Council shall act as the principal interagency forum for improving agency practices related to program and project management. The Council shall—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><content>advise and assist the Deputy Director for Management of the Office of Management and Budget;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><content>review programs identified as high risk by the General Accountability Office and make recommendations for actions to be taken by the Deputy Director for Management of the Office of Management and Budget or a designee;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>discuss topics of importance to the workforce, including—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>career development and workforce development needs;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>policy to support continuous improvement in program and project management; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>major challenges across agencies in managing programs;</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="D">“(D) </num><content>advise on the development and applicability of standards governmentwide for program management transparency; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="E">“(E) </num><content>review the information published on the website of the Office of Management and Budget pursuant to section 1122.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><heading><inline class="smallCaps">Membership</inline>.—</heading><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><heading><inline class="smallCaps">Composition</inline>.—</heading><chapeau>The Council shall be composed of the following members:</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>Five members from the Office of Management and Budget as follows:</chapeau><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>The Deputy Director for Management.</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="II">“(II) </num><content>The Administrator of the Office of Electronic Government.</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="III">“(III) </num><content>The Administrator of Federal Procurement Policy.</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>The Controller of the Office of Federal Financial Management.</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="V">“(V) </num><content>The Director of the Office of Performance and Personnel Management.</content></subclause></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>The Program Management Improvement Officer from each agency described in section 901(b).</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>Any other full-time or permanent part-time officer or employee of the Federal Government or member of the Armed Forces designated by the Chairperson.</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><heading><inline class="smallCaps">Chairperson and vice chairperson</inline>.—</heading><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>The Deputy Director for Management of the Office of Management and Budget shall be the Chairperson of the Council. A Vice Chairperson shall be elected by the members and shall serve a term of not more than 1 year.</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading><inline class="smallCaps">Duties</inline>.—</heading><content>The Chairperson shall preside at the meetings of the Council, determine the agenda of the Council, direct the work of the Council, and establish and direct subgroups of the Council as appropriate.</content></clause></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">“(4) </num><heading><inline class="smallCaps">Meetings</inline>.—</heading><content>The Council shall meet not less than twice per fiscal year and may meet at the call of the Chairperson or a majority of the members of the Council.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="5">“(5) </num><heading><inline class="smallCaps">Support</inline>.—</heading><content>The head of each agency with a Project Management Improvement Officer serving on the Council shall provide administrative support to the Council, as appropriate, at the request of the Chairperson.”</content></paragraph></subsection></section>
</quotedContent>.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d55366e435" identifier="/us/bill/114/s/1550/s2/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Report required</inline>.—</heading><content>Not later than 1 year after the date of enactment of this Act, the Director of the Office of Management and Budget, in consultation with each Program Management Improvement Officer designated under <ref href="/us/usc/t31/s1126/a/1">section 1126(a)(1) of title 31, United States Code</ref>, shall submit to Congress a report containing the strategy developed under section 1126(a)(2)(B) of such title, as added by paragraph (1).</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d55366e447" identifier="/us/bill/114/s/1550/s2/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Program and Project Management Personnel Standards</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d55366e454" identifier="/us/bill/114/s/1550/s2/c/1" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Definition</inline>.—</heading><content>In this subsection, the term “<term>agency</term>” means each agency described in <ref href="/us/usc/t31/s901/b">section 901(b) of title 31, United States Code</ref>, other than the Department of Defense.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d55366e466" identifier="/us/bill/114/s/1550/s2/c/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Regulations required</inline>.—</heading><chapeau>Not later than 180 days after the date on which the standards, policies, and guidelines are issued under <ref href="/us/usc/t31/s503/c">section 503(c) of title 31, United States Code</ref>, as added by subsection (a)(1), the Director of the Office of Personnel Management, in consultation with the Director of the Office of Management and Budget, shall issue regulations that—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d55366e478" identifier="/us/bill/114/s/1550/s2/c/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>identify key skills and competencies needed for a program and project manager in an agency;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d55366e482" identifier="/us/bill/114/s/1550/s2/c/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>establish a new job series, or update and improve an existing job series, for program and project management within an agency; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d55366e486" identifier="/us/bill/114/s/1550/s2/c/2/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content>establish a new career path for program and project managers within an agency.</content></subparagraph></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d55366e490" identifier="/us/bill/114/s/1550/s2/d" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="d">(d) </num><heading><inline class="smallCaps">Gao Report on Effectiveness of Policies on Program and Project Management</inline>.—</heading><chapeau>Not later than 3 years after the date of enactment of this Act, the Government Accountability Office shall issue, in conjunction with the High Risk list of the Government Accountability Office, a report examining the effectiveness of the following on improving Federal program and project management:</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d55366e498" identifier="/us/bill/114/s/1550/s2/d/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>The standards, policies, and guidelines for program and project management issued under <ref href="/us/usc/t31/s503/c">section 503(c) of title 31, United States Code</ref>, as added by subsection (a)(1).</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d55366e506" identifier="/us/bill/114/s/1550/s2/d/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>The 5-year strategic plan established under <ref href="/us/usc/t31/s503/c/1/H">section 503(c)(1)(H) of title 31, United States Code</ref>, as added by subsection (a)(1).</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d55366e514" identifier="/us/bill/114/s/1550/s2/d/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>Program Management Improvement Officers designated under <ref href="/us/usc/t31/s1126/a/1">section 1126(a)(1) of title 31, United States Code</ref>, as added by subsection (b)(1).</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d55366e522" identifier="/us/bill/114/s/1550/s2/d/4" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><content>The Program Management Policy Council established under <ref href="/us/usc/t31/s1126/b/1">section 1126(b)(1) of title 31, United States Code</ref>, as added by subsection (b)(1).</content></paragraph></subsection></section>
