<section id="HA0A9BB1FEF7A43C6B69DFCE67B939E25" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Menopausal Workers’ Fairness Act of 2026</short-title></quote>.</text></section> <section id="H62FB718E38DC4746A2C4D2BCE425C193"><enum>2.</enum><header>Findings and purposes</header> <subsection id="H550CAF445C80417BBC11F2604BF20547"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">The Congress finds the following:</text> 
<paragraph id="HFEAA24B0437B42E6AA368D9E519ADDC9">
                    <enum>(1)</enum>
 <text>Federal law currently does not explicitly protect against discrimination based on menopause and the menopause transition, though employees experiencing symptoms related to menopause and the menopause transition may have protection under laws and regulations—such as the Americans with Disabilities Act—prohibiting employment discrimination, including harassment, on the basis of age, sex, disability, or a combination of these characteristics, and from retaliation for requesting reasonable accommodation.</text>
                </paragraph> 
<paragraph id="H61CD2FDC209A48B38ADFB536C45E4053"><enum>(2)</enum><text>Despite existing protections, the topic of menopause and the menopause transition is often surrounded by stigma, and employees may not disclose the workplace impact of symptoms of menopause and the menopause transition or request accommodations related to symptoms of menopause and the menopause transition.</text></paragraph> <paragraph id="HD0A3540163DA4605A84E5B10E29DFBD1"><enum>(3)</enum><text>According to the Women’s Bureau at the United States Department of Labor, menopause has not been addressed comprehensively in the context of work, which has contributed to a lack of understanding about the impact of menopause and the menopause transition on workers and what types of policies and supports can be implemented to improve their experiences at work.</text></paragraph> 
<paragraph id="H4C7A28BE320344679CFC64E256D283A3">
                    <enum>(4)</enum>
 <text>Formal workplace protections for workers experiencing symptoms of menopause and the menopause transition would bolster the ability of these workers to fully participate in the workplace, particularly now that women ages 45 to 64 make up over 17 percent of the U.S. labor force. </text>
                </paragraph>
                <paragraph id="eth_lnk_zjc">
                    <enum>(5)</enum>
 <text>Other countries, such as the United Kingdom, have taken steps to address menopause and the menopause transition in the workplace, recognizing the economic and social costs of failing to accommodate these workers.</text>
                </paragraph></subsection> 
<subsection id="HE93F366BCAC9479F8D152941BBA5B742"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are the following:</text> <paragraph id="HF71BF3360A3440D8965CA466176EF67A"><enum>(1)</enum><text>To carry out the objective of expanding access for workers experiencing symptoms related to menopause and the menopause transition to reasonable accommodations that enable them to perform the essential functions of their job without risking their health or economic security.</text></paragraph> 
<paragraph id="HE2EE99545F804CE39AE3A05B660DF847"><enum>(2)</enum><text>To reduce stigma and promote awareness of menopause and the menopause transition in the workplace by normalizing the provision of accommodations and addressing the impact of menopause, the menopause transition, and symptoms related to the menopause transition in the workplace.</text></paragraph> <paragraph id="HBF55A46B7CE645FEB1E394D4E646122D"><enum>(3)</enum><text>To further align the landscape of workplace protections with updated understandings of women’s health, by recognizing menopause and the menopause transition as a normal stage of life that requires appropriate workplace accommodations to support worker well-being and productivity.</text></paragraph> 
<paragraph id="HD87504CEF41A4E46A0F6E9F71EDA1BAA"><enum>(4)</enum><text>To foster increased workplace inclusivity and equity, supporting women throughout their entire reproductive life cycle, and ensuring that individuals experiencing symptoms related to menopause and the menopause transition can continue to contribute their skills without facing discrimination or unnecessary barriers.</text></paragraph> <paragraph id="H698D0DBE5D584AE5A3D4CCCB5E5F4EA4"><enum>(5)</enum><text>To support the retention of experienced employees by improving the workplace impacts of symptoms of menopause and the menopause transition, thereby promoting economic growth and reducing productivity losses tied to absenteeism, early retirement, and reduced job satisfaction.</text></paragraph> 
