<resolvingClause class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Resolved by the House of Representatives (the Senate concurring),</resolvingClause>
<section class="inline">
<chapeau> That in the enrollment of S. 178, an Act to provide justice for the victims of trafficking, the Secretary of the Senate shall—</chapeau>
<paragraph class="indentUp1 firstIndent1 fontsize10" id="d127127e71" identifier="/us/resolution/114/hconres/47/s/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>in section 702(b)(2), insert “pilot program” after “identified by the”; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d127127e75" identifier="/us/resolution/114/hconres/47/s/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>strike section 1002 and insert the following:</content></paragraph></section>
<section id="d127127e80" identifier="/us/resolution/114/hconres/47/s1002" role="instruction" style="-uslm-lc:I650172"><num value="1002">SEC. 1002. </num><heading>PROTECTIONS FOR HUMAN TRAFFICKING SURVIVORS.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Section 1701(c) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t42/s3796dd/c">42 U.S.C. 3796dd(c)</ref>), as amended by section 601 of this Act, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d127127e92" identifier="/us/resolution/114/hconres/47/s1002/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>in paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>or</quotedText>” at the end;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d127127e100" identifier="/us/resolution/114/hconres/47/s1002/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>in paragraph (2)(C), by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; or</quotedText>”; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d127127e111" identifier="/us/resolution/114/hconres/47/s1002/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="insert">inserting</amendingAction> after paragraph (2) the following:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><chapeau>from an applicant in a State that has in effect a law—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>that—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>provides a process by which an individual who is a human trafficking survivor can move to vacate any arrest or conviction records for a non-violent offense committed as a direct result of human trafficking, including prostitution or lewdness;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>establishes a rebuttable presumption that any arrest or conviction of an individual for an offense associated with human trafficking is a result of being trafficked, if the individual—</chapeau><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>is a person granted nonimmigrant status pursuant to section 101(a)(15)(T)(i) of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1101/a/15/T/i">8 U.S.C. 1101(a)(15)(T)(i)</ref>);</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="II">“(II) </num><content>is the subject of a certification by the Secretary of Health and Human Services under section 107(b)(1)(E) of the Trafficking Victims Protection Act of 2000 (<ref href="/us/usc/t22/s7105/b/1/E">22 U.S.C. 7105(b)(1)(E)</ref>); or</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="III">“(III) </num><content>has other similar documentation of trafficking, which has been issued by a Federal, State, or local agency; and</content></subclause></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>protects the identity of individuals who are human trafficking survivors in public and court records; and</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><content>that does not require an individual who is a human trafficking survivor to provide official documentation as described in subclause (I), (II), or (III) of subparagraph (A)(ii) in order to receive protection under the law.”</content></subparagraph></paragraph></quotedContent>.</content></paragraph></section>
