<enactingFormula style="-uslm-lc:I650120">  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</enactingFormula>
<section id="d167700e62" identifier="/us/bill/113/s/1545/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">PEPFAR Stewardship and Oversight Act of 2013</shortTitle>”.</content></section>
<section id="d167700e72" identifier="/us/bill/113/s/1545/s2" role="instruction" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>INSPECTOR GENERAL OVERSIGHT.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Section 101(f)(1) of the United States Leadership Against HIV/AIDS, Tuberculosis, and Malaria Act of 2003 (<ref href="/us/usc/t22/s7611/f/1">22 U.S.C. 7611(f)(1)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d167700e84" identifier="/us/bill/113/s/1545/s2/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>in subparagraph (A), by <amendingAction type="delete">striking</amendingAction> “<quotedText>5 coordinated annual plans for oversight activity in each of the fiscal years 2009 through 2013</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>coordinated annual plans for oversight activity in each of the fiscal years 2009 through 2018</quotedText>”; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d167700e95" identifier="/us/bill/113/s/1545/s2/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in subparagraph (C)—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d167700e99" identifier="/us/bill/113/s/1545/s2/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>in clause (ii)—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" id="d167700e103" identifier="/us/bill/113/s/1545/s2/2/A/i" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">(i) </num><content>in the heading, by <amendingAction type="delete">striking</amendingAction> “<quotedText><headingText class="smallCaps">Subsequent</headingText></quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText><headingText class="smallCaps">2010 through 2013</headingText></quotedText>”; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d167700e120" identifier="/us/bill/113/s/1545/s2/2/A/ii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">(ii) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>the last four plans</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>the plans for fiscal years 2010 through 2013</quotedText>”; and</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d167700e131" identifier="/us/bill/113/s/1545/s2/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new clause:<quotedContent><clause class="indentUp3 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">“(iii) </num><heading><inline class="smallCaps">2014</inline><inline class="smallCaps"> plan</inline>.—</heading><content>The plan developed under subparagraph (A) for fiscal year 2014 shall be completed not later than 60 days after the date of the enactment of the PEPFAR Stewardship and Oversight Act of 2013.</content></clause><clause class="indentUp3 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iv">“(iv) </num><heading><inline class="smallCaps">Subsequent plans</inline>.—</heading><content>Each of the last four plans developed under subparagraph (A) shall be completed not later than 30 days before each of the fiscal years 2015 through 2018, respectively.”</content></clause></quotedContent>.</content></subparagraph></paragraph></section>
<section id="d167700e160" identifier="/us/bill/113/s/1545/s3" style="-uslm-lc:I650141"><num value="3">SEC. 3. </num><heading>ANNUAL TREATMENT STUDY.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d167700e164" identifier="/us/bill/113/s/1545/s3/a" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Annual Study; Message</inline>.—</heading><chapeau>Section 101(g) of the United States Leadership Against HIV/AIDS, Tuberculosis, and Malaria Act of 2003 (<ref href="/us/usc/t22/s7611/g">22 U.S.C. 7611(g)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d167700e179" identifier="/us/bill/113/s/1545/s3/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>in paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>through September 30, 2013</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>through September 30, 2019</quotedText>”;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d167700e190" identifier="/us/bill/113/s/1545/s3/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraph (2) as paragraph (3);</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d167700e198" identifier="/us/bill/113/s/1545/s3/a/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="insert">inserting</amendingAction> after paragraph (1) the following new paragraph:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><heading><inline class="smallCaps">2013</inline><inline class="smallCaps"> through 2018 studies</inline>.—</heading><chapeau>The studies required to be submitted by September 30, 2014, and annually thereafter through September 30, 2018, shall include, in addition to the elements set forth under paragraph (1), the following elements:</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><content>A plan for conducting cost studies of United States assistance under section 104A of the Foreign Assistance Act of 1961 (<ref href="/us/usc/t22/s2151b–2">22 U.S.C. 2151b–2</ref>) in partner countries, taking into account the goal for more systematic collection of data, as well as the demands of such analysis on available human and fiscal resources.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>A comprehensive and harmonized expenditure analysis by partner country, including—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>an analysis of Global Fund and national partner spending and comparable data across United States, Global Fund, and national partner spending; or</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>where providing such comparable data is not currently practicable, an explanation of why it is not currently practicable, and when it will be practicable.”</content></clause></subparagraph></paragraph></quotedContent>; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d167700e238" identifier="/us/bill/113/s/1545/s3/a/4" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new paragraph:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">“(4) </num><heading><inline class="smallCaps">Partner country defined</inline>.—</heading><content>In this subsection, the term ‘<term>partner country</term>’ means a country with a minimum United States Government investment of HIV/AIDS assistance of at least $5,000,000 in the prior fiscal year.”</content></paragraph></quotedContent>.</content></paragraph></subsection></section>
