<enactingFormula style="-uslm-lc:I650120">  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</enactingFormula>
<section id="d138062e62" identifier="/us/bill/113/hr/5057/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">EPS Service Parts Act of 2014</shortTitle>”.</content></section>
<section id="d138062e72" identifier="/us/bill/113/hr/5057/s2" role="instruction" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>EXEMPT SUPPLIES.</heading><content class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Section 325(u) of the Energy Policy and Conservation Act (<ref href="/us/usc/t42/s6295/u">42 U.S.C. 6295(u)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="5">“(5) </num><heading><inline class="smallCaps">Exempt supplies</inline>.—</heading><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><heading><inline class="smallCaps">February 10, 2014, rule</inline>.—</heading><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><heading><inline class="smallCaps">In general</inline>.—</heading><chapeau>An external power supply shall not be subject to the final rule entitled ‘Energy Conservation Program: Energy Conservation Standards for External Power Supplies’, published at <ref href="/us/fr/79/7845">79 Fed. Reg. 7845</ref> (February 10, 2014), if the external power supply—</chapeau><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>is manufactured during the period beginning on February 10, 2016, and ending on February 10, 2020;</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="II">“(II) </num><content>is marked in accordance with the External Power Supply International Efficiency Marking Protocol, as in effect on February 10, 2016;</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="III">“(III) </num><content>meets, where applicable, the standards under paragraph (3)(A), and has been certified to the Secretary as meeting International Efficiency Level IV or higher of the External Power Supply International Efficiency Marking Protocol, as in effect on February 10, 2016; and</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="IV">“(IV) </num><chapeau>is made available by the manufacturer as a service part or a spare part for an end-use product that—</chapeau><item class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650130"><num style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>constitutes the primary load; and</content></item><item class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650130"><num style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>was manufactured before February 10, 2016.</content></item></subclause></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading><inline class="smallCaps">Reporting</inline>.—</heading><content>The Secretary may require manufacturers of products exempted pursuant to clause (i) to report annual total units shipped as service and spare parts that fall below International Efficiency Level VI.</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">“(iii) </num><heading><inline class="smallCaps">Limitation of exemption</inline>.—</heading><content>The Secretary may issue a rule, after providing public notice and opportunity for public comment, to limit the applicability of the exemption established under clause (i) if the Secretary determines that the exemption is resulting in a significant reduction of the energy savings that would otherwise result from the final rule described in such clause.</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><heading><inline class="smallCaps">Amended standards</inline>.—</heading><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><heading><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Secretary may exempt an external power supply from any amended standard under this subsection if the external power supply—</chapeau><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>is manufactured within four years of the compliance date of the amended standard;</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="II">“(II) </num><content>complies with applicable marking requirements adopted by the Secretary prior to the amendment;</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="III">“(III) </num><content>meets the standards that were in effect prior to the amendment; and</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="IV">“(IV) </num><chapeau>is made available by the manufacturer as a service part or a spare part for an end-use product that—</chapeau><item class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650130"><num style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>constitutes the primary load; and</content></item><item class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650130"><num style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>was manufactured before the compliance date of the amended standard.</content></item></subclause></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading><inline class="smallCaps">Reporting</inline>.—</heading><content>The Secretary may require manufacturers of a product exempted pursuant to clause (i) to report annual total units shipped as service and spare parts that do not meet the amended standard.”</content></clause></subparagraph></paragraph></quotedContent>.</content></section>