<paragraph id="H5502B93CEFC64150A233C4C3122312ED"><enum>(6)</enum><text>To make it easier for workers experiencing symptoms related to menopause, and the menopause transition to obtain protection under Federal law.</text></paragraph></subsection></section> <section id="H8907420506B3469C92E2CBD5C120777E"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this Act—</text> 
<paragraph id="HA3B072CD17F14DAF9489FA6C27A6C672"><enum>(1)</enum><text>the term <quote>Commission</quote> means the Equal Employment Opportunity Commission;</text></paragraph> <paragraph id="H07E37B2AB27043F0B8846F0CCB5EF63F"><enum>(2)</enum><text>the term <quote>covered entity</quote>—</text> 
<subparagraph id="HCCA30845182843168F116887AE234344"><enum>(A)</enum><text>has the meaning given the term <quote>respondent</quote> in section 701(n) of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e–">42 U.S.C. 2000e–(n)</external-xref>); and</text></subparagraph> <subparagraph id="H79514F4838B14ED6A0B444DC73FDEABF"><enum>(B)</enum><text>includes—</text> 
<clause id="H507913F954A84D8D9FC12ADB50B1E8EB"><enum>(i)</enum><text display-inline="yes-display-inline">an employer, which means a person engaged in industry affecting commerce who has 15 or more employees as defined in section 701(b) of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e(b)</external-xref>);</text></clause> <clause id="HE10D469649624BF89FC80D3C30A9CB27"><enum>(ii)</enum><text>an employing office, as defined in section 101 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>) and section 411(c) of title 3 of the United States Code;</text></clause> 
<clause id="HB7F369D267C0472EA317D4E4043EC5AB">
                        <enum>(iii)</enum>
 <text display-inline="yes-display-inline">an entity employing a State employee described in section 304(a) of the Government Employee Rights Act of 1991 (42 U.S.C. 2000e–16c(a)); and</text>
                    </clause>

                        <enum>(iv)</enum>
 <text display-inline="yes-display-inline">an entity to which section 717(a) of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-16">42 U.S.C. 2000e–16(a)</external-xref>) applies;</text>
                    </clause></subparagraph></paragraph> 
<paragraph id="HF41ECC3C6267406F943DE4869826B724"><enum>(3)</enum><text>the term <quote>employee</quote> means—</text> <subparagraph id="HD2B14F6AA506478591FB15CD494059B3"><enum>(A)</enum><text display-inline="yes-display-inline">an employee (including an applicant), as defined in section 701(f) of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e(f)</external-xref>);</text></subparagraph> 
<subparagraph id="HF53FB2B2566D4C3C8ED9CD37C9696770"><enum>(B)</enum><text display-inline="yes-display-inline">a covered employee (including an applicant), as defined in section 101 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>), and an individual described in section 201(d) of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1311">2 U.S.C. 1311(d)</external-xref>);</text></subparagraph> <subparagraph id="H48096CDA427F460DBEFFE0A8FC303F3E"><enum>(C)</enum><text>a covered employee (including an applicant), as defined in section 411(c) of title 3 of the United States Code;</text></subparagraph> 
<subparagraph id="H62A0B8FBC6204650A571C275810C7B53">
                    <enum>(D)</enum>
 <text display-inline="yes-display-inline">a State employee (including an applicant) described in section 304(a) of the Government Employee Rights Act of 1991 (42 U.S.C. 2000e–16c(a)); or</text>
                </subparagraph> 
<subparagraph id="H1282D34F235F4972AF1DFC75882015ED">
                    <enum>(E)</enum>
 <text display-inline="yes-display-inline">an employee (including an applicant) to which section 717(a) of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-16">42 U.S.C. 2000e–16(a)</external-xref>) applies;</text>
                </subparagraph></paragraph>

                <enum>(4)</enum>
 <text display-inline="yes-display-inline">the term <quote>known limitation</quote> means physical or mental effects related to, affected by, or arising out of menopause, menopause transition, symptoms, and related effects that the employee or employee’s representative has communicated to the employer whether or not such effects meets the definition of disability specified in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>), including but not limited to—</text>

                </subparagraph>

                    <enum>(K)</enum>
 <text>depression;</text> </subparagraph> <subparagraph id="H39E71D14898B413F885FE85EDDDDAF4C"> <enum>(L)</enum> <text>urine leakage and urinary incontinence;</text>
                </subparagraph>

                    <enum>(M)</enum>
 <text>increased urinary tract and gynecological infections;</text> </subparagraph> <subparagraph id="H411476E95A1347669A51E7AEEDF0CA27"> <enum>(N)</enum> <text>dry skin;</text>
                </subparagraph>
                <subparagraph id="HDF5D28A566D04AA8A231229814E54BC8">
                    <enum>(O)</enum>
