<enactingFormula style="-uslm-lc:I650120">  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</enactingFormula>
<section id="d152895e62" identifier="/us/bill/113/hr/2019/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Gabriella Miller Kids First Research Act</shortTitle>”.</content></section>
<section id="d152895e72" identifier="/us/bill/113/hr/2019/s2" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>TERMINATION OF TAXPAYER FINANCING OF POLITICAL PARTY CONVENTIONS; USE OF FUNDS FOR PEDIATRIC RESEARCH INITIATIVE.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d152895e76" identifier="/us/bill/113/hr/2019/s2/a" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Termination of Payments for Conventions; Use of Funds for Pediatric Research</inline>.—</heading><content>Section 9008 of the Internal Revenue Code of 1986 <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new subsection:<quotedContent><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="i">“(i) </num><heading><inline class="smallCaps">Termination of Payments for Conventions; Use of Amounts for Pediatric Research Initiative</inline>.—</heading><chapeau>Effective on the date of the enactment of the Gabriella Miller Kids First Research Act—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><content>the entitlement of any major party or minor party to a payment under this section shall terminate; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><content>all amounts in each account maintained for the national committee of a major party or minor party under this section shall be transferred to a fund in the Treasury to be known as the ‘10-Year Pediatric Research Initiative Fund’, which shall be available only for the purpose provided in section 402A(a)(2) of the Public Health Service Act, and only to the extent and in such amounts as are provided in advance in appropriation Acts.”</content></paragraph></subsection></quotedContent>.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d152895e109" identifier="/us/bill/113/hr/2019/s2/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Continuation of Priority of Payments From Accounts Over Payments to Candidates</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d152895e116" identifier="/us/bill/113/hr/2019/s2/b/1" role="instruction" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Availability of payments to candidates</inline>.—</heading><content>The third sentence of section 9006(c) of such Code <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>section 9008(b)(3),</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>section 9008(i)(2),</quotedText>”.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d152895e134" identifier="/us/bill/113/hr/2019/s2/b/2" role="instruction" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Availability of payments from presidential primary matching payment account</inline>.—</heading><content>The second sentence of section 9037(a) of such Code <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>section 9008(b)(3)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>section 9008(i)(2)</quotedText>”.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d152895e152" identifier="/us/bill/113/hr/2019/s2/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Conforming Amendments</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d152895e159" identifier="/us/bill/113/hr/2019/s2/c/1" role="instruction" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Elimination of reports by federal election commission</inline>.—</heading><chapeau>Section 9009(a) of such Code <amendingAction type="amend">is amended</amendingAction>—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d152895e171" identifier="/us/bill/113/hr/2019/s2/c/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="add">adding</amendingAction> “<quotedText>and</quotedText>” at the end of paragraph (2);</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d152895e179" identifier="/us/bill/113/hr/2019/s2/c/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> the semicolon at the end of paragraph (3) and <amendingAction type="insert">inserting</amendingAction> a period; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d152895e190" identifier="/us/bill/113/hr/2019/s2/c/1/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="delete">striking</amendingAction> paragraphs (4), (5), and (6).</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d152895e198" identifier="/us/bill/113/hr/2019/s2/c/2" role="instruction" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Elimination of penalties</inline>.—</heading><chapeau>Section 9012 of such Code <amendingAction type="amend">is amended</amendingAction>—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d152895e210" identifier="/us/bill/113/hr/2019/s2/c/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>in subsection (a)(1), by <amendingAction type="delete">striking</amendingAction> the second sentence;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d152895e218" identifier="/us/bill/113/hr/2019/s2/c/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>in subsection (c), by <amendingAction type="delete">striking</amendingAction> paragraph (2) and <amendingAction type="redesignate">redesignating</amendingAction> paragraph (3) as paragraph (2);</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d152895e229" identifier="/us/bill/113/hr/2019/s2/c/2/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content>in subsection (e)(1), by <amendingAction type="delete">striking</amendingAction> the second sentence; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d152895e237" identifier="/us/bill/113/hr/2019/s2/c/2/D" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="D">(D) </num><content>in subsection (e)(3), by <amendingAction type="delete">striking</amendingAction> “<quotedText>, or in connection with any expense incurred by the national committee of a major party or minor party with respect to a presidential nominating convention</quotedText>”.</content></subparagraph></paragraph></subsection></section>