<section id="d167700e258" identifier="/us/bill/113/s/1545/s4" style="-uslm-lc:I650141"><num value="4">SEC. 4. </num><heading>PARTICIPATION IN THE GLOBAL FUND TO FIGHT AIDS, TUBERCULOSIS, AND MALARIA.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d167700e262" identifier="/us/bill/113/s/1545/s4/a" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Limitation</inline>.—</heading><chapeau>Section 202(d)(4) of the United States Leadership Against HIV/AIDS, Tuberculosis, and Malaria Act of 2003 (<ref href="/us/usc/t22/s7622/d/4">22 U.S.C. 7622(d)(4)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d167700e277" identifier="/us/bill/113/s/1545/s4/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subparagraph (A)—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d167700e281" identifier="/us/bill/113/s/1545/s4/a/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>in clause (i), by <amendingAction type="delete">striking</amendingAction> “<quotedText>2013</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>2018</quotedText>”;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d167700e292" identifier="/us/bill/113/s/1545/s4/a/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>in clause (ii)—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" id="d167700e296" identifier="/us/bill/113/s/1545/s4/a/1/B/i" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">(i) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>2013</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>2018</quotedText>”; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d167700e307" identifier="/us/bill/113/s/1545/s4/a/1/B/ii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">(ii) </num><content>by <amendingAction type="delete">striking</amendingAction> the last two sentences; and</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d167700e315" identifier="/us/bill/113/s/1545/s4/a/1/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content>in clause (vi), by <amendingAction type="delete">striking</amendingAction> “<quotedText>2013</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>2018</quotedText>”; and</quotedText>” and <amendingAction type="insert">inserting</amendingAction> a semicolon; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d167700e447" identifier="/us/bill/113/s/1545/s4/b/1/E/ii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">(ii) </num><content>by <amendingAction type="delete">striking</amendingAction> clause (ii) and <amendingAction type="insert">inserting</amendingAction> the following new clauses:<quotedContent><clause class="indentUp3 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>all principal recipients and subrecipients and the amount of funds disbursed to each principal recipient and subrecipient on the fiscal cycle of the grant;</content></clause><clause class="indentUp3 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">“(iii) </num><chapeau>expenditure data—</chapeau><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>tracked by principal recipients and subrecipients by program area, where practicable, prevention, care, and treatment and reported in a format that allows comparison with other funding streams in each country; or</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="II">“(II) </num><content>if such expenditure data is not available, outlay or disbursement data, and an explanation of progress made toward providing such expenditure data; and</content></subclause></clause><clause class="indentUp3 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>high-quality grant performance evaluations measuring inputs, outputs, and outcomes, as appropriate, with the goal of achieving outcome reporting;”</content></clause></quotedContent>; and</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d167700e480" identifier="/us/bill/113/s/1545/s4/b/1/F" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="F">(F) </num><content>by <amendingAction type="amend">amending</amendingAction> subparagraph (G) to read as follows:<quotedContent><subparagraph class="indentUp2 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="G">“(G) </num><chapeau>has published an annual report on a publicly available Web site in an open, machine readable format, that includes—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>a list of all countries imposing import duties and internal taxes on any goods or services financed by the Global Fund;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>a description of the types of goods or services on which the import duties and internal taxes are levied;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>the total cost of the import duties and internal taxes;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>recovered import duties or internal taxes; <section id="d167700e515" identifier="/us/bill/113/s/1545/s5" role="instruction" style="-uslm-lc:I650141"><num value="5">SEC. 5. </num><heading>ANNUAL REPORT.</heading><content class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Section 104A(f) of the Foreign Assistance Act of 1961 (<ref href="/us/usc/t22/s2151b–2/f">22 U.S.C. 2151b–2(f)</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="f">“(f) </num><heading><inline class="smallCaps">Annual Report</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>Not later than February 15, 2014, and annually thereafter, the President shall submit to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives a report in an open, machine readable format, on the implementation of this section for the prior fiscal year.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><heading><inline class="smallCaps">Report due in 2014</inline>.—</heading><content>The report due not later than February 15, 2014, shall include the elements required by law prior to the enactment of the PEPFAR Stewardship and Oversight Act of 2013.