 <text>dry eyes;</text> </subparagraph> <subparagraph id="HE31EAD586AA64B418E0B32DCFC1CF6FB"> <enum>(P)</enum> <text>dry mouth;</text>
                </subparagraph>
                <subparagraph id="HD74F2E87480046D7A814F1669B21D0F9">
                    <enum>(Q)</enum>
 <text>racing heart; and</text> </subparagraph> <subparagraph id="HDF99495D540A4098B7AFD7683A1F25C6"> <enum>(R)</enum> <text>headaches;</text>
                </subparagraph>
            </paragraph> 
<paragraph id="HE111C16A5791474F91752154733A429F"><enum>(5)</enum><text display-inline="yes-display-inline">the term <quote>person</quote> has the meaning given such term in section 701(a) of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e(a)</external-xref>);</text></paragraph> <paragraph id="HF243E86C3DCD4C0D8F85A95F9614697C"><enum>(6)</enum><text>the term <quote>qualified employee</quote> means an employee or applicant who, with or without reasonable accommodation, can perform the essential functions of the employment position, except that an employee or applicant shall be considered qualified if—</text> 
<subparagraph id="HF2320B6CC8B94300BDF9E3CF5D6FEEB1"><enum>(A)</enum><text>any inability to perform an essential function is for a temporary or intermittent period;</text></subparagraph> <subparagraph id="H17A2F13862A14900A33694A973A2953D"> <enum>(B)</enum> <text>the essential function could be performed in the near future, taking into account the episodic nature of the condition; or</text>
                </subparagraph> 
<subparagraph id="H9087A850D69C465986C4540F140229EB">
                    <enum>(C)</enum>
 <text>the inability to perform the essential function can be reasonably accommodated;</text>
                </subparagraph></paragraph> 
<paragraph id="HEC9D43C0FDB14C45BEC7B0B402ED7681">
                <enum>(7)</enum>
 <text display-inline="yes-display-inline">the terms <quote>reasonable accommodation</quote> and <quote>undue hardship</quote> have the meanings given such terms in section 101 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12111">42 U.S.C. 12111</external-xref>) and shall be construed as such terms are construed under such Act and as set forth in the regulations required, including with regard to the interactive process that will typically be used to determine an appropriate reasonable accommodation;</text>
                <subparagraph id="H920F4659A6FE41078FFD65E89E36A84C" indent="paragraph">
                    <enum>(8)</enum>
 <text>the term <quote>Predictable Assessments</quote> means the individualized assessment of whether a modification listed in section 101 is a reasonable accommodation that would cause undue hardship will, in virtually all cases, result in a determination that the modifications listed in subparagraphs (I) through (IV) are reasonable accommodations that will not impose undue hardship when they are requested as accommodations by an employee who is experiencing menopause, menopause transition, symptoms, and related effects. Therefore, with respect to these modifications, the individualized assessment should be particularly simple and straightforward, without requiring documentation—</text>
                    <clause id="HADF881E379504508BEAF883C9EDB16A1" indent="subparagraph">
                        <enum>(A)</enum>
 <text>allowing an employee to carry or keep water near and drink, as needed;</text>
                    </clause>
                    <clause id="H274FB790EDF54C57940E665589E1AC03" indent="subparagraph">
                        <enum>(B)</enum>
 <text>allowing an employee to take additional restroom breaks, as needed;</text>
                    </clause>
                    <clause id="H09C4D150FBE14EDCB4EA5C0CA7744782" indent="subparagraph">
                        <enum>(C)</enum>
 <text>allowing an employee whose work requires standing to sit and whose work requires sitting to stand, as needed;</text>
                    </clause>
                    <clause id="H6D153A83584347369718F14019484BF0" indent="subparagraph">
                        <enum>(D)</enum>
 <text>allowing an employee to take breaks to eat and drink, as needed; and</text>
                    </clause>
                    <clause id="H482F89BB4D5A4FB09254B50D0857A592" indent="subparagraph">
                        <enum>(E)</enum>
 <text>any other such modification deemed appropriate by the Commission based on their expertise and on public comment; and</text>
                    </clause>
                </subparagraph>
            </paragraph> 
<paragraph id="HCBE22DBF9DB0406CB5F1CB2A26BFA1EA">
                <enum>(9)</enum>
 <text>the terms <quote>menopause, menopause transition, symptoms and related effects</quote> shall be construed broadly in favor of expansive coverage to the maximum extent given their variable and intermittent nature, and include but are not limited to—</text>