<section id="d152895e246" identifier="/us/bill/113/hr/2019/s3" style="-uslm-lc:I650141"><num value="3">SEC. 3. </num><heading>10–YEAR PEDIATRIC RESEARCH INITIATIVE.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d152895e250" identifier="/us/bill/113/hr/2019/s3/a" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Allocation of NIH Funds in Common Fund for Pediatric Research</inline>.—</heading><content>Paragraph (7) of section 402(b) of the Public Health Service Act (<ref href="/us/usc/t42/s282/b">42 U.S.C. 282(b)</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="7">“(7)</num><subparagraph class="inline"><num value="A">(A) </num><chapeau>shall, through the Division of Program Coordination, Planning, and Strategic Initiatives—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>identify research that represents important areas of emerging scientific opportunities, rising public health challenges, or knowledge gaps that deserve special emphasis and would benefit from conducting or supporting additional research that involves collaboration between 2 or more national research institutes or national centers, or would otherwise benefit from strategic coordination and planning;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>include information on such research in reports under section 403; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="iii">“(iii) </num><chapeau>in the case of such research supported with funds referred to in subparagraph (B)—</chapeau><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>require as appropriate that proposals include milestones and goals for the research;</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="II">“(II) </num><content>require that the proposals include timeframes for funding of the research; and</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="III">“(III) </num><content>ensure appropriate consideration of proposals for which the principal investigator is an individual who has not previously served as the principal investigator of research conducted or supported by the National Institutes of Health;</content></subclause></clause></subparagraph><subparagraph class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="B">“(B)</num><clause class="inline"><num value="i">(i) </num><content>may, with respect to funds reserved under section 402A(c)(1) for the Common Fund, allocate such funds to the national research institutes and national centers for conducting and supporting research that is identified under subparagraph (A); and</content></clause><clause class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>shall, with respect to funds appropriated to the Common Fund pursuant to section 402A(a)(2), allocate such funds to the national research institutes and national centers for making grants for pediatric research that is identified under subparagraph (A); and</content></clause></subparagraph><subparagraph class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="C">“(C) </num><content>may assign additional functions to the Division in support of responsibilities identified in subparagraph (A), as determined appropriate by the Director;”</content></subparagraph></paragraph></quotedContent>.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d152895e313" identifier="/us/bill/113/hr/2019/s3/b" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Funding for 10-Year Pediatric Research Initiative</inline>.—</heading><chapeau>Section 402A of the Public Health Service Act (<ref href="/us/usc/t42/s282a">42 U.S.C. 282a</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d152895e328" identifier="/us/bill/113/hr/2019/s3/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (a)—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d152895e332" identifier="/us/bill/113/hr/2019/s3/b/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (1) through (3) as subparagraphs (A) through (C), respectively, and moving the indentation of each such subparagraph 2 ems to the right;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d152895e340" identifier="/us/bill/113/hr/2019/s3/b/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>For purposes of carrying out this title</quotedText>” and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><heading><inline class="smallCaps">This title</inline>.—</heading><content>For purposes of carrying out this title”</content></paragraph></quotedContent>; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d152895e361" identifier="/us/bill/113/hr/2019/s3/b/1/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><heading><inline class="smallCaps">Funding for 10-year pediatric research initiative through common fund</inline>.—</heading><content>For the purpose of carrying out section 402(b)(7)(B)(ii), there is authorized to be appropriated to the Common Fund, out of the 10-Year Pediatric Research Initiative Fund described in section 9008 of the Internal Revenue Code of 1986, and in addition to amounts otherwise made available under paragraph (1) of this subsection and reserved under subsection (c)(1)(B)(i) of this section, $12,600,000 for each of fiscal years 2014 through 2023.”</content></paragraph></quotedContent>; and</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d152895e379" identifier="/us/bill/113/hr/2019/s3/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>in subsections (c)(1)(B), (c)(1)(D), and (d), by <amendingAction type="delete">striking</amendingAction> “<quotedText>subsection (a)</quotedText>” each place it appears and <amendingAction type="insert">inserting</amendingAction> “<quotedText>subsection (a)(1)</quotedText>”.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d152895e390" identifier="/us/bill/113/hr/2019/s3/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Supplement, Not Supplant; Prohibition Against Transfer</inline>.—</heading><chapeau>Funds appropriated pursuant to section 402A(a)(2) of the Public Health Service Act, as added by subsection (b)—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d152895e398" identifier="/us/bill/113/hr/2019/s3/c/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>shall be used to supplement, not supplant, the funds otherwise allocated by the National Institutes of Health for pediatric research; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d152895e402" identifier="/us/bill/113/hr/2019/s3/c/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>notwithstanding any transfer authority in any appropriation Act, shall not be used for any purpose other than allocating funds for making grants as described in section 402(b)(7)(B)(ii) of the Public Health Service Act, as added by subsection (a).</content></paragraph></subsection></section>
