<section id="d169013e128" identifier="/us/bill/113/hr/267/s2" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Congress finds that—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169013e134" identifier="/us/bill/113/hr/267/s2/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>the hydropower industry currently employs approximately 300,000 workers across the United States;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169013e138" identifier="/us/bill/113/hr/267/s2/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>hydropower is the largest source of clean, renewable electricity in the United States;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169013e142" identifier="/us/bill/113/hr/267/s2/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>as of the date of enactment of this Act, hydropower resources, including pumped storage facilities, provide—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d169013e146" identifier="/us/bill/113/hr/267/s2/3/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>nearly 7 percent of the electricity generated in the United States; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d169013e150" identifier="/us/bill/113/hr/267/s2/3/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>approximately 100,000 megawatts of electric capacity in the United States;</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169013e154" identifier="/us/bill/113/hr/267/s2/4" role="instruction" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><content>only 3 percent of the 80,000 dams in the United States generate electricity, so there is substantial potential for <amendingAction type="add">adding</amendingAction> hydropower generation to nonpowered dams; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169013e162" identifier="/us/bill/113/hr/267/s2/5" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="5">(5) </num><content>according to one study, by utilizing currently untapped resources, the United States could add approximately 60,000 megawatts of new hydropower capacity by 2025, which could create 700,000 new jobs over the next 13 years.</content></paragraph></section>
<section id="d169013e167" identifier="/us/bill/113/hr/267/s3" role="instruction" style="-uslm-lc:I650141"><num value="3">SEC. 3. </num><heading>PROMOTING SMALL HYDROELECTRIC POWER PROJECTS.</heading><content style="-uslm-lc:I650120">  Subsection (d) of section 405 of the Public Utility Regulatory Policies Act of 1978 (<ref href="/us/usc/t16/s2705">16 U.S.C. 2705</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>5,000</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>10,000</quotedText>”.</content></section>
<section id="d169013e187" identifier="/us/bill/113/hr/267/s4" style="-uslm-lc:I650141"><num value="4">SEC. 4. </num><heading>PROMOTING CONDUIT HYDROPOWER PROJECTS.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d169013e191" identifier="/us/bill/113/hr/267/s4/a" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Applicability of, and Exemption From, Licensing Requirements</inline>.—</heading><chapeau>Section 30 of the Federal Power Act (<ref href="/us/usc/t16/s823a">16 U.S.C. 823a</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169013e206" identifier="/us/bill/113/hr/267/s4/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> subsections (a) and (b) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">“(a)</num><paragraph class="inline"><num value="1">(1) </num><content>A qualifying conduit hydropower facility shall not be required to be licensed under this part.</content></paragraph><paragraph class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="2">“(2)</num><subparagraph class="inline"><num value="A">(A) </num><content>Any person, State, or municipality proposing to construct a qualifying conduit hydropower facility shall file with the Commission a notice of intent to construct such facility. The notice shall include sufficient information to demonstrate that the facility meets the qualifying criteria.</content></subparagraph><subparagraph class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>Not later than 15 days after receipt of a notice of intent filed under subparagraph (A), the Commission shall—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>make an initial determination as to whether the facility meets the qualifying criteria; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>if the Commission makes an initial determination, pursuant to clause (i), that the facility meets the qualifying criteria, publish public notice of the notice of intent filed under subparagraph (A).</content></clause></subparagraph><subparagraph class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>If, not later than 45 days after the date of publication of the public notice described in subparagraph (B)(ii)—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>an entity contests whether the facility meets the qualifying criteria, the Commission shall promptly issue a written determination as to whether the facility meets such criteria; or</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>no entity contests whether the facility meets the qualifying criteria, the facility shall be deemed to meet such criteria.</content></clause></subparagraph></paragraph><paragraph class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="3">“(3) </num><chapeau>For purposes of this section:</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="A">“(A) </num><content>The term ‘<term>conduit</term>’ means any tunnel, canal, pipeline, aqueduct, flume, ditch, or similar manmade water conveyance that is operated for the distribution of water for agricultural, municipal, or industrial consumption and not primarily for the generation of electricity.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="B">“(B) </num><content>The term ‘<term>qualifying conduit hydropower facility</term>’ means a facility (not including any dam or other impoundment) that is determined or deemed under paragraph (2)(C) to meet the qualifying criteria.