                <subparagraph id="H910E7EFA00EA4847A461943882CA1879">
                    <enum>(A)</enum>
 <text>the term <quote>menopause</quote> refers to a life event—</text> <clause id="H6293230120874D8C9D181D25A918298C"> <enum>(i)</enum> <text>defined by 12 consecutive months of no menstruation;</text>
                    </clause>
                    <clause id="H3AB441163CEA4AEE8CB353CE489420EC">
                        <enum>(ii)</enum>
 <text>irreversible and marked by the cessation of menstrual cycling, normally due to a decreased production of ovarian hormones associated with aging; and</text>
                    </clause>
                    <clause id="HC72CD18211C349AC80045637500E07BF">
                        <enum>(iii)</enum>
 <text>often occurs naturally with age, but can also happen due to surgery or medical treatments, including—</text>
                        <subclause id="H5485343805D64D66AEBD5A4E8BF4C77B">
                            <enum>(I)</enum>
 <text><quote>induced menopause</quote>, which refers to menopause that results from surgery (removal of the ovaries or uterus), chemotherapy, or radiation therapy; and</text>
                        </subclause>
                        <subclause id="HD718560D546D46D282AF03535B2DBFAD">
                            <enum>(II)</enum>
 <text><quote>primary ovarian insufficiency</quote>, which refers to menopause occurring before the age of 40, either naturally or as a result of medical treatment or medical conditions;</text>
                        </subclause>
                    </clause>
                </subparagraph>
                <subparagraph id="H4F8E67FC2F0C47F3B2AD19662A23B1D9">
                    <enum>(B)</enum>
 <text>the term <quote>menopausal transition</quote> refers to a period of time that—</text>
                    <clause id="H650315D125A44E128A5DA2C3AD7EFCF1">
                        <enum>(i)</enum>
 <text>largely overlaps with perimenopause;</text> </clause> <clause id="H644B17FFABE24F078D2F43C202542127"> <enum>(ii)</enum> <text>is often signaled by menstrual irregularity;</text>
                    </clause>
                    <clause id="H92873D0D122B4F98BB1C84E13DE9B6AE">
                        <enum>(iii)</enum>
 <text>encompasses the highly symptomatic years;</text> </clause> <clause id="H0B282E5486DF40DA90722FF2D85FF7AE"> <enum>(iv)</enum> <text>is marked by fluctuations in estrogen levels;</text>
                    </clause>
                    <clause id="H848B7FF513F74E8CA0B122743721DEFB">
                        <enum>(v)</enum>
 <text>has been estimated to last about four to eight years; and</text> </clause> <clause id="HC1B9C7C1E74847D0B641321E52825FF8"> <enum>(vi)</enum> <text>ends with the final menstrual period;</text>
                    </clause>
                </subparagraph>
                <subparagraph id="H96CF8C37B26141B5B22E64EA4B8C1A33">
                    <enum>(C)</enum>
 <text>the term <quote>menopausal symptoms and related effects</quote> refers to symptoms that occur because of hormone fluctuations. Symptoms can include but are not limited to those listed in subparagraphs (A) through (J) of paragraph (4), which can affect work and overall quality of life patterns.</text>
                </subparagraph>
            </paragraph></section> 
<section id="H6A9BAB0F2CC24848AEEA948385F8D63C"><enum>4.</enum><header>Nondiscrimination with regard to reasonable accommodations related to menopause</header><text display-inline="no-display-inline">It shall be an unlawful employment practice for a covered entity to—</text> <paragraph id="H32DC6681795A407396AB9FEDE8D1B359"><enum>(1)</enum><text>not make reasonable accommodations to the known limitations related to the menopause, menopause transition, symptoms, and related effects of a qualified employee, unless such covered entity can demonstrate that the accommodation would impose an undue hardship on the operation of the business of such covered entity;</text></paragraph> 
<paragraph id="H726B17035924422EB1D946F73A1AC898">
                <enum>(2)</enum>
 <text display-inline="yes-display-inline">require a qualified employee affected by menopause, menopause transition, symptoms, or related medical effects to accept an accommodation other than any reasonable accommodation;</text>
            </paragraph> 
<paragraph id="HFDF9A97CF97B47759FC81698362656EA">
                <enum>(3)</enum>
 <text>deny employment opportunities to a qualified employee if such denial is based on the need of the covered entity to make reasonable accommodations to the known limitations related to the menopause, menopause transition, symptoms, or related medical effects of the qualified employee;</text>
            </paragraph> 
<paragraph id="H9E941F9E875243DA8ABC7E023695DC98">
                <enum>(4)</enum>
