<enactingFormula style="-uslm-lc:I650120">  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</enactingFormula>
<section id="d168306e62" identifier="/us/bill/113/s/793/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Organization of American States Revitalization and Reform Act of 2013</shortTitle>”.</content></section>
<section id="d168306e72" identifier="/us/bill/113/s/793/s2" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Congress makes the following findings:</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e78" identifier="/us/bill/113/s/793/s2/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>The Charter of the Organization of American States recognizes that—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168306e82" identifier="/us/bill/113/s/793/s2/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>representative democracy is indispensable for the stability, peace, and development of the Western Hemisphere; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168306e86" identifier="/us/bill/113/s/793/s2/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>a purpose of the Organization of American States is to promote and consolidate representative democracy, with due respect for the principle of nonintervention.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e90" identifier="/us/bill/113/s/793/s2/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>The United States supports the purposes and principles enshrined in—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168306e94" identifier="/us/bill/113/s/793/s2/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>the Charter of the Organization of American States;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168306e98" identifier="/us/bill/113/s/793/s2/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>the Inter-American Democratic Charter; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168306e102" identifier="/us/bill/113/s/793/s2/2/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content>the American Declaration on the Rights and Duties of Man.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e106" identifier="/us/bill/113/s/793/s2/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>The United States supports the Organization of American States in its efforts with all member states to meet our commitments under the instruments set forth in paragraph (2).</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e110" identifier="/us/bill/113/s/793/s2/4" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><content>Congress supports the Organization of American States as it operates in a manner consistent with the Inter-American Democratic Charter.</content></paragraph></section>
<section id="d168306e115" identifier="/us/bill/113/s/793/s3" style="-uslm-lc:I650141"><num value="3">SEC. 3. </num><heading>STATEMENT OF POLICY.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  It is the policy of the United States—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e121" identifier="/us/bill/113/s/793/s3/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>to promote democracy and the rule of law throughout the Western Hemisphere;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e125" identifier="/us/bill/113/s/793/s3/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>to promote and protect human rights and fundamental freedoms in the Western Hemisphere; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e129" identifier="/us/bill/113/s/793/s3/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>to support the practices, purposes, and principles expressed in the Charter of the Organization of American States, the American Declaration on the Rights and Duties of Man, the Inter-American Democratic Charter, and other fundamental instruments of democracy.</content></paragraph></section>
<section id="d168306e135" identifier="/us/bill/113/s/793/s4" style="-uslm-lc:I650141"><num value="4">SEC. 4. </num><heading>SENSE OF CONGRESS.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  It is the sense of Congress that—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e141" identifier="/us/bill/113/s/793/s4/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>the Organization of American States (OAS) should be the primary multi-lateral diplomatic entity for regional dispute resolution and promotion of democratic governance and institutions;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e145" identifier="/us/bill/113/s/793/s4/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>the OAS is a valuable platform from which to launch initiatives aimed to benefit the countries of the Western Hemisphere;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e149" identifier="/us/bill/113/s/793/s4/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>the Summit of the Americas institution and process embodies a valuable complement to regional dialogue and cooperation;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e153" identifier="/us/bill/113/s/793/s4/4" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><content>the Summit of the Americas process should be formally and more effectively integrated into the work of the OAS, the Inter-American Development Bank, and other Members of the Joint Summit Working Group, and the OAS should play a central role in overseeing and managing the Summit process;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e157" identifier="/us/bill/113/s/793/s4/5" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="5">(5) </num><content>the OAS General Assembly and the Summit of the Americas events should be combined geographically and chronologically in the years in which they coincide;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e161" identifier="/us/bill/113/s/793/s4/6" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="6">(6) </num><content>the OAS has historically accepted too many mandates from its member states, resulting in both lack of clarity on priorities and loss of institutional focus, which in turn has reduced the effectiveness of the organization;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e165" identifier="/us/bill/113/s/793/s4/7" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="7">(7) </num><content>to ensure an appropriate balance of priorities, the OAS should review its core functions no less than annually and seek opportunities to reduce the number of mandates not directly related to its core functions;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e169" identifier="/us/bill/113/s/793/s4/8" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="8">(8) </num><content>key OAS strengths lie in strengthening peace and security, promoting and consolidating representative democracy, regional dispute resolution, election assistance and monitoring, fostering economic growth and development cooperation, facilitating trade, combating illicit drug trafficking and transnational crime, and support for the Inter-American Human Rights System;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e174" identifier="/us/bill/113/s/793/s4/9" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="9">(9) </num><content>the core competencies referred to in paragraph (8) should remain central to the strategic planning process of the OAS and the consideration of future mandates;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e178" identifier="/us/bill/113/s/793/s4/10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="10">(10) </num><content>any new OAS mandates should be accepted by the member states only after an analysis is conducted and formally presented consisting of a calculation of the financial costs associated with the mandate, an assessment of the comparative advantage of the OAS in the implementation of the mandate, and a description of the ways in which the mandate advances the