<enactingFormula style="-uslm-lc:I650120">  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</enactingFormula>
<section id="d88370e62" identifier="/us/bill/113/hr/1206/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Permanent Electronic Duck Stamp Act of 2013</shortTitle>”.</content></section>
<section id="d88370e72" identifier="/us/bill/113/hr/1206/s2" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  In this Act:</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e78" identifier="/us/bill/113/hr/1206/s2/1" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Actual stamp</inline>.—</heading><content>The term “<term>actual stamp</term>” means a Federal migratory-bird hunting and conservation stamp required under the Act of March 16, 1934 (<ref href="/us/usc/t16/s718a/etseq">16 U.S.C. 718a et seq.</ref>) (popularly known as the “Duck Stamp Act”), that is printed on paper and sold through the means established by the authority of the Secretary immediately before the date of enactment of this Act.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e90" identifier="/us/bill/113/hr/1206/s2/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Automated licensing system</inline>.—</heading><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d88370e97" identifier="/us/bill/113/hr/1206/s2/2/A" role="definitions" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>The term “<term>automated licensing system</term>” means an electronic, computerized licensing system used by a State fish and wildlife agency to issue hunting, fishing, and other associated licenses and products.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d88370e105" identifier="/us/bill/113/hr/1206/s2/2/B" role="definitions" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><heading><inline class="smallCaps">Inclusion</inline>.—</heading><content>The term “<term>automated licensing system</term>” includes a point-of-sale, Internet, telephonic system, or other electronic applications used for a purpose described in subparagraph (A).</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e113" identifier="/us/bill/113/hr/1206/s2/3" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><heading><inline class="smallCaps">Electronic stamp</inline>.—</heading><chapeau>The term “<term>electronic stamp</term>” means an electronic version of an actual stamp that—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d88370e121" identifier="/us/bill/113/hr/1206/s2/3/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>is a unique identifier for the individual to whom it is issued;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d88370e125" identifier="/us/bill/113/hr/1206/s2/3/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>can be printed on paper or produced through an electronic application with the same indicators as the State endorsement provides;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d88370e129" identifier="/us/bill/113/hr/1206/s2/3/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content>is issued through a State automated licensing system that is authorized, under State law and by the Secretary under this Act, to issue electronic stamps;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d88370e133" identifier="/us/bill/113/hr/1206/s2/3/D" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="D">(D) </num><content>is compatible with the hunting licensing system of the State that issues the electronic stamp; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d88370e137" identifier="/us/bill/113/hr/1206/s2/3/E" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="E">(E) </num><content>is described in the State application approved by the Secretary under section 4(b).</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e141" identifier="/us/bill/113/hr/1206/s2/4" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><heading><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Interior.</content></paragraph></section>
<section id="d88370e150" identifier="/us/bill/113/hr/1206/s3" style="-uslm-lc:I650141"><num value="3">SEC. 3. </num><heading>AUTHORITY TO ISSUE ELECTRONIC DUCK STAMPS.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d88370e154" identifier="/us/bill/113/hr/1206/s3/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><content>The Secretary may authorize any State to issue electronic stamps in accordance with this Act.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d88370e162" identifier="/us/bill/113/hr/1206/s3/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Consultation</inline>.—</heading><content>The Secretary shall implement this section in consultation with State management agencies.</content></subsection></section>
<section id="d88370e172" identifier="/us/bill/113/hr/1206/s4" style="-uslm-lc:I650141"><num value="4">SEC. 4. </num><heading>STATE APPLICATION.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d88370e176" identifier="/us/bill/113/hr/1206/s4/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Approval of Application Required</inline>.—</heading><content>The Secretary may not authorize a State to issue electronic stamps under this Act unless the Secretary has received and approved an application submitted by the State in accordance with this section. The Secretary may determine the number of new States per year to participate in the electronic stamp program.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d88370e184" identifier="/us/bill/113/hr/1206/s4/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Contents of Application</inline>.—</heading><chapeau>The Secretary may not approve a State application unless the application contains—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e192" identifier="/us/bill/113/hr/1206/s4/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>a description of the format of the electronic stamp that the State will issue under this Act, including identifying features of the licensee that will be specified on the stamp;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e196" identifier="/us/bill/113/hr/1206/s4/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>a description of any fee the State will charge for issuance of an electronic stamp;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e200" identifier="/us/bill/113/hr/1206/s4/b/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>a description of the process the State will use to account for and transfer to the Secretary the amounts collected by the State that are required to be transferred to the Secretary under the program;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e204" identifier="/us/bill/113/hr/1206/s4/b/4" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><content>the manner by which the State will transmit electronic stamp customer data to the Secretary;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e208" identifier="/us/bill/113/hr/1206/s4/b/5" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="5">(5) </num><content>the manner by which actual stamps will be delivered;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e212" identifier="/us/bill/113/hr/1206/s4/b/6" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="6">(6) </num><content>the policies and procedures under which the State will issue duplicate electronic stamps; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e216" identifier="/us/bill/113/hr/1206/s4/b/7" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="7">(7) </num><content>such other policies, procedures, and information as may be reasonably required by the Secretary.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d88370e220" identifier="/us/bill/113/hr/1206/s4/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Publication of Deadlines, Eligibility Requirements, and Selection Criteria</inline>.—</heading><chapeau>Not later than 30 days before the date on which the Secretary begins accepting applications under this section, the Secretary shall publish—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e228" identifier="/us/bill/113/hr/1206/s4/c/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>deadlines for submission of applications;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e232" identifier="/us/bill/113/hr/1206/s4/c/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>eligibility requirements for submitting applications; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e236" identifier="/us/bill/113/hr/1206/s4/c/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>criteria for approving applications.</content></paragraph></subsection></section>