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>The term ‘<term>qualifying criteria</term>’ means, with respect to a facility—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>the facility is constructed, operated, or maintained for the generation of electric power and uses for such generation only the hydroelectric potential of a non-federally owned conduit;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the facility has an installed capacity that does not exceed 5 megawatts; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>on or before the date of enactment of the Hydropower Regulatory Efficiency Act of 2013, the facility is not licensed under, or exempted from the license requirements contained in, this part.</content></clause></subparagraph></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">“(b) </num><chapeau>Subject to subsection (c), the Commission may grant an exemption in whole or in part from the requirements of this part, including any license requirements contained in this part, to any facility (not including any dam or other impoundment) constructed, operated, or maintained for the generation of electric power which the Commission determines, by rule or order—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><content>utilizes for such generation only the hydroelectric potential of a conduit; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><content>has an installed capacity that does not exceed 40 megawatts.”</content></paragraph></subsection></quotedContent>;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169013e297" identifier="/us/bill/113/hr/267/s4/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>in subsection (c), by <amendingAction type="delete">striking</amendingAction> “<quotedText>subsection (a)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>subsection (b)</quotedText>”; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169013e308" identifier="/us/bill/113/hr/267/s4/a/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>in subsection (d), by <amendingAction type="delete">striking</amendingAction> “<quotedText>subsection (a)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>subsection (b)</quotedText>”.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d169013e319" identifier="/us/bill/113/hr/267/s4/b" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Conforming Amendment</inline>.—</heading><content>Subsection (d) of section 405 of the Public Utility Regulatory Policies Act of 1978 (<ref href="/us/usc/t16/s2705">16 U.S.C. 2705</ref>), as amended, is further amended by <amendingAction type="delete">striking</amendingAction> “<quotedText>subsection (a) of such section 30</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>subsection (b) of such section 30</quotedText>”.</content></subsection></section>
<section id="d169013e338" identifier="/us/bill/113/hr/267/s5" role="instruction" style="-uslm-lc:I650141"><num value="5">SEC. 5. </num><heading>FERC AUTHORITY TO EXTEND PRELIMINARY PERMIT PERIODS.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Section 5 of the Federal Power Act (<ref href="/us/usc/t16/s798">16 U.S.C. 798</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169013e350" identifier="/us/bill/113/hr/267/s5/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>by designating the first, second, and third sentences as subsections (a), (c), and (d), respectively; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169013e354" identifier="/us/bill/113/hr/267/s5/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (a) (as so designated) the following:<quotedContent><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">“(b) </num><content>The Commission may extend the period of a preliminary permit once for not more than 2 additional years beyond the 3 years permitted by subsection (a) if the Commission finds that the permittee has carried out activities under such permit in good faith and with reasonable diligence.”</content></subsection></quotedContent>.</content></paragraph></section>
<section id="d169013e369" identifier="/us/bill/113/hr/267/s6" style="-uslm-lc:I650141"><num value="6">SEC. 6. </num><heading>PROMOTING HYDROPOWER DEVELOPMENT AT NONPOWERED DAMS AND CLOSED LOOP PUMPED STORAGE PROJECTS.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d169013e373" identifier="/us/bill/113/hr/267/s6/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><content>To improve the regulatory process and reduce delays and costs for hydropower development at nonpowered dams and closed loop pumped storage projects, the Federal Energy Regulatory Commission (referred to in this section as the “Commission”) shall investigate the feasibility of the issuance of a license for hydropower development at nonpowered dams and closed loop pumped storage projects in a 2-year period (referred to in this section as a “2-year process”). Such a 2-year process shall include any prefiling licensing process of the Commission.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d169013e381" identifier="/us/bill/113/hr/267/s6/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Workshops and Pilots</inline>.—</heading><chapeau>The Commission shall—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169013e389" identifier="/us/bill/113/hr/267/s6/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>not later than 60 days after the date of enactment of this Act, hold an initial workshop to solicit public comment and recommendations on how to implement a 2-year process;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169013e393" identifier="/us/bill/113/hr/267/s6/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>develop criteria for identifying projects featuring hydropower development at nonpowered dams and closed loop pumped storage projects that may be appropriate for licensing within a 2-year process;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169013e397" identifier="/us/bill/113/hr/267/s6/b/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>not later than 180 days after the date of enactment of this Act, develop and implement pilot projects to test a 2-year process, if practicable; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169013e401" identifier="/us/bill/113/hr/267/s6/b/4" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><content>not later than 3 years after the date of implementation of the final pilot project testing a 2-year process, hold a final workshop to solicit public comment on the effectiveness of each tested 2-year process.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d169013e405" identifier="/us/bill/113/hr/267/s6/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Memorandum of Understanding</inline>.