 <text>require a qualified employee to take leave, whether arrived at through the interactive process referred to in section 102(7) of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12111">42 U.S.C. 12111(7)</external-xref>), paid or unpaid, if another reasonable accommodation can be provided to the known limitations related to the menopause, menopause transition, symptoms, or related medical effects of the qualified employee;</text>
            </paragraph> 
<paragraph id="H7AA0E63495494F4EA1C00167CCC21C5C">
                <enum>(5)</enum>
 <text>take adverse action in terms, conditions, or privileges of employment against a qualified employee on account of the employee requesting or using a reasonable accommodation to the known limitations related to the menopause, menopause transition, symptoms, or related medical effects of the employee; and</text>
            </paragraph> 
<paragraph id="H66145EFD4E754560ABAE0DFFC16DD845"><enum>(6)</enum><text>treat information obtained regarding the medical condition or history of the employee as anything other than a confidential medical record that is collected and maintained on separate forms and in separate medical files, except that—</text> <subparagraph id="H4CCE462279454135A20E6FC037F7B1F1"><enum>(A)</enum><text>supervisors and managers may be informed regarding necessary restrictions on the work or duties of the employee and necessary accommodations;</text></subparagraph> 
<subparagraph id="HC5119F5CC93042399D6BB704B9A02E03"><enum>(B)</enum><text>first aid and safety personnel may be informed, when appropriate, if effects related to menopause or the menopause transition might require emergency treatment; and</text></subparagraph> <subparagraph id="H39FB8BFAFC58485895A9D9252E8A9180"><enum>(C)</enum><text display-inline="yes-display-inline">government officials investigating compliance with this chapter shall be provided relevant information on the request.</text></subparagraph></paragraph></section> 
<section id="HBA90BF4468FB4D52992FE2D5536BBEF3"><enum>5.</enum><header>Appropriation</header><text display-inline="no-display-inline">There is hereby appropriated $4,500,000 to carry out this Act.</text></section> <section id="HAFD2D7B45854400B9DF16AF030DAE52E"><enum>6.</enum><header>Remedies and enforcement</header> <subsection id="HCA73EA8BAB0F4E629A4CD348A33ED6C3"><enum>(a)</enum><header>Employees covered by title VII of the Civil Rights Act of 1964</header> <paragraph id="HB0DDDF3518C047ED9909609B5D4EAE25"> <enum>(1)</enum> <header>In general</header> <text display-inline="yes-display-inline">The powers, remedies, and procedures provided in sections 705, 706, 707, 709, 710, and 711 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-4">42 U.S.C. 2000e–4 et seq.</external-xref>) to the Commission, the Attorney General, or any person alleging a violation of title VII of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>) shall be the powers, remedies, and procedures this Act provides to the Commission, the Attorney General, or any person, respectively, alleging an unlawful employment practice in violation of this Act against an employee described in section 102(3)(A) of the Pregnant Workers Fairness Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000gg">42 U.S.C. 2000gg(3)(A)</external-xref>) except as provided in paragraphs (2) and (3) of this subsection.</text>

                </paragraph></subsection> 
<subsection id="H0FE5CF6253374742B80FCFE31E2E6207"><enum>(f)</enum><header>Prohibition against retaliation</header> 
<paragraph id="H23A52B4C27F64DD2960720A0826F98D5"><enum>(1)</enum><header>In general</header><text>No person shall discriminate against any employee because such employee has opposed any act or practice made unlawful by this Act or because such employee made a charge, testified, assisted, or participated in any manner in an investigation, proceeding, or hearing under this Act.</text></paragraph> <paragraph id="H9D622D5D11714C139FED70944AEF8EA2"> <enum>(2)</enum> <header>Prohibition against coercion</header> <text>It shall be unlawful to coerce, intimidate, threaten, harass, or interfere with any individual in the exercise or enjoyment of, or on account of such individual having exercised or enjoyed, or on account of such individual having aided or encouraged any other individual in the exercise or enjoyment of, any right granted or protected by this Act.</text>
                </paragraph> 
