<enactingFormula style="-uslm-lc:I650120">  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</enactingFormula>
<section id="d169723e62" identifier="/us/bill/113/s/982/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Freedom to Fish Act</shortTitle>”.</content></section>
<section id="d169723e72" identifier="/us/bill/113/s/982/s2" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>RESTRICTED AREAS AT CORPS OF ENGINEERS DAMS.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d169723e76" identifier="/us/bill/113/s/982/s2/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this Act:</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169723e84" identifier="/us/bill/113/s/982/s2/a/1" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Restricted area</inline>.—</heading><content>The term “<term>restricted area</term>” means a restricted area for hazardous waters at dams and other civil works structures in the Cumberland River basin established in accordance with chapter 10 of the regulation entitled “Project Operations: Navigation and Dredging Operations and Maintenance Policies”, published by the Corps of Engineers on November 29, 1996, and any related regulations or guidance.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169723e92" identifier="/us/bill/113/s/982/s2/a/2" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Army, acting through the Chief of Engineers.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d169723e100" identifier="/us/bill/113/s/982/s2/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Existing Restricted Area</inline>.—</heading><chapeau>If the Secretary has established a restricted area or modified an existing restricted area during the period beginning on August 1, 2012, and ending on the day before the date of enactment of this Act, the Secretary shall—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169723e108" identifier="/us/bill/113/s/982/s2/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>cease implementing and enforcing the restricted area until the date that is 2 years after the date of enactment of this Act; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169723e112" identifier="/us/bill/113/s/982/s2/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>remove any permanent physical barriers constructed in connection with the restricted area.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d169723e116" identifier="/us/bill/113/s/982/s2/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Establishing New Restricted Area</inline>.—</heading><chapeau>If, on or after the date of enactment of this Act, the Secretary establishes any restricted area, the Secretary shall—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169723e124" identifier="/us/bill/113/s/982/s2/c/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>ensure that any restrictions are based on operational conditions that create hazardous waters;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169723e128" identifier="/us/bill/113/s/982/s2/c/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>publish a draft describing the restricted area and seek and consider public comment on that draft prior to establishing the restricted area;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169723e132" identifier="/us/bill/113/s/982/s2/c/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>not implement or enforce the restricted area until the date that is 2 years after the date of enactment of this Act; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169723e136" identifier="/us/bill/113/s/982/s2/c/4" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><content>not take any action to establish a permanent physical barrier in connection with the restricted area.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d169723e140" identifier="/us/bill/113/s/982/s2/d" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="d">(d) </num><heading><inline class="smallCaps">Exclusions</inline>.—</heading><content>For purposes of this section, the installation and maintenance of measures for alerting the public of hazardous water conditions and restricted areas, including sirens, strobe lights, and signage, shall not be considered to be a permanent physical barrier.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d169723e148" identifier="/us/bill/113/s/982/s2/e" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="e">(e) </num><heading><inline class="smallCaps">Enforcement</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169723e155" identifier="/us/bill/113/s/982/s2/e/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>Enforcement of a restricted area shall be the sole responsibility of the State in which the restricted area is located.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169723e163" identifier="/us/bill/113/s/982/s2/e/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Existing authorities</inline>.—</heading><content>The Secretary shall not assess any penalty for entrance into a restricted area under section 4 of the Act entitled “An Act authorizing the construction of certain public works on rivers and harbors for flood control, and for other purposes”, approved December 22, 1944 (<ref href="/us/usc/t16/s460d">16 U.S.C. 460d</ref>).</content></paragraph></subsection></section>
