and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><content>diagnosis of heritable disorders in newborns.”</content></subparagraph></paragraph></quotedContent>; and</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d139551e441" identifier="/us/bill/113/hr/1281/s3/4" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><content>by <amendingAction type="delete">striking</amendingAction> subsection (d) (relating to authorization of appropriations).</content></paragraph></section>
<section id="d139551e451" identifier="/us/bill/113/hr/1281/s4" role="instruction" style="-uslm-lc:I650141"><num value="4">SEC. 4. </num><heading>ADVISORY COMMITTEE ON HERITABLE DISORDERS IN NEWBORNS AND CHILDREN.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Section 1111 of the Public Health Service Act (<ref href="/us/usc/t42/s300b–10">42 U.S.C. 300b–10</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d139551e463" identifier="/us/bill/113/hr/1281/s4/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (b)—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d139551e467" identifier="/us/bill/113/hr/1281/s4/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (4) through (6) as paragraphs (6) through (8), respectively;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d139551e475" identifier="/us/bill/113/hr/1281/s4/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="insert">inserting</amendingAction> after paragraph (3), the following:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">“(4) </num><content>provide technical assistance, as appropriate, to individuals and organizations regarding the submission of nominations to the uniform screening panel, including prior to the submission of such nominations;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="5">“(5) </num><content>take appropriate steps, at its discretion, to prepare for the review of nominations prior to their submission, including for conditions for which a screening method has been validated but other nomination criteria are not yet met, in order to facilitate timely action by the Advisory Committee once such submission has been received by the Committee;”</content></paragraph></quotedContent>;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d139551e493" identifier="/us/bill/113/hr/1281/s4/1/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content>in paragraph (6) (as so redesignated), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>, including the cost</quotedText>” after “<quotedText>public health impact</quotedText>”; <section id="d139551e1003" identifier="/us/bill/113/hr/1281/s10" role="instruction" style="-uslm-lc:I650142"><num value="10">SEC. 10. </num><heading>AUTHORIZATION OF APPROPRIATIONS.</heading><content class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Part A of title XI of the Public Health Service Act (<ref href="/us/usc/t42/s300b–1/etseq">42 U.S.C. 300b–1 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end, the following:<quotedContent><section style="-uslm-lc:I650144"><num class="bold " value="1117">“SEC. 1117. </num><heading class="bold ">AUTHORIZATION OF APPROPRIATIONS FOR NEWBORN SCREENING PROGRAMS AND ACTIVITIES.</heading><chapeau class="indentUp2 firstIndent1 fontsize10" style="-uslm-lc:I650120">  “There are authorized to be appropriated—</chapeau><paragraph class="indentDown1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><content>to carry out sections 1109, 1110, 1111, and 1112, $11,900,000 for each of fiscal years 2015 through 2019; and</content></paragraph><paragraph class="indentDown1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><content>to carry out section 1113, $8,000,000 for each of fiscal years 2015 through 2019.”</content></paragraph></section>

<section id="d139551e1038" identifier="/us/bill/113/hr/1281/s11" style="-uslm-lc:I650142"><num value="11">SEC. 11. </num><heading>REPORTS TO CONGRESS.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d139551e1042" identifier="/us/bill/113/hr/1281/s11/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">GAO Report on Timeliness of Newborn Screening</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d139551e1049" identifier="/us/bill/113/hr/1281/s11/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 2 years after the date of enactment of this Act, the Comptroller General of the United States shall submit a report to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives concerning the timeliness of screening for heritable disorders in newborns.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d139551e1057" identifier="/us/bill/113/hr/1281/s11/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Contents</inline>.—</heading><chapeau>The report submitted under paragraph (1) shall include the following:</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d139551e1065" identifier="/us/bill/113/hr/1281/s11/a/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>An analysis of information regarding the timeliness of newborn screening, which may include the time elapsed from birth to specimen collection, specimen collection to receipt by laboratory, specimen receipt to reporting, reporting to followup testing, and followup testing to confirmed diagnosis.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d139551e1069" identifier="/us/bill/113/hr/1281/s11/a/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>A summary of any guidelines, recommendations, or best practices available to States and health care providers intended to support a timely newborn screening system.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d139551e1073" identifier="/us/bill/113/hr/1281/s11/a/2/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content>An analysis of any barriers to maintaining a timely newborn screening system which may exist and recommendations for addressing such barriers.</content></subparagraph></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d139551e1077" identifier="/us/bill/113/hr/1281/s11/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Report by Secretary</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d139551e1084" identifier="/us/bill/113/hr/1281/s11/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Secretary of Health and Human Services shall—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d139551e1092" identifier="/us/bill/113/hr/1281/s11/b/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>not later than 1 year after the date of enactment of this Act, submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on activities related to—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" id="d139551e1096" identifier="/us/bill/113/hr/1281/s11/b/1/A/i" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">(i) </num><content>newborn screening; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d139551e1100" identifier="/us/bill/113/hr/1281/s11/b/1/A/ii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">(ii) </num><content>screening children who have or are at risk for heritable disorders; and</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d139551e1104" identifier="/us/bill/113/hr/1281/s11/b/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>not less than every 2 years, submit to such committees an updated version of such report.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d139551e1108" identifier="/us/bill/113/hr/1281/s11/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Contents</inline>.—</heading><chapeau>The report submitted under this subsection shall contain a description of—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d139551e1116" identifier="/us/bill/113/hr/1281/s11/b/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>the ongoing activities under sections 1109, 1110, and 1112 through 1115 of the Public Health Service Act; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d139551e1120" identifier="/us/bill/113/hr/1281/s11/b/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>the amounts expended on such activities.</content></subparagraph></paragraph></subsection></section>
<section id="d139551e1125" identifier="/us/bill/113/hr/1281/s12" style="-uslm-lc:I650142"><num value="12">SEC. 12. </num><heading>INFORMED CONSENT FOR NEWBORN SCREENING RESEARCH.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d139551e1129" identifier="/us/bill/113/hr/1281/s12/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><content>Research on newborn dried blood spots shall be considered research carried out on human subjects meeting the definition of <ref href="/us/cfr/t45/s46.102/f/2">section 46.102(f)(2) of title 45, Code of Federal Regulations</ref>, for purposes of Federally funded research conducted pursuant to the Public Health Service Act until such time as updates to the Federal Policy for the Protection of Human Subjects (the Common Rule) are promulgated pursuant to subsection (c). For purposes of this subsection, sections 46.116(c) and 46.116(d) of <ref href="/us/cfr/t45">title 45, Code of Federal Regulations</ref>, shall not apply.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d139551e1144" identifier="/us/bill/113/hr/1281/s12/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Effective Date</inline>.—</heading><content>Subsection (a) shall apply only to newborn dried blood spots used for purposes of Federally funded research that were collected not earlier than 90 days after the date of enactment of this Act.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d139551e1152" identifier="/us/bill/113/hr/1281/s12/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Regulations</inline>.—</heading><content>Not later than 6 months after the date of enactment of this Act, the Secretary of Health and Human Services shall promulgate proposed regulations related to the updating of the Federal Policy for the Protection of Human Subjects (the Common Rule), particularly with respect to informed consent. Not later than 2 years after such date of enactment, the Secretary shall promulgate final regulations based on such proposed regulations.</content></subsection></section>