<paragraph id="H58590226D83249249FA236C98E742183"><enum>(3)</enum><header>Remedy</header><text>The remedies and procedures otherwise provided for under this section shall be available to aggrieved individuals with respect to violations of this Act.</text></paragraph></subsection> <subsection id="HAB8806EFB8EF4DD6800EAB84F3D3AC82"><enum>(g)</enum><header>Limitation</header><text display-inline="yes-display-inline">Notwithstanding subsections (a)(3), (b)(3), (c)(3), (d)(3), and (e)(3), if an unlawful employment practice involves the provision of a reasonable accommodation pursuant to this Act or regulations implementing this Act, damages may not be awarded under section 1977A of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1981a">42 U.S.C. 1981a</external-xref>) if the covered entity demonstrates good faith efforts, in consultation with the employee with known limitations related to menopause, menopause transition, symptoms, or related medical effects who has informed the covered entity that accommodation is needed, to identify and make a reasonable accommodation that would provide such employee with an equally effective opportunity and would not cause an undue hardship on the operation of the covered entity.</text></subsection> 
<subsection id="H004D9F3379C448CB9588E47DDA39430B"><enum>(h)</enum><header>Rules of construction</header><text>The primary object of attention in cases under this Act should be whether covered entities have complied with their obligations and whether discrimination has occurred, not whether the individual meets the definition of <quote>menopause, menopausal transition, symptoms, and related effects</quote>. Given the variable and intermittent nature of menopause, the menopausal transition, symptoms, and related effects, along with the need for further, more thorough examination into its full range of impacts, the question of whether an individual meets this definition under this part should not demand extensive analysis or documentation.</text></subsection></section> <section id="H978D3E4DEDE249B2902CD21BF623DC3E"><enum>7.</enum><header>Rulemaking</header> <subsection id="H011E38ADCF9D4932A68B216B34F3B733"><enum>(a)</enum><header>EEOC rulemaking</header><text>Not later than 1 year after the enactment of this Act, the Commission shall issue regulations in an accessible format in accordance with subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5 of the United States Code to carry out this Act. Such regulations shall provide examples of known limitations associated with menopause, menopause transition, and related effects, examples of reasonable accommodations addressing such known limitations, and examples of when it is reasonable for covered entities to seek supporting documentation.</text></subsection> 
<subsection id="HB98534117DBE41078940AD0EFF840CFD"><enum>(b)</enum><header>OCWR rulemaking</header> 
<paragraph id="H2BE6B1D0CDF0451DA347BD7C050C273F">
                    <enum>(1)</enum>
                    <header>In general</header>
 <text display-inline="yes-display-inline">Not later than 6 months after the Commission issues regulations under subsection (a), the Board (as defined in section 101 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>)) shall (in accordance with section 304 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1384">2 U.S.C. 1384</external-xref>)) issue regulations to implement the provisions of this Act made applicable to employees described in section 104(b) of the Pregnant Workers Fairness Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000gg-2">42 U.S.C. 2000gg–2(b)</external-xref>).</text>
                </paragraph> 
<paragraph id="H96B334A92CD64609BED609A25CECC5CD"><enum>(2)</enum><header>Parallel with agency regulations</header><text>The regulations issued under paragraph (1) shall be the same as substantive regulations issued by the Commission under subsection (a) except to the extent that the Board may determine, for good cause shown and stated together with the regulations issued under paragraph (1) that a modification of such substantive regulations would be more effective for the implementation of the rights and protection under this Act.</text></paragraph></subsection></section> <section id="H576F5141F6DE47BC8B8958E6A041CAA2"><enum>8.</enum><header>Waiver of State immunity</header><text display-inline="no-display-inline">A State shall not be immune under the 11th Amendment to the Constitution from an action in a Federal or State court of competent jurisdiction for a violation of this Act. In any action against a State for a violation of this Act, remedies (including remedies both at law and in equity) are available for such a violation to the same extent as such remedies are available for such a violation in an action against any public or private entity other than a State.</text></section> 
<section id="HA6D87E9E14C046E684F2078B91D57DCC"><enum>9.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or the application of that provision to particular persons or circumstances is held invalid or found to be unconstitutional, the remainder of this Act and the application of that provision to other persons or circumstances shall not be affected.</text></section> </legis-body></bill>