—</heading><content>The Commission shall, to the extent practicable, enter into a memorandum of understanding with any applicable Federal or State agency to implement a pilot project described in subsection (b).</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d169013e413" identifier="/us/bill/113/hr/267/s6/d" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="d">(d) </num><heading><inline class="smallCaps">Reports</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169013e420" identifier="/us/bill/113/hr/267/s6/d/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Pilot projects not implemented</inline>.—</heading><chapeau>If the Commission determines that no pilot project described in subsection (b) is practicable because no 2-year process is practicable, not later than 240 days after the date of enactment of this Act, the Commission shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Energy and Natural Resources of the Senate a report that—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d169013e428" identifier="/us/bill/113/hr/267/s6/d/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>describes the public comments received as part of the initial workshop held under subsection (b)(1); and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d169013e432" identifier="/us/bill/113/hr/267/s6/d/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>identifies the process, legal, environmental, economic, and other issues that justify the determination of the Commission that no 2-year process is practicable, with recommendations on how Congress may address or remedy the identified issues.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169013e436" identifier="/us/bill/113/hr/267/s6/d/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Pilot projects implemented</inline>.—</heading><chapeau>If the Commission develops and implements pilot projects involving a 2-year process, not later than 60 days after the date of completion of the final workshop held under subsection (b)(4), the Commission shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Energy and Natural Resources of the Senate a report that—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d169013e444" identifier="/us/bill/113/hr/267/s6/d/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>describes the outcomes of the pilot projects;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d169013e448" identifier="/us/bill/113/hr/267/s6/d/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>describes the public comments from the final workshop on the effectiveness of each tested 2-year process; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d169013e452" identifier="/us/bill/113/hr/267/s6/d/2/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C)</num><clause class="inline" id="d169013e455" identifier="/us/bill/113/hr/267/s6/d/2/C/i"><num value="i">(i) </num><content>outlines how the Commission will adopt policies under existing law (including regulations) that result in a 2-year process for appropriate projects;</content></clause><clause class="indentUp0 firstIndent1 fontsize10" id="d169013e459" identifier="/us/bill/113/hr/267/s6/d/2/C/ii" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="ii">(ii) </num><content>outlines how the Commission will issue new regulations to adopt a 2-year process for appropriate projects; or</content></clause><clause class="indentUp0 firstIndent1 fontsize10" id="d169013e463" identifier="/us/bill/113/hr/267/s6/d/2/C/iii" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="iii">(iii) </num><content>identifies the process, legal, environmental, economic, and other issues that justify a determination of the Commission that no 2-year process is practicable, with recommendations on how Congress may address or remedy the identified issues.</content></clause></subparagraph></paragraph></subsection></section>
<section id="d169013e468" identifier="/us/bill/113/hr/267/s7" style="-uslm-lc:I650141"><num value="7">SEC. 7. </num><heading>DOE STUDY OF PUMPED STORAGE AND POTENTIAL HYDROPOWER FROM CONDUITS.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d169013e472" identifier="/us/bill/113/hr/267/s7/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><chapeau>The Secretary of Energy shall conduct a study—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169013e480" identifier="/us/bill/113/hr/267/s7/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1)</num><subparagraph class="inline" id="d169013e483" identifier="/us/bill/113/hr/267/s7/a/1/A"><num value="A">(A) </num><content>of the technical flexibility that existing pumped storage facilities can provide to support intermittent renewable electric energy generation, including the potential for such existing facilities to be upgraded or retrofitted with advanced commercially available technology; and</content></subparagraph><subparagraph class="indentUp0 firstIndent1 fontsize10" id="d169013e487" identifier="/us/bill/113/hr/267/s7/a/1/B" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>of the technical potential of existing pumped storage facilities and new advanced pumped storage facilities, to provide grid reliability benefits; and</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d169013e491" identifier="/us/bill/113/hr/267/s7/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2)</num><subparagraph class="inline" id="d169013e494" identifier="/us/bill/113/hr/267/s7/a/2/A"><num value="A">(A) </num><content>to identify the range of opportunities for hydropower that may be obtained from conduits (as defined by the Secretary) in the United States; and</content></subparagraph><subparagraph class="indentUp0 firstIndent1 fontsize10" id="d169013e498" identifier="/us/bill/113/hr/267/s7/a/2/B" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>through case studies, to assess amounts of potential energy generation from such conduit hydropower projects.</content></subparagraph></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d169013e502" identifier="/us/bill/113/hr/267/s7/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Report</inline>.—</heading><content>Not later than 1 year after the date of enactment of this Act, the Secretary of Energy shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Energy and Natural Resources of the Senate a report that describes the results of the study conducted under subsection (a), including any recommendations.</content></subsection></section>