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><heading><inline class="smallCaps">Report elements</inline>.—</heading><chapeau>Each report submitted after February 15, 2014, shall include the following:</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>A description based on internationally available data, and where practicable high-quality country-based data, of the total global burden and need for HIV/AIDS prevention, treatment, and care, including—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>estimates by partner country of the global burden and need; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>HIV incidence, prevalence, and AIDS deaths for the reporting period.</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>Reporting on annual targets across prevention, treatment, and care interventions in partner countries, including—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>a description of how those targets are designed to—</chapeau><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>ensure that the annual increase in new patients on antiretroviral treatment exceeds the number of annual new HIV infections;</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="II">“(II) </num><content>reduce the number of new HIV infections below the number of deaths among persons infected with HIV; and</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="III">“(III) </num><content>achieve an AIDS-free generation;</content></subclause></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>national targets across prevention, treatment, and care that are—</chapeau><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>established by partner countries; or</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="II">“(II) </num><content>where such national partner country-developed targets are unavailable, a description of progress towards developing national partner country targets; and</content></subclause></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">“(iii) </num><chapeau>bilateral programmatic targets across prevention, treatment, and care, including—</chapeau><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>the number of adults and children to be directly supported on HIV treatment under United States-funded programs;</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="II">“(II) </num><content>the number of adults and children to be otherwise supported on HIV treatment under United States-funded programs; and</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="III">“(III) </num><content>other programmatic targets for activities directly and otherwise supported by United States-funded programs.</content></subclause></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">“(C) </num><content>A description, by partner country, of HIV/AIDS funding from all sources, including funding levels from partner countries, other donors, and the private sector, as practicable.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="D">“(D) </num><content>A description of how United States-funded programs, in conjunction with the Global Fund, other donors, and partner countries, together set targets, measure progress, and achieve positive outcomes in partner countries.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="E">“(E) </num><content>An annual assessment of outcome indicator development, dissemination, and performance for programs supported under this section, including ongoing corrective actions to improve reporting.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="F">“(F) </num><content>A description and explanation of changes in related guidance or policies related to implementation of programs supported under this section.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="G">“(G) </num><chapeau>An assessment and quantification of progress over the reporting period toward achieving the targets set forth in subparagraph (B), including—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>the number, by partner country, of persons on HIV treatment, including specifically—</chapeau><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>the number of adults and children on HIV treatment directly supported by United States-funded programs; and</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="II">“(II) </num><content>the number of adults and children on HIV treatment otherwise supported by United States-funded programs;</content></subclause></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>HIV treatment coverage rates by partner country;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>the net increase in persons on HIV treatment by partner country;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>new infections of HIV by partner country;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="v">“(v) </num><content>the number of HIV infections averted;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="vi">“(vi) </num><chapeau>antiretroviral treatment program retention rates by partner country, including—</chapeau><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>performance against annual targets for program retention; and</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="II">“(II) </num><content>the retention rate of persons on HIV treatment directly supported by United States-funded programs; and</content></subclause></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="vii">“(vii) </num><content>a description of supportive care.</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="H">“(H) </num><chapeau>A description of partner country and United States-funded HIV/AIDS prevention programs and policies, including—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>an assessment by country of progress towards targets set forth in subparagraph (B), with a detailed description of the metrics used to assess—</chapeau><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>programs to prevent mother to child transmission of HIV/AIDS, including coverage rates;</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="II">“(II) </num><content>programs to provide or promote voluntary medical male circumcision, including coverage rates;</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="III">“(III) </num><content>programs for behavior-change; and</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>other programmatic activities to prevent the transmission of HIV;</content></subclause></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>antiretroviral treatment as prevention; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>a description of any new preventative interventions or methodologies.