<section id="d88370e241" identifier="/us/bill/113/hr/1206/s5" style="-uslm-lc:I650141"><num value="5">SEC. 5. </num><heading>STATE OBLIGATIONS AND AUTHORITIES.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d88370e245" identifier="/us/bill/113/hr/1206/s5/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Delivery of Actual Stamp</inline>.—</heading><chapeau>The Secretary shall require that each individual to whom a State sells an electronic stamp under this Act shall receive an actual stamp—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e253" identifier="/us/bill/113/hr/1206/s5/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>by not later than the date on which the electronic stamp expires under section 6(c); and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e257" identifier="/us/bill/113/hr/1206/s5/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>in a manner agreed upon by the State and Secretary.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d88370e261" identifier="/us/bill/113/hr/1206/s5/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Collection and Transfer of Electronic Stamp Revenue and Customer Information</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e268" identifier="/us/bill/113/hr/1206/s5/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Requirement to transmit</inline>.—</heading><chapeau>The Secretary shall require each State authorized to issue electronic stamps to collect and submit to the Secretary in accordance with this section—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d88370e276" identifier="/us/bill/113/hr/1206/s5/b/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>the first name, last name, and complete mailing address of each individual that purchases an electronic stamp from the State;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d88370e280" identifier="/us/bill/113/hr/1206/s5/b/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>the face value amount of each electronic stamp sold by the State; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d88370e284" identifier="/us/bill/113/hr/1206/s5/b/1/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content>the amount of the Federal portion of any fee required by the agreement for each stamp sold.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e288" identifier="/us/bill/113/hr/1206/s5/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Time of transmittal</inline>.—</heading><content>The Secretary shall require the submission under paragraph (1) to be made with respect to sales of electronic stamps by a State according to the written agreement between the Secretary and the State agency.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e296" identifier="/us/bill/113/hr/1206/s5/b/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><heading><inline class="smallCaps">Additional fees not affected</inline>.—</heading><content>This section shall not apply to the State portion of any fee collected by a State under subsection (c).</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d88370e304" identifier="/us/bill/113/hr/1206/s5/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Electronic Stamp Issuance Fee</inline>.—</heading><content>A State authorized to issue electronic stamps may charge a reasonable fee to cover costs incurred by the State and the Department of the Interior in issuing electronic stamps under this Act, including costs of delivery of actual stamps.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d88370e312" identifier="/us/bill/113/hr/1206/s5/d" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="d">(d) </num><heading><inline class="smallCaps">Duplicate Electronic Stamps</inline>.—</heading><content>A State authorized to issue electronic stamps may issue a duplicate electronic stamp to replace an electronic stamp issued by the State that is lost or damaged.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d88370e320" identifier="/us/bill/113/hr/1206/s5/e" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="e">(e) </num><heading><inline class="smallCaps">Limitation on Authority To Require Purchase of State License</inline>.—</heading><content>A State may not require that an individual purchase a State hunting license as a condition of issuing an electronic stamp under this Act.</content></subsection></section>
<section id="d88370e329" identifier="/us/bill/113/hr/1206/s6" style="-uslm-lc:I650141"><num value="6">SEC. 6. </num><heading>ELECTRONIC STAMP REQUIREMENTS; RECOGNITION OF ELECTRONIC STAMP.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d88370e333" identifier="/us/bill/113/hr/1206/s6/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Stamp Requirements</inline>.—</heading><chapeau>The Secretary shall require an electronic stamp issued by a State under this Act—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e341" identifier="/us/bill/113/hr/1206/s6/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>to have the same format as any other license, validation, or privilege the State issues under the automated licensing system of the State; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e345" identifier="/us/bill/113/hr/1206/s6/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>to specify identifying features of the licensee that are adequate to enable Federal, State, and other law enforcement officers to identify the holder.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d88370e349" identifier="/us/bill/113/hr/1206/s6/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Recognition of Electronic Stamp</inline>.—</heading><chapeau>Any electronic stamp issued by a State under this Act shall, during the effective period of the electronic stamp—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e357" identifier="/us/bill/113/hr/1206/s6/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>bestow upon the licensee the same privileges as are bestowed by an actual stamp;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e361" identifier="/us/bill/113/hr/1206/s6/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>be recognized nationally as a valid Federal migratory bird hunting and conservation stamp; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e365" identifier="/us/bill/113/hr/1206/s6/b/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>authorize the licensee to hunt migratory waterfowl in any other State, in accordance with the laws of the other State governing that hunting.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d88370e369" identifier="/us/bill/113/hr/1206/s6/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Duration</inline>.—</heading><content>An electronic stamp issued by a State shall be valid for a period agreed to by the State and the Secretary, which shall not exceed 45 days.</content></subsection></section>
<section id="d88370e378" identifier="/us/bill/113/hr/1206/s7" style="-uslm-lc:I650141"><num value="7">SEC. 7. </num><heading>TERMINATION OF STATE PARTICIPATION.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  The authority of a State to issue electronic stamps under this Act may be terminated—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e384" identifier="/us/bill/113/hr/1206/s7/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>by the Secretary, if the Secretary—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d88370e388" identifier="/us/bill/113/hr/1206/s7/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>finds that the State has violated any of the terms of the application of the State approved by the Secretary under section 4; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d88370e392" identifier="/us/bill/113/hr/1206/s7/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>provides to the State written notice of the termination by not later than the date that is 30 days before the date of termination; or</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d88370e396" identifier="/us/bill/113/hr/1206/s7/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>by the State, by providing written notice to the Secretary by not later than the date that is 30 days before the termination date.</content></paragraph></section>
