which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 23, United States Code, to require the Secretary of Transportation to develop a national infrastructure intelligence tool for congestion mitigation, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Need for Speed Act</short-title></quote>.</text></section><section id="ideb11d02ee24d4c2bac33da7229f439c7"><enum>2.</enum><header>National infrastructure intelligence tool</header><subsection commented="no" display-inline="no-display-inline" id="idd11a4ba5ffc54c2e8454adf7bf05fd68"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/5">Chapter 5</external-xref> of title 23, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/23/505">section 505</external-xref> the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id8af3eba7db584dcb85d5e59b572e64cd"><section commented="no" display-inline="no-display-inline" id="id1c2351e896e84f03b22544110a1e8e3b"><enum>506.</enum><header>National infrastructure intelligence tool</header><subsection id="idbc1f115201d043a6973d7671ad11da79"><enum>(a)</enum><header>In general</header><text>The Secretary, in coordination with relevant Federal agencies and departments, as appropriate, shall engage with a university-based transportation research institute with a history of research related to traffic and freight mobility, safety, freight and supply chains (including truck parking), asset conditions, congestion mitigation, performance measurement and management, and data integration, to develop and maintain a national infrastructure intelligence tool with consistent data aligned to a roadway inventory network database, such as the official public highway performance monitoring system, for use by the Department of Transportation, State and local transportation agencies, metropolitan planning organizations, other transportation agencies, coalitions of public agencies, and regional planning agencies.</text></subsection><subsection id="id2682fce537504236869c45276f4991e9"><enum>(b)</enum><header>Purpose</header><text>The tool developed pursuant to subsection (a) shall serve as a consistent and ongoing national congestion mitigation resource to leverage and integrate relevant Federal, State, local, and private, but publicly available, data sets with the official public highway performance monitoring system or roadway inventory network—</text><paragraph commented="no" display-inline="no-display-inline" id="id694a25d1080343929e408cdf22c9d3e2"><enum>(1)</enum><text display-inline="yes-display-inline">to identify the locations of congestion;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5a05a7f3e6be4efd876dadc139588b58"><enum>(2)</enum><text display-inline="yes-display-inline">to provide context to determine the cause of congestion;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd9d6fc473bc54865a5a3a5ae9232ed68"><enum>(3)</enum><text display-inline="yes-display-inline">to quantify impacts of congestion; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd7b8df20a94f4493a2c3097d9db73b4b"><enum>(4)</enum><text display-inline="yes-display-inline">to enable the expeditious deployment of congestion mitigation resources through investment and operational decisions.</text></paragraph></subsection><subsection id="idcad891319fea4a9a8cea296f0c379c51"><enum>(c)</enum><header>Components</header><text>In developing the tool pursuant to subsection (a), the Secretary shall leverage and include the following types of publicly available data sources and measures:</text><paragraph id="id454ea3296d904148b01b1f300f05a253"><enum>(1)</enum><text>The official highway performance monitoring system or roadway inventory network used by States and the Department of Transportation.</text></paragraph><paragraph id="id01f0929cdcf34960935a3be2cb002346"><enum>(2)</enum><text>The following data sources, leveraging existing data sources to the extent possible, which shall be aligned with the official highway performance monitoring system or roadway inventory network:</text><subparagraph id="id122f64e067a448028986ee54f838cbfb"><enum>(A)</enum><text>A national speed data set, including operating speeds and posted speed limits, with not less than 3 years of historical data for all available public, paved roads functionally classified 1 through 6.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd9874ea7381a44d6bf1249398673c86e"><enum>(B)</enum><text display-inline="yes-display-inline">A national vehicle origin and destination information dataset with not less than 3 years of historical data on all public road travel.</text></subparagraph><subparagraph id="id21f67f4417f14b629e64f3b6d61842b9"><enum>(C)</enum><text>Crash and other relevant safety data.</text></subparagraph><subparagraph id="id73bf9c4091d64c8b88c4d1e93ff29081"><enum>(D)</enum><text>Asset condition data, such as data available in the Highway Performance Monitoring System dataset of the Federal Highway Administration.