</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>A description of the goals, scope, and measurement of program efforts aimed at women and girls.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="J">“(J) </num><content>A description of the goals, scope, and measurement of program efforts aimed at orphans, vulnerable children, and youth.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="K">“(K) </num><chapeau>A description of the indicators and milestones used to assess effective, strategic, and appropriately timed country ownership, including—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>an explanation of the metrics used to determine whether the pace of any transition to such ownership is appropriate for that country, given that country’s level of readiness for such transition;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>an analysis of governmental and local nongovernmental capacity to sustain positive outcomes;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>a description of measures taken to improve partner country capacity to sustain positive outcomes where needed; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>for countries undergoing a transition to greater country ownership, a description of strategies to assess and mitigate programmatic and financial risk and to ensure continued quality of care for essential services.</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="L">“(L) </num><chapeau>A description, globally and by partner country, of specific efforts to achieve and incentivize greater programmatic and cost effectiveness, including—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>progress toward establishing common economic metrics across prevention, care and treatment with partner countries and the Global Fund;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>average costs, by country and by core intervention;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>expenditure reporting in all program areas, supplemented with targeted analyses of the cost-effectiveness of specific interventions; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>import duties and internal taxes imposed on program commodities and services, by country.</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="M">“(M) </num><chapeau>A description of partnership framework agreements with countries, and regions where applicable, including—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>the objectives and structure of partnership framework agreements with countries, including—</chapeau><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>how these agreements are aligned with national HIV/AIDS plans and public health strategies and commitments of such countries; and</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650128"><num style="-uslm-lc:emspace2" value="II">“(II) </num><content>how these agreements incorporate a role for civil society; and</content></subclause></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>a description of what has been learned in advancing partnership framework agreements with countries, and regions as applicable, in terms of improved coordination and collaboration, definition of clear roles and responsibilities of participants and signers, and implications for how to further strengthen these agreements with mutually accountable measures of progress.</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="N">“(N) </num><content>A description of efforts and activities to engage new partners, including faith-based, locally-based, and United States minority-serving institutions.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="O">“(O) </num><content>A definition and description of the differentiation between directly and otherwise supported activities, including specific efforts to clarify programmatic attribution and contribution, as well as timelines for dissemination and implementation.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="P">“(P) </num><chapeau>A description, globally and by country, of specific efforts to address co-infections and co-morbidities of HIV/AIDS, including—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>the number and percent of people in HIV care or treatment who started tuberculosis treatment; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the number and percentage of eligible HIV positive patients starting isoniazid preventative therapy.</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="Q">“(Q) </num><content>A description of efforts by partner countries to train, employ, and retain health care workers, including efforts to address workforce shortages.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="R">“(R) </num><content>A description of program evaluations completed during the reporting period, including whether all completed evaluations have been published on a publically available Internet website and whether any completed evaluations did not adhere to the common evaluation standards of practice published under paragraph (4).</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">“(4) </num><heading><inline class="smallCaps">Common evaluation standards</inline>.—</heading><content>Not later than February 1, 2014, the Global AIDS Coordinator shall publish on a publically available Internet website the common evaluation standards of practice referred to in paragraph (3)(R).</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="5">“(5) </num><heading><inline class="smallCaps">Partner country defined</inline>.—</heading><content>In this subsection, the term ‘<term>partner country</term>’ means a country with a minimum United States Government investment of HIV/AIDS assistance of at least $5,000,000 in the prior fiscal year.”</content></paragraph></subsection></quotedContent>.</content></section>
