which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize grants to States to collect and analyze data from State law enforcement agencies on the number of migrants in the United States who have been charged or convicted of a criminal offense.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Migrant Crime Reporting Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id570883ab891c43b795d878990c80dfdd"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="ide717ca320f514a2088fdba999a2be92c"><enum>(1)</enum><header>Eligible State</header><text>The term <term>eligible State</term> means a State that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd75b7712dc944ef9ac6df298b7d09c41"><enum>(A)</enum><text display-inline="yes-display-inline">requests a migrant crime reporting grant for a fiscal year; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id05f526751b0148ab8236cada65303a2c"><enum>(B)</enum><text display-inline="yes-display-inline">for the fiscal year before the fiscal year for which the State requests a migrant crime reporting grant, makes publicly available on a website operated by the State and submits to the Secretary a migrant crime report for the State.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idefda8745d3514c3883221eaa937edb24"><enum>(2)</enum><header display-inline="yes-display-inline">Migrant</header><text>The term <term>migrant</term> means a person who is unable to present a valid document issued to such person that is—</text><subparagraph id="id0068c4b798c14d47a8db529fe6e80269" commented="no"><enum>(A)</enum><text>a Permanent Resident Card (Form I–551) issued by U.S. Citizenship and Immigration Services;</text></subparagraph><subparagraph id="id35ddb24411854f6bbf4cd50d9e0c39b3" commented="no"><enum>(B)</enum><text>an official birth certificate issued by a State, local government, or territory of the United States or by the United States;</text></subparagraph><subparagraph id="id66287dcd8e4740cbbd7ddf6351bd9caf" commented="no"><enum>(C)</enum><text>a valid, unexpired United States passport;</text></subparagraph><subparagraph id="idc7372f52e9f24514b7661bdbd75db797" commented="no"><enum>(D)</enum><text>a Certificate of Citizenship (Form N–560 or Form N–561); or</text></subparagraph><subparagraph id="idc3ba200bb2b84964a01aa09c3969365d" commented="no"><enum>(E)</enum><text>a Certificate of Naturalization (Form N–550), a Replacement Certificate of Naturalization (Form N–570), or a Special Certificate of Naturalization (Form N–578).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2b0de532dab9495b886e0a14621de36b"><enum>(3)</enum><header>Migrant crime report</header><text>The term <term>migrant crime report</term> means a report regarding the number of migrants who have been charged with or convicted of a criminal offense in a State during a fiscal year.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbc250d0033c94ae4a7ce4b36cae7a674"><enum>(4)</enum><header>Migrant crime reporting grant</header><text>The term <term>migrant crime reporting grant</term> means a grant awarded under section 3(a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd5fbb0f7d0204844ac7f3a2e95406b13"><enum>(5)</enum><header display-inline="yes-display-inline">Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id04a6de3b1a5747b98af2c28eb852f0fe"><enum>(6)</enum><header display-inline="yes-display-inline">State</header><text>The term <term>State</term> means each of the several States of the United States.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id9ae3c20f26384ee3a9f86f904ffbd850"><enum>3.</enum><header>Migrant crime reporting grants</header><subsection commented="no" display-inline="no-display-inline" id="id7531814606954c068ad9334d2595d35f"><enum>(a)</enum><header>In general</header><text>For fiscal year 2027, and each fiscal year thereafter, the Secretary shall, subject to the availability of appropriations, award to each eligible State a grant in the amount of $1,000,000.</text></subsection><subsection id="id27f95bffa1994d169645655ee5641d45"><enum>(b)</enum><header>Use of funds</header><text>A State shall use amounts received under a migrant crime reporting grant to collect and analyze data from law enforcement agencies in each county, parish, borough, or other general purpose political subdivision of the State on the number of migrants who have been charged with or convicted of a criminal offense in the State.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idff8ef8f9fcbe4aada63893fbc10fab17"><enum>(c)</enum><header>Migrant crime reporting requirement</header><text display-inline="yes-display-inline">A State that receives a migrant crime reporting grant for a fiscal year shall make publicly available on a website operated by the State and submit to the Secretary a migrant crime report for the State with respect to the fiscal year.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id6577ce5b740c460581c96194169fc5f6"><enum>4.</enum><header>Funding</header><text display-inline="no-display-inline">Section 100051 of the Act entitled <quote>An Act to provide
          for reconciliation pursuant to title II of H. Con. Res. 14</quote>, approved July 4, 2025
        (Public Law 119–21; 139 Stat. 385) (commonly known as the <quote>One Big Beautiful Bill