</text></subparagraph><subparagraph id="id640dbe7f9e4549bc9050eee6b668ae53"><enum>(E)</enum><text>Commodity data, including type, tonnage, and value of commodities on the roadway.</text></subparagraph><subparagraph id="id44d952b41098442d8ccc87006187cdd6"><enum>(F)</enum><text>Truck parking demand and supply data, as available.</text></subparagraph></paragraph><paragraph id="id49017a3b95384bddaf128020ee5071a4"><enum>(3)</enum><text>Federal congestion performance measurement resources, such as the Urban Congestion Report of the Federal Highway Administration and related performance measurement materials.</text></paragraph><paragraph id="idb73da0be05d44c8e8de0a3bf5cba565a"><enum>(4)</enum><text>The performance measures for safety and infrastructure condition established pursuant to section 150(c).</text></paragraph><paragraph id="id500ef9aca32e4bf1a7c41ba2eb298c82"><enum>(5)</enum><text>The Freight Mobility Trends tool of the Federal Highway Administration.</text></paragraph><paragraph id="idbc954e7c5f6440ef8ad28efc72f3662a"><enum>(6)</enum><text>The Urban Mobility Report of the Texas A&amp;M Transportation Institute.</text></paragraph><paragraph id="id9c852f13bcb84da1b49bc89e625af9c5"><enum>(7)</enum><text>Relevant State and local congestion and infrastructure intelligence tools, as appropriate, such as—</text><subparagraph id="idcc5979e1176c49898059ad38632f3888"><enum>(A)</enum><text>the Texas Department of Transportation Texas Top 100 Congested Road Segments annual assessment and the associated Texas Assessment of Congested Roadways Tool;</text></subparagraph><subparagraph id="idbc66f111430a4d029574b2c114199f91"><enum>(B)</enum><text>the Texas Congestion Management Process Assessment Tool;</text></subparagraph><subparagraph id="id3762469871e04f90a97a33e90c69108f"><enum>(C)</enum><text>the Texas Truck Congestion Analysis Tool;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcaffb0850a14463e8c10c87399253500"><enum>(D)</enum><text>the University of Maryland Center for Advanced Transportation Technology Lab causes of congestion tool and methodology;</text></subparagraph><subparagraph id="idd5276c31125c40ad9e1a0b8d5f025219"><enum>(E)</enum><text>the Texas Freight Fluidity Tool;</text></subparagraph><subparagraph id="idd1ab5263696547dfbeb710bab8c58ef1"><enum>(F)</enum><text>the Maryland Department of Transportation Truck Parking Tool;</text></subparagraph><subparagraph id="id664b004967d34d099dd3f7af989c65ee"><enum>(G)</enum><text>the Maryland Roadway Performance Tool; and</text></subparagraph><subparagraph id="id93154dcfd1f745f9a6bfe5765fceac25"><enum>(H)</enum><text>the University of Maryland Center for Advanced Transportation Technology Lab Regional Integrated Transportation Information System resource.</text></subparagraph></paragraph><paragraph id="id9c9263cd6bf3468983fd8f5665ff4103"><enum>(8)</enum><text>Other relevant sources, new data, and measures, as determined appropriate by the Secretary.</text></paragraph></subsection><subsection commented="no" id="id5ba08c481e4442bba02293086468befb"><enum>(d)</enum><header>Updates</header><text>The Secretary shall update the tool developed pursuant to subsection (a) as necessary, but not less frequently than annually.</text></subsection><subsection commented="no" id="id8871078048c148d4830036bb5b919375"><enum>(e)</enum><header>Consultation</header><text>The Secretary shall consult with State departments of transportation, transportation advocacy organizations, and other appropriate organizations, as determined by the Secretary, in the development of the tool pursuant to subsection (a).</text></subsection><subsection commented="no" id="id85a1f5b4497c4b558c0ae2155303b9a0"><enum>(f)</enum><header>Authorization of appropriations</header><paragraph commented="no" display-inline="no-display-inline" id="id8072457b870b400f80fa14a2bdb3119b"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated out of the Highway Trust Fund (other than the Mass Transit Account) $50,000,000 to carry out this section.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf9344f1d6c6c41d6bffb2a80a75a0c76"><enum>(2)</enum><header>Availability</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the amounts made available under paragraph (1) shall be available for a period of 5 fiscal years.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcd36f9915d9a4a5e9d7d525d1a9f43bf"><enum>(3)</enum><header>Additional funds</header><text display-inline="yes-display-inline">Amounts made available under paragraph (1) shall be in addition to any amounts otherwise made available to carry out this section, including through an appropriations Act.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id9a37035d8ea34a31989f5afa306ed3aa"><enum>(b)</enum><header>Clerical amendment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/5">Chapter 5</external-xref> of title 23, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/23/505">section 505</external-xref> the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7db7f9dfeaa547bbb240c436b96e1f1b"><toc><toc-entry bold="off" level="section">506.
