<enactingFormula style="-uslm-lc:I650120">  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</enactingFormula>
<section id="d168189e62" identifier="/us/bill/113/hr/3095/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>COMMERCIAL MOTOR VEHICLE OPERATOR REQUIREMENTS RELATING TO SLEEP DISORDERS.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d168189e66" identifier="/us/bill/113/hr/3095/s1/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><content>The Secretary of Transportation may implement or enforce a requirement providing for the screening, testing, or treatment (including consideration of all possible treatment alternatives) of individuals operating commercial motor vehicles for sleep disorders only if the requirement is adopted pursuant to a rulemaking proceeding.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d168189e74" identifier="/us/bill/113/hr/3095/s1/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Applicability</inline>.—</heading><content>Subsection (a) shall not apply to a requirement that was in force before September 1, 2013.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d168189e82" identifier="/us/bill/113/hr/3095/s1/c" role="definitions" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Sleep Disorders Defined</inline>.—</heading><content>In this section, the term “<term>sleep disorders</term>” includes obstructive sleep apnea.</content></subsection></section>