organization’s core mission;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e182" identifier="/us/bill/113/s/793/s4/11" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="11">(11) </num><content>any new mandates should include, in addition to the analysis described in paragraph (10), an identification of the source of funding to be used to implement the mandate;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e186" identifier="/us/bill/113/s/793/s4/12" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="12">(12) </num><content>the OAS would benefit from enhanced coordination between the OAS and the Inter-American Development Bank on issues that relate to economic development;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e190" identifier="/us/bill/113/s/793/s4/13" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="13">(13) </num><content>the OAS would benefit from standard reporting requirements for each project and grant agreement;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e194" identifier="/us/bill/113/s/793/s4/14" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="14">(14) </num><chapeau>the OAS would benefit from effective implementation of—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168306e198" identifier="/us/bill/113/s/793/s4/14/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>transparent and merit-based human resource standards and processes; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168306e202" identifier="/us/bill/113/s/793/s4/14/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>transparent hiring, firing, and promotion standards and processes, including with respect to factors such as gender and national origin; and</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e206" identifier="/us/bill/113/s/793/s4/15" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="15">(15) </num><content>it is in the interest of the United States, OAS member states, and a modernized OAS to move toward an assessed fee structure that assures the financial sustainability of the organization and establishes, not later than five years after the date of the enactment of this Act, that no member state pays more than 50 percent of the organization’s assessed fees.</content></paragraph></section>
<section id="d168306e211" identifier="/us/bill/113/s/793/s5" style="-uslm-lc:I650141"><num value="5">SEC. 5. </num><heading>ORGANIZATION OF AMERICAN STATES REVITALIZATION AND REFORM STRATEGY.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d168306e215" identifier="/us/bill/113/s/793/s5/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Strategy</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e222" identifier="/us/bill/113/s/793/s5/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 180 days after the date of the enactment of this Act, the Secretary of State shall submit to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives a multiyear strategy that—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168306e230" identifier="/us/bill/113/s/793/s5/a/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>identifies a path toward the adoption of necessary reforms that prioritize and reinforce the OAS’s core competencies described in section 4(8);</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168306e234" identifier="/us/bill/113/s/793/s5/a/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>outlines an approach to secure from the OAS effective adoption of—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" id="d168306e238" identifier="/us/bill/113/s/793/s5/a/1/B/i" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">(i) </num><content>a results-based budgeting process in order to strategically prioritize, and where appropriate, reduce current and future mandates; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d168306e242" identifier="/us/bill/113/s/793/s5/a/1/B/ii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">(ii) </num><content>transparent hiring, firing, and promotion practices;</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168306e246" identifier="/us/bill/113/s/793/s5/a/1/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content>reflects the inputs and coordination from other Executive Branch agencies, as appropriate; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168306e250" identifier="/us/bill/113/s/793/s5/a/1/D" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="D">(D) </num><chapeau>identifies a path toward the adoption of necessary reforms that would—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" id="d168306e254" identifier="/us/bill/113/s/793/s5/a/1/D/i" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">(i) </num><content>lead to an assessed fee structure in which no member state would pay more than 50 percent of the OAS’s assessed yearly fees; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d168306e258" identifier="/us/bill/113/s/793/s5/a/1/D/ii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">(ii) </num><content>seek to minimize the negative financial impact on the OAS and its operations.</content></clause></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e262" identifier="/us/bill/113/s/793/s5/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Policy priorities and coordination</inline>.—</heading><chapeau>The Secretary of State shall—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168306e270" identifier="/us/bill/113/s/793/s5/a/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>carry out diplomatic engagement to build support for reforms and budgetary burden sharing among OAS member states and observers; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d168306e274" identifier="/us/bill/113/s/793/s5/a/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>promote donor coordination among OAS member states.</content></subparagraph></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d168306e278" identifier="/us/bill/113/s/793/s5/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Briefings</inline>.—</heading><chapeau>The Secretary of State shall offer to the committees referred to in subsection (a)(1) a quarterly briefing that—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e286" identifier="/us/bill/113/s/793/s5/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>reviews assessed and voluntary contributions;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e290" identifier="/us/bill/113/s/793/s5/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>analyzes the progress made by the OAS to adopt and effectively implement a results-based budgeting process in order to strategically prioritize, and where appropriate, reduce current and future mandates;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e294" identifier="/us/bill/113/s/793/s5/b/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>analyzes the progress made by the OAS to adopt and effectively implement transparent and merit-based human resource standards and practices and transparent hiring, firing, and promotion standards and processes, including with respect to factors such as gender and national origin;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e298" identifier="/us/bill/113/s/793/s5/b/4" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><content>analyzes the progress made by the OAS to adopt and effectively implement a practice of soliciting member quotas to be paid on a schedule that will improve the consistency of its operating budget; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d168306e302" identifier="/us/bill/113/s/793/s5/b/5" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="5">(5) </num><content>analyzes the progress made by the OAS to review, streamline, and prioritize mandates to focus on core missions and make efficient and effective use of available funding.</content></paragraph></subsection></section>
